 Shotguns come in various sizes with lots of options. You can get a 12 gauge, 20 gauge, add a tactical stock, laser and lots more, at least for now. If the ATF has its way, you might get arrested for owning what is primarily the most used weapon for home defense. The Bureau of Alcohol, Tobacco and Firearms wants to redefine a shotgun to limit American citizens from owning powerful weapons or what they are referring to as "military" weapons. This redefining came in the form of a recent study by the ATF, which has its roots in the Gun Control Act of 1968. Beregond's Bar has a complete four part series on the new campaign of the ATF. In Part One, the author ,"Tom", points out that the ATF is focusing on changing the term "sporting use" in order to ban certain shotguns. He writes,

Nancy Becker
Elected as the Montgomery County Recorder of Deeds in 2003, Nancy Becker is an accomplished, professional administrator and manager with over 35 years experience in real estate, financial management, and strategic planning.
Currently she directs the Recorder of Deeds Office, full time, with a staff of twenty-six (26), who maintain the integrity of all land records and other documents entrusted to the department, as well as the collection and monthly distribution of County/State fees and Real Estate Transfer Taxes for the State, Townships, Boroughs, Municipalities and School Districts; while professionally serving the public with efficiency, accountability, and responsibility.
Over these past 8 years, as the Recorder of Deeds, Nancy has implemented new revenue sources, saved taxpayers hundreds of thousands of dollars ($750,000.00 alone in 2006), managed and cut costs; increased efficiency, timely recording and high accuracy rates; prioritized advanced, user-friendly systems, constituent services, security, and disaster recovery; and initiated procedures to protect residents from real estate fraud.
She initiated, coordinated, and spear-headed public effort for sponsorship and support of Senate Bill 1331, which prohibits the state from imposing and collecting state sales and Use Taxes for certain public services performed by any county governmental agency and/or court, and House Bill 1634 (Act 110), which eliminates the need to pre-register a deed prior to recording, thereby saving the residents of Montgomery County tens of thousands of dollars.
November 2011 she initiated a class action suit against MERS and the large banks that have not recorded mortgage assignments. She was featured in Bloomberg Businessweek November 2011 and Westlaw Journal December 2011 for her efforts to maintain the chain of title on mortgages and her attempt to collect in excess of $15 million dollars in recording fees for Montgomery County.
Under her direction, the Recorder of Deeds office has become a model of document management:
- One of the highest tech land records offices in the country.
- One of the first in the state to electronically record land documents (eRecord) accelerating document recording, creating efficiencies, reducing errors, and dramatically improving the county's ability to serve its constituents. "eRecording" is a government priority at both the Federal and State levels. It is just one of the priorities that I am initiating to comply with the Montgomery County Commissioners' eGoverment initiative.
- One of the first in the state to apply artificial intelligence software, Optical Character Recognition (OCR) and Intelligent Character Recognition (ICR) to automatically capture document data.
- One of the first counties in state to participate in its eNotary initiative.
- Digitizing land plans in order to make them available through direct computer entry allowing faster access to information.
- Digitized land records dating back from 1784.
- Implemented Disaster Tolerant/Recovery plan by total "redundant replication" of data and images.
- Offer office information and forms online and in the process of integrating a digital archiving system.
- Founded the first Property Records Educational Partners (PREP) organization in Pennsylvania, to maintain technological advancement, education, and user-friendly constituent service.
Nancy believes that responsibility of citizenship means being involved in the community. She has been a member of numerous community boards and commissions.
To mention some, she is the President of the PA Recorder of Deeds Association, President of the Northern Montgomery County Drug & Alcohol Task Force, Southeast Regional Chairperson of the Property Records Educational Partners; member of the Board of Directors of the Property Reorders Industry Association, Co-Chair of the Law Enforcement Collaborative, working with the FBI Mortgage and Land Fraud Task Force, a member of the Montgomery County Drug & Alcohol Planning Committee, the Northern Montco Technical Career Center Educational Opportunities Council, the North Penn School District Drug Free & Safe Schools Committee, the Towamencin Township Park and Recreation Advisory Council and Planning Commission, the American Society of Professional & Executive Women and the International Association of Clerks, Recorders, Elected Officials & Clerks.
Nancy has also played a significant part in raising millions of dollars in grants and contributions for public causes.

Heading into the most important election of our lifetime, Barack Obama and a terrified Congress want to make sure angry Americans can never again gather en mass to change the course of history as we did with the 1.2 million member 912 March and the demonstrations that flipped Congress in 2010. No, our tyrannical politicians want to force you to stay home and shut up.
THE FIRST AMENDMENT SHALL NOT DIE ON OUR WATCH! - REPEAL HR347 & 1794 - FAX CONGRESS NOW!
The protected right of the people peaceably to assemble is unalienable, something that has afforded deep fundamental and historical foundations to our freedom. Our Founders established a clear "no trespassing sign" via our First Amendment to keep the government away from this God-given right essential to Liberty. "Congress shall make no law abridging...the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." But new legislation has been passed in Congress that will destroy this absolutely central, simple and non-negotiable right imperative to a free people.
HR 347 and S 1794, the "Federal Restricted Buildings and Grounds Improvement Act of 2011" has nothing to do with improving landscaping around federal buildings. This bill is being presented as a No Trespassing bill. Reasonable people understand that lawful restrictions and protections are needed for government officials and government functions. However, this legislation makes it a federal crime to allegedly DISRUPT the "ORDERLY CONDUCT" of government.

The violator doesn't have to be physically on the grounds where the government business is being conducted, just within the vicinity of the self-proclaimed "business of government." The law is not limited to buildings or locations as the title suggests, but seems to be "roving" and follows persons protected by Secret Service wherever they may go.

- Make a statement at a town hall meeting that your Congressman doesn't like? BUSTED
1752(a)(2) knowingly, and with intent to impede or disrupt the orderly conduct of government business or official functions, engages in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions;
1752(a)(3) knowingly, and with the intent to impede or disrupt the orderly conduct of Government business or official functions, obstructs or impedes ingress or egress to or from any restricted building or grounds;
1752(c)(1) the term 'restricted buildings or grounds' means any posted, cordoned off, or otherwise restricted area - (B) of a building or grounds where the President or other person protected by the Secret Service is or will be temporarily visiting; or C) of a building or grounds so restricted in conjunction with an event designated as a special event of national significance;

The right protected in the First Amendment is the right to peaceably assemble. We do not have the right to impede the flow of traffic, either on sidewalks or roadways. We do not have the right to impede anyone's business practices. But this law is not about private business, it is about government operations. Make that Big Brother Government Operations.
This Congress has a habit of writing in vague and overbroad terms; yet, in order for laws to be Constitutionally sound they CANNOT be vague and overbroad in ANY aspect, and they can ONLY interfere with the rights of the people in as narrow a capacity as both necessary and according with Constitutional principle. But this law makes it a crime to disrupt the government. The Supreme Court has said this type of broad language gives too much power to the government, and they have been saying this since 1939. This law actually places the desire of the government to be free from disruption unconstitutional power over the right of the people to redress the government of their grievances.

