Obama's Second Term Transformation Plans

The 2012 election has often been described as the most pivotal since 1860. This statement is not hyperbole. If Barack Obama is re-elected the United States will never be the same, nor will it be able to re-capture its once lofty status as the most dominant nation in the history of mankind.
The overwhelming majority of Americans do not understand that Obama's first term was dedicated to putting in place executive power to enable him and the administration to fulfill the campaign promise of "transforming America" in his second term regardless of which political party controls Congress. That is why his re-election team is virtually ignoring the plight of incumbent or prospective Democratic Party office holders.
The most significant accomplishment of Obama's first term is to make Congress irrelevant. Under the myopic and blindly loyal leadership of Harry Reid and Nancy Pelosi, the Democrats have succeeded in creating an imperial and, in a second term, a potential dictatorial presidency.
During the first two years of the Obama administration when the Democrats overwhelming controlled both Houses of Congress and the media was in an Obama worshipping stupor, a myriad of laws were passed and actions taken which transferred virtually unlimited power to the executive branch.
The birth of multi-thousand page laws was not an aberration. This tactic was adopted so the bureaucracy controlled by Obama appointees would have sole discretion in interpreting vaguely written laws and enforcing thousands of pages of regulations they and not Congress would subsequently write.
For example, in the 2,700 pages of ObamaCare there are more than 2,500 references to the Secretary of Health and Human Services. There are more than 700 instances when he or she is instructed that they "shall" do something and more than 200 times when they "may" take at their sole discretion some form of regulatory action. On 139 occasions, the law mentions that the "Secretary determines." In essence one person, appointed by and reporting to the president, will be in charge of the health care of 310 million Americans once ObamaCare is fully operational in 2014.

"Fitzpatrick Promotes Veterans Job Fair"
I held a press conference on Friday with Bensalem Mayor Joe DiGirolamo, Dan Bates of the Lower Bucks County Chamber of Commerce, and Col. Larry Rubini to discuss joint efforts in promoting employment opportunities for veterans.
In March, the Bureau of Labor Statistics reported that among veterans who have served in the post-9/11 era, the unemployment rate is 12%, higher than the national average.
Among young male veterans aged 18-24, the unemployment rate is 29% -- nearly one third are unemployed.
With the President's announcement on Tuesday night that all of our young men and women will be home from Afghanistan within the next two years, we as a community and as a country must begin working now to ensure that we are providing our returning service men and women with job opportunities as they seek to re-integrate into civilian life.
As your representative in the United States Congress, I have introduced legislation, called the Fairness to Veterans Act, to provide veterans with the same preference given to woman and minority-owned businesses when bidding on federal projects, as well as state projects that use federal dollars.
I have also supported legislation called the Veterans Opportunity to Work Act which creates and improves upon programs that provide employment and training services to veterans separating from active duty.
These legislative efforts are important, and I have made it a top priority of mine to see them passed in Congress and signed into law by the President so that we can begin providing real opportunities for these men and women to whom we owe so much.
In addition to my work at the federal level, much is being done here in the 8th District at a local level. On Saturday, May 19th, Bensalem Township will be co-hosting a Veterans Job Fair with Bucks County and local employers. I want to thank Dan and the Mayor for joining me this morning to share the ways in which we are all working to promote employment opportunities for our returning veterans.
Meeting with Constituents Across the 8th District
For the House of Representatives, last week was a District Work Week. During these periods, I spend the week back home in the 8th District meeting with local non-profit groups, small businesses, and constituents at Town Hall Meetings. The most important part of my job is meeting with you, your friends, and your neighbors to listen to your advice, criticisms, questions and concerns in order to better represent you in our nation's capital. I have worked tirelessly over the course of the last year and a half to be accessible to you and to constituents across the 8th District, and I look forward to continuing to meet with you to discuss the important issues facing our nation.
On Monday night, I was joined by members of the New Hope Chamber of Commerce at a Town Hall Meeting at American Legion Post #79 to take their questions on the hot topics of the day. Questions on the economy, healthcare, and tax reform dominated the two-hour discussion with these local small business owners.
On Wednesday afternoon, I met with a group of senior citizens at the Indian Valley Public Library in Telford. During our time together, we had a chance to discuss issues of national security, the economy, healthcare, and the long-term effects of our ballooning national debt and deficits.

Last Tuesday, I announced my effort to visit 100 Businesses in 100 Days because I truly believe that the next three months may be one of the most critical stretches of time to get our economy moving again. Much of the uncertainty plaguing business owners across the district and the nation will come to a head.
With the coming travel and vacation seasons, fuel prices are expected to rise through Memorial Day and the summer as this Administration has failed to present a comprehensive energy plan. In June, the Supreme Court will determine the constitutionality of this Administration's misguided Obamacare legislation. By August, the Senate will have gone nearly 3 and a half years without passing a budget. Federal tax policy remains complicated and uncertain. All of these factors create an unpredictable lending and consumer spending environment which only makes it more difficult for businesses to grow and hire new workers.
I look forward to meeting with business owners and their employees to learn more about how they have risen to the challenge to sustain jobs, what I can do to get government out of their way, and, how we can work together to address the pending "Summer of Uncertainty."

In response to these requests, this past year, for the first time ever, Hillsdale College offered the "Introduction to the Constitution" lecture series at no charge. Frankly, I wasn't sure what sort of a response a course like this would have.
That's why I was excited to see that YOU and almost 200,000 other people from all over the United States registered for "Introduction to the Constitution."

