Is Sharia Law a Threat to the American Judicial System?

In the last year, we have been hearing a lot of news about Sharia law, its dangers and its threats to the American judicial system. Most Americans believe it is a dangerous set of male centered sexist laws for the complete dehumanizing of members of the female sex.
Then there are those like Jamal Badawi who is making the circuit in the US defending Sharia law and telling us there is nothing to worry about. His latest stop was in Perrysburg, Ohio, a suburb of Toledo. He told the crowd that the states that were trying to enact laws barring judges from considering any foreign laws are reacting to Sharia hysteria.
Badawi also told the crowd that he believes it is very unlikely that Sharia law or any form of Islamic legal code could actually influence our courts and legal decisions without first being approved by the legislatures. He said that this is highly unlikely since only about three percent of the American population is made up of Muslims and then added,
While this email may appear to be far afield from our usual topic of Islam, the tie-in is the Islamist New Black Panther Party, which has been using the Trayvon Martin case to advance Islam by carving out a leadership position for itself via its calls for Zimmerman's punishment. NBC News and MSNBC have shamefully been aiding and abetting the New Black Panthers in doctoring evidence from the case to portray Zimmerman as guilty of murder. In fact, show host Al Sharpton has gone so far as to lead events that call for Zimmerman's arrest (sound starts at 1:50 minute mark) and then advance his cause on his own show!
It's time the public stood up to NBC's bureau of murderous lies and tell them that they cannot get away with overriding the American justice system by creating a nation of vigilantes out to get one man, and in the process empowering the racist conspiracy theories of the Islamist New Black Panther Party . For decades, I have been a faithful viewer of NBC News, and subsequently MSNBC, and I have been shocked at how their journalistic integrity has deteriorated over this time. While this deterioration has been visible for a while, a threshold has been breached in the coverage of the Trayvon Martin case, where bias has given way to outright fabrication.
The way that Brian Williams' show edited an audio recording of Mr. Zimmerman's phone conversation with the police department to express a racism that did not originally exist is truly shameful - and dangerous. The subsequent apology was also entirely inadequate - in fact, it was invisible to many if not most viewers of the original report.
Similarly, you have a news show host in the person of Al Sharpton who can't make up his mind as to whether he should be reporting the news or creating it. He is using his "news" show to conduct his own public trial of Mr. Zimmerman, designed to lead viewers to a conviction of murder!
If anything happens to Mr. Zimmerman, blood will be on Sharpton's hands, Williams's hands, and the hands of others, but especially on President Phil Griffin because it has been under his stewardship that this vicious office of propaganda that claims to inform the public has evolved. If you do nothing, you will be smeared with their bloody hands.
What a shame to see the once honored NBC descend to the level of rabble rouser and agitprop artist. How MURDEROUS!

George W. Bush to speak in Pennsylvania on GOP presidential primary day
Former President George W. Bush will deliver a speech in Pennsylvania on the day of the state's GOP presidential primary. Bush is the only prominent politician in his family that has not made an endorsement in the 2012 presidential race.
Bush will give the keynote address at the Plumstead Christian School's annual "Founders Forum" on the Calvary Church's campus in Souderton, according to the school's official website.
His father, former President George H. W. Bush is the most recent member of the Bush family to endorse former Massachusetts Governor Mitt Romney for president.
Bush reportedly asked Romney if his son had endorsed him for president yet.
"I haven't met with President George W. Bush," Romney said. "We speak from time to time."
Barbara Bush, his wife, replied, "We'll talk about that."

The bad news is last month some well intentioned political activist announced a cut-off date for signing up co-sponsors for Rep. Rose Marie Swanger's American Law's for American Courts (HB 2029) in an effort to inject some urgency into the effort.
What it resulted in was an interruption of the campaign to encourage those Representatives not yet signed on as co-sponsors to join with those Legislators who have already recognized the death by smothering threat to our Constitution.
The good news is there is no cut-off date for adding co-sponsors and we are once again asking your readers to contact their representatives and ask they join the battle.
There are only three Representatives from Bucks who are co-sponsors, Representatives Clymer, Petri and Quinn and we thank them for showing their colors.
But that leaves seven more Representatives who appear to be still standing on the sidelines as the battle for our existence as a free people is joined.