Suppose your Congressman, who is under Secret Service protection, has a town hall meeting and many members of the community show up to challenge him on his voting record. This law could be construed to allow federal charges to be brought against these citizens for disrupting his town hall meeting by attending and demanding to be heard under the First Amendment. After all, it will not be hard to claim that people who are not happy with the Congressman's voting record had the "intent" to disrupt this meeting. This vague and overbroad language has the potential to ultimately prevent people from gathering outside any government building or politician's function for fear of being charged with a federal offense. In Constitutional law, we call that a "chilling effect" and the Supreme Court has always held these restrictions to be unconstitutional. After all, who can afford to risk going to jail, to carry a record of federal arrest, to stand for their rights - even if they will win?
The right to orderly conduct of government is NOT a constitutionally protected right. However we DO have the right to free speech and the right to peaceably assemble. Our Constitution enshrines in government the fundamental principle of protection for our God-given, unalienable rights freely to speak and assemble. These rights of We the People are held as foundation stones of our individual Liberty and the government must protect these rights, not limit them. And throughout history, our Supreme Court has protected these rights.

- United States v. Grace, 461 U.S. 171, 177 (1983)

In every single case, the Court ruled that the people's First Amendment right to protest fundamentally outweighs the government's right to avoid uncomfortable situations at which politicians may be called to account for their actions.

People have the right to complain, the right to have their voices be heard, the right to redress their grievances in the form of protests. These actions are supposed to make the government take notice. Disruption cannot be the standard to stop speech. To allow the government to create this new standard allows the government to tell us to sit down and shut up.
The chilling effect occurs not in the fact that you are denied your due process. If you are arrested because of unlawful legislation you can fight the prosecution and even sue the government for violating your rights. If the Supreme Court has not become completely corrupted you have fairly good odds of winning. But, as anyone who has been wronged by a government agency can tell you, a victory will often come at the expense of a ruined life and livelihood.
The bottom line is that there are laws in every municipality that punish Trespass, Disorderly Conduct, Assault, and any other crime involving real threats against government and persons in government. Why do we need a vague and overbroad FEDERAL LAW to enforce laws that are already in effect, when that law could encroach on our God-given, protected rights? William Penn said, "Necessity, it is said, is the plea for every infringement of human Liberty; it is the argument of tyrants and the creed of slaves." Clearly, we don't need a "Federal Trespass Bill." We already have one; it's called the Bill of Rights!
When will we have enough of government intrusion on our Constitutionally protected rights? We were outraged because we are Taxed Enough Already. When will we recognize that if we cannot trust the government with our finances, then we certainly cannot trust the government with our Liberty?

Pictures of America's Medicare Mess
Earlier this month, President Barack Obama sat down with world leaders at the G8 summit and bragged about his track record of supposed good governance -- how he has worked to "bring down our deficits and debt over the longer term" and made "room to take a balanced approach to reducing our deficit and debt." There are plenty of ways to shoot holes in the president's pronouncement, but there is one glaring example of where he has come up far short -- failing to address America's growing Medicare crisis. In "Medicare at Risk: Visualizing the Need for Reform," Heritage's Kathryn Nix and John Fleming illustrate the facts about Medicare and why Washington must come to the rescue with innovative solutions to preserve the program today and into the future. President Lyndon Johnson signed Medicare into law in 1965, creating a program that today provides health insurance to some 48 million Americans. Now, though, that program is in desperate need of reform as the United States grapples with retiring baby boomers entering the system, increasing health care costs and a status quo that simply can't be sustained. Case in point: Medicare spending is growing faster than the rest of the federal budget, and it's the main cause of America's long-term deficits. As Nix and Fleming show, Medicare's costs are projected to shoot through the roof, surpassing Social Security, Medicaid, Obamacare subsidies and all other non-interest spending by 2050. Want more proof on how bad the situation is? By 2040, Medicare's shortfall will account for 81 percent of the federal deficit. Here's another disturbing fact: The number of workers per Medicare beneficiary is falling dramatically. Back in 1965, there were 4.6 workers contributing to Medicare for every person receiving benefits. Today, there are only 3.3 workers, and in 2030, that number will fall to 2.3. That falling ratio is leading to the program's insolvency. And with longer life expectancy (which of course is a good thing), seniors today are collecting benefits for almost three times as long as when the program first started. That means the program is paying more benefits than ever before. Unfortunately, the situation isn't going to get any better absent congressional action. The Medicare trustees (who issue reports on the program's fiscal stability) project that under current law, Medicare will rack up $26.9 trillion in unfunded obligations over the next 75 years. In a more likely scenario, that number soars to $36.9 trillion. American taxpayers will pay the costs, and seniors will suffer the effects of a program that's going broke. What's that burden look like today? Working Americans pay for about 88 percent of seniors' Medicare benefits through payroll taxes. Right now, that tax rate is set at 2.9 percent, costing a median household about $1,430 in 2010. But if Congress turns to tax hikes alone to cover the deficit in Medicare Part A (which covers inpatient care in hospitals), that rate would have to go up to 5.33 percent, costing that same household $2,630 per year. President Obama's health care plan makes things even worse for the very seniors Medicare serves. Nix and Fleming show that Obamacare cuts $421 billion from Medicare in order to pay for other programs that aren't even for seniors. On top of that, a large chunk of the Obamacare cuts come from slashing reimbursement rates for doctors, meaning that seniors' access to health care providers is at risk, with 40 percent of providers in danger of closing their doors by 2050. It doesn't have to be this way. The Heritage Foundation's Saving the American Dream plan proposes reforms that would transform Medicare into a real insurance program that provides financial security to retirees and guarantees assistance to people who need it. Seniors will enroll in the health plans of their choice, much like Members of Congress and millions of federal employees do, and unlike today, all plans will include catastrophic protection. The picture of Medicare's future is not a pretty one, and doing nothing about it won't improve the situation. America can't afford the status quo, and it's time for leaders in Washington to do more than talk a good game, but to actually enact reforms that make sure Medicare's promise can be kept for those who need it most.

Last week I had the opportunity to get a sneak-peek at the RNC's new Facebook application. Designed, in the words of one RNC staffer to "take our message where the people are," the Social Victory Center app will, among other things, hook users up with campaign news targeted based on their location and preferences (which Facebook already knows, of course), let users join volunteer efforts, distribute voter registration forms, and provide an online phone bank, all without leaving the Facebook website. It will also, if users wish, put those activities on the user's Facebook wall, letting their friends see what they're up to and, hopefully, encouraging them to join in.

