House votes to hold Attorney General Holder in contempt of Congress
Yesterday the House voted to hold Attorney General Eric Holder in contempt of Congress for failing to provide key information pertaining to Operation Fast and Furious, making Holder the first sitting Cabinet member in history to be held in contempt.
With 17 Democrats breaking ranks to side with Republicans in favor of contempt, Holder got more Democrat votes than any of President Obama's budgets in Congress.

As severe a blow as we received today by the hands of the court - and by those who passed the health bill - we do not have the luxury of immersing ourselves in discouragement. Any time we spend on hostility and recriminations is time and energy we rob from ourselves and our fellow citizens, time that must be spent on influencing public opinion and changing the political landscapes of our community, our state and our country.
The sneak attack at Pearl Harbor decimated our Pacific forces, followed just days later by Hitler declaring war on us too, but Americans did not say, "Game over, and we've lost".
Instead, we licked our wounds and prepared ourselves to engage in the most enormous war ever fought on this planet. And we won!
There are obvious things we've got to do, to help make things right, among them:
1. Get Casey out of the senate
You'll soon receive a one-page list of reasons from me on why he must be booted out. This list must be circulated by you and every other member as widely as possible.
Assuming Romney gets in, he'll need a majority in the senate. Without it, he'll be handicapped. If he doesn't get in, we'll need a majority to help block further damage.
Either way, Casey must go!
2. Draw people into our movement
Our General Wayne ad campaign begins next week, to attract people to our meetings and our web site. At our July 10th meeting, you'll be provided with material to "reach out and touch" people you know or know of.
3. Work against the socialist indoctrination by our schools
I'm stumped on how to go about this. If you have some ideas, please send them to me.
4. Get your letters into the news media. Over the past six months, I've noticed a significant increase in letters from conservatives. The most effective letters are those that include facts about the issue(s). If you don't submit such letters, you are deferring to those who might hold the opposing view.
This administration has declared war on our personal freedoms, and has also declared war on people of faith, including the Catholic Church, a church that has vowed to engage in civil disobedience rather than violate their principles.
We've had this war thrust upon us. Understand that each of us must become a combatant on the front line. I'll look for you at our July 10th meeting with some ideas; we'll have lots to cover

How the original Tea Parties got started:
In May of 1773 Parliament concocted a clever plan. They gave the struggling East India Company a monopoly on the importation of tea to America. Additionally, Parliament reduced the duty the colonies would have to pay for the imported tea. The Americans would now get their tea at a cheaper price than ever before. However, if the colonies paid the duty tax on the imported tea they would be acknowledging Parliament's right to tax them.
The colonists were not fooled by Parliament's ploy. When the East India Company sent shipments of tea to Philadelphia and New York the ships were not allowed to land. In Charleston the tea-laden ships were permitted to dock but their cargo was consigned to a warehouse where it remained for three years until it was sold by patriots in order to help finance the revolution.
In Boston, the arrival of three tea ships ignited a furious reaction. The crisis came to a head on December 16, 1773 when as many as 7,000 agitated locals milled about the wharf where the ships were docked. A mass meeting at the Old South Meeting House that morning resolved that the tea ships should leave the harbor without payment of any duty. A committee was selected to take this message to the Customs House to force release of the ships out of the harbor. The Collector of Customs refused to allow the ships to leave without payment of the duty. Stalemate. The committee reported back to the mass meeting and a howl erupted from the meeting hall. It was now early evening and a group of about 200 men, some disguised as Indians, assembled on a near-by hill. Whopping war chants, the crowd marched two-by-two to the wharf, descended upon the three ships and dumped their offending cargos of tea into the harbor waters.
Most colonists applauded the action while the reaction in London was swift and vehement. In March 1774 Parliament passed the Intolerable Acts which among other measures closed the Port of Boston. The fuse that led directly to the explosion of American independence was lit.

Bucks, Montco political reaction to U.S. Supreme Court decision

When the U.S. Supreme Court reached its momentous decision Thursday morning, Theresa BrownGold was standing not far from the front steps of the stately building as she had so many times this year.
Brown Gold, of New Britain Township, is an advocate of the Affordable Care Act and an artist who paints portraits of people who have struggled with the health care system.
A man standing nearby told her the court ruled in favor of President Barack Obama's health care mandate. "I didn't believe it," she said. "I needed it confirmed."
Her phone soon rang and it was her son. He told her the mandate stood. "I was numb, numb and dizzy" she said, recalling the crowded sidewalk and Washington's summer heat. She hugged the man standing next to her and asked if he had some water.
"I felt like I was going to buckle," she said.
Democrats and Republicans each felt some of that weakness Thursday. Democrats from the thrill of a long-fought victory; Republicans from a kick to the stomach from a conservative chief justice, John Roberts, who joined with the bench's liberals in a majority 5-4 decision.

While plans for school vouchers remain mired in the General Assembly, some lawmakers are supporting a new idea to help kids in failing schools. Rep. Jim Christiana, R-Beaver, is introducing a bill that would create a $100 million tax credit program aimed at children in poor-performing schools. The bill to create the new Educational Improvement Scholarship Credit will be introduced today in the House of Representatives. The program would try to build on the state's $75 million Educational Improvement Tax Credit program. That program grants tax credit to companies that donate to preschool and K-12 scholarships to students or to innovative public education programs. Tax credits for this program typically are spoken for in a matter of days after they become available. The new tax credit program would be limited to companies donating to organizations that provide scholarships to students in the state's worst-performing schools. In Christiana's plan as well as the existing EITC program, businesses donating to scholarship organizations could cut their state taxes by up to 90 cents on every dollar donated to education. The goal of Christiana's plan is to generate enough money to provide an escape for 30,000 low- and middle-income students in failing public schools. His plan would provide scholarships of up to $8,500 for a regular education student and up to $15,000 for a special-needs student. "I think it is a very attractive program to those that want to help these kids get out of the violent underperforming schools," Christiana said. Support for a new education tax credit is evolving among House Republican leaders. "I think it's definitely something we should do," said House Majority Whip Stan Saylor, R-York.

