Some Never Learn: MSNBC Caught Selectively Editing Romney Video to Make Him Seem 'Out of Touch'
UPDATE: Mitchell responded to the controversy on Tuesday. Watch how she addressed it, but didn't apologize, here.

After NBC was caught selectively editing the George Zimmerman police tapes to make it seem like he was volunteering racial information, MSNBC has been caught editing a clip of Mitt Romney to make him seem wildly "out of touch," when he was really just explaining the difference between the private and public sectors.
In the MSNBC clip, Romney is shown discussing Wawa's convenience stores like he has never been to one before (presumably because he is "too good" for such an establishment).
Introduced by Andrea Mitchell saying: "I get the feeling-take a look at this- that Mitt Romney has not been to too many Wawa's along the roadside in Pennsylvania," Romney says: "I was at Wawa's, I wanted to order a sandwich. You press the little touch tone keypad, alright, you just touch that, and you know, the sandwich comes at you, touch this, touch this, touch this, go pay the cashier, there's your sandwich. It's amazing."
Momentarily speechless, Mitchell repeats, "It's amazing," as her guest breaks into sharp laughter.
Too bad the clip was taken wildly out of context.

Last-minute deal fizzles; Holder contempt vote still on tap

Attorney General Eric H. Holder Jr. faces a contempt of Congress hearing Wednesday after refusing a last-minute compromise offer to turn over subpoenaed documents to a House committee investigating the botched Fast and Furious gunrunning operation.
Deadlocked since October over the delivery of hundreds of pages of Justice Department documents concerning the Bureau of Alcohol, Tobacco, Firearms and Explosives investigation that saw more than 2,000 weapons "walked" to drug smugglers in Mexico, Mr. Holder showed up empty-handed during a 20-minute, face-to-face meeting Tuesday afternoon on Capitol Hill with House Oversight and Government Reform Committee Chairman Darrell E. Issa.

Anti-Obama sentiment fueling Romney on campaign trail

DAVENPORT, Iowa - Mitt Romney's six-state bus swing through small cities and towns in New England, the Rust Belt and the industrial Midwest served as a clear reminder that his biggest ally in the presidential race is also his biggest foe: President Obama.
Even among the crowds that turned out to hear the presumptive GOP nominee, it was evident that this election remains very much a referendum on Mr. Obama's first term in office.
Joseph Calasante, for instance, fought back tears when asked why he backed Mr. Romney, just minutes after the former Massachusetts governor's first stop at a picturesque farm in New Hampshire.
The biggest reason? Mr. Obama.

Israeli intel: Egypt's Islamist party ordered today's deadly attack. 1 civilian killed in partially thwarted 'large-scale terror attempt.' Israeli intelligence has information that elements of the Al-Nour Party, an Islamic extremist group that controls the second largest bloc in Egypt's parliament, called for today's deadly terrorist attack that killed an Israeli civilian in the country's south, KleinOnline has learned.
An Israeli security source said there is further information about planned attacks, including against tourist sites in the Sinai as well as within Israel, if the Egyptian military follows through with a threat to dissolve the parliament.

OBAMA TIED TO ARCHITECT OF U.S. COLLAPSE: New Party leader planned to bring about 'crisis' of overloaded welfare state. Tom Smith's background is a common one in Pennsylvania and across the country, but one that is all too rare in the United States Senate-which may explain a great deal about how our country came to this point in our history.
Tom still lives on the farm in Armstrong County where he grew up. After graduating from Elderton High School in 1965, he postponed college to help his father tend that farm and supplemented his income by driving a school bus. Before too long, Tom had married his high school sweetheart, Saundy, started a family, and went to work in a local surface coal mine.
In 1989, Tom entered the coal business himself, mortgaging everything he had in the hope that he could build a better life for himself and his family. He succeeded, building a series of companies in a highly regulated industry through some tough economic times. When he sold the companies in 2010, they were mining more than a million tons of coal a year and employed over one-hundred people.

While plans for school vouchers remain mired in the General Assembly, some lawmakers are supporting a new idea to help kids in failing schools. Rep. Jim Christiana, R-Beaver, is introducing a bill that would create a $100 million tax credit program aimed at children in poor-performing schools. The bill to create the new Educational Improvement Scholarship Credit will be introduced today in the House of Representatives. The program would try to build on the state's $75 million Educational Improvement Tax Credit program. That program grants tax credit to companies that donate to preschool and K-12 scholarships to students or to innovative public education programs. Tax credits for this program typically are spoken for in a matter of days after they become available. The new tax credit program would be limited to companies donating to organizations that provide scholarships to students in the state's worst-performing schools. In Christiana's plan as well as the existing EITC program, businesses donating to scholarship organizations could cut their state taxes by up to 90 cents on every dollar donated to education. The goal of Christiana's plan is to generate enough money to provide an escape for 30,000 low- and middle-income students in failing public schools. His plan would provide scholarships of up to $8,500 for a regular education student and up to $15,000 for a special-needs student. "I think it is a very attractive program to those that want to help these kids get out of the violent underperforming schools," Christiana said. Support for a new education tax credit is evolving among House Republican leaders. "I think it's definitely something we should do," said House Majority Whip Stan Saylor, R-York.

"Losing our Sons": Documentary looks at domestic Islamic radicalization and jihadization
Charles Jacobs at Americans for Peace and Tolerance announced today the release of a trailer for their upcoming documentary, "Losing Our Sons", featuring Melvin Bledsoe - father of domestic terrorist Carlos Bledsoe aka Abdulhakim Mohamed who gunned down US Army recruiter Pvt. William Long at an Army-Navy recruiting center in Little Rock, Arkansas in June 2009. Melvin Bledsoe testified at the House Homeland Security Committee hearing earlier this month.
The upcoming documentary discusses how Bledsoe was radicalized by the Muslim Student Association in Tennessee and sent to terrorist training in Yemen with the written recommendation of the imam of a Nashville mosque. It also discusses how the agents of radicalization in the Nashville Muslim community have been aided by collaborators in the establishment media, politics and the so-called "interfaith" community.