It's an attempt to leverage Facebook's popularity in a new way and, at the moment, the Democrats have nothing like it. The Social Victory Center was unveiled to the public yesterday, so if you're on Facebook, check it out. As the general election ramps up, check back for volunteer activities as they're added. Also, like I did in 2008, I'll be pushing online phone banking in the final weeks of the election, only this time the RNC will have done the heavy-lifting that the McCain team wasn't too keen on. 1. Time to do What We Can For Ted Cruz
David Dewhurst and Ted Cruz are in a runoff in Texas.
Cruz has long odds in the runoff, given the margin of Dewhurst's victory.
But it is very doable. Conservatives across the country, however, must unite today. This race must be a national priority for each and every conservative. It is not enough to pray for Ted Cruz, though that helps tremendously. We must put our money where our mouths are.
2. Tim Noah's Sad Parade
The publication of Jonah Goldberg's new book The Tyranny of Clichés has brought forth a number of responses from liberals and progressives, many of them either essentially proving Goldberg's point or entirely avoiding grappling with the book's substance. The latest entrant is Tim Noah, now writing with The New Republic, who seeks to offer a companion to Goldberg's collection of liberal clichés with his own "conservative clichés." It is clear from the column that Noah either (1) did not read the book, (2) completely missed its point, or (3) simply could not come up with counter-examples of the same type.
3. Let's tax wealthy foundations the same way we tax wealthy individuals
Down with the 1%! End the social injustice of gross income inequality! Smash the unfair fruits of capitalist oppression, in which a wealthy few take care of well-connected allies, instead of circulating their money into the economy for the 99% to get to touch!
It's time we started taxing wealthy foundations at the same rate we tax wealthy individuals. Gates. Ford. Getty. Kellogg. Hewlett and Packard. Moore. Mellon. Rockefeller. Soros. These are not just the 1%, but the 1% of the 1%.
Great wealth in the hands of a few is undemocratic, whether it's directly by a person, or given over to these private corporations that serve as embodiments of boundless ego. Tax them to fund a truly charitable social safety net for all Americans.
4. Sex Selection Abortion in America
In the wake of Chen Guangcheng arriving safely in the United States, after years of persecution in China for his anti-abortion activism, The House of Representatives will vote tomorrow on H.R. 3541 (also known as the Prenatal Nondiscrimination Act - PRENDA), a bill to ban sex-selection abortions in the United States. Although the US has strongly condemned China for their sex-selection abortion practices, only four states (AZ, OK, PA and IL) currently have laws banning the procedure. Sex-selection abortions have long been an issue around the globe, most notably in China and India, and studies show they are rampant in the US. A series of videos, the first of which was released by Live Action this morning, exposes the role Planned Parenthood plays in America's sex-selection abortion problem.
The first video, shows a woman visiting a Planned Parenthood facility in South Austin, Texas. The woman, undercover for Live Action, spoke at length with a Planned Parenthood employee about how to proceed with an abortion should she find out that she is pregnant with a girl. The employee's instructions included how to use local OB/GYNs to find out the sex of the baby and how to defraud Medicaid to pay for all the costs associated. She also advised the woman that many "regular" doctors would not provide an ultrasound should she indicate her desire to abort, as sex determination is usually made 5 months into the pregnancy and pretty much everything (including the brain) is already developed.

Meet 'Flame,' The Massive Spy Malware Infiltrating Iranian Computers

A massive, highly sophisticated piece of malware has been newly found infecting systems in Iran and elsewhere and is believed to be part of a well-coordinated, ongoing, state-run cyberespionage operation.
The malware, discovered by Russia-based antivirus firm Kaspersky Lab, is an espionage toolkit that has been infecting targeted systems in Iran, Lebanon, Syria, Sudan, the Israeli Occupied Territories and other countries in the Middle East and North Africa for at least two years.
Dubbed "Flame" by Kaspersky, the malicious code dwarfs Stuxnet in size - the groundbreaking infrastructure-sabotaging malware that is believed to have wreaked havoc on Iran's nuclear program in 2009 and 2010. Although Flame has both a different purpose and composition than Stuxnet, and appears to have been written by different programmers, its complexity, the geographic scope of its infections and its behavior indicate strongly that a nation-state is behind Flame, rather than common cyber-criminals - marking it as yet another tool in the growing arsenal of cyberweaponry.
The researchers say that Flame may be part of a parallel project created by contractors who were hired by the same nation-state team that was behind Stuxnet and its sister malware, DuQu.

By reform, D.C. politicians mean, to make that which is currently illegal, legal. Lawmakers have been stopped from passing amnesty for millions of illegal aliens living in America. President Obama has broken many of his promises aimed at the general public and jobless Americans, but he has kept promises to his left-wing base that involved divisive wedge issues. He promised to create 7 million new jobs on seven different occasions in 2008. But these jobs have not materialized: "just 16 states have seen job growth since President Obama took office," overwhelmingly conservative states like Texas that have rejected liberal economic policies.

This Memorial Day weekend 2012, we turn to God and give rememberance to those who have died for our country. Freedom is not free. Memorial Day, originally called Decoration Day, is a day of remembrance for those who have died in our nation's service. There are many stories as to its actual beginnings, with over two dozen cities and towns laying claim to being the birthplace of Memorial Day. There is also evidence that organized women's groups in the South were decorating graves before the end of the Civil War: a hymn published in 1867, "Kneel Where Our Loves are Sleeping" by Nella L. Sweet carried the dedication "To The Ladies of the South who are Decorating the Graves of the Confederate Dead" (Source: Duke University's Historic American Sheet Music, 1850-1920).

The U.S. Senate is now gearing up to debate cybersecurity legislation-and will have to vote on whether the federal government should regulate cybersecurity measures of the private sector as well as those of government. The government's track record on cybersecurity does not inspire confidence that it can devise effective cybersecurity regulations for the private sector. Cybersecurity for the nation should be a cooperative effort between the private sector and the government, with each contributing in its own way. Onerous regulations are not the solution to the ever-expanding reality of cyberthreats.

After the use of bigoted language by ThinkProgress contributors turned into a growing scandal, the White House publicly distanced itself from ThinkProgress, an outlet of the Center for American Progress, which Time Magazine called the think tank with the largest influence on the Obama administration. Jarrod Bernstein, the White House's liaison to the Jewish community, described the events there as troubling and stated that the Center for American Progress's attitude was not that of the Obama administration.

