The Supreme Court has struck down most of the controversial Arizona immigration law, but upheld a key provision.

 

The provision that was upheld requires state and local police officers, during routine stops, to check the immigration status of anyone they suspect could be in the country illegally.

Just hours after the U.S. Supreme Court rendered its ruling and upheld the controversial so-called "show me your papers" provision in Arizona's immigration law, the Obama administration announced Monday they are suspending a vital program that lets state and local law enforcement agencies enforce federal immigration law, Fox News reports.

Obama administration officials said program 287(g) would be suspended indefinitely. Under the program, local authorities were permitted by the federal government to make immigration-related arrests.

 

Officials also said Immigration and Customs Enforcement (ICE) will not respond to calls from Arizona and other police agencies regarding the immigration status of people they pull over unless they meet a specified criteria. For example, they will respond if the person is wanted for a felony.

While plans for school vouchers remain mired in the General Assembly, some lawmakers are supporting a new idea to help kids in failing schools. Rep. Jim Christiana, R-Beaver, is introducing a bill that would create a $100 million tax credit program aimed at children in poor-performing schools. The bill to create the new Educational Improvement Scholarship Credit will be introduced today in the House of Representatives. The program would try to build on the state's $75 million Educational Improvement Tax Credit program. That program grants tax credit to companies that donate to preschool and K-12 scholarships to students or to innovative public education programs. Tax credits for this program typically are spoken for in a matter of days after they become available. The new tax credit program would be limited to companies donating to organizations that provide scholarships to students in the state's worst-performing schools. In Christiana's plan as well as the existing EITC program, businesses donating to scholarship organizations could cut their state taxes by up to 90 cents on every dollar donated to education. The goal of Christiana's plan is to generate enough money to provide an escape for 30,000 low- and middle-income students in failing public schools. His plan would provide scholarships of up to $8,500 for a regular education student and up to $15,000 for a special-needs student. "I think it is a very attractive program to those that want to help these kids get out of the violent underperforming schools," Christiana said. Support for a new education tax credit is evolving among House Republican leaders. "I think it's definitely something we should do," said House Majority Whip Stan Saylor, R-York.

IF your image of a city hall involves a venerable building, some Roman pillars and lots of public employees, the version offered by this Atlanta suburb of 94,000 residents is a bit of a shocker.

 

The entire operation is housed in a generic, one-story industrial park, along with a restaurant and a gym. And though the place has a large staff, none are on the public payroll. O.K., seven are, including the city manager. But unless you chance into one of them, the people you meet here work for private companies through a variety of contracts.

 

Applying for a business license? Speak to a woman with Severn Trent, a multinational company based in Coventry, England. Want to build a new deck on your house? Chat with an employee of Collaborative Consulting, based in Burlington, Mass. Need a word with people who oversee trash collection? That would be the URS Corporation, based in San Francisco.

Yes, Pennsylvania Really Is Up for Grabs

QUAKERTOWN, Pa.- Standing behind the cash register of a Wawa store, a young man handing change to a customer was distracted by Mitt Romney's "Believe in America - Every Town Counts" campaign bus arriving outside.

 

"He's here! He came here!" the young man shouted, grinning from ear to ear.

Customers who happened to be gassing up their vehicles at the attached service station, and those who happened to be shopping at a nearby mall, gathered as close as the Secret Service would allow, to catch a glimpse of or to shake hands with the presumptive Republican presidential nominee.

 

Most news reports that day led with the charge that Romney "dodged" (a term coined in endless tweets by a frustrated Obama campaign staffer) a visit by former Pennsylvania Gov. Ed Rendell to Romney's original destination.

 

What those reports missed was that Romney pulled off a spontaneous visit to a location lacking any staged comforts.

 

Except for a handful of supporters who learned of the venue change, Romney was on his own: No handmade signs from devoted fans. No local elected officials to ease his transition or to crack jokes. No balloons. No perfectly timed advance movements.

It was the sort of unstructured event that causes campaign staffers to prematurely gray.

 

Despite a reputation for being awkward among regular folks, Romney proved to be capable of acting on the fly. He found a way to take a potential confrontation with Rendell (and a parking lot full of paid hecklers) and turn it into a sharp learning curve for himself and his staff.