"Losing our Sons": Documentary looks at domestic Islamic radicalization and jihadization
Charles Jacobs at Americans for Peace and Tolerance announced today the release of a trailer for their upcoming documentary, "Losing Our Sons", featuring Melvin Bledsoe - father of domestic terrorist Carlos Bledsoe aka Abdulhakim Mohamed who gunned down US Army recruiter Pvt. William Long at an Army-Navy recruiting center in Little Rock, Arkansas in June 2009. Melvin Bledsoe testified at the House Homeland Security Committee hearing earlier this month.
The upcoming documentary discusses how Bledsoe was radicalized by the Muslim Student Association in Tennessee and sent to terrorist training in Yemen with the written recommendation of the imam of a Nashville mosque. In big Supreme Court cases, it's all about winning

A number of good conservative legal commentators have taken solace in the fact that the Supreme Court found that the Obamacare mandate cannot be upheld under the Commerce Clause. For example, Michael James Barton writes:
The mandate is upheld as a tax, using the coercive - but not unlimited - power that Congress has always possessed. This is a distinction with a very big difference. Had Obamacare been upheld under the Commerce Clause, then our Constitution would have been a dead letter without limits on congressional power. We still have our Constitution.
I'm not consoled. The vote on the Commerce Clause was 5-4. If the next Court to hear a big Commerce Clause case has one additional liberal Justice (in net terms), then today's holding on that provision will be distinguished away in one fashion or another.
A decision upholding the mandate under the Commerce Clause would have been vulnerable to the same fate in a more conservative future court. Admittedly, this is less certain, since conservative Justices, or at least one variety of them, tend to be a little more respectful of precedent than their left-wing counterparts.
The point is that one should never take too seriously what the Supreme Court says because its pronouncements about the law are always subject to de facto modification through one bit of manipulation or another. In cases that have the capacity to affect the way we live our lives, it's only what the Supreme Court does - the bottom line - that is likely to matter.

A Defeat-But It's Not Over, Or, Roberts' Rules of Disorder

Finally back in Ashland, Ohio, after my turn this morning at Bill Bennett's radio mic, which is always fun. Dinner tonight with Mike Huckabee. Wonder what will be on his mind?
I wont's sugarcoat this: today's Supreme Court decision was a significant defeat for the cause of constitutionally limited government, made all the more galling by the fact that Justice Kennedy-the usual wobbler-was on board for striking down the whole thing. I won't, however, go as far as Churchill's words about Munich-"a total and unmitigated defeat"-because there are some aspects of Chief Justice Roberts' strange opinion that make it something of a mitigated defeat.
First, let's note that there were five votes to declare that the Commerce Clause cannot be stretched this far. (There's also a small affirmation of federalism in the Medicaid issue, which may, by the way, telegraph problems for the state exchanges under Obamacare, which will now be litigated). A constriction of the Commerce Clause was far from certain at any point along the way; remember that several strong conservatives at lower courts-especially Larry Silberman on the DC Circuit-had upheld Obamacare on Commerce Clause grounds. And then scroll back to a Power Line entry of mine from June of last year:
Eric Claeys, a former clerk for Chief Justice Rehnquist, thinks there is a good chance that even the Court's conservative justices might not vote to strike down the individual mandate at the heart of Obamacare:
But this conventional wisdom [that the five conservatives will vote to strike down] is wrong - and adhering to it could prove highly counterproductive for Obamacare's opponents. It is wrong largely because it assumes that the Roberts Court's "judicial conservatives" are members of a monolithic bloc. But in fact, conservative judges are often pulled in different directions by two competing attachments: to "originalism" and to "judicial restraint." In constitutional cases that touch on questions of federalism, Justice Thomas has generally voted and reasoned as a committed originalist. Justices Scalia and Alito, and Chief Justice Roberts, however, have often appealed to judicial restraint to uphold acts of Congress that may be in tension with an originalist reading of the Constitution. One or more of these three judicial conservatives may well do the same with regard to Obamacare.
Claeys thinks, and I agree, that a direct political strategy of congressional repeal is necessary. I've worried from the beginning that relying on the Supreme Court to deliver a political victory would dissipate conservative energy against Obamacare in particular along with Obama's broader agenda. In fact, a Supreme Court victory in favor Obamacare would be a huge blow, as Obama would claim it as a signal of legitimacy for the plan.
So the fact that we came within an ace of having five votes to strike down the entire law should tell us something about how Obama's overreach with health care has affected legal thought in the country.
Second, putting aside Roberts' reasoning about how the mandate can be shoehorned into the taxing power (which no one disputes would have been a valid basis for Obamacare), it is surely plausible that what dictated his reasoning was political concern for the reputation of the Court. While this shouldn't be a factor in judging any case, it is not entirely insensible. The Court will not now be an issue in this election-the substance of Obamacare will be, though. (And from the sounds of things, the kettles of the Tea Party are back at a full boil this afternoon. Good.) Obama now has to run for re-election beneath the cloud of having lied to us about Obamacare "not being a tax." Roberts' opinion also implicitly says that Congressional Democrats are incompetent legislators. (But didn't we know that already?) I look forward to seeing Sen. McCaskill, among others, respond to the inevitable TV ads that she "voted for a $1.7 trillion tax increase on the middle class." Should be fun to watch. Just off the top of my head, I am guessing the "mandate is a tax" outcome will cost Democrats two or three Senate seats and another half-dozen House seats.
Some people are comparing this decision to Marbury, in that Obama wins the tactical victory, but loses the strategic victory. (The incomparable Jay Cost, among others.) There may be something to this. Let's wait for the dust to settle. I'm not happy about things, but let's let this play out a bit. All I know for sure right now is that it's not over.