The critical Egyptian presidential election is the subject of this ITAI WEEKLY MIDDLE EAST REPORT. For Egyptians it is a clear choice between an Islamist state like Iran or a secular state that is inclusive of its minorities and somewhat friendly towards the West.
EGYPT: A CRITICAL PRESIDENTIAL ELECTION

In what amounted a to a major surprise, the Muslim Brotherhood (MB) candidate Mohamed Morsy and the secular independent candidate Ahmed Shafik advanced to the next round of the Egyptian presidential elections. The presidential elections in Egypt began on Wednesday, May 23, 2012, in what is heralded as the first ever free election in this most populous Arab state. Whatever the outcome may be, it is unlikely that Egypt will be as close to the U.S. and the West as it had been under President Mubarak, nor will Egypt's peace with Israel, "cold" as it was, be the same. At best, it will be "colder," at the worst the 1979 peace treaty will be abrogated, depending on who wins the election. For Egyptians however, it is a choice between an Islamist state or a secular one.
Approximately 52 million Egyptian citizens are eligible to vote out of a population of about 85 million. There are 13 candidates for the presidency, and if none of the candidates win more 50% of the vote, a second round of voting will take place on June 16 and 17, 2012. It is unlikely that we will know who the winner is before June 21, 2012. At that point the Supreme Council of the Armed Forces is supposed to pass the governing powers on to the newly elected president.
The five leading candidates are Abdel Moneim Aboul Fotouh (60), Amr Moussa (75), Mohamed Morsy (61), Ahmed Shafik (70), and Hamdeen Sabahi (57).
Aboul Fotouh (an Independent candidate) is a physician by profession, married and the father of six. He was a senior member in the MB but resigned last year in order to run for the presidency. He is a moderate Islamist whose platform calls for a combination of Sharia law and democratic principles. Aboul Fotouh wants the combating of crime to be the sole purpose of the police. He has promised to appoint a young Vice President, and govern with transparency.
Aboul Fotouh is popular among moderate Islamists especially among the younger members of the MB. Ironically, he has the support of many in the Salafist Nour Party (second largest party in the Egyptian parliament). As an activist in the Arab Physician Association, he has had exposure to regional and international problems. However, his own Muslim Brotherhood (now, the largest party in the Egyptian parliament) did not endorse him but rather Mohamed Morsy.
The Copts of Egypt and liberal elements in Egyptian society are wary of his connection to the MB. Aboul Fotouh's attitude towards Israel is hostile, and he views Israel as an enemy. He demands changes in the peace treaty with Israel and supports all aspects of the Palestinian struggle.
Amr Moussa (Independent) is the most widely known internationally among the competing candidates. He served as Egypt's Foreign Minister in Hosni Mubarak's government (1991-2001) and as Secretary General of the Arab League (2001-2011). His campaign promises included combating corruption in government, stronger parliamentary oversight over government operations, and the use of the Armed forces to aid the civilian population.
Moussa has the support of the 12 million strong Coptic-Christian community, as well as liberal elements in Egyptian society who view him as a "moderate." He is also seen as the figure with the widest and most extensive political experience. Yet, his identification with the Mubarak regime and his advanced age might hurt him, particularly with the younger generation of voters.
Amr Moussa has, like the man he served, been hostile towards Israel, and has pledged to pursue "a more critical relationship with Israel," raising fresh fears that the Arab world's most populous state is intent on weakening its alignment with Washington. Since half of polled Egyptians would like to cancel the peace treaty with Israel, Moussa' position is aligned with public sentiments. In a September 2011 interview he told Patrick Seale, "The Treaty will continue to exist, but Egypt needs forces in Sinai. The security situation requires it. Israel must understand that the restrictions imposed by the Treaty have to be reviewed." According to Eric Trager (New Republic, April 30, 2011) "Moussa owes his startling political ascendency primarily to one thing: his shameless exploitation of anti-Israel demagoguery for political gain."
Ahmed Shafik (Independent) was a combat pilot in the Egyptian Air Force, and briefly served in Mubarak's government (from January to March 2011). Shafik's platform calls for the appointment of appoint four vice-presidents, a special governor to combat corruption, removing the police from political affairs and the extension of health services to all Egyptians.
Shafik has the support of the Mubarak loyalists, including the business sector and the generals. His identification with the Mubarak regime and the Supreme Council of the Armed Forces might present problems for him. Unlike Moussa, he would fully maintain the peace treaty with Israel and has expressed his willingness to visit Israel.
The MB tried to disqualify him from running but failed. They did, however, manage to disqualify Omar Suleiman. Shafik represents the friendliest approach towards both the U.S. and Israel.
Mohamed Morsy (MB candidate) is married with five children, is an engineering professor, (received his PhD from the University of Southern California) and currently serves as the Chairman of the Freedom and Justice Party (official name of the MB party). Morsy's platform calls for the implementation of Sharia law in state affairs, the strengthening of the Egyptian army and making Egypt once again a regional leader. He also believes in increasing cooperation with the Arab and Islamic states, and lowering the age for holding public office. Morsy has declared that he would combat corruption in government, and would encourage "Green" construction.
Morsy is the most religious of the candidates and has the institutional support of the MB. His candidacy may however suffer as a result of Aboul Fotouh presence in the race.
Eliot Spitzer interviewed Mohamed Morsy on CNN (2/4/11) and asked, "Would you continue to recognize the existence of the State of Israel? Morsy replied: "Well, the State of Israel is already registered in the United States ..." adding, "We are not against people. We are not against mankind. We are not against the Jews. We are against Zionism. We are against torturing the Palestinians." Morsy would maintain the peace treaty but would change Egypt's international agreements to suit its national interests.
Morsy like Fotouh, Sabahi, and, to a lesser extent, Moussa would reorient Egypt's foreign policy away from the US in closer alignment with Iran and Turkey.
Hamdeen Sabahi, the youngest of the viable candidates, is the representative of the Nasserite party (named after Egypt's president from 1952-1970, Gamal Abdul Nasser) and the "leftist" candidate in the race. He is married with two children and is a journalist by profession. In the 1980's he was a member of the Egyptian Communications Syndicate, and in 1996 he founded the al-Karama Party. In 2010, he formed the National Association for Change. Sabahi was also among those who established the pro-democracy Kefaya movement.
Sabahi's platform calls for a democratic and civilian society. He would reorganize the security services and would appoint three vice-presidents (a woman, a Copt, and a young person). He would advance laws that would bring a president or government ministers to trial on charges of wrongdoing or corruption. Sabahi promised to provide health insurance to all Egyptians, and seeks to improve the educational system.
Sabahi enjoys the support of the lower income classes, and has established his credentials, which are in opposition to Presidents Mubarak and Sadat. He was a strong presence in Tahrir Square last year. With three other leftists on the ballot, however, Sabahi's chances are diminished.
Sabahi is hostile towards Israel and he opposes the sale of gas to Israel. He also declared that if elected he would materially support the Palestinian's in their fight against Israel.
While polls predicted that Aboul Fotouh (moderate Islamist) and Amr Moussa (secularist) will advance to the second round instead, it is the hard Islamist Mohamed Morsy, and the military's choice Ahmed Shafik who will square off.

Kansas Victory: The Untold Story The week of May 7th, the Kansas legislature passed, on a near-unanimous vote, the Kansas version of ALAC (American Laws for American Courts). According to a Fox News report, Gov. Sam Brownback signed the bill on May 21st. ALAC prohibits judges from applying foreign law when doing so infringes on the constitutional rights of a party to the case. This can include sharia law. Numerous media outlets reported the legislature's vote. But here's what happened behind the scenes that didn't get reported.