Tomorrow, the United States Senate will vote on a resolution that could determine the future of energy in America. President Obama's EPA is on the attack with a series of regulations that will significantly increase the costs of energy, which means higher prices for consumers, businesses, and producers, especially in Midwestern states where coal is used to generate electricity.
The EPA's most recent regulation, known as the "Utility MACT" rule, is the most expensive rule ever issued by the agency. Not only will this rule generate higher prices, it also threatens jobs and the reliability of the electricicty grid itself.
By the EPA's own estimates, the rule's attempt to regulate toxic air pollutants will cost $10 billion per year while only generating at most $6 million in benefits-that means the ratio of costs to benefits is 1,600 to 1!
Moreover, because of the EPA's aggressive regulations, 1.65 million jobs may be lost by 2020.
Please help put an end to job-crushing regulations and an unaccountable EPA. Republican Senator Jim Inhofe from Oklahoma has introduced Senate Joint Resolution 37, a resolution of disapproval, which would put the brakes on the EPA's costly new rule. Using the Congressional Review Act, only a simple majority is needed in the Senate to pass the resolution.

School Choice in D.C. Saved...For Now
President Obama has begun "evolving" his positions on various policy issues as polls show him neck and neck with Mitt Romney. His latest about-face restores a popular school voucher program for needy children in Washington, D.C.-after he had yanked its funding. Thanks to the tireless efforts of Speaker John Boehner (R-OH) and Senator Joe Lieberman (I-CT), the Obama Administration has agreed to restore funding for the D.C. Opportunity Scholarship for another year. The D.C. Opportunity Scholarship Program (OSP), which allows children from low-income homes to escape the underperforming D.C. public schools and attend a private school of their choice, has given scholarships to nearly 5,000 children since 2004. Although legislation passed by Congress and signed by the President last year authorized the program to continue for five years, the President's budget request for fiscal year 2013 went back on his word and eliminated the program's funding, giving what was authorized for the scholarships to the public schools instead. In seeking to end the program, the President sided with the teachers union, which consistently opposes policies like school choice that improve student outcomes. Yesterday, Boehner and Lieberman announced they had reached an agreement with the Administration to restore the program for at least the next school year. "Thousands of families have taken advantage of this scholarship program to give their children an opportunity to succeed in life, and there's strong evidence that it's both effective and cost-effective," Boehner said. The D.C. OSP has been highly successful. According to federally mandated evaluations of the program, student achievement has increased, and graduation rates of voucher students have increased significantly. Graduation rates in D.C. public schools languish (hovering around 55 percent), and the public school system ranks last in the country in terms of academic achievement. Yet, students who used a voucher to attend private school had a 91 percent graduation rate. In addition, 89 percent of OSP graduates have gone on to enroll at a 2- or 4-year college or university. And its cost effectiveness is clear. At $8,000, the vouchers are a bargain compared to the more than $18,000 spent per child by D.C. public schools. Even more importantly, the OSP gives freedom of choice to parents and hope to children in low-income families. Parents are able to choose a better education for their children, with the aim of lifting them out of poverty. They want schools that are safe, cultivate a positive attitude about learning, and best fit their children's abilities and interests. Only school choice can satisfy these diverse preferences and expectations, and parents in the OSP have expressed high levels of satisfaction. For three years, President Obama fought against this and other school choice programs, and he and Education Secretary Arne Duncan may take up that fight again. But for now, as electoral pressure grew and the popularity of this program expanded, he had little choice but to keep his end of last year's agreement. The program's restoration was welcome news to Virginia Walden Ford, who fought for school choice in Washington, D.C., for more than 10 years. She now lives in Arkansas and advocates for school choice there. "I am excited and relieved that the Obama Administration has worked with D.C. OSP champions Senator Lieberman and Speaker Boehner to make sure the program is fully implemented," she said. "This means so much to the families who have been so concerned about the future of their children's educational journey. It is truly incredible news for all the supporters who have fought over the years to make sure all the District's children have access to a quality education." Last week I had the opportunity to get a sneak-peek at the RNC's new Facebook application. Designed, in the words of one RNC staffer to "take our message where the people are," the Social Victory Center app will, among other things, hook users up with campaign news targeted based on their location and preferences (which Facebook already knows, of course), let users join volunteer efforts, distribute voter registration forms, and provide an online phone bank, all without leaving the Facebook website. It will also, if users wish, put those activities on the user's Facebook wall, letting their friends see what they're up to and, hopefully, encouraging them to join in.