How many fouls are basketball players allowed to commit?

We used to argue this question in law school. I took the position that NBA players were allowed to commit six fouls, and college players five. My argument was that, while you would pay a significant price for committing the sixth foul (or the fifth in college), namely having to sit out the rest of the game, the rules did not bar you from committing it. If you were on the court and elected to commit it, no one would stop you.
The students I argued with said that NBA players were only permitted five fouls (college players four) because any additional fouls would be harshly penalized in a way that earlier fouls were not. In this sense, players were prohibited from committing the "fatal" foul.
I can't remember whether I actually believed my position or took it just for the sake of arguing. I'm pretty sure I thought that both views were defensible, and that arguing the matter was fun but not at all consequential.
A similar dispute, though not an identical one, appears to lie at the heart of the highly consequential debate between Chief Justice Roberts and Justice Kennedy over whether it is "fairly possible" to view the payment that must be made under Obamacare for not purchasing health insurance as a tax. Roberts' view that it reasonably can be considered a tax rests, at least on part, on the claim that there is no prohibition against not buying health insurance. An individual can refuse to buy insurance, just as a basketball player can commit that last foul, though he or she will pay a price for the refusal.
Kennedy's view is that the price one must pay for not purchasing insurance entails a prohibition. He quotes the great jurist Chancellor Kent as follows: "If a statute inflicts a penalty for doing an act, the penalty implies a prohibition, and the thing is unlawful, though there be no prohibitory words in the statute."
Kennedy's view of this matter is more persuasive than the Chief Justice's. But remember, under rules of constitutional adjudication, Roberts' view need not be the most persuasive one. As Kennedy concedes, it must only be "fairly possible."
Unfortunately, the "fairly possible" test is a squishy one, to say the least. In the end, its application can depend on the lengths to which a judge is willing to go to avoid overturning a legislative act. Chief Justice Roberts went to considerable lengths, and is vulnerable to the criticism that he went too far.

A message from "Law World" - What Chief Justice Roberts said about the individual mandate

Like Scott, I was skeptical that the Supreme Court would save us from Obamacare, although in light of the oral argument, I thought the chance of such "salvation" was close to 50 percent. In late April, at 15 to 20 person dinner organized by the Federalist Society, there was a show of hands of those who thought the Obamacare mandate would be upheld. My hand went up. I'm pretty sure it was the only one.
I'm disappointed that my prediction turned out to be right. But the decision confirms that "Law World" is a highly indeterminate place. It would be indeterminate enough if every member of the Court viewed the job as applying the words of the Constitution as they were originally understood. But that view of the job is rejected by a majority of the Justices and, with no other rule-based view of the job in its place, a range of plausible outcomes becomes possible in a great many cases.
Chief Justice Roberts' opinion demonstrates this, I think. In this post, I summarize, without much commentary, my understanding of what Roberts wrote in reaching his conclusion, joined by the four liberal Justices, that the individual mandate is constitutional. Many of his arguments reflect well-established precedent and rules of construction, while the remaining ones seem plausible, at least facially, in Law World. However, I reserve the right to revise this conclusion after I have re-read the opinions and given the matter more thought.
Roberts found that the individual mandate in Obamacare cannot be upheld under the Commerce Clause. He did so essentially because the mandate regulates economic inactivity by individuals, which that Clause does not permit.
But the government argued, as an alternative theory, that the mandate can be upheld as a legitimate exercise of the federal government's taxing power. For Roberts, resolving this claim required answers to two questions. First, is it reasonable to view the mandate as a tax; second, if so, is the mandate a valid exercise of the taxing power.
Notice how Roberts framed the first question. He didn't ask whether the mandate is best viewed as a tax, rather than a penalty. He asked whether viewing it as a tax is reasonable - i.e., a "fairly possible" interpretation.
Here, the Chief Justice adopted the view, which appears often in constitutional jurisprudence, that before a court overturns a statute as unconstitutional, it must resort to every reasonable interpretation of the statutory language to see whether the statute can be saved. This is part of the "judicial modesty" that Roberts likes to talk about. In his view, and the view of many, this approach guards against a "judicial activism" in which judges are too aggressive in thwarting the will of popularly elected branches of the government.
To find it reasonable to view the mandate as a tax, Roberts had to overcome Congress' own characterization of the mandate as a penalty, not a tax. Here, Roberts noted that congressional labeling doesn't control the nature of its actions for purposes of constitutional adjudication. This view also has support in court precedent.
But earlier in the decision, Roberts found that the mandate is not tax for purposes of the Anti-Injunction Act precisely because Congress called the exaction a penalty. He defended this seeming contradiction by arguing that it is up to Congress to decide whether to apply the Anti-Injunction Act (its own creature) to its own legislation. But Congress cannot decide whether something is a tax for purposes of the Constitution.
Roberts then noted that the mandate looks like a tax as much as it does a penalty in some important respects. For example, the IRS collects it, and the levy is, for most people, much less exacting than the price of the insurance they are declining to buy. Thus, Roberts concluded that it is a reasonable view, though not necessarily the best one, to say that this is a tax.
While this portion of Roberts' opinion is debatable, it should be noted that many critics of the mandate described it as a tax. Of course, as noted, the mandate's defenders denied that it is. To the extent that these defenders are elected officials, the response to their hypocrisy, I imagine Roberts would say, is to "throw the bums out."
For Roberts, the issue then became whether the mandate is a valid exercise of the taxing power. Dealing with the main argument raised by the plaintiff in the case, he found that the mandate is not a direct tax under the recognized definition, and therefore doesn't need to be apportioned among the states.
But what about the fact that the government is taxing inactivity? This seemed to trouble Roberts a bit. However, he argued that, though the Constitution protects citizens from being forced into economic activity, it doesn't provide a guarantee that inactivity won't be taxed.
Roberts agreed that there are limits to the government's ability to tax inaction. The tax cannot be overly punitive; the power to tax should not become the power to destroy. But Roberts found that the "tax" imposed by the mandate meets this test because, in essence, the amounts involve do not exceed, and usually are lower than, the cost of the insurance.
On its face, Roberts' decision is not a shocking "missive" from Law World. But I'll have more to say about the case after I've re-read the opinions and given things more thought.