Israel revives military option after Obama rejects its nuclear demands of Iran

Israel has withdrawn its pledge to US President Barack Obama not to strike Iran's nuclear sites before the November presidential election after he rejected its minimal demands for nuclear negotiations with Iran. This is reported exclusively by debkafile's Washington sources.
In public, Israeli ministers still talk as though they believe in results from the Six-Power talks with Iran, which Thursday May 24 limped into their second day in Baghdad with the parties still miles apart. But the presidential veto has essentially cast Israel outside the loop of influence on the outcome of diplomacy.
When Israeli Defense Minister Ehud Barak met US Defense Secretary Leon Panetta at the Pentagon on May 17 he was told that Obama had rejected Israel's toned-down demands for Iran to at least to halt high-grade uranium enrichment, export its stocks of material enriched higher than 3.5 percent grade and shut down production at the Fordo nuclear plant near Qom. For six months, the Obama administration tried to sweeten the bitter pill of this rejection by bumping up security aid. The latest appropriation covered another $70 million for manufacturing more Iron Dome short-range missile interceptors.

SEATTLE -- The heaviest polar ice in more than a decade could postpone the start of offshore oil drilling in the Arctic Ocean until the beginning of August, a delay of up to two weeks, Shell Alaska officials said.
Unveiling a newly refurbished ice-class rig that is poised to begin drilling two exploratory wells this summer in the Beaufort Sea, Shell executives said Friday that the unusually robust sea ice would further narrow what already is a tight window for operations. The company's $4-billion program is designed to measure the extent of what could be the United States' most important new inventory of oil and gas.

If you visit northern California, you might think everything works well. But as soon as you reach San Francisco and travel south, you understand nothing can end up 'well' in a state morphing into third world slums.
What defines the 'third world'? In a word: illiteracy! Once entrenched, you cannot and will not solve it, change it or rearrange it. It grows like barnacles on a whale's belly, like slums in a city, like the AIDS virus.
On the Mexican border, the poorest of the poor cross the Rio Grande and set up Colonias known as 'new neighborhoods' in California, Arizona, New Mexico and Texas. The New York Times reported on them, "The Third World forms on America's southern border." They found in 1985 an estimated 500,000 Mexicans living in cardboard shacks, trailers, no water, no electricity, no roads, no sewage. In 1995, the numbers hit 1 million. The NYT estimated at the current growth, colonias would reach 20 million within 30 years.
It means a gargantuan predicament for our country as to health, welfare, education, medical care and sustainability.

To make all of this go away Public Policy Polling (PPP) a North Carolina firm that had misled Obama into thinking he was going to lose the vote the North Carolina gay "marriage" vote by a "manageable" 55% against and possibly even do better hurried, to "make things right" with a ridiculous poll of Maryland's Black voters showing a 36% swing to support Obama and Gay "marriage."

'Taxmageddon' isn't only about the half-trillion-dollar blow to the economy that arrives in 2013 on the end of the Bush-Obama tax rates. Several of the Affordable Care Act's worst tax increases kick in too, such as the new excise tax on medical devices.
The 2.3% levy applies to the sale of everything from cardiac defibrillators to artificial joints to MRI scanners. The device tax is supposed to raise $28.5 billion from 2013 to 2022, and it is especially harmful because it applies to gross sales, not profits. Companies at make-or-break margins could be taxed out of existence, especially in an intensely competitive industry where four of five businesses are start-ups or midsized.
As even the liberal papoose Elizabeth Warren recently put it, the device tax "disproportionately impacts the small companies with the narrowest financial margins and the broadest innovative potential."

Bauer COUNTDOWN TO VICTORY: 161 DAYS TO THE 2012 ELECTIONS Democrat Leader Bolts Over Marriage Jo Ann Nardelli became a Republican last week, and made headlines in the process. Nardelli wasn't just any registered voter switching parties. She was a member of the Pennsylvania Democratic State Committee; president of the Blair County Federation of Democratic Women; vice president of the Pennsylvania State Women's Caucus; and first vice president of the State Federation of Democratic Women. A committed Catholic, Nardelli was always pro-life and hoped to change her party from the inside. But, according to a report in the National Catholic Register, Nardelli realized she was in the wrong party when Joe Biden and Barack Obama publicly embraced same-sex "marriage." After consulting with her priest, she made the decision to join the GOP. Like Ronald Reagan decades before her, Nardelli said, "I didn't leave the Democratic Party. The party left me." Not surprisingly, she has been barraged by phone calls from angry liberals accusing her of betraying her party and being a bigot. From time to time, we include action items in these daily messages. But I don't think Jo Ann Nardelli needs any more phone calls. That said, I hope she gets three more -- from Mitt Romney, John Boehner and Mitch McConnell. Values voters are a key constituency of the Republican Party, and there are more folks out there like Jo Ann Nardelli. They may not agree with the GOP on marginal tax rates, but they know marriage is between a man and a woman. Marriage Matters Our friends at The Weekly Standard observed that last week's debate between Wisconsin Governor Scott Walker (R) and Milwaukee Mayor Tom Barrett (D) was largely uneventful. But Barrett may have doomed his chances in the recall election when he endorsed same-sex "marriage." In 2006, 59% of Wisconsin voters supported a constitutional amendment preserving the meaning of normal marriage. In a campaign almost entirely focused on economic issues, Barrett just highlighted the Democrat Party's extremism and gave values voters a reason to turn out in droves. Bishops Prepare For Civil Disobedience From June 21st to July 4th, Catholic churches across America will take part in the "Fortnight for Freedom," described as "special period of prayer, study ... and public action [to] emphasize both our Christian and American heritage of liberty." Church leaders are taking this extraordinary action in order to draw attention to "concerns over threats to religious freedom." And the bishops are preparing to go beyond prayer and protests. Taking their inspiration from the civil rights movement, Catholic leaders are warning their congregations that civil disobedience may be next. In a bulletin prepared for nationwide distribution next month, church leaders write: "Some unjust laws impose such injustices on individuals and organizations that disobeying the laws may be justified. Every effort must be made to repeal them. When fundamental human goods, such as the right of conscience, are at stake, we may need to witness to the truth by resisting the law and incurring its penalties. ...This is a matter of whether religious people and institutions may be forced by the government to provide [certain medical services] even when it violates our consciences." Obama's Latest Whopper Fearful that this election may well be a referendum on his economic record, Barack Obama wants voters to believe he is a penny pincher. Last week, he told an Iowa audience, "Federal spending since I took office has risen at the slowest pace of any president in almost 60 years." On Fox News, Charles Krauthammer labeled Obama's claim, "the whopper of the year" and "an unbelievable distortion of the truth." To begin with, it is factually inaccurate. As the Associated Press noted, this claim is based on spending from 2010 to 2013. It completely ignores all of the massive spending in 2009, including the $830 billion stimulus bill! And there are other accounting gimmicks too. For example:
"The federal takeover of Fannie Mae and Freddie Mac also makes Obama's record on spending look better than it was. The government spent $96 billion on the Fannie-Freddie takeovers in 2009 but only $40 billion on them in 2010. By the administration's reckoning, the $56 billion difference was a spending cut by Obama." In addition, it is intellectually dishonest. Obama and his party firmly believe that government spending is the key to economic growth. That's why Obama, Reid and Pelosi rammed through the massive stimulus bill. That's why Obama constantly demands tax increases -- so he can spend more of your hard-earned money. That's why Obama and his socialist allies in Congress constantly fight GOP efforts to cut spending. Like so many other issues, Obama is out of touch with mainstream American values when it comes to spending. A recent Gallup poll found that 46% of Americans consider themselves "economic conservatives," while just 20% say they are "economic liberals." But Obama knows that identifying with the "tax and spend" crowd didn't work well for Jimmy Carter, Walter Mondale or Michael Dukakis. So he's trying to convince voters that he is a fiscal conservative. Don't let your friends and family members fall for it! Dishonoring Our Heroes Chances are you have probably never heard of MSNBC host Chris Hayes. But he got his 15 minutes of fame this Memorial Day weekend for expressing his discomfort at referring our fallen soldiers as "heroes." Here's what he said: "Why do I feel so uncomfortable about the word 'hero'? I feel uncomfortable about the word hero because it seems to me that it is so rhetorically proximate to justifications for more war. ...But it seems to me that we marshal this word in a way that is problematic. But maybe I'm wrong about that." Yes, Mr. Hayes, you are wrong about that, and a whole lot more. As one conservative blogger wrote: "This is a man who over and over again has spoken with greater reverence about the 'Occupy Movement' than he did today about our fallen service members." Hayes is a perfect example of the warped worldview that has infected the left from MoveOn.org to Code Pink, MSNBC and the DNC. It helps to explain why Mitt Romney has 24-point lead over Barack Obama among veterans. How meritorious are the Catholic lawsuits? Part Two