Designed, in the words of one RNC staffer to "take our message where the people are," the Social Victory Center app will, among other things, hook users up with campaign news targeted based on their location and preferences (which Facebook already knows, of course), let users join volunteer efforts, distribute voter registration forms, and provide an online phone bank, all without leaving the Facebook website. It will also, if users wish, put those activities on the user's Facebook wall, letting their friends see what they're up to and, hopefully, encouraging them to join in.

It's an attempt to leverage Facebook's popularity in a new way and, at the moment, the Democrats have nothing like it. The Social Victory Center was unveiled to the public yesterday, so if you're on Facebook, check it out. As the general election ramps up, check back for volunteer activities as they're added. Also, like I did in 2008, I'll be pushing online phone banking in the final weeks of the election, only this time the RNC will have done the heavy-lifting that the McCain team wasn't too keen on.

The Arizona Decision and What It Means Today, the United States Supreme Court, in a 5-3 decision (with Justice Kagan recusing herself), mainly gutted Arizona's SB 1070, the state's immigration law. Make no mistake, although prevailing on the most publicized aspect of the case, Arizona lost. What is somewhat surprising is the legal rationale used and if you are a conservative proponent of state laws that address the problem of illegal aliens within their borders, this has to be disheartening news.  

 

 

2. I Can See Russia From My Backyard

Last week I released a video on the 2nd Amendment stating well-documented, historical facts about totalitarian leaders and their implementation of gun control laws prior to exterminating millions of their own citizens in 1911 Turkey and 1939 Nazi Germany.

 

3. On Elizabeth Warren's Claims of American Indian Ancestry

For those of you who don't know, I'm a history major currently working toward his Master's Degree in the same. My particular focus is American Indian history, so I think it should come as little surprise that I've been watching the Massachusetts Senate race for more reasons than wanting Scott Brown to win. The moment Elizabeth Warren's claims of Native ancestry surfaced, a little something went off in my head telling me I had to follow this. I can't say I was surprised when I learned that these claims are, by everything we know, spurious. Neither can I say I was surprised when I learned she has shown little to no interest in meeting with a group of Cherokees outraged over her apparently fabricated claims.

I can't profess to be an "expert" on American Indian issues-there are so many tribes and cultures, there are so many differing opinions, and there is much I still have to learn-and I can't claim to speak for American Indians, whether all or in part. Nevertheless, that doesn't stop me from being outraged over what Elizabeth Warren has done.

Destroy a liberal's argument by exposing the underlying rhetorical cheat.

Argumentum ad Verecundiam, otherwise known as the "argument from authority." This is a favorite trick especially of the green movement-as in, "The National Academy of Sciences says that man-made global warming is real so it must be," or, "The Intergovernmental Panel on Climate Change represents the expert views of 2,500 of the world's top scientists: who are you to say they're wrong?" Reply that all it takes is one scientist to falsify a hypothesis: in fact, that's exactly how science is done, with one paradigm replacing another: think Copernicus (or Galileo) and the heliocentric theory of the solar system. Why is it, dear liberal, that you always want to close off debate whether it's about science or anything else in the name of your authorities and political correctness? Is it because liberals believe (as William F. Buckley noted) that everyone has a right to his own opinion-and then are shocked and outraged to find there is another opinion?

A Lawless Society

A lawless society is a depressing place to live because it's a place completely without law. And while going lawless might be appealing, we aren't talking about an end to laws requiring you to wear bicycle helmets or drink small sodas. Not even laws ordering you to pay recycle, pay taxes and join up during a war. These are laws, but they're also ordinances, commands and compulsions. They are not really any different from your parents telling you to wash behind your ears or a mugger ordering you to give him your money. They might be right or wrong, but they aren't law.

 
Law exists apart from what a group of people at any given time want you to do. That is why the aged nature of the United States Constitution is a strength. The farther away we travel from 1788, the less that the foibles and frailties of the Framers affect us. The transitory human things fall away leaving only the essence of law.

A Bill of Rights drafted today would look very different than it did back then. Not only would there be no Second Amendment, but most of the others would read dramatically different. There would be few severe restrictions on government power. Nor would there be unlimited Freedom of Speech. The entire thing would run a few thousand pages and would be filled with all sorts of escape clauses, which when added together would render the whole thing meaningless.