But before you do anything, if your Pennsylvania Representative has not yet ssigned on as co-sponsor, urge her/him to do so and ask what is it that prevents him/her from doing so.
Help Pennsylvania be counted among those States that have shown the courage to face off with the enemies who have plainly stated their aim is to destroy our Nation. Our laws have worked just fine since colonial times. What is needed are politicians who respect them. And you know whose job it is to remind them of that.
Resistance to a new bill aimed at limiting foreign law in Pennsylvania courts serves as a case study of how Islamists and their allies operate: peddling falsehoods about Shari'a, painting Muslims as victims, and denying that anyone seeks to institutionalize aspects of Islamic law - even as they vigorously promote that very agenda. With similar legislationbeingdebated across the U.S., understanding their tactics is critical.
At issue in Pennsylvania is House Bill (HB) 2029, which stipulates that "a tribunal shall not consider a foreign legal code or system which does not grant ... the same fundamental liberties, rights and privileges" as guaranteed by the federal and state constitutions. Introduced in November, it follows the American Laws for American Courts (ALAC) model and makes no mention of Shari'a. A preliminary memo sent to legislators last June in the name of Rep. RoseMarie Swanger, HB 2029's chief sponsor, does highlight Islamic law, but she later said that it had been circulated accidentally. Regardless, concerns about Shari'a are warranted due to its many provisions that conflict with the standards of American jurisprudence. For example, it disadvantages women in terms of inheritance, divorce, child custody, and other areas of family law. Shari'a already has shaped numerous cases nationwide, including in Pennsylvania, where one state court decided how assets should be distributed according to Islam.
Pushback against HB 2029 has been led by the Philadelphia office of the Hamas-linked Council on American-Islamic Relations (CAIR-PA) and was punctuated by an interfaith press conference (video here) at CAIR-PA headquarters on December 14. The overall campaign reflects CAIR's usual recipe of distortion, victimology, and contradiction between words and deeds.
Attacks on bills like HB 2029 begin by sowing confusion about Shari'a. Because Islamic law encompasses virtually every facet of life - governing personal activities such as eating and worship, but also forming an oppressive social and legal structure - suit-and-tie Islamists work to emphasize its unthreatening pieces whenever possible. CAIR-PA executive director Moein Khawaja's suggestion that Shari'a should worry Pennsylvanians no more than halal gyros is a fine example of this technique.
In the coming months, critical decisions are going to be made about Iran, Israel and the world. Finally, Washington is beginning to focus on the issue of a nuclear Iran. Many of our leaders want to confront this looming threat. But others want to keep kicking the can down the road. The debate is far from over.
We know that when thousands of CUFI activists arrive in DC and on Capitol Hill, we can change the conversation.
We can remind our leaders that a nuclear Iran is not only a threat to Israel, but to the US as well. And we can demonstrate to our elected officials that their constituents care enough about this issue to show up at their DC offices.
We know that we can create a sense of immediacy that's otherwise lacking.
We know that the more of us who show up and speak out -- the louder our voice and the greater our impact.

An American neoconservative political analyst and commentator, Bill Kristol is the founder and editor of the political magazine The Weekly Standard and a regular commentator on the Fox News Channel. He is a regular panelist on Fox News Sunday and often contributes to the nightly program Special Report with Bret Baier.
Before starting the Weekly Standard in 1995, Mr. Kristol led the Project for the Republican Future, where he helped shape the strategy that produced the 1994 Republican congressional victory. Prior to that, Mr. Kristol served as chief of staff to Vice President Dan Quayle during the first Bush Administration, and to Education Secretary William Bennett under President Reagan.
John Stossel's new book, "No, They Can't: Why Government Fails-but Individuals Succeed," argues: "There ought not to be a law." Stossel explains how politicians promise to solve problems by passing laws, but the laws invariably make our problems worse.
After years of obeying our parents, we are programmed to think that anytime there is a problem, whether it's companies going bankrupt or schools keeping kids stupid, government action is the way to solve it. Using his decades of reporting, Stossel tackles how those intuitive, knee-jerk reactions lead us astray.
Central planning sounds right. It feels good. But it has nothing to do with the realities of economics and science. There is nothing that government can do that we cannot do better as free individuals - and as groups of individuals, working together voluntarily, not at the point of a gun or under threat of a fine. Without big government, our possibilities are limitless.