Take this tax...

Has the Supreme Court ever served as a bulwark of constitutional liberty when the chips were down? Contrary to popular belief, and the Supreme Court's own conception of itself, I think the answer is largely negative.
There is a multitude of examples that supports the negative answer. Think of the Court's First Amendment decision extending First Amendment protection to flag burning while (mostly) tying itself in knots on campaign finance laws limiting political speech at the core of the idea of free speech. Or, to take a classic example, think of the Japanese internment case. All was not lost. Mr. Korematsu's conviction for evading internment was set aside in 1983.
To take a somewhat more obscure example, think of the Minnesota Mortgage Moratorium case. When the time came to protect creditors against states impairing the right of contract, the Supreme Court abandoned the constitutional protection on the theory that an emergency supported its suspension.
The idea that the Supreme Court would save us from Obamacare is more fitting for Greek drama, with its device of the deus ex machina, than for modern constitutional law. The big legal fight over Obamacare was a good one, one worth having - and more remain - but I didn't think the Court was going to save us from this monstrous pseudo-law.
Nevertheless, the litigation over Obamacare provides a good education in the idea of limited constitutional government and the imminent danger of its passing. It also demonstrates the jeopardy in which Obamacare has placed it. To borrow an expression from another of the Supreme Court's First Amendment mistakes, Obamacare poses a clear and present danger to limited constitutional government.
Now the fight against Obamacare will be won if it all only on the political battlefield. The Supreme Court has relegated us to the remedy of self-help. The time, coincidentally, is now.
Against the arguments advanced by Obama and the doctrines now adopted in one form or another by the Supreme Court, we have continually to pose Lincoln's question: "Now, I ask you in all soberness if all these things, if indulged in, if ratified, if confirmed and endorsed, if taught to our children, and repeated to them, do not tend to rub out the sentiment of liberty in the country, and to transform this government into a government of some other form." Last week I had the opportunity to get a sneak-peek at the RNC's new Facebook application. Designed, in the words of one RNC staffer to "take our message where the people are," the Social Victory Center app will, among other things, hook users up with campaign news targeted based on their location and preferences (which Facebook already knows, of course), let users join volunteer efforts, distribute voter registration forms, and provide an online phone bank, all without leaving the Facebook website. It will also, if users wish, put those activities on the user's Facebook wall, letting their friends see what they're up to and, hopefully, encouraging them to join in.

It's an attempt to leverage Facebook's popularity in a new way and, at the moment, the Democrats have nothing like it. The Social Victory Center was unveiled to the public yesterday, so if you're on Facebook, check it out. As the general election ramps up, check back for volunteer activities as they're added. Also, like I did in 2008, I'll be pushing online phone banking in the final weeks of the election, only this time the RNC will have done the heavy-lifting that the McCain team wasn't too keen on. RedState Morning Briefing
For June 29, 2012
1. Awake.
In the past twenty-four hours I have gotten a lot of heat from friends over my take on what John Roberts did. What's done is done and I really could not get all worked up about it because Obamacare in the Courts has been such a distraction. Yet again the GOP expected a court to save them from something they did not like.
The GOP has largely turned its nose up at the tea party, which is its salvation. The tea party movement provided the GOP with the energy, man power, and money to take back the House in 2010 and come close in the Senate. For that, the GOP has routinely given the tea party the middle finger and, instead of fighting for repeal of Obamacare, excused itself while the Supreme Court did the heavy lifting.
John Roberts, the man who gave us the Citizens United case has now, with a laughably inane ruling, told us we have to fight politically. The millions of people who joined the tea party in 2009 only to go back to their jobs and families after the 2010 election are now awake.
In waking, what they are seeing is a government claiming that food stamps will make you look amazing and that encourages people to party with food stamps. They are seeing a corrupt tourism program. They are seeing tax cheats getting billions from Barack Obama. They are seeing high unemployment, the United States Attorney General held in contempt of congress, the GOP cave on fiscal issues, and the Supreme Court deciding something the vast majority of Americans hate is constitutional.
And they are seeing that, just like in 2010, they are the only ones who can stop Barack Obama and the Democrats. The GOP is nothing without the tea party. Tea Party activists are awake again. And thanks to John Roberts they are mad as hell.
2. I'm Not Down on John Roberts
Having gone through the opinion, I am not going to beat up on John Roberts. I am disappointed, but I want to make a few points.
3. I Am Down on John Roberts.
We do not choose justices, on our side, because of policy results; we choose them for process, which we believe will usually, but not always, produce better results. Process matters in the law, because process is the law. When the law upon which the majority of our citizens through their representatives have agreed is followed, the result is axiomatically better either substantively or educationally, that is, because it shows us where our process is wrong.
4. How the NRA Helped ObamaCare
It's tough to accuse the National Rifle Association of being left-wing, but events on Thursday highlight just how useless the organization can be to the conservative movement at large. On the day that the Supreme Court found the most odious provisions of the Affordable Care Act - ObamaCare - constitutional, the House of Representatives took the historic step of holding a sitting attorney general in contempt of Congress.