It's an attempt to leverage Facebook's popularity in a new way and, at the moment, the Democrats have nothing like it. The Social Victory Center was unveiled to the public yesterday, so if you're on Facebook, check it out. As the general election ramps up, check back for volunteer activities as they're added. Also, like I did in 2008, I'll be pushing online phone banking in the final weeks of the election, only this time the RNC will have done the heavy-lifting that the McCain team wasn't too keen on. 1. From Senator Pat Toomey: America vs. the Sugar Lobby
It's not often conservatives and liberals, Democrats and Republicans, pro-growth conservative groups and the Teamsters agree on something. In fact, it's almost unheard of.
But when it comes to the federal government's sugar program - one of the most egregious corporate welfare handouts in a long list of wasteful programs - these strange bedfellows have found common ground.
For years, the federal government has kept the price of sugar high by capping domestic production, imposing a de facto government price floor, and mandating that USDA buy excess sugar to sell to ethanol producers at a loss. The U.S. government also places exorbitant restrictions on sugar imports. The cumulative effect of all these special protections is an artificial increase in the price of sugar for Americans relative to other countries.
As a result, American consumers pay more for products containing sugar, and U.S. manufacturers of sugar consuming products are at a competitive disadvantage. Not surprisingly, many of these manufacturers have closed their doors or moved their factories to Canada and Mexico where sugar costs less than half the price. The Department of Commerce agrees, finding that for every one job protected by the sugar program, three others are lost in sugar using manufacturing industries.
2. It's On: Holder tries to play Issa on Fast and Furious, will be subject of contempt vote tomorrow
Republican members of the House Oversight and Senate Judiciary Committees have been turning up the heat on Attorney General Eric Holder over his obstructive and misleading testimony about Fast and Furious, the operation in which the ATF coerced American gun dealers into selling firearms to Mexican cartels, and then allowed them to "walk" across our southern border (all without a whisper to the Mexican government).
After being threatened with a contempt of Congress vote (scheduled for Wednesday, June 20), Holder made a last-ditch attempt to avert what he has repeatedly referred to as a "constitutional crisis," requesting a meeting with Oversight Committee Chairman Darrell Issa (R-CA) to "discuss [the Department of] Justice's knowledge of the controversial 'gun walking' tactics used in Fast and Furious, including information about whistleblowers." Issa agreed to the meeting, but informed Holder that nothing less than full disclosure - including the handover of all documents related to the program, its cover-up, and the action taken against ATF whistleblowers - would be acceptable.
3. From Rep. Michele Bachmann: The Case for Medicaid Audits to Prevent Fraud
Minnesotans are proud people. We're proud to boast of our 11,842 lakes and the fact that we can survive subzero temperatures for months straight. But one thing Minnesotans can't be proud of is our state's questionable handling of Medicaid dollars.
The House Oversight Committee recently reported, "Minnesota provides a stunning example of how states are failing to properly ensure the appropriate use of taxpayer dollars spent on Medicaid managed care."
So how did Minnesota end up with this disappointing designation?
4. WaWa and Kerry: A Tale of Two Memes
Yesterday saw two trial balloons floated by the Obama campaign and its surrogates in their ongoing struggle to define Mitt Romney as someone who should not be president. The first was centered around a Romney campaign stop in Pennsylvania over the weekend, the second about an announcement, of sorts, to the media over who has been selected to act as Romney in Obama's debate rehearsals.
Let's examine them both and what they mean in the context of this presidential campaign.
5. California State Bar Recommends Law License for Illegal Immigrant
I am probably a good deal squishier than most conservatives on the immigration issue - I broadly favor a set of immigration reforms that would probably be (inaccurately) called "amnesty" by most people who read this blog. But this story right here really chaps my hide.
6. Jared Polis May Have Violated House Rules Following High Park Fire Visit
Rep. Jared Polis (D-Colo.) may have violated House ethics rules last week when he used his official .gov website to broadcast the details of his visit to the High Park Fire Command Post, which is located outside of the congressional district Polis' currently represents. Both the House ethics and administration committees have issued clear guidance prohibiting the use of official resources for out-of-district events. The recently completed decennial redistricting process added new territory to Polis' district, but he will only represent the new areas if he is re-elected in November.
Ethics committee guidelines, which are based on House rules that forbid the use of taxpayer dollars for what are effectively campaign activities, also prohibit members of Congress from using official resources, including staff time, to solicit donations for external organizations.

The Progressive-Traditionalist War
The main weapon that progressives wield against traditionalists is their ability to break down the values that make up their worldview by challenging norms of behavior and thought, with the goal of using cultural friction to slowly replace traditional values and mores with their own. This is a weapon that progressives have explicitly disavowed using against Islam. In Europe there are some hesitant attempts at promoting integration, but it's a fitful self-doubting effort that consists of the authorities telling everyone who listens that integration is moving along smoothly, while the No-Go Zones grow, black ghosts haunt the alleyways of major cities and the mosques go on crying Jihad from minaret loudspeakers rising above European capitals. There is the occasional burqa ban, a nervous ban placed on the most extreme of the extreme clerics, an occasional investigation of a school that teaches that infidels are animals to be killed, and a cautious warning from some putatively conservative politician to the Muslim community that things have to change. But none of them adds up to anything. The left, which excels at attacking traditional values, has signed a pact with Islam. Not only does it refuse to undermine its religion and traditional values, the way that it undermines those of everyone else, but it actively promotes Islamic values and traditions as morally superior to those of its own society. The reason for this is simple strategy. The progressives of the left in each society are at war with their own traditionalists. American liberals are at war with American conservatives. European liberals are at war with European conservatives. Liberal Christians are at war with Conservative Christians and Progressive Jews are at war with Traditional Jews. This war isn't always as overt as it was in the Soviet Union, or as it is in Cuba or Sweden. It's a quiet war marked by "artistic statements", by the school curriculum and the late-night newscast, by laws that transform public spaces into government spaces and private spaces into public spaces, and put the whole thing under government regulation whose overriding purpose is behavior modification.

