'They're Harassing People': Family Misses Flight After TSA Comes to Gate to Rescreen Girl With Palsy

While traveling from New York's John F. Kennedy International Airport to Florida this week, Dina and her parents had to endure two separate screenings from TSA. Why two? Because after the agents had cleared Dina one time, they came back later to her gate and told her that wasn't enough and she was forced to endure it a second time.
"They make our lives completely difficult," her father, Dr. Joshua Frank, who is a pediatrician, told The Daily. "She's not a threat to national security."
The Daily explains the series of events:
With her crutches and orthotics, Dina cannot walk through metal detectors and instead is patted down by security agents. The girl, who is also developmentally disabled, is often frightened by the procedure, her father said. Marcy Frank usually asks the agents to introduce themselves to her daughter, but those on duty on Monday were exceptionally aggressive, Joshua Frank said, and he began to videotape them with his iPhone. "And the woman started screaming at me and cursing me and threatening me," he said.

TSA Pats Down 4-Year-Old Girl and Defends Themselves for Doing It

WICHITA, Kan. (AP/The Blaze) - The grandmother of a 4-year-old girl who became hysterical during a security screening at a Kansas airport says security agents forced her to undergo a pat-down, and even yelled at the child and called her an uncooperative suspect.
The incident has been attracting increasing media and online attention since the child's mother, Michelle Brademeyer of Montana, detailed the ordeal in a public Facebook post last week. The Transportation Security Administration says its agents followed proper screening procedures.
The child's grandmother, Lori Croft, told The Associated Press on Wednesday that mother and daughter initially passed through security at Wichita's airport without incident. But then the child ran to briefly hug Croft, who was awaiting a pat-down after tripping the alarm.
That's when TSA agents insisted the child undergo a physical pat-down.

OCCUPY were just trained to create confrontations at Tea Party events and rallies, nationwide!
In observing the OCCUPY activities over the past year or so, I surmised that their "first wave" was designed to serve as their learning curve, and that their puppet masters would then deploy them to mount "Wave Two", creating new and more vehement outrages, building on their experience.
That's now coming to pass.

Training for OCCUPY members & supporters was conducted around the U.S. this past weekend. We know of this because some Tea Party members infiltrated some training meetings and reported what they've learned
The training was conducted in cities, towns and even smaller communities. Every trainer was equipped with a DVD, handouts and a training manual, and urged to recruit others.
The training included specific instructions to attend Tea Party activities - meetings, rallies and town halls
At such Tea Party events, they were instructed to instigate confrontations and disruption. My source added, '... remember that they are well trained, well funded, extremely well organized and directed. This is no longer the ragtag bunch of fools who are clueless about what they are there for - they are still ragtag but now they have marching orders and each group will have an even better trained leader(s)".
My source also said, "...the OCCUPY movement has gone from semi-organic to fully supported and organized - and as I wrote before (and provided the links to prove this) - they are backed by the Communist and Socialist parties, UAW, SEIU, ACORN, myriad other communist/socialist organizations, Moveon.org, and of course, one of the key money people is George Soros. This collection of 'sponsors' has no good intentions; moreover they are providing tents, food, water, sleeping bags, entertainment, drugs and more. And they have insider's in key roles of leaders to incite and whip these people into a frenzy".
How should Tea Party members handle any "situations"? My suggestions:
1. For your upcoming events, contact your local law enforcement chief well in advance and appraise him or her of your concerns.
2. Share this heads up with your news media - print and broadcast outlets - in advance. Do not wait until stuff happens.
3. Ask your members to have the phone number of the local law enforcement people on their speed dial
4. Ask members to bring a video camera with sound
5..At our weekly sidewalk rallies, I'll call the police first, but if things look bad, I'll instruct my members to leave as soon as something starts. There's no use in engaging in a dispute with them because they will escalate it.
6.If they crash a meeting, call the police. Police have a handy thing in their toolkit called, "Inciting to riot" which aroundhere is good for thirty days in the slammer.
7. One purpose of their disruptions will be to create "news", in which your Tea Party appears in headlines about violence or disturbances. The other purpose is the disruption itself.
8. Be aware that the date May 1st,, May Day, is a traditional big day with lefties of all types, who know it as "International Workers Day". I've seen a separate report that OCCUPY is planning "something big" for that date, but I have no other confirmation about it.