Michael Ledeen reports that the Natanz uranium enrichment site has been shut down after a mysterious blast happened "in the next-to-bottom level of the underground structure." A second explosion has struck a site in Zarin Dasht that is used for producing warheads and missile fuel and 7 people are missing.
Iran's Foreign Minister Ali Akbar Salehi, declared earlier this week that 'The sanctions may have caused us small problems but we will continue our path.' Arthur Knight, ITAI presented an analysis of the Middle East before the Camden County, NJ Religious Leaders at the Universalist Unitarian Church in Cherry Hill on last Wednesday. Joseph Puder discussed the Shiite-Sunni Divide and the Rise of Islamism in the Arab world, while Dr. Robert Mikhail described what it was like to live as a Christian in Egypt...ITAI wishes its Jewish members a very Happy and Sweet Passover, and to our Christian members, a very Happy Easter.
This ITAI WEEKLY MIDDLE EAST REPORT has to do with The Dangerous Side of Moral Equivalency. This Marxist concept of moral equivalency is undermining the West while significant segments of the U.S. Government, Academia, and the mainline Protestant churches have adopted it.
THE DANGEROUS SIDE OF MORAL EQUIVALENCY

During a recent presentation made by this writer at a meeting attended by religious leaders and held in a Universalist Unitarian Church in New Jersey, the minister/host, in response to hearing the results of a survey addressing the rise of extremist Islamism in the Middle East and elsewhere exclaimed, "There are extremist Jews and Christians too, and since we don't have a Muslim present, you should refrain from speaking negatively about Muslims."
The focus of the presentation was the Shia-Sunni conflict in the Middle East and the rise to dominance of Islamism in the Arab world. My colleague, Dr. Mikhail, a native Egyptian, related his personal experiences living as a Christian in Egypt. He described the teaching of hate against non-Muslims, and the resultant killings and raping rampages against Christians in Egypt by Muslims. (In the most recent elections held in Egypt, since the fall of the Mubarak regime, the Salafist "Nour" party, members of which are extremist Islamists won 27.8% of the seats in the Egyptian Parliament and the more "moderate" Muslim Brotherhood won 37.5% of the vote.
"Progressive" thinking members of the clergy seem to have their minds made up and cannot and will not allow facts to alter their beliefs. And, while our presentation focused on reported, factual events in the Middle East, these facts seemed irrelevant to our "progressive" Unitarian Minister host. While it is true that there are extremist Christians and Jews, not since the dawn of the 21st century has one heard cries from either Christians or Jews advocating the killing of an infidel Muslim as we have seen when a Muslim cries out "Allahu Akbar" while stabbing or shooting a Jew or a Christian. There have been no reported killings of Muslims in the name of Jesus or Moses...
The exercising of moral equivalency by the "Progressive Left" negates the teachings of all monotheistic faiths. If one cannot distinguish between right and wrong, one invites chaos and confusion into society. Moreover, our legal system will collapse under such a practice. A murderer's guilt will become "relative" not complete, and under such relativist conditions, it would be impossible to convict anyone, without having extenuating circumstances.
What holds true for individual offenders applies to communities of faiths as well. In today's Europe (most recently exhibited in Toulouse), as in Gaza and Cairo, Islamist incitement to murder infidels is excused by European elites who react to such heinous acts with moral relativism and political correctness. Relativism and political correctness found in academia, media, churches, or government, regard the probing into aberrant Islamist behavior as Islamophobia or racism.
Similar complaints as that made by the Unitarian minister, regarding the call to restraint in the absence of Muslim representatives, reveals an endemic hypocrisy that exists not just in this particular church, but in the United Methodist and the Presbyterian USA churches, where anti-Israel and at times anti-Semitic resolutions are being discussed without consideration of the Jewish/Israeli point of view or, not including input from one of the parties - the Jewish/Israeli party as part of the discussion.
At the upcoming United Methodist Church (UMC) General Conference taking place this April 2012, and the Presbyterian Church USA General Assembly to be held in July 2012, leaders will be calling for divestment from companies doing business with Israel, and statements will be made labeling Israel "an Apartheid State" and equating Israel with South Africa.