Take for example the EU Charter of Fundamental Rights, which includes dozens of new rights, such as the right of asylum, the right to environmental protection and consumer protection, and the right to social security, in addition to the more basic rights familiar to Americans, but it comes with a simple addendum.

"Any limitation on the exercise of the rights and freedoms recognised by this Charter must be
provided for by law and respect the essence of those rights and freedoms. Subject to the principle of proportionality, limitations may be made only if they are necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others."

Which is to say there is freedom of speech, only until a compelling argument can be made why banning someone's freedom of speech will help protect the general interests of the European Union or the rights of others to have environmental protection and social security.

That is the essence of a lawless society, which is to say that there are oodles and oodles of law, but it's merely a complicated way for those in power to enforce their will on others. If you want to force people to do something, all you need to do is study enough clauses, lay out your reasoning and it's done.

The Cult of Obama
The Corporate Cult evolved in the United States as a hybrid of the sales force of the corporation and the religious devotion of the cult. This type of entity might be a cult like Scientology, which used the aggressive and organized sales tactics and marketing campaigns of a corporation, or it could be a corporation like Apple, whose employees earn little, but feel a sense of satisfaction at being part of a meaningful entity.

 
The Obama Campaign is a fantastic marketing machine. It is constantly discovering new ways to sell things to people. But the problem is that it has no actual product. A company that goes corporate cult uses some of the tactics of a cult to inflate the value of its product. But a cult has no product except the sense of satisfaction that comes from being in the cult. The only things it sells are images of its leader, emblazoned everywhere, his books, speeches and photos, and these are used as tokens of membership in the cult.

In retrospect, the Cult of Obama had much in common with other cults. Like them it recruited young volunteers on campus. Its recruitment materials leaned heavily on books by its beloved leader. It promised them that a new age was coming and that they could be a big part of bringing it about. And its vector of introduction to older viewers was through a woman who has been accused of promoting cults on her popular television show.

Strip away the politics, forget the push and pull of the election issues, wipe the polar identities of the parties from your minds and take a fresh look at the 2008 campaign. Then compare the pitch to any of the major cults in the seventies and eighties. There really isn't all that much of a difference. They're all "Transformative" movements that promise to solve society's problems by using new insights to create a wave of change that begins with "us".

Last Wednesday, I attended Chairman Peter King's fifth hearing addressing Islamic radicalization in the United States. This particular discussion was entitled: "The American Muslim Response to Hearings on Radicalization within their Community." The hearing room was filled to capacity. The witnesses were all Muslims or Muslim-Americans and the hearing was designed to take their pulse on the effectiveness of the Committee's approach to addressing the problem of Islamic radicalization throughout American communities.

To accompany the hearing, Chairman King released a report entitled, "The Radicalization of Muslim-Americans: The Committee on Homeland Security's Investigation of the Continuing Threat." Click HERE to read the report in its entirety.

In 2010, prior to the start of the 112
th Congress, Congressman King promised that if he were to serve as Chairman of the House Homeland Security Committee, he would place a top priority on understanding and addressing the threat of Muslim radicalization within our nation. The Chairman has proven true to his word - but it hasn't been an easy road for him.

As Congressman King noted in his opening remarks, from the moment he announced the hearings, he was "attacked by politically correct special interests and their unthinking allies in the media..." He noted that more than 1000 protestors came out in the rain to rally against him in Times Square, just days before the first hearing. Even so, Chairman King stayed the course. Why? Because as he put it, "the necessity of these hearings was obvious - and there should have been bipartisan support." See Chairman King's full opening statement HERE.

Unfortunately, after almost two years of his Chairmanship, that bipartisan support has yet to materialize. This is disappointing to say the least. As Brigitte Gabriel likes to say, "the threat of radical Islam to our national security is not a Republican issue or a Democratic issue, it's an American issue."