I was thrilled, not only by the response, but at what it indicates: Americans are willing and eager learn about the Constitution and to defend the principles of liberty that made America so prosperous!

It is my honor to teach the first class, "The American Mind," and the final class, "The Recovery of the Constitution." All of the classes will be taught by Hillsdale College professors - the top teachers in their field and the same ones who instruct our students here on Hillsdale's campus.

Chris Christie's Obamacare Acquiescence

New Jersey is on the cusp of taking its biggest leap towards planting the roots of Obamacare in the Garden State. Last March, the state Legislature passed a bill that would establish the law's bureaucratic health care exchanges and now time is running out to stop it. If Gov. Christie does not veto the New Jersey Health Exchange Act by May 10, Obamacare will become entrenched in New Jersey as state law.
Since taking office in January of 2010, Governor Chris Christie has established a persona as a no-nonsense, straight talker, confronting liberal reporters, smacking down government union workers or openly engaging in wars of words with Democratic legislators. The bluster and bravado has made the governor a YouTube sensation and the right's version of Barack Obama, a celebrity-style political "rock star". Unfortunately, the governor tends to offer far more sizzle than steak and his credentials as a movement conservative are few.
Many conservatives in New Jersey have become jaded by the governor's ambivalence towards a number of the issues dearest to them, most particularly with respect to the government takeover of our health care. In contrast to the governor's very well-crafted image, his positions on Obamacare have been anything but fervent. Rather, they have been non-committal and laced with excuses and double-talk; nothing that could remotely be described as a principled stance against this extraordinary federal overreach and gross infringement on our liberties. To date, Gov. Christie has done nothing to stop the implementation of Obamacare in New Jersey. In fact, he has facilitated it at every turn.

Last week I had the opportunity to get a sneak-peek at the RNC's new Facebook application. Designed, in the words of one RNC staffer to "take our message where the people are," the Social Victory Center app will, among other things, hook users up with campaign news targeted based on their location and preferences (which Facebook already knows, of course), let users join volunteer efforts, distribute voter registration forms, and provide an online phone bank, all without leaving the Facebook website. It will also, if users wish, put those activities on the user's Facebook wall, letting their friends see what they're up to and, hopefully, encouraging them to join in.
It's an attempt to leverage Facebook's popularity in a new way and, at the moment, the Democrats have nothing like it. The Social Victory Center was unveiled to the public yesterday, so if you're on Facebook, check it out. As the general election ramps up, check back for volunteer activities as they're added. Also, like I did in 2008, I'll be pushing online phone banking in the final weeks of the election, only this time the RNC will have done the heavy-lifting that the McCain team wasn't too keen on. 1. A Terrible, No Good, Awful Night for Barack Obama
One initial point to ponder: if the No-H8 campaign tries to fire up in North Carolina as the No-A1 campaign, people will wonder why they are campaigning against steak sauce. Probably won't happen. North Carolina did not pass a ban on gay marriage as the media reports. Rather they refused to allow their definition of marriage to be changed. The marriage definition was put into law years ago, but with an onslaught of judicial activists, the voters in North Carolina decided to shut down any further consideration of the issue.
The most fascinating bit of it all is that time and time again gay marriage polls quite well in the United States. Time and time again, gay marriage proponents go down to defeat at the actual polls. Said one gay marriage proponent on Twitter last night to me, "It will be a happy day when all hate filled Xians are dead." Xians is "Christians" in Twitter speak. At first I thought it was a Xenu or Thetans reference.
This was a bad night for Barack Obama. Whoever decided to put the Democratic National Convention in North Carolina should be given a lollipop by the GOP for the intense level of comedic schadenfreude we can all now watch. The Democrats will convene in a proudly right to work state whose state Democratic Party is imploding due to a gay sexual harassment scandal, the state itself just voted for marriage by a margin few statewide candidates in North Carolina get, and twenty percent of Democrats voted against Barack Obama in the North Carolina Democratic Primary.
On the bright side, North Carolina is not West Virginia where a felon in federal prison in Texas locked up 40% of the vote in the Democratic Primary against Barack Obama. The Chain Gang looks to be as popular as the Change Gang.
2. Elizabeth Warren's ancestor traced back to Trail of Tears! ...On the side holding the guns. Yeah, when's that primary in Massachusetts, again? Because the general election is going to be a trip. 3. Victory in NC and IN, But There's More to Do In North Carolina CD-8, the Cantor/establishment candidate, Richard Hudson, only won 32% against Scott Keadle's 22%. There will be a runoff. Keep in mind that the other lesser candidates in the race, who garnered 45% of the vote in total, enjoyed a lot of Tea Party support. Many of their supporters should go to Keadle. However, he needs our help. Keadle will stand with the most conservative members of Congress and lead a coalition to challenge leadership when necessary. This is a guy who is worth as much support as a Senate candidate. 4. Chilean Study Proves that Outlawing Abortion Does Not Lead to "Coat-hanger Deaths" For decades, supporters of abortion on demand have insisted on two completely unproven assertions concerning what would happen if abortion were made generally illegal in this country. First, they have asserted, somewhat counter-intuitively and again without any proof, that such a law would not work, and women would continue to get abortions. Second, based on the first unfounded assertion, they insist that therefore women would be forced into "back alley abortions" which would presumably always be performed with a dirty coat-hanger, thus leading to massive maternal mortality. These two pronouncements have been peddled uncritically with all the fervor (and factual backing) of a particularly obnoxious street corner preacher wearing a "THE END IS NEAR" sandwich sign by virtually everyone who supports abortion on demand. Now, for the first time, a scientific study published in a peer-review journal has scientifically disproven both assertions.