1. A Nobody With No Audience Gets Noticed by Mitch McConnell
Yesterday on Laura Ingraham's radio show, she asked Senate Republican Leader Mitch McConnell about a recent Roll Call article that framed me as one of the loud leaders of conservatives opposed to Mitch McConnell. The Senator from Kentucky responded that he had never heard of me and I did not have an audience.
That sounds a bit like the child, when asked if he ate the cookie, replying that he had not and besides it did not taste good. If he'd never heard of me, how can he comment on my audience? If he states plainly I have no audience, how can he claim to not have heard of me? His remarks also came less than a day after I came out publicly against bronies, the adult male fans of My Little Pony. I hope that's just a coincidence.
Mitch McConnell's remark is just another example of him being vastly overrated as both a strategist and tactician. He claims to have advanced the conservative cause, but told Laura he has to be mindful that to govern Republicans must reach out to all Americans. Perhaps that is why in 2010, with the rise of the tea party, Mitch McConnell backed Arlen Specter against Pat Toomey, Charlie Crist against Marco Rubio (McConnell staffers went to Florida to help Crist), Robert Bennett against Mike Lee, and Trey Grayson against Rand Paul.
I grew up thinking Mitch McConnell was a right wing warrior. It turns out he's just a typical Washingtonian appropriator who has presided over a massive expansion of the welfare state doing not much more than issuing bold platitudes as he cuts deals to expand government spending and along the way made some major tactical and strategic blunders that groups like ACORN were able to thrive.
Let's review the record.
2. Planned Parenthood's Bad, Bad Night An untold story today following Tuesday's Pennsylvania primaries is what a bad, bad night it was for Planned Parenthood. In Pennsylvania's 134th House district, they spent an eye-popping $100,000 on a TV ad campaign trying to sink the candidacy of Republican Ryan Mackenzie by linking him to ultrasound legislation that was before the legislature. As Politico noted, this was seen as a trial-balloon of sorts. 3. President Obama: 'encouraging'/planning to tax into oblivion start-up businesses. Never mind the fact that Obama got yoghurt splashed on him last night - that's just an ongoing hazard of being a politician running for re-election in this country. The real story here is this: the President went to Colorado to, essentially, lie to a bunch of kids about how they can get themselves out of this mess that they're in. And it is a mess. 50% of college graduates are unemployed/underemployed; couple that with student loan debt levels that should really be frightening more people and we end up with a situation where millions of kids are getting out of college and staring DOOM right in the face. And while they are adults - and thus, responsible for their own fates - guess what? The people that connived to put them in this mess are adults, too. We expect twenty-somethings in this culture to make poor life choices, sometimes; what we don't expect is for the generations above them to so ruthlessly take advantage of that. Anyway: Obama's answer in Colorado, last night? ...Entrepreneurship. That's what he was telling the kids. Start that restaurant! Develop that smartphone app! Make your own destiny! Get slammed with a tax hike on small businesses in the form of tighter restrictions on payroll tax exemptions! ...Yeah. One of these things is not like the others.

Quote him: "The basis of [the classical liberal] argument is that nobody can know who knows best and that the only way by which we can find out is through a social process in which everybody is allowed to try and see what he can do." Exactly! This shows up the rottenness at the core of all liberal arguments: built into them is the assumption that liberals know what is best for us. But they don't. What's the Senate Thinking?
April 29 marks the third year in which the U.S. Senate has not passed a budget -- a staggering dereliction of duty, particularly given the country's near-$16 trillion debt. But that's not the Senate's only blockbuster failure under the leadership of Majority Leader Harry Reid (D-NV). From spending to jobs to energy policy, the Senate has totally dropped the ball, leaving one to wonder, "What's the Senate thinking?"
But it's not just a matter of a simple failure or benign neglect, like forgetting to take out the trash. The way some in the Senate are behaving is equivalent to buying a dog but then deliberately choosing not to feed it. These men and women sought elective office, won a seat in the Senate and now have the power to take action to confront America's problems. But under the leadership of Majority Leader Reid, they're making the choice not to do so.

