| What Happens if Husband And Wife Pay Money to Purchase Home, Do They Each Get the Money Back Upon Divorce? |

Typically a married couple will use the
money they had saved before they got
married to pay the down payment for their
house. The Question is what
happens when they get divorced? Do they
each get their money back and then divide
the proceeds? The answer is NO unless
you can prove special circumstances.
Florida law provides that the money
husband and wife used to contribute
towards the down payment is a gift to each
other. The presumption of a gift to one
another can be rebutted if you have a pre-
nuptial or post-nuptial agreement that says
each gets their down payment back upon
divorce. If you can prove the special
circumstances to reject the presumption of
gift, then upon divorce each get
their money back and then divide the
proceeds.