While everyone is focused on how to deal with the impending government takeover of healthcare, we must continue to battle the forces of big-government in Congress. Yesterday, in another display of venerable bipartisanship, leaders from both parties agreed to roll the $120 billion Democrat highway bill, subsidies to fuel the Big Education bubble, and a 5-year extension of government-run flood insurance into one omnibus bill, H.R. 4348.
The House and Senate plan to vote on the bill tomorrow. We'll be keeping score.
6. Hold Mitch McConnell To His Word
In February, Mitch McConnell told Senate Republicans he would not bring up any votes on Obamacare repeal.
7. The Repeal Pledge: Another Reason to Support Ted Cruz
Today the United States Supreme Court left Obamacare in tact.
That means every Republican Primary left now matters even more significantly.
In Texas, Ted Cruz is in a runoff with David Dewhurst.
Only Ted Cruz has sided the repeal pledge pledging to repeal Obamacare. David Dewhurst has not. These differences matter. Go support Ted Cruz right now. We'll need every vote we can muster in the Senate next year to repeal this thing and only Ted is on record willing to repeal Obamacare.
By the way, the Dewhurst campaign reached out and said they signed the repeal pledge on May 26th. I reached out to the repeal coalition and they can find no record of a Dewhurst signature until yesterday . . . after Ted Cruz yet again made an issue out of it.

We are winning on the exchanges!
Fellow freedom lover,
Lynn Jensen, another PA docs4patientcare physician, and I met yesterday with Todd Shamash, the Governor's Assistant Chief of Staff. John Basial, Senator Folmer's Chief of Staff, Aaron Scheck of the Governor's office, and Matthew O'Donnell from the PA Department of insurance. Although I had made multiple email and phone attempts to initiate a dialogue with the Governor's office about the exchanges, those efforts were ignored until last week, when Mr. Shamash's office invited me to come to Harrisburg for some discussion. It became clear during our conversation that the meeting was motivated as a result of the grassroots and our efforts to stop the exchanges including calling and emailing the Governor's office, emailing and visiting our state representatives, and local op-eds.
I gave a brief presentation outlining some of the fiscal and healthcare catastrophic ramifications of President Obama's healthcare law, the components of viable market-based reforms, and the appropriate action (refusing to set up an exchange, passing HB42 Medical freedom act, and passing state based reform to increase affordability and access of healthcare insurance) our state government should take for the contingency of Obamacare not being ruled unconstitutional by the Supreme Court. Mr. Shamash responded by saying the Governor was in agreement with the great majority of our position. We expressed our appreciation for the Governor's opposition to Obamacare but made it clear that the Governor's intent to establish a compliant exchange was the wrong course of action to protect the Commonwealth's citizens from the harmful ramifications of Obamacare, and that we will continue to actively and public work to stop establishment of an exchange.
Clearly all of our efforts not only stopped their earlier active effort to move ahead with an exchange bill but is making them reconsider their position on the exchanges. We may have at a minimum convinced them not do anything until the November election. At this point, I believe they wish this issue would go away by SCOTUS declaring Obamacare unconstitutional.
So, good job! But, we need to keep the pressure on. Please encourage your members to continue to call and email the Governor's office and to email and visit you state representative and senator. Insist the sign the Americans for Prosperity Health Care Freedom Pledge. I attached a couple of documents to arm your members with the facts on the exchange.
One last request on this too long email - please encourage your members to encourage their doctors to join the fight to protect our healthcare by joining docs4patientcare. I attached a letter to give to doctors and some info on Docs4patientcare.

Communist Party: Obama's Reelection is 'Absolutely Essential'
For reasons we at the Blaze have never fully found persuasive, it has long been considered bad form to accuse President Obama of communist or socialist sympathies, even in the most roundabout way.
Yet what happens when the communists themselves sympathize with him? We have not yet been handed our official protocol on that from the mainstream media. Whatever shall we do?
In this case, most likely laugh after we've silenced the feeling of queasiness brought about by this story. You see, while President Obama doesn't claim to be a communist, certainly communists seem to be in a hurry to get him reelected. John Case, a writer at People's World, one of the official web organs of the Communist Party, has made precisely that case. You may be surprised to learn that his reasoning is, though, the reverse of Glenn Beck's reasoning for supporting Mitt Romney. To quote Beck on Romney, "At least he's not a commy."
In short: We can't vote for Romney because he's not a commy.

Since the toppling of Hosni Mubarek, there have been a number of reports regarding Obama administration behind-the-scenes support of the Muslim Brotherhood in Egypt. The Washington Times reports the latest below. You may recall that in 2009, when Iranians rose up in protest of the election of Mahmoud Ahmadinejad in Iran, President Obama refused to issue even a statement of support for the protestors. His justification was that we shouldn't get involved in the internal politics of Iran. Apparently no such reluctance existed for the Obama administration to get involved in the internal politics of Egypt-on the side of the Muslim Brotherhood.