The witnesses for this particular hearing were all of the Muslim faith:

  • Dr. Zuhdi Jasser, MD, President and Founder of the American Islamic Forum for Democracy, who spoke about the importance of the separation of Mosque and State and noted that "ten years after 9/11 our heroes at the Department of Homeland Security remain occupied predominantly with a highly sophisticated whack-a-mole program..."   • Ms. Asra Nomani speaking as a "Private Citizen," though she was a former reporter for the Wall Street Journal and a journalist who reported on extremism for the last decade for publications such as the Daily Beast, the Washington Post, the New York Times, Time magazine and Washingtonian magazine. She titled her statement, "Toward an Islam of Grace: Owning Up Instead of Being Wound Collectors." Ms. Nomani told the Committee that "inside much of our Muslim communities, we have departed from our very clear sense of holding ourselves accountable...we are very much a culture of denial, fixated on perceived wounds."   • Dr. Qanta A. A. Ahmed, a British citizen and Permanent Resident in the United States, currently working with the World Trade Center First Responder patient population in New York. Dr. Ahmed's fellowship at the University of Cambridge in England was on the "psychological manipulation of Islam into the service of terror." She spoke of how her family not only has supported Chairman King's hearings on radicalization, but has welcomed them, even though they "remain aware of the risks" that her participation as a witness "can pose to me in my everyday life."   • Ms. Faiza Patel, Co-Director of the Liberty and National Security Program at the Brennan Center for Justice. Ms. Patel expressed her opposition to the Chairman's hearing topic as she felt they did not "rest on a firm factual basis." She elaborated that the hearings "proceed from a premise - which is contrary to empirical evidence - that 'radicalization' is prevalent among American Muslims and poses an existential threat to our country. Moreover, they adopt a view of 'radicalization' that treats religious belief as a precursor to terrorism." See HERE for Ms. Patel's full statement.

Yesterday's hearing presented yet another wonderful opportunity to understand and address the threat of radical Islam within our nation - this time spoken by those of the Muslim faith. Unfortunately, some members of the Committee used this as an opportunity to sidetrack the discussion, frequently in a way that was rude and disrespectful to the witnesses.

For example, the Committee's Ranking Member Bennie Thompson (D-MS), asked witness Dr. Qanta Ahmed if she was a U.S. citizen. When she replied that she was not, he insinuated that because she didn't have "any kind of security clearance or anything" she wasn't qualified to speak on the issue. Congressman Dan Lungren (R-CA) responded that he was "kind of bewildered, frankly, by some of the questions and comments by my colleagues - that somehow your testimony isn't valid because you don't have a security clearance." He continued, "The longer I'm here, I guess, the less I'm surprised by what I hear at times." I think he spoke for many Americans that were watching the hearing from back home.

Congresswoman Laura Richardson (D-CA) belittled some of the panel's Muslim witnesses by saying, "This Committee - we're not a talk show, this isn't Oprah, this isn't entertainment, this isn't radio. This is the United States Congress. I would just ask that in the future, if we are going to have a U.S. Congressional hearing...I believe that at least some of the panelists should be people who have the authority, who receive the regular information to give us the most accurate and helpful information as possible." I found it amazing that after almost 6 years serving her constituents in California's 37
th congressional district, Congresswoman Richardson apparently believes hearing from a regular U.S. citizen was beneath her and her colleagues.

As a final detailed example, Rep. Yvette Clarke (D-NY) reminded those in the committee room of the Japanese internment camps, warning the Muslim witnesses who supported examining the Muslim religion when attempting to understand the Islamist threat, "be careful what you wish for. Our nation has a history that we don't like to connect often times, but be careful what you wish for in America."

I was impressed with Dr. Ahmed's response to Congresswoman Clarke: "Having these hearings is not going to lead to the internment of Muslim-Americans. It is exactly the lack of that kind of nuance which I draw to your attention respectfully, madam, that can damage the outcome of what is something that can be so positive. It's the lack of nuance in our academic community, our politics and our media that's missing."

If you missed today's hearing (and especially if one of your Representatives sits on the Committee), I encourage you to watch it in its entirety so you can be informed about how your legislators are addressing the issue of Islamic radicalization.