These letters seek answers about the U.S. government's involvement with the Muslim Brotherhood, a group that calls for "civilization jihad." In the letter, Bachmann, Franks, Gohmert, Rooney and Westmoreland questioned the Inspectors General about the direct influence within the intelligence community of Muslim Brotherhood operatives. They explained that the U.S. government in federal court has established that the group's mission in the U.S. is "destroying the Western civilization from within." The members went on to request that the respective offices of the Inspectors General conduct a formal investigation or evaluation of the extent to which Muslim Brotherhood-tied individuals or entities are involved. "The national security of our country depends on getting straight answers from the Inspectors General to the questions we posed in these letters," said Bachmann. "The Muslim Brotherhood is not shy about their call for jihad against the United States. We seek answers through these letters because we will not tolerate this group and its affiliates holding positions of power in our government or influencing our nation's leaders." "Evidence indicates that this administration continues to bow before groups associated with the goal of 'destroying Western civilization from within,' and about whom the 5th Circuit Court of Appeals has found that there is plenty of evidence indicating that they support terrorism," said Gohmert. "For departments of this administration to continue meeting with such groups and agreeing to further blind our government agents charged with looking for enemies wanting to destroy us is at best foolhardy. At a minimum, we need an independent inspection regarding the role, the roots and the results of such destructive groups within this administration. Our enemies have been identified; now we need to know what they have done to our ability to protect ourselves." "The Muslim Brotherhood openly calls for violence against the United States, but we're learning that this organization may be infiltrating our ranks, even within our military," said Rooney. "We need our top security agencies to investigate thoroughly the degree to which members of this organization are active in our defense and intelligence communities, and what impact that has on our national security." "We must always stay vigilant when fighting against those who want to destroy our way of life," said Westmoreland. "The Muslim Brotherhood may not have the name recognition of al-Qaeda or the Taliban, but that does not mean they don't have the potential to be just as deadly. I'm hoping these letters will send the message to our country's intelligence, law enforcement and diplomatic agencies that we cannot ignore the Muslim Brotherhood and must look into their operations and membership with the seriousness that is necessary in order to root them out of our government." Founded in 1928, the Muslim Brotherhood's motto reads, "Allah is our objective. The Prophet is our leader. The Qur'an is our law. Jihad is our way. Dying in the way of Allah is our highest hope." Signers of the letter serve on the Permanent Select Committee on Intelligence (Bachmann, Rooney and Westmoreland), the Armed Services Committee (Franks and Rooney) and the Judiciary Committee (Franks and Gohmert). Additionally, Gohmert is the Vice Chair of the Judiciary subcommittee on Crime, Terrorism and Homeland Security. As of this writing world powers are meeting in Moscow with Iran's nuclear negotiators. Most observers have given up on any real agreement or breakthrough coming through negotiation with Iran. While nobody knows the outcome of this or any future talks, reports today say Russia and China, two of the world powers negotiating by the U.S side., are planning the largest ever war games with Iran and Syria. This is a frightening development for Israel and to anyone paying attention to the diplomatic cushion Russia and China have provided the leaders of both Syria and Iran in their ongoing conflicts.
 Iran, Russia, China and Syria are planning to hold the largest war games exercise in the Middle East in less than a month, Iran's Fars media reported Tuesday. Citing "informed sources," the report said that 90,000 soldiers from the four countries are to take part. The massive war games drill will include air defense and missile units as well as ground, air and naval forces. It is scheduled for early July. A total of 400 planes and 1,000 tanks are said to be taking part, among them "12 Chinese warships... Russian atomic submarines and warships, aircraft carriers and mine-clearing destroyers as well as Iranian battleships and submarines." All of the above are to arrive shortly in Syria, according to the report."

According to ShamLife, China had gained Egyptian approval to allow 12 Chinese ships carrying military equipment to pass through the Suez Canal, and that these vessels would reach the Syrian ports of Tartous and Latakia in two weeks' time. ShamLife said Syrian air defense missiles and its coastal defense would be put to the test in the military exercises, and that 90,000 troops from the four countries would be involved in the war games along with 400 aircraft and 1,000 tanks and "hundreds of rockets." The exercises would be carried out after Syrian troops had "cleansed" several cities where "armed groups" - meaning Syrian opposition forces fighting against government troops loyal to President Bashar Assad - were gathering. Fars also noted that in addition to the Chinese ships, Russian nuclear submarines and warships would also sail to Syria.

Iran is deceiving the West by sitting down at the negotiating table while planning large scale war games with the same nations that are sitting across the table. Meanwhile, Israel is slammed with a barrage of rockets and missiles and is dealing with threats from all sides: Egyptian instability and Gaza terrorists in its south, a potential Syrian civil war and Hezbollah terrorists in Lebanon to its north and the potential of a nuclear Iran threatening its very existence. You would think that President Obama and the U.S. would show now more than ever a commitment to Israel's security. But quite the contrary, Obama gave in to Israel's enemies at NATO (Turkey) and denied Israel a chance to participate in last month's NATO summit in Chicago, while allowing many other non-NATO members entry.
Also in January, the U.S. cancelled planned war games with Israel so as not to inflame tensions with Iran. So here you have the U.S. not allowing Israel access to an important security summit after cancelling drills, out of sensitivity to our enemy, that would have prepared both the U.S. and Israel from potential terrorist attacks.
We Stand With Israel is focused on supporting Israel against terrorist threats and stopping a nuclear armed Iran. But with American leaders not ready to take the necessary steps to stop Iran, we must show our support for Israel and demonstrate a united voice to American leaders over this issue. MSNBC continued its tradition of leaning so far forward that its corporate head became lodged in its corporate backside today with a story on Mitt Romney and Wawas. Andrea Mitchell attempted to use a deceptively edited clip to persuade her audience that Romney is out of step with the average voter.
Sooper Mexican compared the edited clip with the full Romney remarks. They clearly show Romney was amazed at the ways in which private sector competition motivates businesses, a fundamental that the government lacks. Mitchell deliberately omitted this point to falsely portray Romney as a fool.