Now Bush fingered in 'green stimulus' madness. Obama, Soros also involved in 'ludicrous' wood chip fuel scheme. Scores of companies have received federal loans and grants from President Obama's 2009 "stimulus" to manufacture an experimental fuel called cellulosic ethanol which has not yet been successfully produced in the U.S. and which may not even work.
The fuel, which is supposed to come from wood chips, was first pushed and funded by the Bush administration.
Despite the fact that no company has yet been able to produce the fuel, Congress previously passed a law imposing mandates on oil companies to mix the non-existent cellulosic fuel into gasoline.

In March, Justice Anthony Kennedy observed that a fully implemented ObamaCare would "...change the relationship of the federal government to the individual in a very fundamental way..." But Justice Kennedy made a very fundamental mistake. The relationship between the American people and what has become the D.C. ruling class actually changed 70 years ago when the Supreme Court decided that a farmer in Ohio could not legally grow wheat on his own land for use by his own family. It was in ruling that Roscoe Filburn threatened the Article I, Section 8 Commerce Clause powers of Congress that a truly "fundamental change" was effected on the relationship between Americans and their government. The existence of ObamaCare is simply a logical result; a not unexpected consequence of that 1942 descent into judicial insanity. (1)

Under questioning by Senator Charles Grassley, Attorney General Eric Holder testified that a handful of emails written to Department of Justice officials by former ATF Acting Director Kenneth Melson are being withheld illegally from congressional committees as a result of Barack Obama's claim of executive privilege. Why I'm afraid of the Supreme Court's ruling on ObamaCare

I'm scared.
I fear that even if the Supreme Court overrules most of ObamaCare, Republicans will join Democrats in restoring "good" parts of the law, like the requirement that insurance companies cover kids up to age 26 and every American with a pre-existing condition.
Those parts of ObamaCare are popular. People like getting what they think is free stuff. But requiring coverage to age 26 makes policies cost more.
Even "Factor" host Bill O'Reilly lectures me that government should ban discrimination against those with pre-existing conditions. Most Americans agree with him.

Brutal: Supreme Court Largely Upholds Obamacare

In a complex ruling, the Supreme Court has largely upheld the controversial Obamacare law. The Court struck down the individual mandate as an unconstitutional penalty under the Commerce Clause, but upheld it as a permissible tax. It also limited the expansion of Medicaid spending under Obamacare, which states had argued was a violation of the Tenth Amendment.
Overall, the decision is a political victory for the Obama administration--but may energize conservatives to turn out to the polls in November, both to back Republican Mitt Romney's promise to repeal the law, and to prevent Obama from packing the Court with liberal justices.

The Price of Liberty
Thank God for American Patriots
"This was the object of the Declaration of Independence. Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject, in terms so plain and firm as to command their assent, and to justify ourselves in the independent stand we are compelled to take. Neither aiming at originality of principle or sentiment, nor yet copied from any particular and previous writing, it was intended to be an expression of the American mind, and to give to that expression the proper tone and spirit called for by the occasion." --Thomas Jefferson (1825)
With Independence Day upcoming, one would have to be brain dead or liberal (a distinction without difference) to avoid the comparison between the imperial powers from which our Founders broke free and the Imperial Presidency which now threatens the Essential Liberty they, and generations of American Patriots since, have defended with their "Lives, Fortunes, and Sacred Honor."
Contrast the current Commander in Chief's wanton and willful disregard for his sworn oath to that of generations of uniformed American Patriots who have spilled blood in keeping with their oaths to Support and Defend our Constitution.
That contrast is particularly clear to me today.
This morning, I join many other parents who are delivering a son or daughter for in-processing at one of our fine Military Service Academies. My firstborn son is breaking tradition with our family's naval legacy by joining the Air Force Academy's Cadet Wing, having turned down his appointment to the Naval Academy. However, he alone has set the course for his future with God as his North Star, and that bearing, which guided him to the AFA, will not lead him astray.
In a few hours, he will form up with his squadron and affirm his first oath to "support and defend the Constitution of the United States against all enemies, foreign and domestic [and] bear true faith and allegiance to the same..." I know this young man will honor that oath throughout his life as he has already -- earning the American Legion Award for Patriotism four years ago when just an eighth grader.
Afterward leaving my son, I depart west from Colorado Springs to attend the retirement ceremony for a career Navy captain tomorrow morning. My friend and colleague, a USNA graduate who I first met more than a decade ago when we were on a National Defense University panel, has steadfastly devoted more than 35 years of his life to support and defend our Constitution. I am deeply honored to be included in that ceremony.
So, within the course of the next 24 hours, I will witness my son at the beginning his active military service, and my colleague at the ending of his.
These two events serve as bookends to the generational spirit of American Liberty enshrined by our Founders in the Declaration of Independence and our Constitution. They also stand in stark contrast to BHO's determination to undermine Liberty, by offending constitutional Rule of Law at every turn -- most notably by his successful effort to nationalize the entire American health care system, upheld by the U.S. Supreme Court this morning. Our hope now is for legislative repeal. Moreover, he is determined to undermine the moral integrity of our uniformed service branches. (I can say that publicly; my son no longer can.)
Post Your Opinion: Are you willing to Support and Defend?
However, amid Obama's efforts to erode the pillars of American Liberty, I should interject here that we at The Patriot Post won a small victory for Liberty this week in regard to our mission of service to American military personnel.
Among other projects supported by proceeds from our Patriot Post Shop is the free distribution of our Essential Liberty pocket guides to U.S. military personnel and support groups across the nation and around the world.
Several months ago, Navy investigators notified us that they were considering legal action under the UCMJ against Marine and Navy officers who received our Essential Liberty guides and distributed them at promotion ceremonies in Afghanistan. Apparently, some Obamaphile took offense at the distribution of the Declaration of Independence and Constitution to officers and enlisted personnel.
Fortunately, as notified this week, wiser heads prevailed and investigators have concluded that there is no impropriety in requesting and distributing the booklets. This is a bittersweet victory, however, because this investigation cost a great deal of income seized from taxpayers, and it caused a significant amount of heartburn for those under investigation. While we do not know what affect it might have upon the willingness of officers and enlisted personnel to request Essential Liberty guides, we rest assured that their commitment remains unwavering to their defense of Essential Liberty.
Moreover, this investigation is an indication of how deep the Obama decay and degradation has penetrated even the ranks of military JAG and IG offices ... and how effective his Leftist cadre assaults on Liberty have been. But, American Patriots by the tens of millions remain steadfast in our resolve to "support and defend the Constitution of the United States against all enemies, foreign and domestic," the exposition of Liberty as first enshrined so eloquently in our Declaration of Independence -- so help us God.
As an Fourth Class AFA "doolie," one of the quotes my son will be required to memorize is this from 19th-century libertarian philosopher John Stuart Mill: "War is an ugly thing, but not the ugliest of things; the decayed and degraded state of moral and patriotic feeling which thinks nothing worth a war, is worse. A man who has nothing which he cares more about than he does about his personal safety is a miserable creature who has no chance at being free, unless made and kept so by the exertions of better men than himself."
Indeed.
On the commemoration of the signing of our Declaration of Independence, John Adams wrote to his wife, Abigail, that the date would "be the most memorable Epocha, in the History of America. I am apt to believe that it will be celebrated, by succeeding Generations, as the great anniversary Festival. It ought to be commemorated, as the Day of Deliverance by solemn Acts of Devotion to God Almighty. It ought to be solemnized with Pomp and Parade, with Shews, Games, Sports, Guns, Bells, Bonfires and Illuminations from one End of this Continent to the other from this Time forward forever more. You will think me transported with Enthusiasm but I am not."
Adams continued, "I am well aware of the Toil and blood and treasure, that it will cost Us to maintain this Declaration, and support and defend these States. Yet through all the Gloom I can see the Rays of ravishing Light and Glory. I can see that the End is more than worth all the Means, and that Posterity will tryumph in that Days Transaction, even altho We should rue it, which I trust in God We shall not."
Ahead of Independence Day next Wednesday, we will publish a special edition devoted to our Founding Fathers.
On that, and every day of the year, let us "Proclaim liberty throughout all the land unto all the inhabitants thereof" (Leviticus 25:10 as inscribed on the Liberty Bell). Please pray for our Armed Forces standing in harm's way, that we might live free.