As senator, Obama missed votes on student loan bill he now wants to extend

In 2007, then-Illinois Sen. Barack Obama missed two votes on the student loan interest bill that he now wants Congress to extend. Obama twice skipped the Senate vote on the College Cost Reduction and Access Act when the bill came to the Senate floor first in July and again in September of 2007, according to public records. The bill, introduced by Rep. George Miller (D-Calif.) and signed into law by President George W. Bush, first cleared the Senate in July on a 78 to 18 vote, with Obama as one of only four senators who didn't cast a ballot. Obama did not cast a vote again in September, after the House and Senate had ironed out different versions of the bill. He was on the conference committee assigned to merge the House and Senate versions of the bill.

After sweeping five state primaries yesterday, Governor Mitt Romney kicked off the general election campaign with a victory speech that put the 2012 election in very stark terms. I was cheering last night as the governor aggressively attacked Obama's failed record and brilliantly critiqued Obama's "fairness" claims. Here are some excerpts:
"Tonight is the start of a new campaign to unite every American who knows in their heart that we can do better! The last few years have been the best that Barack Obama can do, but it's not the best America can do! ... "Four years ago Barack Obama dazzled us in front of Greek columns with sweeping promises of hope and change. ...What do we have to show for three and a half years of President Obama? Is it easier to make ends meet? Is it easier to sell your home or buy a new one? ...Do you pay less at the pump? "If the answer were 'yes' to those questions, then President Obama would be running for re-election based on his achievements...and rightly so. But because he has failed, he will run a campaign of diversions, distractions, and distortions. That kind of campaign may have worked at another place and in a different time. But not here and not now. It's still about the economy, and we're not stupid. ... "This president is putting us on a path where our lives will be ruled by bureaucrats and boards, commissions and czars. He's asking us to accept that Washington knows best -- and can provide all. ... "This America is fundamentally fair. We will stop the unfairness of urban children being denied access to the good schools of their choice; ... we will stop the unfairness of requiring union workers to contribute to politicians not of their choosing; we will stop the unfairness of government workers getting better pay and benefits than the taxpayers they serve; and we will stop the unfairness of one generation passing larger and larger debts on to the next. "In the America I see, character and choices matter. ...We'll stop the days of apologizing for success at home and never again apologize for America abroad. Governor Romney clearly made the case why Barack Obama does not deserve a second term, and many voters agree. In today's Rasmussen tracking poll of likely voters, Romney leads Obama 49%-to-44%. Obama can -- and must -- be defeated! Newt Out According to Fox News "senior campaign aides" have confirmed that former Speaker Newt Gingrich will suspend his campaign for the GOP nomination next week. Gingrich had hoped for a possible upset win last night in Delaware to keep his campaign alive, but Gov. Romney won Delaware by a 30-point margin. Unforced Error, Governor While Governor Mitt Romney is clearly enjoying a bounce in the polls and a boost in momentum, his campaign still has some work to do when it comes to reassuring the conservative base and values voters. That's why his appointment of Richard Grenell, who worked in the Bush Administration, to be his spokesman on national security issues was a disappointment to many conservatives. I share their disappointment not because Grenell is gay. He is not weak on defense. In fact, former Ambassador John Bolton is defending Grenell today. Conservative pro-family leaders are disappointed because Grenell has been an outspoken advocate of redefining normal marriage. For the overwhelmingly majority of folks who support Governor Romney that issue is starkly clear -- marriage is the union of one and one woman. But Grenell once caused a controversy by trying to have his partner listed as his spouse when he worked at the U.N. Thankfully, Grenell is not going to be making policy on domestic issues. But his appointment was disappointing because it comes at a time when the Romney campaign should be reaching out to the conservative base. Instead, this appointment seems like a slap at the base. Moreover, Grenell is known for having an acerbic personality, and critics have described his comments in social media as being "catty." He may be competent, but he is creating controversies on multiple fronts where the Romney campaign can least afford them. That said, we should not exaggerate this. Homosexuals were part of the Reagan Administration and the Bush Administrations. Our concern is policy. One of the ways Governor Romney can reassure values voters is to make more statements in his speeches that speak to their concerns about the sanctity of life, the meaning of marriage and the importance of faith and family. Pointing this out does not hurt Mitt Romney. I am making this observation precisely because it is so important that he defeat Barack Obama. There is no path to victory for a Republican presidential candidate that does not involve massive turnout by pro-family voters. The only way Mitt Romney will end up with a majority on Election Day -- and I will do everything I can to make sure that happens -- is to unite economic, defense and social conservatives behind his candidacy. Government Gone Wild With all the issues making headlines these days -- from rising gas prices to our record national debt -- you would think that Obama could get his bureaucrats to focus their attention and prioritize their efforts. Think again. There is news today that Obama's Labor Department is getting ready to ban chores on family farms. The bureaucrats in their infinite wisdom have decided that it is an urgent priority to enforce child labor laws down on the farm. The Daily Caller reports, "The new regulations ... would also revoke the government's approval of safety training and certification taught by independent groups like 4-H and FFA, replacing them instead with a 90-hour federal government training course." Not to be outdone, the Equal Employment Opportunity Commission issued a ruling this week expanding federal anti-discrimination statutes to include transgendered individuals. As if small business owners needed yet one more confusing and burdensome regulation from the Obama Administration, the EEOC contends that "The term 'gender' encompasses not just a person's biological sex but also the cultural and social aspects associated with masculinity and femininity." America cannot afford four more years of Barack Obama's out-of-control bureaucracy! The Christian Crisis "60 Minutes" Ignored Earlier this week I told you about the outrageous "60 Minutes" story that claimed to be about Christian persecution in the Middle East. Instead of accurately portraying the real threat to Christians in the Middle East -- radical Islam -- CBS presented Israel as the villain. The White House threatened to veto a controversial House cybersecurity bill on Wednesday, saying the measure would fail to protect critical infrastructure systems and would undermine Internet privacy.
The House is expected to approve the Cyber Intelligence Sharing and Protection Act (CISPA) on Friday.