After 16 months, it seems that the House leadership finally has Attorney General Eric Holder's attention. Unfortunately, it took the threat of a contempt citation to get it. We likely won't know the full details until this evening, but it seems Holder may have blinked first in the standoff over Operation Fast and Furious. With the House Government Reform Committee set to vote on a contempt citation this week, Holder sent a letter yesterday to the committee's chairman, Rep. Darrell Issa, asking for a meeting this morning. Issa counteroffered -- demanding 1,300 documents be turned over this morning and he said no meeting would take place until 5:00 PM so that his staff could review the newly released material. Meanwhile, Holder has another headache to contend with. Yesterday, the National Border Patrol Council, the union representing 17,000 Border Patrol agents, called on Holder to resign. Shawn Moran, a union vice president, told the Arizona Daily Star, "We take the risks that are out there naturally just being in law enforcement working across from Mexico in the condition it's in right now. But what you can't accept is when your own government is allowing weapons into the hands of the people you're confronting." Green Energy's Waste: Your Tax Dollars Charles Lane, an editorial writer for the Washington Post, has an illuminating column today on the billions of tax dollars wasted by Obama's green energy policies. Barack Obama often says that he wants to "double down" on green energy subsidies. But as Lane notes those subsidies have more than doubled since Obama took office: "U.S. energy subsidies -- spending, tax breaks, loan guarantees -- increased from $17.9 billion in fiscal 2007 to $37.2 billion in fiscal 2010, according to the Energy Department." So what are we getting for it? Not much beyond "a litany of clean-energy failures, from electric cars to Solyndra." As we have repeatedly detailed in this daily report, the fundamental economics simply are not there. Now some on the left seem willing to admit it. Lane cites a new study by three researchers from the Brookings Institution, which is generally viewed as a left-of-center think tank. They examined the rationale for green energy subsidies and were less than impressed with the results. The bottom line from Adele Morris, one of the Brookings scholar: "I'm not aware of a single peer-reviewed economic study that shows these programs create jobs in the long run, and on a net basis." Lane adds, "Solyndra and its 1,861 vanished jobs proves [Morris'] point." More Bad News Here are some additional nuggets from the news confirming what we already know: Obamanomics isn't working. New Labor Department reports indicate that job openings in April hit a five-month low and "showed their sharpest percentage decline in about seven and a half years." And the Washington Examiner reports that nearly 7 million people dropped their cable TV service last year. When asked why, more than 70% cited "cost-cutting" as the reason. Then again, fewer people watching MSNBC is a good thing for America. Let's hope reality has set in and they will change their minds about Barack Obama if they aren't watching the left-wing media! Questioning A Pro-Life Convert Pro-life advocates love a good conversion story. And in recent years they have cheered as a long list of politicians, celebrities, and former abortion facility workers who have embraced the pro-life cause. Yet even in the face of Barack Obama's pro-abortion extremism, many in the pro-life community are hesitant to accept Mitt Romney as one of their own. As I write today at FoxNews.com, Romney, like Ronald Reagan, is a contrite convert to the pro-life cause. Given that either he or Barack Obama will be president for the next four years, I believe pro-lifers should welcome Romney's change of heart. You can read more here.

"With his announcement that he will, in effect, unilaterally enact a key feature of long-debated immigration reform, President Obama is doing something he has always wished to do: Get around a Congress that doesn't see the issue his way. In a speech to La Raza last July, Obama said that on the question of immigration reform, 'some people want me to bypass Congress and change the laws on my own.' Obama said he found the idea 'very tempting' but had to reject it because 'that's not how our system works.' The president was in a somewhat more combative mood last September, when he addressed the Congressional Hispanic Caucus. 'As I mentioned when I was at La Raza a few weeks back, I wish I had a magic wand and could make this all happen on my own,' Obama told the group. 'There are times where -- until Nancy Pelosi is speaker again -- I'd like to work my way around Congress.' ... At the time, Obama conceded only that really big changes require the approval of Congress. 'We live in a democracy, and at the end of the day, I can't do this all by myself under our democratic system,' he said. 'If we're going to do big things -- whether it's passing this jobs bill, or the DREAM Act, or comprehensive immigration reform -- we're going to have to get Congress to act.' Now, Obama has decided, in the words of an Associated Press report, to 'stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives,' a policy that 'will affect as many as 800,000 immigrants.' The action, which Republicans call amnesty and the administration calls 'deferred action,' will surely spark GOP calls to rein in the president's unilateral measures. The question will be whether any Democratic members of Congress, who might agree with Obama's policy goals, will dare express unhappiness with how he enacts them." --columnist Byron York

In fact, the nation's regulatory budget nearly doubled in his eight years, and regulatory staffing climbed 42%, according to an annual report on the federal regulatory state by George Mason University's Mercatus Center. Nor did Bush's tax cuts devastate the budget. In fact, revenues as a share of gross domestic product hit 18.5% in 2007, which is above the post-World War II average. And deficits fell three years in a row to a low of $160 billion. Unemployment, meanwhile, dropped to 4.4% just before the recession hit. And as we've pointed out on countless occasions, the financial crisis that caused the recession was not the result of too little government, but of far too much government intervention in the banking industry. Moments after lambasting Bush's tax-cutting, deregulating ways, he was bragging about how he's imposed fewer regulations than Bush, cut taxes more than a dozen times and how he's not a big spender. (None of that is true.) The real question before voters isn't whether they want to return to some dark, mythical past of Obama's imagination, but whether they want four more years of a dismal present characterized by stagnant growth, chronic unemployment, massive deficits and a president who is utterly clueless about how to fix any of it." --Investor's Business Daily

Attorney General Eric Holder will meet with Fast and Furious nemesis Congressman Darrell Issa at 5:00 this afternoon in what could mark the end of the Congressional investigation of Barack Obama's deadly gun smuggling scheme.
Last week, House Republican leaders at last agreed to schedule a vote on the Contempt of Congress charge Issa has long sought to bring against the Attorney General for 8 months of refusing to honor Congressional subpoenas. Deputy Attorney General James Cole quickly responded with a letter to House Government Reform Committee chair Issa, requesting a meeting to discuss ways of avoiding the vote. Issa agreed to meet with the Attorney General, but only if the Justice Department were willing to "...submit a serious proposal for how it intends to alter its refusal to produce critical documents subpoenaed by the Committee..."

Ernst & Young CEO James Turley, whose accounting firm has welcomed gays and lesbians in its own work force, becomes the first member of the Scouts' Executive Board known to publicly disapprove of the policy. "As I have done in leading Ernst & Young to being a most inclusive organization, I intend to continue to work from within the BSA Board to actively encourage dialogue and sustainable progress," Turley said.