The church leaders pushing these anti-Israel resolutions believe they are doing so in the name of "justice for the Palestinians." They refuse, however, to consider the anti-Jewish and anti-Semitic nature of the Arab-Muslim Palestinian leadership, and its refusal to recognize the right of Israel to exist as a Jewish State and to live in true peace and security. All the buzz words: occupation, right of return and settlements, obfuscate the real issue - that of Islamic intolerance towards any non-Muslim/non-Arab sovereign entities in the Middle East. Had the Arab-Palestinians wished to live in peace and security with the Jews and recognize the Jewish historical rights in their ancestral home, an Arab-Palestinian State would have been established in 1937 under the Peel Commission or in 1947, under the UN Partition Plan. Had the Arabs accepted the division of Palestine into Jewish and Arab states, there would have been no issues such as occupation, settlements, or refugees. Lest we forget - there were 850,000 Jewish refugees from Arab countries - a number far greater than the oft-quoted "Palestinian-Arab refugees." While Israel absorbed and re-settled the Jewish refugees at great cost when the nascent state had barely recovered a five-pronged attempt by Arab armies to obliterate it, the Arab countries turned their backs on their people and have perpetuated the homelessness of Palestinian refugees.
The unfettered malice towards the Jewish State, and the outrageous comparison to Apartheid South Africa, is strangely absent when one notes the violence and persecution of non-Muslims in the Middle East and beyond, by both Muslim states and by the Palestinians in Gaza and Ramallah. Although not all Muslims are terrorists, most terrorists in the 21st Century have been Muslims, who have killed in name of Allah.
Taking issue with the Clinton administration for pressuring Israel and not the Arabs, U.S. Representative and Speaker of the House, Newt Gingrich (R-GA) had this to say on April 9, 1997, "There is extraordinary danger in treating terror and democracy equivalently. There is extraordinary danger in placing the burden on friends, because you are scared to tell the enemy the truth."
Jeane Kirkpatrick, U.S. Ambassador to the U.N. during the Reagan Administration and author of the book "The Myth of Moral Equivalency" pointed out the following: "Marxism incorporates, at the verbal level and the intellectual level, the values of liberal democracy in its assault on liberal democracy, and this is precisely why it entraps so many Western intellectuals who are themselves serious liberal democrats. Thus the slightest restriction on, let's say, the presumption of innocence of the accused is said to demonstrate the absence of the rule of law. The slightest failure of an electoral system demonstrates contempt for political equality. Any use of force in international affairs establishes the lawless character of the society. Now, it is a short step from having demonstrated that a country like the U.S. is not law-abiding society todemonstrating that it is lost and that it is like any other lawless society (morally equivalent-JP). The Soviets can always claim 'We are no worse than you. Even if we are a lawless society, you too are a lawless society, we are no worse than you.' This is the logic of the doctrine of moral equivalence."
What is true in reference to America in its confrontation with the Soviets as described by Jeane Kirkpatrick is also true about Israel in its struggle with the Palestinian Arabs, and it is just as true in distinguishing the Judeo-Christian values from that of Islamism.
It is unfortunate therefore that the mainline Protestant churches and the Unitarian churches in particular have adopted the Marxist notion of moral equivalency while abandoning the truth of a universal right and wrong as enshrined in the holy books of Jews and Christians and manifested in the Judeo-Christian ethos.

It's the sort of weather that would usually make me throw on my hoodie, a relic of my college days that accompanies me on my transition from the jacket to the shirt. But the last time I wore it out, I got thumbs up and grins from people who aren't usually that friendly. It took me a while to get it, until a new neighbor toting a Whole Foods bag clued me in by breaking into a tirade about how horrible Florida and the Republicans are. Then I got it. The hoodie which predated Obama has now come to be defined by him and suddenly wearing one had become a political statement.
Wearing the hoodie would lead to the impression that I was making a statement of solidarity with Trayvon Martin, but not wearing one still meant allowing the left to control me. It was a small reminder on a spring day of how the left politicizes everything. There is nothing that the left considers apolitical. Its ambitions are unbounded by reason, law or sanity. Its singular gift is propaganda. It is terrible at the management of countries, but it is excellent at shaping their dialogue, at seizing organizations and public spaces, until everyone is forced to grapple with its agenda.