Bolton: Obama talks with Hamas 'almost inevitable.' President will act differently 'once any fear of political consequence is removed.'
U.S. talks with Hamas are "almost inevitable" if President Obama is re-elected, John Bolton, former U.S. ambassador to the United Nations, declared in a radio interview today.
"I think that's almost inevitable," Bolton told Aaron Klein on his WABC Radio show in response to a question about whether the former diplomat thinks the U.S. will engage Hamas during a second Obama term.

Busted! Jihadist jailed for Aaron Klein interview. Bin Laden boasts landed terrorist in hot water.
The leader of the group that represents al-Qaida ideology in the Gaza Strip spent two days in jail last year for an interview with WND's Aaron Klein in which the jihadist warned of "big revenge" against the U.S. and Israel for the killing of Osama bin Laden, it has been disclosed.
Immediately following bin Laden's killing, Abu Saqer, leader of Jihadiya Salafiya, said in a WND interview with Klein that al-Qaida groups worldwide "made a connection" to initiate what he called "big revenge."
The interview apparently embarrassed Gaza's Hamas leadership, prompting Saqer's arrest.

For the last twenty years Israel has been swept into an obsession with few parallels except to the Dutch Tulip economy. Except instead of tulips, its commodity of choice is an even more insubstantial thing, the faint promise of peace. Peace fever is the disease consuming Israel as surely as the Black Death took Europe. If the Dutch traded fortunes for flowers, the Israelis have traded away most of their territory for worthless pieces of paper that last about as long as tulips do. Mostly, like Madoff's investments, after they wither and die it turns out that they were never worth anything to begin with. Take the Camp David Accords, greeted with insane romantic fervor in Jerusalem and European capitals, but resented and despised by Egyptians because they were a reminder of how their army had failed to destroy Israel. It was a worthless accord that gave Egypt a vast amount of territory in exchange for maintaining a status quo that it had no choice but to maintain after losing multiple wars. With the fall of Mubarak, it was revealed that the Accords were never more than moonbeams and fairy dust. A puff of Arab Spring and they are gone. Camp David was an illusion, but the Oslo Accords are a delusion. A tulip economy where Israel doles out fortunes in money, land and power in exchange for the promise of peace and an end to the violence... tomorrow, always tomorrow. The most devastating impact of the delusion isn't on the cemeteries where children lie side by side with soldiers, on the broken homes and synagogues of Gaza, or on the tightening circle of terror around Jerusalem. As with all delusions, its most devastating impact is on the mind. The conflict has formed into two camps. The Muslims are pro-Palestine. The Jews are pro-Peace, which means they are both pro-Palestine and pro-Israel. They are for Israel and for the terrorists trying to destroy Israel. What does being pro-Peace actually mean? It means believing above all else that peace is possible and that it will come riding in on a white donkey in our time, if we just want it badly enough. The last twenty years have been hard on the illusion of peace. As the violence goes on year after year, it has become necessary to assign blame somewhere. There are the Dershowitzes who say that Israel wants peace; but that it lacks an amenable peace partner. There are the Friedmans who say that both sides lack leaders who want peace. Then there are the Beinarts who blame Israel for not seizing the opportunity to make peace.

Greene, a Democratic Party operative who was the national director of Project Vote, a group with close ties to the corrupt ACORN organization, has not offered a public apology. There is no indication that her financial relationship with Fox News has suffered as a result of the racial outburst.

There is some interesting calls here by what appears to be, less religious Muslims to their more devout brethren begging them to stop throwing stones at the police during compulsory Muslim riots after some of them caught a glimpse of Kurt Westergaard's famous 'MoToon'.
Of course, it might really just be a difference in tactics and strategy. The Salafists enjoy using blunt force and traditional Islamic diplomacy such as throwing rocks and other heavy objects prepared in advance for such occasions.