Both as governor of Massachusetts and as a presidential candidate, Romney has supported a fence on the border, E-Verify to ensure that employees are legal and allowing state police to arrest illegal aliens. He is the rare Republican who recognizes that in-state tuition, driver's licenses and amnesty are magnets for more illegal immigration.

These positions are totally at odds with establishment Republicans who pander to the business lobby by supporting the cheap labor provided by illegal immigration, and then accuse Americans opposed to a slave-labor class in America of racism. If this continues, America will become California and no Republican will ever be elected president again. Big business doesn't care, and establishment Republicans are too stupid to notice.

A federal judge has dismissed a libel case against a homosexual who claimed Barack Obama's 2008 campaign paid to rig a polygraph test regarding his sensational charge that he had sex and used drugs with the future president.
Larry Sinclair - who claims he twice engaged in sexual activity and used cocaine with Obama in 1999 when Obama was an Illinois state senator - was accused by Internet publisher Daniel Parisi of making false and damaging statements that led to the demise of Parisi's porn website, Whitehouse.com, in 2008.
The alleged defamation did not center on Sinclair's charges of sex and drugs with Obama but on Sinclair's claim in his 2009 book that the Obama campaign and top adviser David Axelrod had agreed to pay Parisi $750,000 to rig the results of a polygraph test.