Several of us, Scott in particular, have written about the lawsuits filed by dozens of Catholic organizations, in 12 different actions, challenging Department of Health and Human Services regulations implemented under Obamacare that would require most health insurance plans to include in the preventive services they cover all FDA-approved forms of contraception, including contraceptives that sometimes operate as abortifacients. The lawsuit alleges that the regulations violate both the First Amendment and the federal Religious Freedom Restoration Act (RFRA).
Earlier this year, Ed Whelan wrote an excellent analysis demonstrating that the HHS regulations clearly violate the RFRA. I recommend reading Ed's piece in its entirety, in conjunction with Michael McConnell's analysis of the same issue. However, I will summarize briefly what Ed wrote.
The RFRA provides that the federal government may substantially burden a person's exercise of religion only if it demonstrates that application of the burden to the person-
(1) is in furtherance of a compelling governmental interest; and (2) is the least restrictive means of furthering that compelling governmental interest.
Accordingly, there are four questions involved in determining whether the HHS mandate violates RFRA:
1. Does a person engage in an "exercise of religion" when he, for religious reasons, refuses to provide health insurance that covers contraceptives and abortifacients? 2. Does the HHS mandate "substantially burden" such exercise of religion? 3. Does application of the burden to the person further a "compelling governmental interest"? 4. Is application of the burden to the person the "least restrictive means" of furthering a compelling governmental interest?
If the answer to question 1 or question 2 is no, then there is no violation of the RFRA and no reason to reach questions 3 and 4. If the answers to question 1 AND question 2 are yes, then questions 3 and 4 come into play; if the answer to either question 3 or question 4 is no, then the RFRA has been violated.
There can be no doubt as to the answer of the first question - plainly it is yes. Ed also demonstrates that the HHS mandate substantially burdens the exercise of religion, under the standards established by the Supreme Court. As he puts it:
The HHS mandate forces Catholic employers to choose between following the precepts of their religion and incurring huge fines, on the one hand, and abandoning one of the precepts of their religion in order to stay in business, on the other hand. Government imposition of such a choice puts the same kind of burden upon the free exercise of religion as would a fine imposed against Catholics for their opposition to contraceptives and abortifacients.
In light of these answers to the first two questions, the HHS mandate violates RFRA unless the burden imposed further a compelling governmental interest AND application of the burden is the least restrictive means of furthering that interest. The interest furthered by the HHS mandate is a marginal increase in access to contraceptives.
That interest does not seem compelling, particularly since the mandate exempts some plans - those that are grandfathered and those of employers of fewer than 50 people - from its requirements. These plans are exempt even if offered by secular employees with no religious objection to the substance of the mandate. And, as Prof. McConnell says, they exempt millions of people.
In any event, Ed shows that there are less restrictive means of furthering the government's interest in providing employees of religious institutions with access to contraceptives. Secretary Sibelius has said that "contraceptive services are available at sites such as community health centers, public clinics, and hospitals with income-based support." Pharmacies and doctors also provide them. The mandate requires employers to subsidize the use of these providers.
A less restrictive alternative would be for the government to compensate the provider outside of any policies provided by the religious employer (note: this is not the so-called compromise President Obama offered, under which contraceptives would still be part of the employer's plan). This alternative would restrict religious liberty less than the HHS mandate because the employer would not be required to sponsor an insurance plan that subsidizes services to which it has religious objections.
Given the existence of this alternative, the HHS mandate violates the RFRA.

Private Equity vs. Public Equity: the White House Tries to Explain

Earlier today, White House press secretary Jay Carney was asked about Solyndra. He responded that the government made a number of "green energy" investments; some of the companies failed, but most haven't (not yet, anyway). So an alert reporter asked Carney how that is any different from Mitt Romney's Bain Capital experience, which has been so bitterly attacked by Barack Obama. As Romney has often said, Bain made many investments, frequently in troubled companies; most succeeded, but some failed. Carney's deer-in-the-headlights response is entertaining:
Actually, of course, Bain's record was far better than the Obama administration's. There is a good lesson here: Bain's record was better because it decided to invest based on the numbers, not based on favoritism and political influence.

