The CCE will be hosting the second "Stakeholder's Meeting" on July 12, 2012 in Scottsdale, Arizona. In anticipation of that meeting and for the general good of the order, Dr. Walsemann has asked Dr. Steve Welsh and me to provide you with a briefing addressing the ICA's efforts relative to the CCE over the recent past. For some of you this may be covering information that is well known to you and for others it might help fill in some blanks. Regardless, it will be helpful for us to all have a common understanding and document reference point as we move forward.

2009

  

September 4, 2009

The Council on Chiropractic Education (CCE) Releases Draft 1 of proposed changes to the Standards for Doctor of Chiropractic Programs and Requirements for Institutional Accreditation (Standards) for public comment.

 

November 3, 2009        
ICA Provides CCE with Comments on Draft 1This feedback was provided in the format and within the time frame as outlined in the CCE announcement and call for comment dated September 4, 2009.

 

 

2010

 

July/August, 2010

 The Council on Chiropractic Education (CCE) Releases Draft 2 of proposed changes to the Standards for Doctor of Chiropractic Programs and Requirements for Institutional Accreditation (Standards) for public comment.  Comments are due on September 24, 2010. 

 

 

September 22, 2010      

ICA Provides CCE with Comments on Draft 2.

 

 

2011

 

January 14, 2011      

At the annual meeting of the CCE held in Scottsdale the revised Standards were presented for discussion. The same were approved by the CCE.

 

June 20, 2011        

The ICA submitted a request for information from the CCE requesting information related to the review and approval of changes to the 3rd draft. (Please note: This request was responded to on June 14, 2012. Please see the entry for June 14, 2012 below.)  ICA's request for information of June 20, 2011 is attached. 

 

June 22, 2011                

CCE acknowledges RFI ... does not respond for 11 months.

 

September 16, 2011       

In anticipation of the December 14, 2011 hearing of the CCE before the NACIQI the ICA files 27 pages of written comments ,referencing over 600 pages of supporting documents, to USDE and NACIQI. 

 

November 22, 2011      

CCE Publishes "Open Letter to the Profession"   

 

December 14, 2011

The CCE appeared before the NACIQI and addressed the report of the USDE staff as well as the input from the written and in-person testimony offered with respect to the continuing authorization of the CCE by the Secretary.   ICA prepared a written submission and in-person testimony on behalf of ICA was offered by James Turner, ICA Counsel. Several other ICA Board members also offered their input but did so as individuals. Dr. Steve Welsh was the only ICA officer to present testimony, however, he clearly indicated that his comments were on his own behalf.  The NACIQI accepted the findings of the staff and added two additional requirements of the CCE related to broad acceptance of the agency by the profession and demonstrating that its efforts improved the quality of chiropractic education. December 22, 2011

The CCE provided the Department of Education with a response, as provided for under the regulations, with respect to the hearing and the recommendations of NACIQI. In this response the CCE pled its case as to why the two additional requirements added by the NACIQI were inappropriate and should not be sanctioned by the Department in the final determination by the Undersecretary.  In the feedback offered to the Department the CCE was critical of the ICA, questioned the accuracy of the feedback offered by the ICA and in general cast aspersions on the credibility of ICA and ICA Counsel.

 

February 9, 2012

The ICA received a letter from the CCE inviting the ICA to be a participant in the presidential search process for a new CCE president. Accompanying the invitation was a series of requirements related to acceptance of the opportunity and the terms of participation.

 

February 12, 2012

The ICA responded to the CCE with respect to participation in the presidential search process. Dr. Walsemann appointed Dr. Maltby to serve in this capacity. The terms of participation were agreed to at this time.

 

February 14, 2012

The CCE acknowledge receipt of the ICA's letter regarding participating in the presidential search process. The terms of ICA's participation were accepted by the CCE at this time.

 

February 14, 2012

The ICA was invited as a "stakeholder" to a meeting scheduled for mid-March 2012 in Las Vegas in conjunction with the annual ACC-RAC meeting. The ICA was also requested to provide a written statement to the CCE as to the concerns of the Association with respect to the CCE.