Egypt Islamist vows global caliphate in Jerusalem

Egypt's Islamists aim to install a global Islamic caliphate with its capital in Jerusalem, a radical Muslim preacher told thousands of Muslim Brotherhood supporters in a clip released Monday.
"We can see how the dream of the Islamic caliphate is being realized, God willing, by Dr. Mohamed Mursi," Safwat Higazi told thousands of Brotherhood supporters at a Cairo soccer stadium as Mursi - the movement's presidential candidate - and other Brotherhood officials nodded in agreement.
"The capital of the caliphate - the capital of the United States of the Arabs - will be Jerusalem, God willing," Higazi said. "Our capital shall not be in Cairo, Mecca or Medina," he said, before leading the crowd in chants of "Millions of martyrs march toward Jerusalem."
Higazi is an unaffiliated Islamist who is barred from the United Kingdom for making statements endorsing terror attacks against Israelis. The clip, from Egypt's Islamist-oriented Al-Nas television station, was aired last week and uploaded to YouTube on Monday by the Middle East Media Research Institute.
Members of the crowd carried banners emblazoned with slogans related to next week's "Nakba Day," when Palestinians and other Arabs mourn Israel's creation in 1948.
"Tomorrow, Mursi will liberate Gaza," an unidentified man cheers in the video before leading the crowd in chants of "Allah Akbar."
"Banish the sleep from the eyes of all Jews," the man repeats, accompanied by drumming. "Come on, you lovers of martyrdom, you are all Hamas... Forget about the whole world, forget about conferences. Brandish your weapons, say your prayers and pray to the Lord."
Returning to the stage, Mursi vowed to pray in Jerusalem. "Yes, Jerusalem is our goal. We shall pray in Jerusalem, or die as martyrs on its threshold."
Raymond Stock, an American translator and academic who spent two decades in Egypt, said the clip should come as a surprise to no one.
"This is what the Muslim Brotherhood really stands for: the extermination of Israel - and Jews everywhere - as well as the spread and control of radical Islam over the world," he told The Jerusalem Post.
"How anyone can fail to see this boggles the mind - yet its denial is virtual dogma in the global mainstream media, US government and Western academia today," said Stock, who has translated a number of books by the Nobel Prize-winning Egyptian novelist Naguib Mahfouz.
The Brotherhood won about half of Egypt's parliamentary seats, but its main candidate Khairat al-Shater was disqualified last month from running for president and Mursi has struggled to win wide support.
Hard-line Salafi Islamists were parliamentary elections' biggest surprise, taking around 25% of seats.
Instead, the two front-runners are Abdel Moneim Abol Fotouh - a former Brotherhood figure who has won the backing of a broad range of voters from liberals to Salafis - and Amr Moussa, a former foreign minister and Arab League chief.
A presidential election, which starts on May 23-24, will choose a replacement for Hosni Mubarak, who was toppled in February last year.
Poll numbers released Monday by the state-run Al-Ahram Center show Moussa leading the field with 39%, followed by Abol Fotouh with 24%, former Mubarak premier Ahmed Shafiq with 17% and Mursi in fourth with just 7%.
Stock said Amr Moussa has a significant chance of replacing Mubarak.
"Many people want Islamist values but are afraid that Islamist control of the presidency in addition to parliament could be bad for tourism and foreign investment. Others simply like Moussa," he said. "He is a radical nationalist with a pragmatic streak, and from a Western point of view is the best we can hope for now that Omar Suleiman has been excluded."
"But we can't rule out Mohamed Mursi yet - the Brotherhood machine is extremely formidable, and nearly everyone has underestimated them before," he said, adding that "the Salafis remain wild cards, as ever."

The group NY ICE (New Yorkers For Immigration Control and Enforcement), took to the streets on May 1st to counter protest the throngs of communists, pro-illegal aliens and other assorted racist and socialists groups marching down the streets of New York City. In 2002 to the surprise of no careful observer, Democrat Georgia Congresswoman Cynthia McKinney was beaten in a primary and rendered unable to run for re-election. McKinney was defeated rather easily (58/42) by Denise Majette a first time candidate. Ordinarily this local primary would have little significance, but the results of a McLaughlin and Associates poll done two weeks before that election day changes that view. The survey found that Majette had a slight lead, but the really startling news was that while McKinney enjoyed over a 90% name recognition rate, just 28% knew who her opponent was. In other words people didn't care who Denise Majette was, if she was breathing and not in prison she was their choice over McKinney.

The results and turnout in tomorrow's Primary Day voting in North Carolina will be an important indication of Barack Obama's chances for holding the Tar Heel State in his column next November.
Aside from the usual array of primary candidates from both Parties voters will be able to cast a ballot for or against Amendment One which will protect traditional marriage by banning same sex "marriage."
Already plagued by a Gay sexual harassment scandal hanging over the head of the outgoing Democrat State Chairman, the decision of its Democrat governor not to run for reelection and the specter of a grossly underfunded Democrat National Convention held in an anti union Right To Work state it doesn't seem that things could get worse for North Carolina's Democrats. But, a resounding victory for the pro marriage Republicans could because it could take North Carolina off the board for Obama's reelection campaign.