We are approaching the final months of the 112
th Congress, and a very important election cycle is upon us. I don't know if Chairman King plans to hold any more hearings on Islamic radicalization during this term. What I do know, however, is that we should be tremendously thankful to him for his efforts to increase the visibility, and maintain the discussion, of the Islamist threat in America -- and for his unrelenting work to protect our nation by finding a solution to that threat. That is one reason he will be awarded the 2012 National Security Eagle Award (our top honor) at our National Conference in Washington, DC next week.

As the Chairman stated during yesterday's discussion, "to somehow deny that there is any correlation between certain people of the Muslim faith and the greatest terrorist threat facing this country today just defies credulity...it just does not add up at all."

2012-06-25-brief "Last Thursday was a bust, at least as far as the two most anticipated cases before the Supreme Court this term. [We got] a ruling on one of them this morning, the challenge to Arizona's SB1070 immigration-enforcement law. However, we [won't] see anything on ObamaCare until the last day of the session, on Thursday of this week. ... This may just extend the pain for Barack Obama ... as the problem for the White House is the bill's unpopularity regardless of whether the court overturns it in whole or in part this week. ... Looks like the key part of Arizona's SB1070 got upheld -- the part that required state and local law enforcement to check immigration status on detained individuals. Scalia wanted to uphold the entire law, but a couple of provisions did get struck down. Kennedy wrote the majority opinion. ... Basically, the Supreme Court decision on SB1070 will allow the stop-and-check provision to take effect, but leave open the possibility that a case showing actual harm could be used to challenge the law at a later date." --blogger Ed Morrissey

Obama's Gay Friends Trash White House

Last week, Obama ordered military service branches to celebrate "Gay Pride" month. What we now know is that the same day he issued that order, Obama hosted the first ever "gay activist" reception at the White House.

Obama welcomed his guests promising to make good on their agenda: "We'll get there because of every man and woman and activist and ally who is moving us forward by the force of their moral arguments, but more importantly, by the force of their example."

"According to the report by the National Renewable Energy Laboratory, which is part of the U.S. Department of Energy, Section 1503 of the American Recovery and Reinvestment Act (aka the stimulus), the part that covers green energy projects got some $9 billion in stimulus cash for 2009-11 and created a whopping 910 direct jobs -- those involved in the ongoing operation of the wind and solar projects that were funded. Now, the report doesn't come right out and say this. You have to pick through it and look past the 'indirect' jobs said to have been created by the manufacture and installation of the bird-chopping wind turbines and water-cleansed solar panels. The administration has a most curious way of describing what a green job is, but if you count just the 'direct' jobs, it cost taxpayers $9.8 million to create each of those long-term jobs. Throw in the indirect jobs supporting the direct jobs estimate of 4,600 (we're confused too) and there are 5,510 total jobs (direct and indirect). Starting with the $9 billion in grants, the result to establish 5,510 jobs averages out to $1.63 million per job. ... While campaigning four years ago, Sen. Barack Obama promised that $150 billion in government spending on renewable energy projects would create 5 million green-collar jobs over 10 years. Near the end of this administration's first year in office, Vice President Joe Biden promised 722,000 green jobs would be generated by the stimulus. To this end, avowed Marxist and wealth redistribution advocate Van Jones was appointed as green jobs czar. The wealth redistribution part has gone very well. But where, gentlemen, are the jobs?" --Investor's Business Daily

"Saving the bankers requires kicking national sovereignty to the curb. And not just in Europe, where they at least they have the guts to bring it up. Right here in the United States as well, where the Fed can -- make that has -- operated with the kind of impunity that makes Congress, and in turn the Constitution, irrelevant. Thus it's no surprise that Ben Bernanke has extended Operation Twist, buying $267 billion of long-term government bonds in another effort to bring down borrowing costs. Just like Spain and Italy are trying to do. The Obama administration undoubtedly loves Operation Twist because, just like everything else the Fed does, it's designed to artificially prop up the stock market, which artificially props up Mr. Obama's re-election chances. What doesn't prop up Mr. Obama's re-election chances? Moody's downgrading 15 banks, the housing market hitting a 15-year low, US factory output growing at its slowest pace in 11 months, EU business activity shrinking for a fifth straight month, and Chinese manufacturing contracting for the eighth month in a row. And let's not forget unemployment that is 'officially' expected to remain above 8 percent right through November, even as most Americans know it's much higher than that, 'unofficially.' ... Perhaps the president can issue another executive order -- banning the release of economic data until after the election." --columnist Arnold Ahlert

