What do you do when you if you do not receive your
child support? Use civil contempt as a remedy to
enforce payment of child support. It requires proof
that the defaulting parent has the ability to pay all or
part of the support obligation and is simply not
paying. Another remedy is indirect criminal contempt.
This means that you are trying to put the non-payor
in jail. Start with a verified motion for order to show
cause and state the facts of non-payment. Once the
order is issued the sheriff serves the order upon the
non-payor, and an arraignment and trial are
scheduled.