Socialism Rises Again
Last weekend, the people of France took a sharp turn to the left, and the rest of Europe may be on the brink of rebuking its recent tack toward fiscal responsibility. With Sunday's election of French Socialist leader Francois Hollande, France has leapt backward toward the policies that have helped sink the continent in a sovereign debt crisis. Disturbingly, the big government platform Hollande campaigned on is all too familiar to the American people, and if the United States is not careful, it could suffer the same fate as its European allies.
Hollande sailed to victory by appealing to an electorate dissatisfied with having to face necessary cutbacks, proclaiming that he is "proud to have been capable of giving people hope again." That brand of hope called for a change from President Nicolas Sarkozy's relatively conservative policies -- in his first term, Sarkozy worked to reduce the number of public sector employees, eliminate the 35-hour work week, reform the university system and cut taxes.
Hollande, by contrast, promised to raise taxes on big corporations and wealthy individuals, implement a top rate tax of 75 percent, increase public spending by 20 billion euros, raise the minimum wage, hire 60,000 more teachers, and lower the retirement age from 62 to 60 for some workers. He says he is "president of the youth of France" and believes that government stimulus, not cutting spending, is the right way to achieve economic growth.
If you've been a student of President Obama's presidency, much of this should sound familiar. President Obama came into office on a promise of hope and change, appealed to young Americans and promised renewed prosperity. His solution was more government spending to the tune of a near-trillion-dollar stimulus, a government-run health care plan, a bailout of government unions, and a call for higher taxes on wealthy Americans and corporations.
The difference between the United States and France is that the latter is much further down the path of a social welfare state. Hollande's proposals are not a new direction, they're merely a return to form. France is notoriously emblematic of the European way of life. As Daniel Hannan, a member of the European Parliament, describes in Why America Must Not Follow Europe, "Long vacations, paternity leave, a higher minimum wage, a short working week: What's not to like? The trouble is that eventually the money runs out."
In France, the money has indeed run out. The country's public debt now stands at more than 80 percent of GDP, government spending is at 55 percent of GDP, the tax burden is equivalent to 42 percent of total domestic income, and it hasn't balanced its budget since 1974.
The United States, unfortunately, is headed in much the same direction. As Heritage's Federal Budget in Pictures shows, U.S. debt stood at 67 percent of GDP in 2011, but unless the United States controls its spending, its debt will surpass that of France, Italy and even Greece, hitting 187 percent of GDP by 2035. Spending on Medicare, Medicaid, the Obamacare subsidies, and Social Security will devour all revenues by 2045, and taxes are soaring past their highest levels ever. And as for the budget, the U.S. Senate hasn't passed one in three years -- let alone brought it to balance.
The world has seen what lies at the end of this road to perdition. Though France is a prime example of a country that is spending itself into crisis, Greece has already gone beyond that tipping point. The country's debt has exploded, 21.8 percent of its people are unemployed, and among the youth, more are out of work than have jobs. In the face of belt-tightening measures that came as a condition of an EU/IMF bailout -- which include public sector pay cuts and pension reductions -- the country turned to open political revolt with violent riots in the streets. In elections this week, Greek voters rejected the political parties that support fiscal responsibility and instead turned toward the Radical Left.
If there is any bright spot in Europe's far left turn, it came Friday in the re-election of Boris Johnson, the Conservative mayor of London. Johnson campaigned for tax cuts and eliminating public sector waste in the hopes of spurring job growth. But alas, France's return to the deeply entrenched socialist policies could signal an end to the fiscally responsible measures that German Chancellor Angela Merkel has championed, leading to economic disaster.
Though Europe is an ocean away, the policies that are sinking the continent could have the same impact in the United States if replicated here. Endless spending has dire consequences, and if America is not careful, it could follow Europe's path to economic ruin.

"Decades of big government policies have now brought several European economies to their knees," The Heritage Foundation's Nile Gardiner argues. "Soaring taxes, spiraling unemployment, mountains of red tape, stifling labour regulations, and ruinous levels of public spending needed to fund vast and unsustainable welfare states and entitlement programs have created a perfect storm of economic malaise."

France's new policies reflect Hollande's belief that government stimulus spending will restore France's economy. But by drastically taxing corporations and job creators, France is removing the incentive for self sufficiency and creating a nation even more dependent on big government programs to provide for their basic needs.

MAY 8, 2012 Members of Congress Work to Rein In Overcriminalization in America
What do a legendary guitar maker and a lobster importer have in common? Both are alleged to have run afoul of the Lacey Act, one of the most egregious, overcriminalized statutes on the books. Now some Members of Congress are working to inject some much-needed fairness into the justice system.
Originally enacted in 1900 as a modest law designed simply to protect states against poachers who fled across state lines, the Lacey Act today makes it a federal crime to import fish, wildlife, or plants in violation of any foreign law adopted in any form by any foreign nation, irrespective of the reasonableness of a person's conduct. No other nation puts its citizens at such risk of imprisonment.
The result, predictably, has been miscarriage of justice. Federal agents raided the Tennessee manufacturing plant of Gibson Guitar for an alleged violation of the Lacey Act due to the import of certain wood from India. Months after the raid, the U.S. government still holds more than $1 million in seized property but has yet to file charges against the company.
Abner Schoenwetter spent over 5 years in prison for "heinous" crimes like importing lobsters into the U.S. that, under a void Honduran law, were too small to be taken and should have been packed in boxes rather than in clear plastic bags.
Now, some members of Congress are looking to change that. On May 8, the House Subcommittee on Fisheries, Wildlife, Oceans, and Insular Affairs of the House Committee on Natural Resources is scheduled to hold a hearing on H.R. 4171, The Freedom from Over-Criminalization and Unjust Seizures Act of 2012 (FOCUS Act), a bill that would eliminate the foreign law provisions and make the Lacey Act enforceable only through civil process.
Tomorrow, on May 9 at 3:30 p.m., Senator Rand Paul (R-KY) and Representative Paul C. Broun (R-GA) will be at Heritage to discuss their companion bills and the impact they would have on federal criminal law. You can join us live or watch online via our free webcast.
Even with the injustices clearly documented and extensive research into the merits of reforming the Lacey Act, the bills from Senator Paul and Representative Broun do not come without opposition. The Federal Law Enforcement Officers Association has opposed the decriminalization of foreign environmental laws for reasons that Heritage's Paul Larkin has argued are unconvincing.
It is high time that Congress begin to recognize the problems of overcriminalization, as Former Attorney General Ed Meese has explained on several occasions. Rather than writing more outrageous criminal laws (such as those concerning the Titanic, for example), Congress should join the discussion and carefully consider what truly should be punishable as a crime.