The hoodie began life as a practical garment, like jeans and other elements of working class clothing, it was hijacked as a fashion statement and then turned into high end clothing while still being marketed as dirty and dangerous. But practical things outlasts the tics and trends, they persist because unlike the 'Friends of the People' who pop up in working class wear, they are actually useful. It doesn't keep them from being politicized, but it allows them to outlast the politicizers.
With a last minute Passover purchase to make, I tossed on the hoodie and saluted a squirrel on the way out.

PINING FOR THE OSLO FJORDS
The Israeli left is dead. It's politically dead, conceptually dead and brain dead. But like the fabled Norwegian blue parrot, there is an industry dedicated to assuring us that it's still alive and well, just pining for the Oslo peace process.
The left in Israel is one of the few in the world to exist on foreign subsidies. Without generous funds from the European Union, the State Department, George Soros and assorted members of the Shadow Party, the last remnants of the Israeli left would have packed up their suitcases, their degrees in art philosophy and their framed photos of Amos Oz and Leon Trotsky and moved to Paris or San Francisco.
Workers at a United States pro-democracy group were detained by the United Arab Emirates government, according to a report - a move that echoes a clampdown last month by Egypt that drew criticism from Washington.
Foreign Policy reported that the UAE governmentdetained foreign employees of the National Democratic Institute (NDI) and prevented at least one of them from leaving the country.
It said the director of NDI's Dubai office, Patricia Davis, an American, and her deputy director Slobodon Milic, a Serbian national, were stopped at the Dubai airport by UAE government authorities as they tried to leave the country.
RIYADH, Saudi Arabia - As Secretary of State Hillary Rodham Clinton worked hard on Saturday to focus attention on deepening security ties with the Arab nations of the Persian Gulf, she found herself having to deal with a surprising act of diplomatic defiance: the decision by the United Arab Emirates, an ally, to shutter the offices of an American-financed group that promotes democracy.
So far, the U.A.E. have not publicly explained their actions against the organization, the National Democratic Institute, which only recently was one of several nonprofits prosecuted in Egypt amid concerns about what many Egyptians perceive as foreign meddling.
The move by the U.A.E. was not as shocking as that by the Egyptians - in that case, the son of a Cabinet member was charged in criminal court. But it was especially provocative, coming just before Mrs. Clinton arrived in the region for talks with the U.A.E. and other members of the Gulf Cooperation Council.
Egypt's investigation of the group, along with the International Republican Institute and others, prompted a fierce debate in Washington over whether to continue providing military assistance to the Egyptian military. The Obama administration eventually allowed $1.3 billion in arms sales to move ahead, but only after Egypt allowed American employees of the groups to leave the country.
The State Department on Saturday defended the National Democratic Institute's work in the U.A.E., while an official with the group in the United States expressed some bafflement since he said it did not do democracy-building work in the country. Les Campbell, the regional director for the Middle East and North Africa, said the office in Dubai, one of the emirates, was used to coordinate work in nearby countries, including Saudi Arabia.
A German organization that was also targeted in Egypt, the Konrad Adenauer Foundation, recently closed its office in the U.A.E. at the demand of the country's foreign ministry.

Like a constant speed conveyor, the Indoctrination by university profs deposits unwittingly indoctrinated graduates into our society with every graduation. Some - too many - will be affected for life because they've been denied a grasp of history, denied the knowledge of how this country prospered and grew based on free market principles. They enter into various careers and bring their skewed education along with them - into the law, journalism, education, government, entertainment, business and the rest.
A few years in the private sector will enable some to catch on. The others are likely to be lost for the rest of their lives, indoctrinating their children accordingly.
One of our members now taking a course at a community college in this area tells me his accounting teacher spends the first few minutes of every class on what amounts to socialist indoctrination.
The socialists' intent is to create a society that blindly accepts government as the source of all rights, subversion of the individual to the community, something akin to "The Stepford Wives". And this requires the universities to restrict or forbid opposing thought, as we see in so many schools.
The article below contains rather bleak facts. Let's not ignore them; we need ideas on how to deal with them.