 

February 24, 2012

 

The ICA responded to the CCE's letter of February 14 regarding the Stakeholder's Meeting accepting the invitation to participate in this manner. The ICA, as requested by the CCE, submitted  a 26-page document to the CCE outlining the issues of concern held by the ICA with respect to the CCE prior to the meeting. The CCE did not offer any response beyond acknowledgement of receipt of the feedback from ICA.

 

March 14, 2012

The ICA wrote CCE expressing concern about the closed nature of the stakeholder meeting. The ICA suggests that the meeting be recorded and distributed as a means of insuring accuracy and transparency.

 

March 15, 2012

Dr. Ochoa issues letter to CCE removing requirements added relieving the CCE of the responsibility to address the two concerns added by the NACIQI on December 14, 2011 stating that "the dissenting voices in my judgment are a small minority within the profession".

 

March 16, 2012

The CCE "Stakeholder's Meeting" was convened in Las Vegas as planned. ICA was represented by Gerard W. Clum, D.C. There was no agenda provided in advance of the meeting and no indication of how the meeting would be conducted was offered to any attendee to the best of the knowledge of the ICA.  At this meeting there were several important points noted:

 

  1. At the start of the meeting CCE Chairperson, Craig Little, D.C. reviewed a letter dated the previous day from the Assistant Secretary of Education relieving the CCE of the responsibility to address the two concerns added by the NACIQI on December 14, 2011. ( click to review letter dated March 15, 2012
  2. Dr. Little indicated that even in the absence of the requirement to demonstrate broad based support within the profession the CCE planned to proceed with the Stakeholder's Meeting.
  3. The CCE distributed an agenda following the start of the meeting.
  4. Following a break in the proceedings Dr. Little called the meeting into order and related that over the break he had received disturbing news that the ICA had recently initiated inquiry regarding the CCE's reauthorization process with members of Congress. The audience was immediately agitated and hostile towards the ICA.
  5. Dr. Clum excused himself from the meeting and called Dr. Walsemann and Mr. Hendrickson to try and learn more about any actions taken by ICA. It was reported to Dr. Clum that:
    1. ICA had NOT made any Congressional contacts with respect to the re-authorization of the CCE by the Assistant Secretary
    2. ICA was aware that an ICA member from Florida, who had a member of Congress and his family as patients, had initiated a conversation with the Congressman about the situation of the CCE
    3. Dr. Clum was advised that the ICA was not contemplating any similar action but in the final analysis it could not control the actions of individuals who were members of the Association with regard to their personal right to petition government on any subject they desired
    4. Dr. Clum returned to the meeting and related the feedback he had received from Dr. Walsemann and Mr. Hendrickson

March 19, 2012

Dr. Clum provided Dr. Walsemann and the ICA Board of Directors with a report of the Stakeholder's Meeting

 

March 20, 2012

CCE posts public announcement regarding stakeholder meeting and the removal of certain requirements. The announcement highlights the paragraph referencing "the small minority within the profession". The announcement also misstates attendees at the meeting ( COCSA was invited but was a no show ) and mischaracterizes the outcome.

 

March 21, 2012

The ICA wrote to the Assistant Secretary of Education, Dr. Ochoa, requesting documents sent by the CCE to Dr. Ochoa as a matter of follow-up to the NACIQI hearing of December 14, 2011.

 

April 2, 2012

The ICA received a copy of the letter from the CCE to the USDE dated December 22, 2011 that the ICA had requested of the USDE on March 21, 2012. This is the letter that reflected a number of inaccuracies, accusing the ICA, the ICA Counsel and ICA officers of misleading the NACIQI at the December 14, 2011 NACIQI hearing. This letter appeared to be the basis for the reversal of the NAIQI requirements.

 

April 3, 2012

The next day CCE posted a copy of the December 22, 2012 letter from the CCE to the USDE its website claiming:  "In a spirit of transparency, the CCE makes available to the general public its recent letter to the USDE concerning issues related to CCE's reporting requirements for recognition.  The letter was sent on December 22, 2011, before a final decision was made by the USDE on the CCE's recognition status and before final reporting requirements were determined." 