"Imagine: A Republican president submits to Congress a bill abolishing the capital gains tax. Congress rejects it. The president then orders the IRS to stop collecting capital gains taxes, and declares that anyone refusing to pay them will suffer no fine, no penalty, no sanction whatsoever. (Analogy first suggested by law professor John Yoo.) It would be a scandal, a constitutional crisis, a cause for impeachment. Why? Because unlike, for example, war powers, this is not an area of perpetual executive-legislative territorial contention. Nor is cap-gains, like the judicial status of unlawful enemy combatants, an area where the law is silent or ambiguous. Capital gains is straightforward tax law. Just as Obama's bombshell amnesty-by-fiat is a subversion of straightforward immigration law. It is shameful that Congressional Democrats should be applauding such a brazen end-run. In the same issue of Social Science Research, University of Texas sociologist Mark Regnerus publishes the results of a large national study, based on interviews with a random sample of 15,000 young adults (aged 18 to 39) about their families, upbringing, and life experiences. Regnerus's bottom line: Children raised by their biological mother and father in stable families tended to turn out better than those whose parents had been in same-sex relationships. ... Children raised by one or more gay parents, Regnerus wrote in an essay on Slate, 'were more apt to report being unemployed, less healthy, more depressed.' "So a feminist writes in the New York Times how we have to think more before we breed and lamenting how too many people end up with kids because they don't have enough abortions and stuff. But then I look to places where birth control has really taken root in Europe and Japan and they're below replacement rates on births and their countries are starting to die because of it. The whole point of being parents is putting someone else ahead of your own needs, but birth control is all about looking at your needs first before having kids. It seems like a great idea to wait until you're ready to have children, but there is no such things as a magical point when people are ready. And thus families are waiting longer to have children and having less -- or just looking at them as this avoidable inconvenience to one's lifestyle -- and that's how a society dies out. Editor's Reply: Of course that photo was objectionable -- as is the policy, so we drove the point home with words and imagery. Amazingly, there are some folks who consider themselves conservative and Christian, but are unable to distinguish between right and wrong on the "gay" issue. That photograph is the net result of Obama's mandate and sometimes a picture is worth a thousand words. Our Patriot Post team is comprised of warriors, not pantywaists. There is a culture war well underway, and to defeat the enemy, you must know it. If you can't face your enemy and the ugliness it represents, then run and hide, because he will cut your head off.

Back in April, the Shark Tank floated the likelihood that Democratic National Committee Chairwoman (DNC) Debbie Wasserman Schultz was perhaps on her way out as DNC Chairwoman. We now have learned that Wasserman Schultz will not be back as DNC Chairwoman after the November elections.

 

According to our source within the Democratic Party, who is also a close associate of Wasserman Schultz, the arrangements have already been made for her to leave DNC regardless if President Obama wins re-election or not.

 

This same source believes that Wasserman Schultz will be forced to resign behind closed doors and then stage an press event in which she tells Americans that her job as the DNC chair was a temporary one and that she is moving on with her congressional career.

 

The National Journal has also picked up on the fact that she is indeed getting the boot from Obama-

Debbie Wasserman Schultz of Florida was tapped last year to lead the Democratic National Committee, it seemed like the latest ascension for a fast-rising star destined for even higher positions. When one guy said words to the effect that we're stuck with what we bought because "how could we justify being the most militarily powerful nation on earth if we don't even bother to make sure the man in charge is legitimate," another guy came back with keyboard keys blaring. Of course Barack Obama won't lose California but as in other states, California's minorities are not yet motivated to vote. Getting them to the polls will use up Democrats' time energy and money penciled in for other purposes.

"They'll use Voter fraud," you say. Well maybe not. Even Democrats have to know how to do vote fraud to commit voter fraud.  

Is something going on in California?

Last Friday after a long drawn out counting process, a California ballot measure to add a one dollar tax to tobacco products "to aid cancer research" failed by a margin of 50.3 to 49.7 - about 27,000 votes out of about 5 million cast. Protecting Religious Liberty from Obamacare

The Supreme Court will hand down its verdict on Obamacare this week, making it a timely occasion for Americans to show their support for religious freedom-only one of many freedoms steamrolled by the health care law.