Young Americans emerge from college favoring socialism over free markets

Republican presidential candidate Rick Santorum caused a bit of a stir last month when he labeled college campuses "indoctrination mills" that enforce a strict adherence to "politically correct left doctrine." For conservatives, Mr. Santorum might as well have called the sky blue. But from the way the media and liberal pundits pounced on his remarks, you'd think he had said something profoundly indecent.
For decades, conservatives have documented and criticized how liberal ideology runs rampant throughout higher education. Hence William F. Buckley's famous quip from the 1960s: "I'd rather entrust the government of the United States to the first 400 people listed in the Boston telephone directory than to the faculty of Harvard University." Fifty years later, few conservatives would disagree.
But could the problem be getting worse? The Pew Research Center released a study in December showing that more Americans age 18 to 29 have a favorable view of socialism over capitalism. In fact, this demographic has a net positive view of socialism (49 percent positive to 43 percent negative) and net negative view of capitalism (46 percent positive and 47 percent negative). When Pew released an earlier version of the same study two years ago, this demographic's views on socialism were exactly the opposite (43 percent positive and 49 percent negative).
The Obama Record: Little noticed in the president's remarks attacking the Supreme Court last week were two whoppers he told about ObamaCare. Then again, since that reform was built on untruths, why should he stop now?
At that press event, Obama told any justice thinking of overturning ObamaCare's central tenet that "in the absence of an individual mandate, you cannot have a mechanism to ensure that people with pre-existing conditions can actually get health care."
But this is false.
In fact, Obama himself argued precisely the opposite during the 2008 campaign, saying a mandate wasn't needed to achieve universal coverage. "The reason people don't have health insurance isn't because they don't want it," he said then. "It's because they can't afford it."
Plus, ObamaCare itself proves a mandate isn't needed to cover those with pre-existing conditions. The law set up federal "high risk" pools that offer insurance to those denied it by private companies. Yet instead of making this a permanent solution, Obama kills these pools off in 2014 in favor of the mandate.
Obama also claimed at that press conference that the law "was passed by a strong majority of a democratically elected Congress."

A global climate model that does not simulate current climate accurately does not necessarily imply that it cannot produce accurate projections.
Think about that one for a while. One of the many problems with global warming "science" is that the models on which the entire enterprise is based cannot accurately describe or simulate the Earth's current climate, nor can they, when cast backward, accurately describe the Earth's climate history. It seems obvious that a model that can't get the past and the present right is an unreliable guide to the future-predicting the future is the hard part-but alarmists are in the position of claiming reliability for such deeply flawed models.
So Pielke responded as follows:
I invite anyone to defend this perspective, and we will present as a guest weblog post. From my perspective, if a global climate model cannot simulate current climate, as well as changes in the climate system, accurately it cannot produce accurate projections of climate in the coming decades.
Papers that fail this test, or do not even make it, which then are still published, is a subversion of the scientific process.
That strikes me as inarguable. It will be interesting to see whether any of the alarmists take Pielke up on his challenge. This is one more reminder that global warming alarmism isn't science, it is a toxic mixture of faith and politics.
In another post, Pielke sets out these minimal standards for models' predictions to have any credibility:
In terms of testing the models, necessary conditions (but still not a sufficient condition) for the models to have any credibility to predict the future climate on decadal time scales are:
1. They must accurately simulate (hindcast) the statistics of major atmospheric and ocean circulation features over the last few decades (since real world data is available)
and
2. They must accurately simulate (hindcast) the statistics of the changes in the statistics of these major atmospheric and ocean circulation features over the last few decades.
If they cannot do both #1 and #2, they must be rejected as robust predictive (projection) tools for the coming decades.
... If they cannot skillfully predict #1 and #2, model predictions of the coming decades, published in journal articles, news reports, and climate assessments, are misinforming and misleading stakeholders and policymakers.
Pielke offers this graphic that sums up the range of B.S. that one encounters in wading through the alarmists' papers:
We established beyond a reasonable doubt in our "Don't leave it to Cleaver" series that Missouri Rep. Emanuel Cleaver is one of the most reprehensible men in Congress. Cleaver and a few of his colleagues in the Congressional Black Caucus retailed the story that Tea Party protesters abused them with racial epithets while the protesters demonstrated against Obamacare on Capitol Hill on March 20, 2010. McClatchy News swallowed the story whole even though it was shown in short order to be nothing but a fabrication.