 

April 24, 2012

The ICA invites organizations and groups that have expressed concerns about the activities of the CCE to participate at a conference to be held on May 19, 2012 for the purpose of developing a coordinated and cohesive approach with common concerns to the CCE. Enclosed in the invitation are the following documents:

 

1)    The 27-page testimony ICA submitted to the NACIQI prior to the hearing.

2)     The March 9, 2012 version of the CCE reform paper done by the ICA Ad-Hoc Committee.

3)    The letter of December 22, 2011 from CCE to the USDE objecting to the added compliance requirements.  

4)    Dr. Ochoa's letter of March 15, 2012 from USDE to CCE advising that the Assistant Secretary is not adopting NACIQI Committee compliance requirements added on December 14, 2011. 

 

May 1 - May 5, 2012

A series of conference calls are conducted by the ICA with individuals representing many organizations with common concerns regarding CCE in anticipation of the conference of may 19, 2012.

 

May 10, 2012

The ICA wrote to Dr. Ochoa, following receipt of the letter received from the USDE on April 2, 2012 and requested the opportunity to meet with Assistant Secretary Ochoa with respect to his decision to remove the two requirements imposed by NACIQI on December 14, 2011

 

May 18, 2012

The ICA received a response from Assistant Secretary Ochoa with request to ICA's letter of May, 2012 requesting a meeting with the gentleman. The request was denied and Dr. Ochoa indicated that there is no provision in the regulation for such a meeting/conference )

 

May 18, 2012

The Adjustthevote.org website posted an encouragement to interested parties to contact their Congressional representatives and request inquiry into the circumstances of the USDE and CCE. This action was taken unilaterally by the ATV webmaster and was done without direct authorization by the ICA. The ICA immediately entered into dialogue with the webmaster over this matter and no further postings of this nature have been made. Further, no other action by the ICA encouraging the efforts suggested by adjustthevote.org have been made in any medium.

 

May 19, 2012

A meeting convened by ICA was held in Atlanta to bring together as many of the parties and organizations expressing concern about the CCE as possible. The goals of the meeting included a desire for greater coordination with respect to issues of concerns and actions to be taken. The meeting concluded with the development of a consensus statement agreed to by all parties present. It was agreed at this time that a second meeting of this group, now known as the "Da Vinci Group" be scheduled for July 12, 2012. Appointments were made to an ad-hoc planning committee for the July 12 meeting that included Mr. Hendrickson and Dr. Clum acting on behalf of the ICA.

 

May 26, 2012

 

ICA Releases on behalf of the DaVinci  Group a Press Release, Three Consensus Statements and a Call for Reform.

 

May 31, 2012

CCE posts a public announcement criticizing the ICA and stating that the act of petitioning government regarding CCE was irresponsible.

 

June 7 2012

The ICA was contacted by the CCE regarding a second Stakeholder's Meeting scheduled for July 12, 2012 in Scottsdale, Arizona. At that time the CCE also released an application process of sorts that required parties desiring to be identified as "Stakeholders" to complete. CCE also requested the return of a survey by June 22, 2012.

 

June 11, 2012

The ICA wrote CCE acknowledging request for information and requested follow-up on unanswered request for information dated June 20, 2011.

 

June 14, 2012

CCE provides a response to the request for information dated June 20, 2011.

 

June 21, 2012

CCE issues announcement for its Semi-Annual Business meeting. The public is invited to observe. No mention is made of a public comment period.

 

June 29, 2012

The ICA responded to the announcement of the CCE regarding participation in the proposed "Stakeholder's Meeting" of July 12, 2012. Dr. Walsemann asked Dr. Clum to continue his efforts with the Da Vinci Group in the name of ICA as the meeting facilitator and for Dr. Maltby to represent the ICA at the July 12, 2012 "Stakeholder's Meeting".

 

June 29, 2012

The ICA wrote CCE requesting the opportunity to provide comments at the July 13, 2012 CCE business meeting.

 

 

 

 

 

 

 

 

 

 

 

 

The ICA continues to strive to advance chiropractic throughout the world as a distinct health care profession predicated on its unique philosophy, art and science on a daily basis.  I sincerely hope that the "ICA In Action" newsletter will assist you in combating the mis-information campaigns that have begun to proliferate as the ICA continues to increase its efforts to defend chiropractic.