Just back from the Supreme Court steps and the scene there is both chaotic and invigorating. As is clear from the oral arguments in U.S. v. Arizona, the years of effort we've put into re-igniting a state role in U.S. immigration law enforcement are paying off.
Building on the favorable decision last year involving Arizona's "E-verify" mandate, many justices today were skeptical of the Obama Administration's arguments by the Solicitor General that Arizona's SB1070 is unconstitutional. Even Justice Sotomayor conceded that on the most volatile provision - the one requiring Arizona police to obtain legal status verification under certain circumstances - the Administration's arguments "weren't selling very well."
It appears to me that some of SB1070's most powerful provisions are likely to survive this Supreme Court review. We have much more on these arguments (today's arguments) on our website.
This is huge. Devious Taxation
This column by ACRU Policy Board Member and Professor of Economics Dr. Walter E. Williams was published April 25, 2012 on Townhall.com The Washington, D.C.-based Tax Foundation does a yeoman's job of keeping track of how much we're paying in taxes and who's paying what. It turns out that American taxpayers worked this year from Jan. 1 to April 17, 107 days, to earn enough money to pay their federal, state and local tax bills. That statistic requires some clarification, and I ask my readers to help me examine it. According to the Congressional Budget Office, Congress will spend $3.8 trillion this year, about 24 percent of our $15 trillion gross domestic product. But federal tax revenue will be much less, only $2.5 trillion, or 16 percent of the GDP. That means there's a shortfall of $1.3 trillion. Some people, including economists, say there's a deficit. That's true, but only in an accounting sense, not in any meaningful economic sense. Let's look at it. If Congress spends $3.8 trillion out of this year's $15 trillion GDP, what must it do to accomplish that goal? If you said it must "find a way to force us not to spend $3.8 trillion privately," go to the head of the class. One way to force us to spend $3.8 trillion less is to tax us that amount, but we're being taxed only $2.5 trillion. Where does the extra $1.3 trillion come from? It surely doesn't come from the tooth fairy, Santa Claus or the Easter Bunny.

Stealing Our Elections

Columnist David Limbaugh, brother of Rush, asks in a recent column, "Can anyone think of an innocuous reason that President Obama and Attorney General Eric Holder oppose state voter ID laws?" The correct answer is definitely "No!" But even Limbaugh dances around the full answer to the question, suggesting only at the end that the lack of a good reason to oppose voter ID suggests that the real motivation is an ulterior motive to rig elections. Let's be fully frank. It's not just Obama and Holder, true. It's the whole Democrat party. And the transparent reason they oppose Voter ID, and favor loose election laws like Motor Voter, election day registration, mail in registration, online voting, and extended voting over days and even weeks before Election Day is that vote fraud is a central Democrat strategy for "winning" elections.

Einhorn was a leftist leader who cheered on the Viet Cong in the 1960s, hoping for a United States defeat. Then he adopted environmentalism and in 1970 hosted one of the very first Earth Day rallies. Thereafter, he claimed to be co-founder of Earth Day.

Appeals Court Gives Arizona Partial Victory on Voter-ID Law

Arizona might be going to the U.S. Supreme Court yet again. A federal appeals court upheld part of the Grand Canyon State's voter-ID law, but struck down another part of Arizona's law as inconsistent with a 1993 federal law. This might become the third citizen/voting Arizona law to go to the Supreme Court in just three years. Arizona allows for citizens to adopt ballot propositions with the force of law, which trump state statutes but fall short of amending the Arizona Constitution. Arizona's voters adopted Proposition 200 in 2004. It requires showing proof of citizenship when you register to vote, and then showing government-issued photo-ID on Election Day when you cast your ballot. Several individuals and groups sued, arguing that these requirements violate two provisions of the U.S. Constitution and also the National Voter Registration Act of 1993 (NVRA), which had been passed by a Democrat-controlled Congress and signed by Bill Clinton. After years of litigation, the case was decided by the U.S. Court of Appeals for the Ninth Circuit.

The April 23 report shows that all people who receive Social Security benefits face about a 25 percent benefit cut as soon as 2033-three years earlier than predicted in last year's report. The program's long-term deficit is now larger than it was before the 1983 reforms. In order to pay all of its promised benefits, Social Security would require massive annual injections of general revenue tax money in addition to what the program receives from payroll taxes.

In 2011, benefits totaled $11.5 billion more than contributions. These deficits will only grow as more and more Baby Boomers retire. Worse, many lawmakers continue to believe that the program can be saved by the Social Security trust fund. But as John notes, "the existence of a trust fund does not make Social Security healthy."Back in 2004, he pointed out that "the Social Security trust fund is merely an accounting device filled with IOUs that future taxpayers must repay." Taxpayers are still on the hook.