It turns out that Rep. Cleaver is not just a liar without a conscience, he is also a deadbeat (to borrow Glenn Reynolds's formulation). The Kansas City Star reports:
U.S. Rep. Emanuel Cleaver's car wash headache is raging once again.
The bank that loaned the Kansas City congressman and his wife $1.3 million in 2002 to buy the Grandview Auto Wash at 12204 Blue Ridge Extension is now demanding payment of more than $1.5 million, after the Cleavers repeatedly fell behind on repaying the loan.
The suit, filed last week in Jackson County Circuit Court, said the demand for repayment came after three attempts to delay foreclosure. Bank of America also is seeking attorney's fees and a receiver to protect collateral.
"The Cleaver Company failed and refused, and continues to fail and refuse, to pay the outstanding obligations due and owing ... under the note and other loan documents," the lawsuit said.
In an email statement, Cleaver said, "This is a business dispute. The business has been run by an outside manager for years." He said because it was a legal matter, he would have no further comment.
According to court documents, the outstanding principal totals $1.2 million with interest totaling $240,545 as of March 6. Late fees have reached $54,587. Both Cleavers had personally guaranteed the debts, according to the suit.
But wait! There's more. Taxpayers are on the hook: "The loan was originally part of a Small Business Administration program. It was not clear Thursday how much money, if any, taxpayers will have to provide if the loan defaults." Surely there must be some "stimulus" money left to help Cleaver out.
Reading Rich Lowry's Easter column paying tribute to Charles Colson - "When redemption is real" - brought back warm memories of my interviews with Colson, Colson biographer Jonathan Aitken, and Colson's Prison Fellowship successor Mark Earley back in 2005. A Washington Post Book World review of Aitken's biography of Colson by Rutgers University Professor David Greenberg was the occasion of my conversations with Colson and the others.
Greenberg had slimed Colson in the course of his review, which alludes to Colson's service in the Nixon administration with the headline "Tricky Chuck." Here is Greenberg sliming Colson in his review of Aitken's biography, still sitting out there for anyone to read on the Internet as originally published by the Post:
Under Nixon, Colson tried to lure working-class Catholic Democrats to the Republican Party by funneling federal funds to parochial schools. Little came of the effort, partly because Nixon administration officials considered the constitutional barriers too high. Today, however, President Bush doles out taxpayer monies to groups performing Christian social work under a plan Colson has advocated. While Colson's motives might be less cynical now than they were under Nixon, the project of eroding the church-state wall is essentially the same. And while Colson's current schemes surely don't merit him more jail time, they hardly suggest a meaningfully changed man. Indeed, in the book's final pages, Aitken fleetingly mentions that grants from Bush's faith-based initiative now fill Colson's coffers. In this context, it seems, "redemption" means cashing in.
If you actually read Aitken's book, which I seriously doubt Greenberg did, you would know that Greenberg's disparagement of Colson for lining his coffers with government money or enriching himself through his ministry is a lie. Aitken goes out of his way in the book to document Colson's sacrifice of riches he could rightly have claimed as his own - such as the royalties from his multimillion selling memoir - for the benefit of his prison ministry.
I interviewed Colson, Aitken and Earley about Greenberg's libel of Colson in the review. At one point I caught up with Colson while he was shopping for groceries with his autistic grandson in Florida. Having the opportunity to talk to a guy who served hard time with Jeb Magruder for a (highly questionable) crime to which he had pleaded guilty, I asked him if he ever found out what Nixon's minions were looking for in the Watergate. He said that he had wondered the same thing himself and that he had asked Magruder that at one point in prison. What did he say? "He didn't say anything; he just turned red," Colson said. Drat!
I wrote about Greenberg's false and defamatory review in the Weekly Standard column "Wielding the hatchet." With the kind permission of the Standard, we also posted the column on Power Line as "Book World's dirty trick."
When the Post got around to publishing Mark Earley's letter taking issue with Greenberg, I took a close look at Greenberg's mealymouthed response in "Professor Greenberg regrets." Long story short: Greenberg still owes Colson an apology that he can't bring himself to offer, and I wanted to take the occasion of Rich Lowry's terrific column to tack on this addendum.