Meet Julia, Obama's Ideal Woman
Meet Obama's ideal woman. Her name is Julia.
As told by Obama's latest ad campaign, Julia's parents didn't teach her the alphabet or how to make friends; Head Start did. Her parents didn't need to save for college, because she got a government grant and student loans (which she'll spend a good portion of her adult life paying back). Her first job as a graphic designer didn't have benefits, but that's okay, because government provided free health care (since she couldn't stay on her parents' plan). Julia had free birth control-thanks to government. When she decided to have a baby, she had free prenatal care-thanks to government. Her son got the same great education she had-thanks to government. Julia started a small business-thanks to government. She retired with Medicare and Social Security-thanks to...well, you get the picture.
Julia is successful, we are told. She succeeded not because of her loving family, a supportive church, strong local ties, or a free economy that gives her opportunity-but because big government maintains a lavish welfare state.
She is no ideal American woman.
She is not the self-governing woman America has long been known to have. American women were the first to exercise the right to vote in human history (in New Jersey in 1797). Alexis de Tocqueville in Democracy in America praised America for its women. Unlike aristocratic girls from Tocqueville's day, the American girl "thinks for herself [and] speaks freely." Her education arms her with reason. She is a self-governing woman able to identify vice, virtue, and opportunity. She belongs to a family, a church, and private associations.
But not Julia. She needs the helping hands of thousands of bureaucrats to fulfill with expert precision every want in life so that she can retire and putter around the community (organized) garden. There's a bureaucrat to determine the Head Start curriculum, one for primary school, one to approve her college grant, another to determine what health care she gets at every age and stage of life.
President Obama wants to keep it that way. Thanks to his latest campaign, the name Julia now means dependence upon government for education, health care, and meaning in life.
But the name Julia actually means "youthful, energetic." It's a great name that belongs to many self-governing women across America-who put themselves through school, marry, raise children, volunteer at the local church or charity, and run their own businesses (despite miles of red tape). It's the responsibility of every citizen-not just the Julias-to resist the tyranny of the bureaucratic state and ensure that the ideal citizen (man or woman) remains a self-governing one.

 I saw a note slide across the #TCOT feed on Twitter last night that mentioned Michelle Obama had no law license. This struck me as odd, since (a) she went to school to be a lawyer, and (b) she just recently held a position with the University of Chicago Hospitals as legal counsel - and that's a pretty hard job to qualify for without a law license.
But being a licensed professional myself, i knew that every state not only requires licensure, they make it possible to check online the status of any licensed professional. So I did, and here's the results from theARDC Website:

Landmark Lawsuit by US Home Owners Implicates Obama and Big Banks in Massive Global Laundering Scheme

A new lawsuit, which is bordering on the unbelievable, implicates the Obama administration and some of the world's largest banks in the largest international money laundering case in history.
This global money laundering network was allegedly formed during the Obama administration and helped banks rob U.S. home owners through offshore affiliates in infamous tax havens and money laundering hubs like the Cayman Island, Isle of Man, Luxembourg and Malaysia.
A press release published by Marketwatch (a website owned by the Wall Street Journal) via Marketwire on April 23, 2012, by America's Spire Law Group, revealed that a mass tort action on behalf of home owners across the United States has been filed in the Supreme Court of New York, County of Kings.
The release states that the suit implicates every major bank servicer and their subsidiaries, as well as the Obama administration which allegedly was privately ratifying the formation of shell corporations in violation of not only the USA PATRIOT Act, but also State and Federal law as well.
This is all while the administration was very publicly encouraging home owners to modify their loans.

Dear President DeGioia:
It has come to the attention of The Cardinal Newman Society and the following signers that U.S. Department of Health and Human Services Secretary Kathleen Sebelius has been granted the honor of speaking at the commencement [diploma] ceremony for Georgetown University's Public Policy Institute on Friday, May 18. We strongly urge you to withdraw the invitation to Secretary Sebelius immediately.
It is scandalous and outrageous that America's oldest Catholic and Jesuit university has elected to provide this prestigious platform to a publicly "pro-choice" Catholic who is most responsible for the Obama administration's effort to restrict the Constitution's first freedom -- the right to free exercise of religion -- while threatening the survival of many Catholic and other religious colleges and universities, schools, charities, hospitals and other apostolates.
Georgetown insults all Americans by this honor. The selection is especially insulting to faithful Catholics and their bishops, who are engaged in the fight for religious liberty and against abortion. The contrast is stark between Georgetown University and those faithful Catholic colleges and universities that have stood for faith and freedom.