"Re-electing President Obama is really important to President Obama, which isn't news. What is news are the out-of-liberal-character acts that his Administration is committing to serve this political goal. ... ObamaCare slashes about $145 billion from Medicare Advantage, the program that allows one of four seniors to escape the traditional entitlement and choose commercial plans. ... Medicare's budget counters estimate that ObamaCare's cuts in the Advantage program will result in enrollment falling by half. The cuts were scheduled to begin this year. ... So in November 2010 Mr. Obama's Medicare team announced a nationwide Medicare Advantage 'demonstration project' that would test if paying insurers bonus subsidies would improve quality over the next two years. Lo and behold, according to a new investigation by the Government Accountability Office, or GAO, the $8.35 billion pilot program is just enough to reverse 71% of the Advantage cuts that would have hit seniors in the run-up to November. And behold again, the demonstration project turns into a pumpkin in 2013. ... [M]r. Obama's Health and Human Services Department is allowed to spend unlimited taxpayer dollars as long it claims the money is going to 'demonstration projects' to fine-tune Medicare Advantage. The real game here is purely political -- to give a program that is popular with seniors a temporary reprieve past Election Day. ... The battle for the survival of the Catholic Church in America is heating up and the faculty at the formerly Catholic University of Notre Dame has lined up on the side of those who would keep Roman Catholic Bishops from teaching Church doctrine.
On April 14, Daniel Jenky the Catholic Bishop of Peoria Illinois delivered a homily that has stirred the resentment of Americans for Separation of Church and State, (ASCS) a rabidly leftist group who would extinguish 1st Amendment freedom of speech rights for Catholic priests.
Not content to merely complain about Bishop Jenky's comparison of Barack Obama Hitler and Stalin, ASCS has asked the Internal Revenue Service to take away the Diocese Peoria's tax exempt status.
Speaking in his own church, Bishop Jenky said, "Hitler and Stalin, at their better moments, would just barely tolerate some churches remaining open, but would not tolerate any competition with the state ... After 6 terms in the United States senate, long time RINO Orrin Hatch will face his first primary battle after failing to attain the necessary 60% of delegate votes at Saturday's Utah Republican convention. After falling 32 votes short of the required total on the final ballot, Hatch will take on conservative Republican Dan Liljenquist on June 26th.
In 2010 Hatch watched nervously as Utah colleague Robert Bennett was removed from the Senate in his own primary contest, a victim of having too often sold-out the conservative Republican base. Concerned with mounting criticism of his own predilection for confirming Marxists to the Supreme Court from his seat on the Senate Judiciary Committee, his perpetual votes to raise the debt ceiling and his vote in favor of TARP, Hatch has spent much of the past 3 years feigning the role of dedicated conservative and champion of the right.