Obama Administration Stonewalling Corruption Investigation

Green energy seems to be the topic of the day. Those who have been following the story know that the real issue is cronyism-the Obama administration's practice of rewarding its donors and political allies with taxpayer money. Of course, the line between cronyism and outright corruption is a fine one, at best. Accordingly, Jeff Sessions, ranking Republican on the Senate Budget Committee, and Darrell Issa, Chairman of the House Committee on Oversight and Government Reform, have been looking into the procedures followed by the Department of the Interior and the Department of Energy in approving taxpayer loans and guarantees to "green energy" companies. A Budget Committee aide gave us this background:
On November 21, 2011, and again on February 17th, 2012, Budget Committee Ranking Member Jeff Sessions requested that the Department of the Interior (DOI) produce documents and communications related to seven energy projects approved by Secretary Salazar under a new "fast-tracking" process. These seven projects all received Section 1705 (stimulus) loan guarantees from the Department of Energy (DOE), and several also received 1603 grants from the Department of Treasury. To date, DOI has failed to comply with Sessions' oversight request.
The new "fast-tracking" process created by Secretary Salazar for renewable energy projects creates a two-tiered system for approving projects on federal lands-with politically favored, and often connected, renewable energy plans receiving less rigorous review than traditional energy projects. Environmental and regulatory reviews can take as long as 14-16 years for oil and gas leases, but many of these favored projects were pushed through in less than a year-and awarded on a no-bid basis. DOI also cut short the public comment period for at least one project (BrightSource), despite significant local opposition.
In addition to the environmental groups like the NRDC and the Sierra Club, unions like SEIU have also joined an umbrella organization (the BlueGreen Alliance) to lobby for federal funding for "green" projects. Collectively, these groups have been involved in hundreds of lawsuits with the federal government over stopping fossil energy projects. Key political appointees at the DOI are former employees of the NRDC and other environmental groups.
Like the Department of Energy, DOI did not adequately vet the financial health of several of these favored companies. The failures of Solyndra and Beacon Power are well known, and reports indicate that at least two other companies (Nevada Geothermal and First Solar) may go bankrupt in the near future. But as ABC News reported, a pattern has emerged whereby green energy firms receive taxpayer dollars and then file for bankruptcy-"but not before the firms doled out six-figure bonuses and payouts to top executives."
The connections between executives involved in the green energy companies under investigation and the Obama administration and, more broadly, the Democratic Party are eye-opening:
The companies behind these projects have extensive political connections to the Administration and senior members of Congress.
* Commerce Secretary John Bryson - Prior to becoming Commerce Secretary, Mr. Bryson was CEO of Edison International, a company that secured exclusive purchase rights for four solar projects in California. He also served on the boards of BrightSource and KKR, two companies that owned or invested heavily in similar projects. Sec. Bryson cofounded the Natural Resources Defense Council (NRDC), the lead environmental group that secretly negotiated many of the agreements to secure federal funding. (Mr. Bryson was succeeded in his role as chairman of BrightSource's board by Richard Kelly, a former donor to Sec. Salazar.)
* John Woolard, CEO of BrightSource Energy - Mr. Woolard had 10 meetings at the White House, and donated almost $22,000 to Democrats from 2008 to 2012 (including $2,000 to President Obama, $4,000 to Majority Leader Reid, and $4,000 to the DCCC). He held a fundraiser for Sen. Reid in 2010 at the BrightSource headquarters.
* Michael Ahearn, founder and CEO of First Solar - Mr. Ahearn and his wife have donated over $120,000 to Democrats since 2008. He sold $69 million in shares in August, when his company's project was approved. Stock has since fallen by over 50 percent.
* Steve Black, Counselor to Sec. Salazar - Mr. Black and his Special Assistant, Janea Scott, repeatedly contacting career staff in the field with concerns about the slowness or delays in approving the projects-an unheard of practice in the area of oil and gas leases.
* Kathleen (Kathy) Weiss, lead lobbyist / VP for First Solar - Ms. Weiss had 16 meetings at the White House with Valerie Jarrett and other senior Administration staffers. In 2008, she donated $2,300 to then-Sen. Salazar and $2,000 to Senator Reid.
The Obama administration is stonewalling Congress's efforts to get information about the communications that led to the green energy loans and loan guarantees that have now developed into a scandal. Thus, earlier today Sessions and Issa wrote to Ken Salazar, Secretary of the Interior, to request once again the relevant documents relating to the transactions in question. In conjunction with that letter, they released this statement:
Last November, a request was made of the Department of the Interior for information and answers about its role in the Department of Energy's green energy loan guarantee program, as well as favorable loans and federal land-use deals provided to certain corporations. These lucrative deals were provided to well-connected firms on a much faster timeline and with fewer restrictions, including environmental, than those applied to traditional energy products that often provide a better value for taxpayers.
It is suggestive and troubling that more than half a year has passed without DOI providing the requested documents and information. Our concern is heightened given the serious nature of the questions raised and the government's pattern of indiscretion in providing government assistance to politically connected green energy companies such as Solyndra.
The information currently accessible to the public raises the question of whether these companies received approval to use federal lands and taxpayer monies based not on the best value for the American people but the political clout of the recipients. Given the taxpayer dollars at risk, at a time of fiscal crisis, Interior's failure to provide answers is unacceptable. These questions warrant an expeditious and thorough response, and we intend to ensure we receive one.
Until now, the Obama administration has generally been regarded as incompetent rather than scandal-ridden. That stereotype may be too generous. The administration is incompetent, yes; but it has become increasingly clear that some of what has been chalked up to ineptitude is really corruption.

This new Romney ad is absolutely sensational. Titled "Not Even Half," it reviews the Obama administration's failed "green energy" giveaways. It is beautifully produced, but what I like about it is that it highlights not just the waste but the cronyism of the Obama administration. That is the real key to the "green energy" issue. Cronyism hurts legitimate businesses and damages our economy even-maybe especially-when the companies that benefit from government favoritism don't go broke. Here it is:

The Green Energy Bubble Is Bursting Fast Everywhere

So the tech bubble burst a decade ago, and the housing bubble five years ago. The higher education bubble is swelling to the bursting point, but it is the green energy bubble that is bursting loudest at the moment, and as usual environmentalists are slow to see that they're about to get run over by a revival of the hydrocarbon economy. Those old dinosaurs may have been big lumbering animals, but the nimble fossil fuels they threw off are crushing the so-called green "fuels of the future" beloved of fruit-juice drinkers and vegans everywhere.
Item: In an extremely curious New York Times story last week, Times environmental writer John Broder notes that President Obama pushed hard for the final approval of Shell Oil's long sought permit to begin drilling in a new offshore oil field in Alaska, which has been held up for years by bureaucratic red tape and environmental lawsuits:
The president's preoccupation with the Arctic proposal, even as the nation was still reeling from the BP spill, was the first hint that Shell's audacious plan to drill in waters previously considered untouchable had gone from improbable to inevitable.
Yes, Obama played to the cheap green seats by delaying the Keystone pipeline, but the Alaska decision shows where the real action is. As the Times story continues:
And now, the president is writing a new chapter in the nation's unfolding energy transformation, in this case to the benefit of fossil fuel producers.
"We never would have expected a Democratic president - let alone one seeking to be 'transformative' - to open up the Arctic Ocean for drilling," said Michael Brune, executive director of the Sierra Club.
Well get used to it Michael. It's what happens when you make yourself a wholly-owned subsidiary of one political party. If you go further into the story, the irony emerges that the key to breaking the bureaucratic logjam to approve the permit was a Democratic president and a Democratic senator from Alaska (Mark Begich) who would like to be re-elected:
The intensity of Shell's campaign was matched by the fervor of Mark Begich, the new senator from Alaska. He had won his seat in something of a fluke, defeating the longtime Republican incumbent, Ted Stevens, who was ensnared in what later turned out to be a deeply flawed Justice Department corruption investigation.
No politician in Alaska can survive as an opponent of any oil development, including those in the waters of the Arctic, the National Petroleum Reserve and the Arctic National Wildlife Refuge. Mr. Begich enthusiastically supported all three.
When he first met Mr. Obama at a mayors' conference in June 2008, Mr. Begich said, he told him, "If I'm elected, this is what I'm going to focus on."
Being a crucial Democratic vote in a narrowly divided Senate representing a decidedly Republican state gave Mr. Begich leverage. Whenever the president called to court his support - on health care, climate change, the debt ceiling or budget matters - Mr. Begich always turned the discussion to oil and gas in Alaska, particularly Arctic exploration.
"Any time he initiated a call, I felt that was carte blanche to make my case," Mr. Begich said. A chronology of his contact with the Obama administration on Arctic oil issues fills six pages.
He came to believe that his re-election hinged on delivering a reluctant president on oil issues, particularly drilling on the Outer Continental Shelf in the Arctic.
A Begich aide said that the unstated premise of every conversation with the president was, "You need me, and I need the O.C.S."
Item: Meanwhile, on the other side of the ledger, Obama has grown very quiet about climate change. He can spot a political loser from a Chicago mile away. He's not attending the UN's 20th anniversary of the Earth Summit that started the whole climate diplomacy circus. Twenty years ago the greens browbeat President Bush to attend, which he ultimately did. But the craven greens seem to be giving Obama a pass. As Roll Call reports:
President Barack Obama's first Earth Day proclamation in 2009 was an urgent call to address global warming. This year? The word "climate" didn't even get a mention. . .
Gone are the urgent statements warning of melting glaciers and rising sea levels. Indeed, the energy and environment page at WhiteHouse.gov now shows a photo of the president walking in front of segments of oil pipeline, and the White House never neglects an opportunity to tout its support for domestic oil and natural gas drilling. In briefings on background, senior administration officials now talk about exporting fracking technology, which has caused natural gas production to boom and prices to fall.
This Washington Post headline tells why the enviros are about to get run over:

From Canada to Colombia to Brazil, oil and gas production in the Western Hemisphere is booming, with the United States emerging less dependent on supplies from an unstable Middle East. Central to the new energy equation is the United States itself, which has ramped up production and is now churning out 1.7 million more barrels of oil and liquid fuel per day than in 2005. . .
"We have a revolution here," said Larry Goldstein, director of the Energy Policy Research Foundation in New York. "In 47 years in this business, I've never seen anything like this. This is the equivalent of a Category 5 hurricane."
Item: It's not just here that the left-leaning party is jumping in front of the fossil fuel parade. It's happening in Germany, too, where the pledge to phase out nuclear power is looking increasingly unrealistic and where renewable energy subsidies are being cut sharply. That's not enough: some leading Social Democrats have called for building . . . more coal-fired power plants (gasp)!
The SPD politician [North Rhine-Westphalia's Prime Minister Hannelore Kraft] pleaded for the construction of new coal-fired power plants. "We will continue to need fossil fuel plants as a bridge technology," she said. After all, the Social Democrats had strengthened their vote in the recent state election because of the SPD's very aggressively support for industry.
And the Berliner Morgenpost reports:
The German government no longer believes in the green energy transition. Doubts are growing in the ruling coalition government that the ecological project can succeed.
Have a nice day, green weenies. Your party is over. Deal with it.
(And yes, it's almost enough to award a Green Weenie Lifetime Achievement Award. But I'll resist the temptation.)

The Tyranny of Conservative Clichés
Everyone has an ideology-a set of bedrock principles through which to view the world. Jonah Goldberg is cool with that. But he has a problem with people-mainly liberals-who deny having an ideology. In his latest book, The Tyranny of Clichés: How Liberals Cheat in the War of Ideas, Goldberg argues that liberals hide their ideology behind tired aphorisms, such as "violence never solved anything" or the Constitution is a "living document." Unlike liberals, conservatives admit to having an ideology (although we prefer the term philosophy). We are also comfortable enough with our intellectual history that we don't shy away from arguments, invoking authorities from the Bible and Publius to Hayek and Reagan. Nevertheless, conservatives use clichés, as everyone does. Here are some we should avoid: "America is a Christian Nation." It's tempting unleash this cliché when confronted with the Left's hostility towards religion. But, fellow conservatives, resist. Yes, Christian morals and many biblical principles influenced the American Founders, and yes Christianity has thrived in America. But America is not a Christian Nation in the strict sense of the term: Christianity isn't the official religion to the exclusion of all others, nor is it the basis for membership in the political community. The better way to defend Christianity's place in the public square is by arguing for religious liberty. The Founders all agreed that practitioners of every faith have a right to the free exercise of their religion-in their houses of worship and in the public square. They enshrined that right in the First Amendment. Why use an inaccurate cliché when you have the original meaning of the First Amendment on your side? "States' Rights" Yes, the Federal Government is out of control. But, sometimes we utter two little words that undermine our entire constitutional system rather than protecting it from unlimited government: states' rights. States don't have rights. People do. Nowhere in the Declaration of Independence or the Constitution are states or any other government-federal, state, or local-said to possess rights. Rather, states have powers. The much beloved, if often ignored, Tenth Amendment says "the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Not only is it incorrect to speak of states' rights, but the expression was the rallying cry of segregationists. Since no right-thinking conservative abides such arguments, let's just drop the term "states' rights" once and for all. If you're concerned about federal encroachments on state sovereignty or the erosion of federalism-as you should be-then speak of federal encroachments on state sovereignty or the erosion of federalism. Or, of the need to restore limited constitutional government, reinvigorate local self-government, decentralize power, and check the growth of out-of-control government. With so many great formulations to choose from, why weaken the case for liberty by relying on "states' rights"? "That's Socialism" American conservatives needlessly undermine their arguments by labeling every liberal program or policy as "socialism." This claim is incorrect-American liberals are generally progressives, not socialists. Socialism, strictly speaking, involves the government's ownership of the means of production in a society. In a socialist economy, there are no private corporations that manufacture goods. Factories and companies belong to the state. By contrast, progressives are more insidious in allowing for markets and private ownership of corporations, while controlling them through extensive regulation and government spending. Conservatives need not rely on the S word to argue against liberals-there's plenty wrong with progressivism. Better yet, demonstrate what's wrong in principle and in practice with a particular liberal program instead of relying on a debatable label. "Small Government" We conservatives are against "big government," so we must be for "small government," right? Wrong. We're for limited government. Here is the difference. The Constitution creates a federal government of enumerated (read: limited) powers. When Congress acts within its legitimate scope-for instance, national defense-then it can do a lot. There is nothing inherently contradictory about a limited government conservative supporting strong national defense, because that is within the federal government's constitutional responsibility. On the other hand, for areas outside of the federal government's constitutional scope (Obamacare, anyone?), there is no role-big, small, or medium. Conservatives use clichés, but not because we shy away from arguments or deny having an ideology. Clichés can be true statements summarizing a longer argument: "there's no such thing as a free lunch" demonstrates that everything has a cost that someone must shoulder. Or clichés can be incorrect arguments masquerading as obvious statements. It's the latter that conservatives should eradicate from our language.