COUNTDOWN TO VICTORY: 182 DAYS TO THE 2012 ELECTIONS
The Real Marriage Crisis
During the last several days the same-sex marriage issue has dominated political debate. Vice President Biden and Education Secretary Arne Duncan voiced their support for same-sex marriage. President Obama says he opposes it but adds that he is "evolving." Most observers believe his endorsement is just a matter of time.
North Carolina is voting today on whether it will keep marriage as one man/one woman, and polls indicate they will become the 31st state to do so. Major media tell us the country is ready for same-sex marriage, but every vote of the people so far has said otherwise.
What is striking to me is the amount of energy, time and money devoted by the political, cultural and media elite of our country on an issue that directly impacts only a small portion of our population. Unless the normal impulse of men and women to "cleave" unto each other has been repealed by modern day liberalism, the number of same-sex couples seems destined to remain a distinct minority.
There is a gigantic marriage problem in America, but it is not the result of a lack of legal rights for homosexuals. America's family crisis is a direct result of fleeing men and fatherless children. Over 40 percent of live births in the United States are to single mothers. In New York City over the last ten years there have been 500,000 out of wedlock births, including around 80,000 to single teenage mothers. Other urban areas have similar figures. These numbers continue at high levels in spite of the widespread availability of contraception and of increasingly explicit sex education courses in our public schools. Kids who have no idea of who the Founding Fathers were or what century the Civil War took place in get great grades when tested on how to correctly put a condom on a banana.
This is a national crisis and we cannot allow the "chattering classes" to brow beat us into embracing same-sex marriage. Our problem is not that men cannot marry men. Our problem is that women and men are not marrying. Our crisis is due to the millions of American children being deprived of what has been the normal family unit for centuries - mothers and fathers loving and raising their children. The "victims" are everywhere. Women whose support comes from government via the taxpayer. Men who are never domesticated by the responsibilities of fatherhood. Schools that don't work. Gangs that keep growing. Decaying inner cities. But rare is the politician who will talk about any of this. They would rather court the "gay vote."
Buffet Breaks With "O" On Pipeline
The "Oracle of Omaha," Warren Buffet, is a close political ally of President Obama's. In fact, Buffet has become the "poster boy" for increasing taxes on capital gains and dividends. He has been so vocal that Obama named his tax increase proposal "The Buffet Rule" and invited Buffet and his secretary to be guests at last January's State of the Union address.
But apparently Buffet's embrace of the Obama agenda only goes so far. In an interview this week on Fox News, Buffet had this to say about the Keystone Pipeline, which Obama has repeatedly refused to authorize building. "I'm not an expert, but it certainly seems like it makes sense to me. There are an awful lot of pipelines running in the United States and net, they've certainly been a huge plus for the country."
Now that sounds like a "Buffet Rule" I could support.

House to Vote on Appropriations Bill this Week!Support Rep. Black's Amendment to De-Fund Obama's Lawsuits Against State Immigration Laws! Rep. Diane Black (R-TN) filed last night an amendment to the House Commerce-Justice-Science Appropriations bill that would prevent the federal government from using taxpayer funds to sue states over their immigration enforcement laws. Specifically, the proposed amendment is based on her previously introduced bill, H.R. 3842, which protects state immigration enforcement laws that the U.S. Department of Justice (DOJ) has either challenged in court or suggested it may challenge. Rep. Black's legislation is the House's companion to S. 1856 introduced by Sens. Jim DeMint (R-SC), Jeff Sessions (R-AL), and David Vitter (R-LA) last fall. The specific state laws protected under Rep. Black's amendment include: Oklahoma HB 1804; Missouri HB 390; Arizona SB 1070; Utah HB 497; Indiana SB 590 and HB 1402; Alabama HB 56; South Carolina S 20; and Georgia HB 87. Call your Representatives today and tell them: - Federal resources should be used to enforce immigration laws - not sue states for passing legislation mirroring federal law; and
- You want U.S. immigration laws enforced - not more of the Administration's backdoor amnesty policies that put illegal aliens before hardworking Americans and legal residents.

Romney Pushes Back on "Julia"

Mitt Romney gave an excellent speech in Lansing, Michigan today. He went after President Obama's record and cast him as a backward-looking, old fashioned liberal:
This wasn't what we expected from President Obama. He promised change and hope, and said that he and we together could do anything. But rhetoric met reality, and reality won. His four years in office have been a disappointment for all of us, and they have been a catastrophe for some of us. In his campaign kickoff speech last week, he asked us not to think about these last four years. Convenient, but not convincing. Ignoring his record would bind us to repeat it. He is asking us, nevertheless, to look only to the years ahead, to consider how much better his policies will make things down the road. But in our hearts we know. As much as we'd like to believe him, we know that America is going in the wrong direction. Not forward, but sideways, or worse. We know that the mounting debt is a problem, not a blessing. We know that failing schools mean failing futures. We know that if more and more good jobs leave America, there won't be enough good jobs to succeed in America.