Religious Liberty Concerns Grow Greater as Obamacare Upheld by Jennifer Marshall and Sarah Torre
This morning, the Supreme Court didn't just miss the opportunity to protect individual liberty. It also failed to defend religious freedom. The Court's ruling to uphold the health care law doesn't mean it has cleared its legal challenges, however. Twenty-three federal lawsuits against the Department of Health and Human Services (HHS) mandate-which goes into effect on August 1-now take on added urgency. Implementation of the behemoth 2,700-page Patient Protection and Affordable Care Act (commonly "Obamacare") has only just begun, and the HHS mandate signals the damage to religious liberty and other freedoms Americans will experience as the teeth of the law sink deeply into our society in the coming months and years. The HHS anti-conscience mandate is a completely separate rule from the individual mandate, and its constitutionality was not considered by the Supreme Court in the cases decided today. The HHS mandate, along with the individual mandate and the rest of Obamacare, still presents a clear threat to individual and religious liberty. Nothing short of full repeal of the statute will adequately protect our freedoms from this federal overreach. The next legal battleground against Obamacare resides in the fight to protect employers from the coercive requirement to provide coverage of abortion-inducing drugs, contraception, and sterilization under the HHS mandate. More than 50 plaintiffs have joined the 23 lawsuits against the anti-conscience mandate to demand relief for countless religious employers forced into an untenable situation by the coercive rule. Obamacare's anti-conscience mandate affords the narrowest religious exemption in federal law, effectively covering only formal houses of worship. Countless other religious employers, like schools, hospitals, and religious charities, are forced to provide coverage for the mandated services despite moral or religious objections-simply because they step outside the four walls of a church to serve others. Creating the choice to violate conscience or forgo providing health insurance entirely-and risk hefty fines under Obamacare-the HHS mandate profoundly and adversely affects many employers and the people they serve. It also does severe damage to the broad understanding of religious freedom that Americans have enjoyed throughout the history of this great nation. As the Becket Fund for Religious Liberty's Senior Legal Counsel Hannah Smith stated:
"Never in history has there been a mandate forcing individuals to violate their deeply held religious beliefs or pay a severe fine, a fine which could force many homeless shelters, charities, and religious institutions to shut their doors."
The HHS anti-conscience mandate is only an early warning sign of how one-size-fits-all health care requirements will trample on religious liberty as well as individual liberty. To protect religious liberty specifically and individual freedom generally, Obamacare must be repealed. While the HHS mandate is litigated in Court, the broader fight for freedom now moves to Congress. Policymakers should repeal the entirety of Obamacare and replace it with health care reform that reduces costs, increases access, and leaves personal health care decisions where they belong: in the hands of the American people. Americans need and want health care reform that respects their liberties and their conscience.