So Mr. Turley is the first Boy Scouts of America executive board member to publicly fight for a policy change that could in all probability create more cases like Penn State's Jerry Sandusky. There is a HUGE DIFFERENCE between a work force of only adult accounting professionals lead by adult professionals and young immature boys supervised by men who are sexually attracted to young males.

The Family Research Institute reported in February 2009 this summary conclusion: About a third of the reports of molestation by the populace have involved homosexuality. Likewise, between a fifth and a third of those who have been caught and/or convicted practiced homosexuality. Finally, a fifth to a third of surveyed gays admitted to child molestation. All-in-all, a rather consistent story. Although homosexuals make up approximately 2% of the population homosexual acts account for as much as 33% of the molestations.

A 1978 position statement to the Boy Scouts' Executive Committee, signed by Downing B. Jenks, the President of the Boy Scouts, and Harvey L. Price, the Chief Scout Executive, expresses the Boy Scouts' "official position" with regard to "homosexuality and Scouting": "Q. May an individual who openly declares himself to be a homosexual be a volunteer Scout leader? "A. No. The Boy Scouts of America is a private, membership organization and leadership therein is a privilege and not a right. We do not believe that homosexuality and leadership in Scouting are appropriate. We will continue to select only those who in our judgment meet our standards and qualifications for leadership." App. 453-454.
"We believe that homosexual conduct is inconsistent with the requirement in the Scout Oath that a Scout be morally straight and in the Scout Law that a Scout be clean in word and deed, and that homosexuals do not provide a desirable role model for Scouts." Hard cases make for bad law. So, apparently, do tight presidential campaigns. On Friday, the Obama Administration's Department of Homeland Security issued a memorandum telling U.S. immigration officials how they should "enforce the Nation's immigration laws against certain young people who were brought to this country as children and know only this country as home." Coming five months before the election, the administration's move is an attempt to implement major elements of the DREAM Act, a controversial bill that's been introduced in both Democratic- and Republican-controlled Congresses but has always lacked the votes to be passed into law. Having failed in the legislative branch, how can the executive do this? The Administration insists it has wide "prosecutorial discretion" when it comes to enforcing immigration law. No one doubts that judges, prosecutors, and law enforcement officers should have discretion about what charges to bring and how to handle particular cases. There are always exceptions to the rule. But Friday's order, which uses the term discretion some ten times, seems to go beyond discretion to the point of creating a policy scheme contrary to existing law. The exception has become the new rule. Imagine a police chief instructing everyone on the police force to issue no speeding tickets to anyone under age 26, regardless of how fast the driver was going. That's not discretion; it's a policy instruction that changes the meaning of the law. Former Bush Administration lawyer John Yoo goes further:
Imagine the precedent this claim would create. President Romney could lower tax rates simply by saying he will not use enforcement resources to prosecute anyone who refuses to pay capital-gains tax. He could repeal Obamacare simply by refusing to fine or prosecute anyone who violates it.
The immediate goal here is to undercut Sen. Marco Rubio, R-Fla., who's been working to find a legislative solution to the situation of children who at a very young age were brought by their parents to the United States illegally. As a policy matter, there are reasonable and targeted ways to address this hard case that would uphold the principles of immigration reform and not open the door to a blanket amnesty. Finding an actual solution through the legislative process would give the law legitimacy, more permanency, and might even result in a bipartisan agreement. It would be part of a larger effort to find effective, reasonable and pro-immigration solutions to safeguard the nation's borders, promote the rule of law and administer a fair and positive immigration and naturalization system. Obama's discretionary policy is government at its worst: arbitrary, narrowly political and subject to administrative whim. This is amnesty by imperial decree. The fundamental problem is that the Administration is trying to implement laws that Congress hasn't passed. The president himself has admitted he doesn't have the constitutional authority to implement the DREAM Act. "The idea of doing things on my own is very tempting, I promise you, not just on immigration reform. But that's not how our system works. That's not how our democracy functions," he told Hispanic activists last year. Indeed, the order seems to recognize its constitutional shortcomings. "This memorandum confers no substantive right, immigration status or pathway to citizenship," it admits. "Only the Congress, acting through its legislative authority, can confer these rights." Yet what the Administration can't achieve as a matter of law it seems to be focused on accomplishing as a matter of fact. The Administration is making a habit of overstepping its bounds. Last fall it issued sweeping waivers of the No Child Left Behind Act (NCLB) if states would implement national education standards not authorized by Congress. "Congress hasn't been able to do it, so I will," Obama announced then. The Obama administration has sued the State of Arizona in an attempt to prevent the state from enforcing a federal law aimed at curbing the problem of illegal immigration. Then there are the president's recess appointments when the Senate isn't in recess. The list goes on. In our system of government, Congress is the legislative branch and is responsible for making the laws. Presidents are supposed to "faithfully execute" the laws to the best of their ability, not reshape them to suit their own policy goals and political needs.

Bryce Harper and conservatism, Part Two

Mark Judge's piece about Bryce Harper as conservative hero appears to have offended Dan Steinberg, a sports blogger for the Washington Post whose frivolous jottings also spill into the print edition of the sports page (a sign of the times, I guess). Steinberg heaps ridicule (but no analysis; that's not in his repertoire) on Judge's thesis. He also quotes Charles Pierce who apparently blogs for Esquire:
Mother of God, there's something fundamentally dehumanizing in dragooning someone like Bryce Harper into the service of your ideology as though he were nothing more than an action figure in your mental toybox.
I wonder whether Pierce realizes that he has just described the project of a large portion of the left-wing professoriate that is so influential in Literature and other Humanities departments at American colleges and universities. For them, great works of literature often become playthings in service of race theory, feminism or some other form of chic leftism.
There's nothing wrong - never mind "fundamentally dehumanizing" - about performing these sorts of stunts on the internet. That's part of what it's there for. But we shouldn't build a religion, or an academic department, around them.