This spring, Department of Health and Human Services (HHS) Secretary Kathleen Sebelius acknowledged she did not even enlist the legal advice of the Department of Justice on whether it is constitutional to force religious employers to provide coverage of abortion-inducing drugs, contraception, and sterilization against their moral or religious beliefs. She admitted in congressional testimony that she neglected to obtain an adequate legal analysis of the HHS anti-conscience mandate before promulgating the Obamacare rule that tramples on religious liberty.

That disrespect for constitutionally guaranteed religious freedom has led Americans to participate in the Fortnight for Freedom, a nationwide demonstration. Launched June 21, the Fortnight for Freedom runs through July 4-a two-week opportunity for citizens to celebrate our rich heritage of religious liberty and call for greater defense of this precious right.

Often called the "first freedom," religious liberty is the cornerstone of American freedoms. The ability to freely worship and act in accordance with a particular faith without fear of government reprisal is essential to civil society.

As Heritage's Jennifer Marshall has explained:

Far from privatizing religion, the American model of religious liberty assumes that religious believers and institutions will take active roles in society...In fact, the American Founders considered religious engagement in shaping the public morality essential to ordered liberty and the success of their experiment in self government.


That right includes the ability to practice one's faith even outside the four walls of a church. The Constitution does not merely protect the freedom to worship in private and on certain days of the week. It is a guarantee that individuals can allow their faith to inform and motivate their lives and work.

That is why Secretary Sebelius's disregard for the Constitution's religious freedom protections is so particularly egregious.

Obamacare's anti-conscience mandate has a narrow religious exemption that applies only to formal houses of worship. Countless other religious employers, like Catholic schools, hospitals, and crisis pregnancy centers are forced to provide coverage for the mandated services despite moral or religious objections-simply because they step outside the four walls of a church to serve others.

Insinuating that faith should remain behind closed doors, not influencing or inspiring care for others, the government's narrow view of religion has created what some have called a "religious caste system." Only those considered "religious enough" by government bureaucrats are awarded religious freedom under the mandate.

The HHS mandate's narrow view of religion is only one of many examples of the increasing erosion of religious liberty. For example:

 

  • State laws instituting civil unions or redefining marriage have forced faith-based adoption and foster care services in Illinois, Massachusetts, and the District of Columbia to close their doors rather than violate their beliefs about placing children in homes with a married mother and father.

 

  • Last fall, HHS bureaucrats refused to renew a grant for the U.S. Conference of Catholic Bishops to partner with law enforcement to help victims of human trafficking, simply because the group would not violate its beliefs by referring for abortions.

 


Religious liberty conflicts are often early warning signs for threats to general freedoms. The anti-conscience mandate, for instance, is only the first of many rules that will run afoul of freedom as Obamacare is fully implemented. Rescinding the mandate would protect religious freedom in this instance specifically, but only repealing Obamacare can adequately protect religious and other liberties more generally and make way for health care reform that meets patients' needs, consistent with their convictions. If the Supreme Court does not strike down the entire health care law this week, Congress should move to repeal what remains.

Protecting Americans' right to live out their faith in the public square and for organizations to hire and serve others in accordance with their deeply held beliefs is essential to sustaining robust religious freedom. That kind of respect requires leaders who recognize constitutional limits on government power.

Despite the Obama Administration's recent neglect of those limits, the freedoms enshrined in our founding document will be hard to ignore on July 4. As the Fortnight for Freedom concludes, church bells across the country will ring simultaneously at noon (Eastern time), declaring loudly: Let Religious Freedom Ring.

Monday Mania

All eyes were on the Supreme Court this morning as the nation awaited rulings on major cases related to immigration, criminal justice, campaign finance reform and health care. But true to form, the justices are holding their blockbuster case -- ObamaCare -- until the very end. We'll find out Thursday morning whether Obama's signature initiative passes constitutional muster.