Roads Taken and Untaken: A Meditation Posted: 08 May 2012 11:50 AM PDT (Steven Hayward) The chart below from our friends at the Heritage Foundation is the kind of visual display of quantitative information (bow here to Edward Tufte) that sets the hearts of wonks fluttering, and the very kind of chart I do fairly often, too. It displays the story of the relentless growth and avariciousness of the Federal government, showing that while median household income, adjusted for inflation, has grown only 24 percent since 1970, federal inflation-adjusted spending grew 287 percent. In other words, federal spending has grown over ten times as much as median household income. 
However, while the underlying point of this chart is correct, I wonder if it isn't misleading in a couple of respects, or in need of additional layers of analysis. What it leaves out is population growth, and more specifically household growth, since one half of the metric here is household income. If the government extracts 20 percent of each person's or each household's income (which is about the historical tax take of total income), and the number of households grow along with income, you would expect total federal spending to grow faster than mere median household income because of that population growth. So, between 1970 and 2010, while total population grew 52 percent, the shrinking size of the average American household means that the total number of households grew 75 percent, and total household income grew by 118 percent. If the federal government merely taxed the higher level of income of the higher number of households at exactly the same tax rate, federal revenues would have also grown about 118 percent, and as such the 287 percent increase in government spending looks less dramatic than when compared only to the 24 percent growth in median household income. Two can play cynical geo-political games Posted: 08 May 2012 08:59 AM PDT (Paul Mirengoff) I wrote here about how the Obama administration undid much of the good work performed by the Clinton and Bush administrations to create a solid partnership between the U.S. and India. Obama tilted away from India and towards Pakistan, which he hoped would become a reliable ally in the struggle against the Taliban. As a symbolic part of this re-ordering, Hillary Clinton skipped India in her initial tour of Asia. In light of the administration's overall stance on South Asia, it was impossible for India to miss the significance of Clinton's gesture. This week, however, Ms. Clinton made a stop in India. Her mission was to persuade the government to sign on to international sanctions against Iran. India relies on Iran for 12 percent of its oil, and so far has been unwilling to go along with the sanctions. Read More . . .
Prisoner releases in Afghanistan and prisioner releases in Iraq - compare and contrast Posted: 08 May 2012 08:24 AM PDT (Paul Mirengoff) In response to news that the Obama adminstration is releasing prisoners who fought against us in Afghanistan, Max Boot presents a thoughtful defense of "tactical" prisoner releases of insurgent fighters. Boot makes the valid point that during the Iraq surge, we released Sunni fighters who vowed to turn against al Qaeda. This policy arguably helped advanced the "Sunni awakening" in Anbar province which, in turn, helped make the Iraq surge a success. Although our releases of Afghan detainees may be loosely modeled on our Iraq policy, there are important differences. The most fundamental is that in Iraq, we were not negotiating with the main enemy, al Qaeda. In Afghanistan, we are negotiating with the main enemy, the Taliban. Read More . . .
The trail to bin Laden Posted: 08 May 2012 05:57 AM PDT (Scott Johnson)
The Journal Editorial Report on Fox News led off with an interview of former Attorney General Michael Mukasey this past weekend. The transcript is here; the video is below. Journal editorial page editor Paul Gigot questioned Judge Mukasey about President Obama's proclamation of the credit he is due for the death of bin Laden, a subject Judge Mukasey had addressed in his excellent Wall Street Journal column. Gigot then turned to the the long trail of intelligence behind the bin Laden operation. This question was originally discussed in the immediate aftermath of the operation by then CIA Director Leon Panetta. Here was Gigot's opening question to Judge Mukasey on this subject along with his pointed answer, based on this April 30 statement by Senators Dianne Feinstein and Carl Levin: GIGOT: OK. Let me talk to you about another issue. There was - that has come up in the news this week, which is the - what happened with the intelligence leading to the bin Laden capture. There's a suggestion by two Democratic Senators, Dianne Feinstein and Carl Levin, that enhanced interrogation techniques, waterboarding and such, did not lead to - did not produce evidence that led to the bin Laden capture. They put it this way, "The CIA learned of the existence of the courier, his true name and location, through means unrelated to the CIA detention and interrogation program." Based on what you knew - learned when you were attorney general, is this correct? MUKASEY: That is a half tru[th] designed to irritate anyone who knows the other half.
Judge Mukasey elaborated as follows: Yes, the CIA knew about the name before it was disclosed by Sheikh Mohammed. However, that information lay unexploited because it came from an insignificant course. When it came from Sheikh Mohammed after he was subjected to harsh interrogation techniques, they followed it up and found this guy was still active. They went back to Sheikh Mohammed, who by then had his wits about him, and asked him again about this guy and he said, oh, he has been out of it for some time. That was a lie. They knew it was a lie. And because he had lied about it, that enhanced even more the significance of the information. So the information did not become significant until they learned about it from him and its significance was increased by the fact that he lied about it. They learned about it after enhanced interrogation techniques.
Here is the rest of the exchange: GIGOT: So based on your experience, you think the enhanced interrogation techniques have absolutely been critical to the progress we have made against Al Qaeda? MUKASEY: There were three people subjected to all - all the fuss is about three people subjected to the most extreme form of interrogation. GIGOT: Khalid Sheikh Mohammed. MUKASEY: Right. GIGOT: Abu Zubaydah. MUKASEY: Abu Zubaydah and Al-Rahim Al-Nashiri, the architect of the Cole attempt. GIGOT: Right. MUKASEY: We got troves of information from all three. We arrested Hambali, Ramzi bin Al Shibh, a whole array, a whole rogues gallery of terrorists who were prepared to carry off attacks. Mike McConnell, the director of - (CROSSTALK) GIGOT: Former national director of intelligence. MUKASEY: Correct. Said that there are people walking around today who would not be walking around today if those techniques had not been used.
As long as we're on the subject, I don't recall President Obama extending any credit to the Bush administration for its role in the policies and practices that led to the discovery of bin Laden's location. Why is that? Let's go to the videotape.

This morning on radio, Glenn shared a truly disturbing story. China, the country so many are looking to as "the future", is using human baby flesh in pill capsules. China's Food and Drug Administration hasn't responded to any of these reports. Just some isolated incidents of not-terror
Glenn tried really, really hard to report on the end of the "War on Terror" - but for some reason he kept being handed "isolated incidents" of terror from around the world. As hard as he tried, he couldn't get the "War on Terror is over" story finished. Bombs, kidnappings, and more just kept popping up and interrupting him. Weird - since we know the War on Terror is over....right?