The United Nation's Useless Genocide Trials

Last year I completed a pamphlet on 10 Reasons to Abolish the UN for the Freedom Center, which you can find at its online bookstore that explores the reasons why the United Nations is a threat to the United States and to freedom around the world. You can learn more about the pamphlet from this video and this excerpt below that discusses the failures of the UN not only at preventing genocide, but at trying those responsible. How effective is the United Nations at tackling genocide? When it happens or is about to happen, its peacekeeping forces usually find a good reason to be somewhere else. And the Security Council and General Assembly find some pressing Israeli matter to concentrate on. But what about after the fact? The United Nations boasts of leading the charge against genocide through its tribunals. Warlords and generals who commit mass murder are supposed to fear the wrath of the international community. But how much wrath is there to fear? Thirty years ago, the Khmer Rouge Communist Party carried out one of the bloodiest reigns of terror in the region causing the deaths of millions. During the Cambodian Genocide, the UN Security Council did not issue a single resolution on it. But it did find time to issue a string of resolutions on Israel. While millions were dying, the UN occupied itself with condemning the Israeli expulsion of the Sharia judge of Hebron and the United States for allowing former members of the Rhodesian government to enter the country. It was not UN action, but the Vietnamese invasion that finally put an end to the worst of the terror. But the United Nations, after being approached by the Cambodian government nearly two decades later, finally got down to the task of trying some of those involved for genocide. That was 1997. An agreement to conduct the actual trials was signed six years later. Another three years after that, actual judges were finally approved to preside over the tribunal. It had taken nine years just to get to this point. In 2007, the first indictment was issued against Pol Pot's second in command. Nuon Chea had been 70 when the UN was first approached. He was now almost 80. Today he is 84 and the trial is still going on. The odds are very good that he will die before it is all over. So far the only man convicted of anything in the proceedings, whose origins date back to the 90's and have budgets in the hundreds of millions of dollars, is Kaing Guek Eav who ran the Tuol Sleng prison. The Khmer Rouge Tribunal could hardly have sent a louder message of UN impotence in the face of genocide, demonstrating that even when there was no risk and the defendants were out of power-their trial would still become nothing more than another UN employment and fundraising opportunity. A forum for its officials to prattle about justice and law, while practicing it as little as possible. Is the Khmer Rouge Tribunal exceptionally incompetent? The International Criminal Tribunal for the Former Yugoslavia has been going on for 18 years. Slobodan Milosevic, its key defendant, died after being on trial for 5 years. Possibly of boredom. So did 16 other defendants. It might be reasonable to conclude that any court where defendants routinely die before the end owes a little too much to Kafka. The International Criminal Tribunal for Rwanda has been going on for 17 years. In 1998, Resolution 1165 urged "the organs of the International Tribunal for Rwanda actively to continue their efforts to increase further the efficiency of the work of the International Tribunal in their respective areas" and mentioned "an exceptional measure to enable the third Trial Chamber to begin to function at the earliest possible date." 7 years later, citing a long string of previous resolutions, Resolution 1503, recalled and reaffirmed "in the strongest terms" a deadline to end all investigations in 2004, to end all activities at first instance in 2008 and to shut down by 2010. It's 2011 and the tribunal is still going strong. The latest deadline is 2014. Or 20 years after the actual genocide took place. After 17 years, only 38 convictions have been completed with no appeal. That isn't even 2 convictions per year. 19 more cases are still pending appeal. 8 were acquitted. 10 cases are still going on.
The International Criminal Tribunal for Rwanda has 25 judges and only 92 defendants over the course of 17 years. That's not even four defendants to a judge for a caseload stretching over nearly two decades. This may make the Tribunal the least efficient justice system in all of human history. The biennial budget for the tribunal is around 250 million dollars with nearly 700 posts. This is actually a reduction, as there used to be well over a 1000 posts. The total cost of the whole affair has long ago run into the billions. In 2005, some 15 million dollars alone was spent on the defense teams. There are entire countries with a smaller judicial budget than that. Half of Africa could have been fed with the money spent on the tribunal. While the United States and its victorious allies had managed to begin the Nuremberg Trials less than half a year after the war in Europe, and end it on the next year... the United Nations was not able to act on the Khmer Rouge Tribunal without the consent of the Cambodian government almost two decades after the fact. And even then it set into motion, a long series of procedures that have been going on in one form or another for 14 years. There is no comparison between the effectiveness of the United States and the United Nations approach in punishing genocide. The Nuremberg Trials sent a message. The Rwanda Tribunal and the Khmer Rouge Tribunal have sent a contrary one. It does not take a scholar of international law to determine which one tyrants fear the most. And even the convictions are often farcical. Vincent Rutaganira was charged on eight counts, including genocide, extermination and murder. He pleaded guilty to one count of a Crime against Humanity, Extermination as an Accomplice by Omission. After three years of assorted hearings, it was decided that due to his "good behavior" and "advanced age of 60"-- that he should be released in three years time. And he was. If such a short sentence for Crimes against Humanity from a billion dollar genocide tribunal was not ridiculous enough, the case notes make it clear that Vincent should probably never have been tried at all. Rather than being tried for perpetrating genocide, he was charged with failing to prevent it. A number of Tutsi survivors however testified that he had saved their lives, given them shelter and false identity cards. The tribunal had arrested the Hutu version of Oskar Schindler and dragged him through the system and imprisoned him on what basis? For failing to prevent the massacres. And what was he supposed to have done? According to the judgment, "the Chamber finds that the Accused had the power to convene a meeting of the inhabitants of the secteur to initiate and conduct discussions on the tragic events that were taking place in his secteur, in order to prevent participation in the massacres that occurred at the church, at least, by civilians." With the conclusion being that, "Vincent Rutaganira's intervention saved some people who had been targeted by attackers. It can be inferred from such a finding that a similar intervention by the Accused against some civilians who participated in the attacks on Mubuga church would have had the same decisive effect in sparing human lives." Vincent's very attempts to save lives were used to indict him for not averting larger massacres.