Today, however, the court largely gutted Arizona's anti-illegal immigration law, which was passed out of frustration with the federal government's failure to control the border and enforce our immigration laws. A July 2010 Rasmussen poll found that 61% of likely voters would support a similar law in their own state. But the court's majority reaffirmed the long-standing view that immigration enforcement is a federal responsibility with virtually no role for the states.

Arizona law enforcement officials will still be permitted to inquire about the immigration status of individuals who have already been stopped. Advocates of the law are suggesting that just the ability of local police to check the immigration status of a detained individual is of some deterrent value.

In his dissenting opinion, Justice Scalia, who would have upheld the entire Arizona law, observed, "Today's opinion... deprives states of what most would consider the defining characteristic of sovereignty: the power to exclude from the sovereign's territory people who have no right to be there."

In another disappointing decision, the court's liberal majority continued down the path it has been on for several years of restricting the right of states to establish their own laws and punishments. The court ruled 5-to-4 that mandatory life sentences for juveniles convicted of murder violated the Eighth Amendment prohibition against "cruel and unusual punishment."

Several years ago, the Supreme Court banned the death penalty for juvenile murderers. Now it has essentially taken life sentences off the books too!

In both cases Justice Anthony Kennedy was part of the liberal majority. And it is possible that Kennedy will disappoint conservatives yet again Thursday morning.

But no matter what happens in the ObamaCare decision, here's the bottom line: This fight doesn't end Thursday morning. Win or lose, the left isn't about to give up and we can't either! Whatever the court does simply raises the stakes in November.

Make Corruption An Issue

The House of Representatives will vote this week on a resolution citing Attorney General Eric Holder with contempt of Congress. As House Republicans prepare to hold the Obama Administration accountable for Operation Fast and Furious, I'm hearing more and more "nervous Nellies" on the right fretting about getting off-message.

Some consultants fear the Obama campaign will use this investigation to portray Republicans as vindictive and mean-spirited. They will do that anyway!

For example, Nancy Pelosi played the race card last week, saying that the contempt vote against Holder was about voter suppression, not Fast and Furious. Republicans should hit back: Make government reform and corruption a major campaign theme.

Yes the voters care about the economy. But they also care about the GSA scandal. They care about politically connected donors getting stimulus funds to prop up failing green energy companies. They care about congressional votes being bought with schemes like the "Cornhusker kickback."

While Democrats are raking JP Morgan over the coals for losing its own money, Romney should remind the voters about Democrat Jon Corzine bankrupting MF Global. (Corzine, by the way, is still listed on the Obama campaign's website as a top $500,000+ bundler.)

Romney should remind the voters about how the Obama Administration routinely ignores Congress, refuses to enforce the law (including the Defense of Marriage Act), and can't seem to keep our national security secrets secret.

There is nothing wrong with pointing out that the "most transparent administration in history" is refusing to comply with congressional subpoenas and covering up the details of a botched operation that led to the death of a Border Patrol Agent. The family of Agent Brian Terry certainly cares about that, and millions of Americans do too.


We're On The Wrong Track

According to a recent Associated Press poll, 60% of Americans believe our country is on the wrong track. Of course the state of Obama's economy is a big part of that negative sentiment. But I also think that figure reflects a deep concern about America's growing virtue deficit too.

Who could not watch the disturbing video of Karen Klein, a 68-year-old bus monitor, being so viciously taunted by seventh and eighth-grade boys and not be worried about the breakdown of the family?

Who can read the almost daily headlines of teachers molesting students and not be worried about the lack of respect for traditional values?

Who can read about Dr. Kermit Gosnell's house of horror and not see the slippery slope of abortion-on-demand?

And is it any wonder that so many Americans think we're on the wrong track when our political and cultural elites no longer know what the meaning of marriage is?

Yes, America is on the wrong track, but not all that ails our nation is economic in nature. Values matter too.


Refuting The "Gospel Of Marx"

Dealing with liberal politicians and the media is frustrating enough. But it really infuriates me when they try to use the Gospel to justify their radical, left-wing ideas. Remember when Obama tried to claim that his faith in Jesus Christ led him to embrace same-sex "marriage"?

The Religious Left also claims that the scriptures require us to support higher taxes to fund massive social justice programs. But the biblical call to help the poor is a personal command, not a call for Big Government.