Live from Jerusalem

My jet lag and laptop are giving me fits in Jerusalem, where I have arrived to attend the Fourth Israeli Presidential Conference. Tonight's opening ceremonies featured the awarding of Israel's Presidential Medal of Merit to Henry Kissinger by President Peres himself. Peres gave a moving tribute to Kissinger in Hebrew followed by an equally good but different one in English. Kissinger opened his remarks with the observation (I am quoting from imperfect memory): "It isn't often that an 89-year-old accepts an award saying, if only my parents were here." He said that of all the awards he has received, this one would have made them the proudest. Kissinger described the signing of the Egypt-Israel agreement in 1973 as the greatest moment of his professional career.
The award ceremony was followed with a keynote speech by Tony Blair. Blair's speech was mostly great, with a slight admixture of nonsense. But his central point was excellent and maybe even brave. He held Israel up as an example for the countries of the region to emulate. He cited democratic institutions. He cited freedom of speech. He cited freedom of religion. He asserted the insufficiency of elections. I thought for a man in his position, it was a remarkable speech.
This is the the fourth annual Presidential Conference. In a short time it has become something of an event. There are 4,000 guests in attendance from more than 40 countries and just about every continent. It is a privilege to be here. The theme of the conference this year is "Tomorrow."
While I have achieved a rare moment of connectivity at the end of a long day, let me ask you to take note of the following. All plenaries and panels held in the auditorium (Schwartz Hall) of the conference site will be broadcast live on the conference Web site. In an emotional ceremony, Israeli President Shimon Peres awarded fellow Nobel Peace Prize laureate and former United States Secretary of State Henry Kissinger with Israel's first Presidential Award of Distinction, for Kissinger's lifetime of contribution to the Jewish State. The ceremony took place as part of the evening session which closed the opening day of Facing Tomorrow 2012.
Joining Peres and Kissinger in offering his perspective on The Compass that Navigates the Future, as the session was entitled, was former British prime minister, and current Quartet envoy Tony Blair. Also in attendance were the President of Albania, the President of Croatia and the President of the Ivory Coast, as well as Israeli foreign minister Avigdor Lieberman and many other dignitaries.
In conferring the award, Peres said, "This award while being delivered from my hands, comes from the hearts of my (the Israeli) people. I feel that I am handing it not to a friend, but to a brother."
Kissinger, who first met Peres in 1962, then joined Peres on-stage and the two long-time statesmen embraced before Kissinger spoke.
"Shimon and friends," began Kissinger, "it is unusual for an 89-year old man to say that I wish my parents (with whom Kissinger fled from the Nazi-dominated Germany in 1938) could be here. They would be more proud of this distinction than any of the other honors that have come my way."
Blair addressed the massive upheaval in the Middle East over the past 12 months, saying, "We (the international community, led by the Quartet) have no option but to stay engaged in this part of the world. Democracy is not just a way of voting. It's a way of thinking. It's about freedom of expression, freedom of the media and freedom of religion."
He also said about Iran, "We must have the will to prevent it (Iran's acquisition of nuclear weapons) and when we say it, we must mean it."
This release accurately conveys the key quotes and some of the emotions of the evening's session.
I sat this evening with Israeli blogger Paula Stern, of A Soldier's Mother. My struggles with the computer have caused me to give short shrift to the opening session this afternoon. Paula summarizes the highlight of that session in "Tomorrow 2012 - Inspiration." Paula also graciously translated the Hebrew portion of Peres's tribute to Kissinger for me.

With all the grim news for lawyers these days-white shoe firms like Dewey filing for bankruptcy, unemployed recent law school graduates (I know, non-lawyers are saying, "the problem with this is . . . what, exactly??), a Justice Department that suddenly can't seem to convict a ham sandwich-perhaps it's time to take in the lighter side of the law with a few excerpts from the most interesting law review in America. No, it's not the Harvard or Yale law reviews, but the 2012 Green Bag Almanac and Reader, produced by Ross Davies and Ira Brad Mateskey.
In particular, Gregory Jacob's "The Year in Law" review section offers some splendid recaps of legal episodes in 2011 you might not have seen in your local bar news, or in the news in your local bar, or whatever. Such as:
March 16: Reuters reports that a passenger on a Delta flight was detained after being overheard falsely identifying himself as a federal air marshal. His problem was mainly that he was overheard by a real air marshal, who knows (because he is one) that real air marshals don't tell passengers they are air marshals because that would defeat the purpose of having air marshals.
April 26: Police in Buffalo say they are looking for a man who escaped from the Central District station earlier than day. The suspect is described as tall and muscular, wearing black clothing, and likely still carrying the chair to which they had handcuffed him. "Police think he still has the chair with him because it is missing from the station," the report says.
June 22: Counsel for the Dallas Mavericks basketball team moves to dismiss a lawsuit filed by a shareholder who alleges that the current owner [Mark Cuban] has "mismanaged" the team. The primary argument in the motion is that ten days earlier, the Mavericks had defeated the Miami Heat to win the NBA championship.
June 24: The House of Representatives fails to pass a resolution that would have authorized the use of force in Libya for up to one year but prohibited the use of ground troops except in emergencies. That is, the House took up, but could not pass, a resolution that would have given the President general authority to do something he had already been doing for three months, and specific authority to do something that everybody agrees he could do without asking.