A Clarion Call for the American People
The Supreme Court's decision to uphold Obamacare reflects a tragic misreading of the law, one which could cost us not just economically but also in terms of liberty. On the bright side, the Court recognized that there are limits to what Congress may do under the Commerce Clause. But this was the silver-lining of a dark cloud. The Court then fundamentally misreads ObamaCare, contorting to find another authority-the power to tax-for Congress to enact the law.
The effects of the decision will be felt far beyond ObamaCare. By allowing government to require Americans to buy a product or service at the federal government's direction, the Court has seriously damaged the principle of limited government. The decision announced today could open the door to even more dictates from Washington for generations to come. Indeed, anyone who has any doubts about this need only read the Court's suggestion that Congress could force Americans to buy energy efficient windows or pay a tax.
Fortunately, Americans have always fought for freedom, and won't give up now. We must turn to the task at hand and work for full repeal of this law. The Supreme Court has in essence given this decision back to Congress and the people, where political power resides.
The American people have spoken-they don't support Obamacare and fear its consequences more every day. Just this month a new poll conducted by The New York Times and CBS News showed that more than two thirds of Americans want to see the Supreme Court strike down Obamacare in whole or in part, and only 24 percent would keep the law in place.
Thankfully, the duty to defend the Constitution is not given solely to the Supreme Court-it is one shared by Congress and the President. It is now Congress' turn to do what's right both for the Constitution and policy reasons: repeal Obamacare.

 Obamacare After the Court The policy landscape will change dramatically after 10 a.m. today. If the Supreme Court does not strike down Obamacare in its entirety, Congress should move to repeal it. Americans support repeal of the health care law, as they have demonstrated in more than 100 polls since it passed in 2010. The infamous individual mandate is only the beginning of the problems Americans face under this law. Most importantly, Americans need real health care reform, and we need to begin moving toward a patient-friendly system where people have the freedom to choose the care that is best for them. Beyond the Individual Mandate Over the past two years, Heritage has laid out the flawed policies of Obamacare, including the individual mandate to purchase health insurance, which is at the center of the law's constitutional questionability. We must remember, as James Capretta says in a recent Heritage paper, that what might remain on the books is just as problematic as the provisions under legal scrutiny: 1. The Taxes. It is often forgotten that in addition to being a massive federal power grab, Obamacare contains one of the largest tax increases ever imposed on the American economy-at a time when job growth should be the nation's number one priority. 2. Deficits and Debt. Obamacare creates two new additional entitlement programs that are expected to add a minimum of 35 million Americans to the entitlement rolls when phased in, at an expense of more than $200 billion annually by the end of the decade. 3. The HHS Mandate. Obamacare has handed over immense regulatory power to the Department of Health and Human Services (HHS) to control just about every aspect of the nation's health system. Among other things, the regulations issued by the Administration thus far would require all employers, including religious employers such as Catholic hospitals and universities, to cover abortifacient products, contraceptives, and sterilization procedures in the health plans they offer to workers. This would directly violate the religious liberty rights of thousands of religious institutions around the country. 4. The Bureaucratic Micromanagement of American Health Care. In addition to creating new federal agencies, boards, and bureaucracies, Obamacare is also pouring hundreds of millions of dollars into the states to coax them into building the "exchanges" that will become the foundation of the Obamacare edifice. These exchanges, far from fulfilling the supposed mission of fostering a dynamic marketplace, will be the means by which the federal government will extend its reach to every corner of the health sector. Every American who does not obtain his or her insurance through an employer will have little choice but to go through Obamacare's exchanges. So What Should We Do? A starting point for developing alternative health insurance reform should be setting commonsense insurance rules for those who buy their own insurance by extending the protections previously established by HIPAA (the Health Insurance Portability and Accountability Act of 1996). As Heritage's Edmund Haislmaier explains: Currently, 90 percent of privately insured Americans are covered by an employer-group plan. Over the past 15 years, the HIPAA employer-group coverage rules have worked reasonably well. Congress should simply extend those rules to the remaining 10 percent of the private market that consists of people covered by individual health insurance policies. The HIPAA rules already extend key protections for those in the employer-group market, including a guaranteed issuing of coverage, guaranteed renewability of coverage, limits on pre-existing condition exclusions, and prohibition on discriminating based on health status. Extending these rules to the individual market would allow greater portability. Coupling sensible individual health insurance market reforms with appropriate tax and Medicaid reforms would be a fair and fiscally sound strategy for expanding coverage to the currently uninsured. The Heritage Foundation's Saving the American Dream provides such a plan and puts health care reform on a course toward a truly consumer-based health care system. No matter what happens this morning, conservatives especially should not be fooled into making short-term concessions that can undermine their long-term policy goals. Instead, Congress should use the opportunity to articulate clearly the shortfalls of the law and contrast them sharply with better solutions. The failure of Obamacare is not only a matter of the public's continued opposition to it; the law is also a major policy failure. It is based on the false premise that more government, more regulations, and more mandates are the right solution to America's health care problems. Congress must use this opportunity to offer an alternative vision for the future of health care-a future where individuals get better care at lower cost without government controlling the dollars and decisions. The Ball is in Our Court

As the day of judgment approaches, half the country sits waiting for a small group of men and women to decide how many of our civil rights we get to keep. After two flawed decisions that draw not from the Constitution, but from policy and opinion, we wait hopefully for a third opinion that will set us free.
Today the Supreme Court is slightly tilted in our favor, which is to say that it has a few members who believe that the Constitution is more than blotting paper for their opinions, and that individuals and states have rights, rather than just being troublesome cogs in the mighty machine of the national policy apparatus bent on tackling one growing crisis or another.
How long will that tenuous state of affairs endure? Who knows. In the meantime we are caught between an omnipotent executive who believes that he is above the law, an unelected court which includes two of his appointees, one of them his lawyer, and a Congress which does little except spend gargantuan amounts of money. And our best bet is the court, because it is the hardest to bribe and some of its members believe in the law, rather than in the almighty policy ends that justify all means.