Bryce Harper and conservatism

There's an old line that goes: "Do you know what I like about Los Angeles? It's not Buffalo." Using the same construction, I say: "Do you know what I like about sports? It's not politics."
Sports and politics are, indeed, as antithetical as Los Angeles and Buffalo (with sports, if anything, representing the Eastern city in the analogy). In politics, opinion and popularity are paramount; in sports, they count for very little. That's the reason why college football fans hate the BCS system as a vehicle in determining the national champion. On its own terms, the system is rational, but it makes opinion paramount and cuts the small and mid-size guy out of the process. That's way too much like politics and way too little like sports.
Because sports and politics are so different, I try to compartmentalize the two. For example, I don't root against teams because they come from Blue states. Even my preferences for national teams in soccer are driven more by considerations of sport than by politics. I'll never be a fan of the German national team, but I reserve my true antipathy for other national teams that, in my view, play the game objectionably.
None of this means that politics don't, or shouldn't enter, into a sports fan's preferences for individual athletes. For example, conservatives tend to get excited about Tim Tebow and Jeremy Lin (I don't, but I like both of them). This is natural enough. Both appear to be rooted, humble, and religious.
Many conservatives were fans of Muhammad Ali. This, I found odd. Ali was unpatriotic, ungracious, and a braggart (and don't tell me that "it's not bragging if you can do it" - if you can do it, it's bragging; if you can't, it's lying). Ali came close to delivering a knock-out blow to sportsmanship.
It turns out that conservative sports fans tend to like athletes who are extremely humble and athletes who are extremely brash. Maybe we're extremists after all.
This brings us to Bryce Harper. As he was rising rapidly through the minors, Harper developed a reputation (apparently well-earned) for extreme brashness. I was prepared to dislike him for that reason.
As a major leaguer, Harper has exhibited a brash side, but he has also demonstrated humility (after an 0-7 outing with 5 strike-outs against the Yankees, followed by a good bounce-back performance, Harper commented that "baseball is a humbling game"). In fact, Harper won me over in part because he seemed to curb his brashness. He was fresh and bold without being abrasive. And, of course, he's been able to "do it."
Recently, Mark Judge (grandson of Joe Judge, the excellent first basemen for the 1924 world champion Washington Senators) wrote this, and much more, about Harper:
The star rookie for the Washington Nationals has woken up Major League Baseball, and watching it unfold has reminded me of nothing so much as the collapse of the old political paradigms and the inevitable and upcoming rebirth of conservatism in November.
Judge has been criticized for the column, but it's worth reading. As long as we remember that the rebirth of conservatism in November isn't "inevitable" (a brash word) and that sports isn't politics.

Watergate, 40 Years Later

So we're up to another decadal anniversary of Watergate, with most of the usual themes being reprised, though with a few modifications from the last decadal reminiscence. First, we finally learned the identity of "Deep Throat" a few years ago-FBI agent Mark Felt-and that his motives were not so noble. Felt was a frustrated climber who was angry that Nixon passed him over to be FBI director, and thus sought revenge by leaking to Woodstein at the Post. There's also been some great stories over the last week debunking what I've always called "the Standard Heroic Account" that places Woodward and Bernstein at the center of the story: without their intrepid reporting, Nixon might have got away with it! It turns out the sensational Woodstein stories advanced the investigation very little. The FBI was generally several steps ahead of the media in unraveling the story.
Watergate remains the Jack the Ripper of political scandals, with many unanswered questions and inexplicable anomalies-and a pattern of anomalies, as my late great teacher Harold Rood taught us, usually add up to something that is not random. Above all, just what the heck were the burglar/buggers after? The infamous "call girl ring" story remains alive, though the favorite theory is still that the Nixon campaign wanted to see what information Democratic National Committee chairman Lawrence O'Brien might have had about Nixon, and particularly Nixon's connections to Howard Hughes or to a Greek tycoon, Thomas Pappas, whose secret contributions to Nixon's campaign would have been embarrassing if publicly revealed. Maybe so, but here's one of the anomalies: According to some accounts, O'Brien's office was never bugged (other accounts say a bug was planted, but didn't work), and the burglars were caught far from O'Brien's office on that fateful night. The original bug the burglars thought had malfunctioned-but which had in fact been removed-had been placed in the office of a low-level subordinate employee who was seldom at the office. Maybe the burglar/buggers were just incompetent? Perhaps. After all, why did veteran CIA agent James McCord do something as stupid as tape a door open a second time, which would be an obvious tip off to Watergate security? This has always unfolded onto a Hollywood-like conspiracy theory that the CIA was behind the whole thing, because The Compnay thought Nixon was trying to exert too much control over the agency, which Nixon disliked. A faction of the military is also alleged to have helped exploit Watergate as a means to derail Nixon's arms control efforts. (This was, coincidentally, the line the Soviet press adopted.) "If we didn't know better," Nixon remarked on one of the famous tapes, "[we] would have thought it was deliberately botched."
Perhaps we'll never know. In any case, how should conservatives think about Watergate, or at least its political consequences? Here's how I summarized it in the first volume of The Age of Reagan:
While the sleuths of history attempt to peel away the tantalizing missing details suggested above, it is in the more abstract arena of Watergate's effect on the constitutional structure of government where the most important revisionism remains to be done. The reaction to the temporary constitutional crisis brought about by Nixon's misdeeds (temporary because he would have been gone from the White House by 1976 anyhow) was a permanent constitutional crisis in the form of the powers that Congress and the bureaucracy usurped from the executive branch during its post-Watergate weakness. Watergate didn't just change our standards of ethics in government; it changed how the Constitution works. Far from showing that "the system works," Watergate introduced significant new distortions into our "system" that Ronald Reagan was largely unable to affect despite two popular landslide elections, and which persist today.
On the lighter side, I can't conclude without recalling the views of my mentor M. Stanton Evans, who quipped that a true conservative was someone who didn't support Nixon until after Watergate. Evans had been a sharp critic of Nixon from the right-he said in 1970 that "There's only two things I don't like about President Nixon: his domestic policy, and his foreign policy." But of Watergate, he said, "After wage and price controls, Watergate was like a breath of fresh air." He supposedly called over to the White House in the midst of their agony and said, "Gosh-if only I'd known you guys were doing all of this neat stuff, I wouldn't have been so hard on you."