Obamacare is a Trojan horse, intended, as Barack Obama has said, to lead to the extinction of private health insurance and its replacement by socialized ("single payer") medicine. So it is pertinent to observe how socialized medicine has worked out in countries where it has been in place for some decades, like the United Kingdom. One key feature of socialized medicine, wherever it exists, is the establishment of death panels. Death panels are needed to ration health care by designating those who are not worth treating, usually by virtue of their age. Thus, the Daily Mail reports:
When Kenneth Warden was diagnosed with terminal bladder cancer, his hospital consultant sent him home to die, ruling that at 78 he was too old to treat. Even the palliative surgery or chemotherapy that could have eased his distressing symptoms were declared off-limits because of his age.
His distraught daughter Michele Halligan accepted the sad prognosis but was determined her father would spend his last months in comfort. So she paid for him to seen privately by a second doctor to discover what could be done to ease his symptoms.
Thanks to her tenacity, Kenneth got the drugs and surgery he needed - and as a result his cancer was actually cured. Four years on, he is a sprightly 82-year-old who works out at the gym, drives a sports car and competes in a rowing team. ...
Sadly, Kenneth's story is symptomatic of a dreadful truth. According to shocking new research by Macmillan Cancer Support, every year many thousands of older people are routinely denied life-saving NHS treatments because their doctors write them off as too old to treat.
The linked article has much more, but the point is simple: the easiest way to cut costs in any socialized system is simply to stop treating elderly people. Further, as the costs of a socialized system rise due to inefficiency, the age at which people are "too old to treat" will inevitably trend downward.
I was disappointed to see one of my favorite investment analysts, Barry Ritholtz, retail some ill-informed and completely without context or comparison harum-scarum on his website about how people in California are being exposed to hundreds of times normal radiation from the Fukushima meltdown of a year ago, adding, Jane Fonda-like, that "the government is doing everything it can to help citizens cover up what's occurring." Higher levels are even showing up in our milk! Panic!
You have to click through to some of the links to find out, for example, that the elevated levels of radiation exposure to someone who drinks a gallon of milk a week is "1 microsievert, or the total effective dose equivalent for only 12 minutes on an airplane flight or 3.7 hours of the average person's background exposure from natural sources of radiation."
So kudos are due to my sensible left-leaning environmental pals Michael Shellenberger and Ted Nordhaus of the Breakthrough Institute, for calling BS on the whole scene with their piece "The Making of a Radiation Panic."
One year after Fukushima, independent scientists working for the UN say bluntly that irrational fears of radiation poisoning will cause far more harm than the radiation itself. Not a single individual from the Japanese public received a dangerous dose, according to the early and informal analyses by the scientists. (Conspiracy theories cannot survive against the constant independent radiation measurements uploaded on Twitter.) Even the 70 altruistic plant workers who stayed behind gained an additional cancer risk of just 0.002% - effectively zero in a country where four out of ten people get cancer.
Michael and Ted go on to conclude that overreaction to Fukushima probably poses greater health risks than radiation from Fukushima.
PJTV's Scott Ott carries out an entertaining undercover investigation: he goes to the offices of several groups that denounce voter identification laws as unconstitutional suppression of minority votes, etc., and tries to get in to see someone. Sure enough: they all require identification, including the Department of Justice, which has sued to invalidate voter identification laws. You have a constitutional right to petition for redress of grievances, but if you want to see Eric Holder or anyone else at the the Department of Justice to explain your grievance, you need a photo ID.
As we noted here, perhaps the ultimate instance of this hypocrisy was when Eric Holder went to the LBJ Library in Texas to rail against that state's voter ID law, which DOJ sued to invalidate shortly thereafter. Sure enough: you couldn't get in to see Holder denounce identification requirements as racist unless you had a photo ID.
There are several variations of Easterbrook's First Law of Doomsaying (after Gregg Easterbrook, author of one of the best environmental books ever, A Moment on the Earth-dated but still worth reading) which goes something like this: Always predict catastrophe soon enough to worry people, but far enough in the future that people will forget when you are wrong.
To this I add what I call the Gore-Hansen Interrogative, which goes as follows: Will people like Gore, James Hansen, et al, who traffic in the trope that "we only have ten years left to do something about X" shut up when the ten years are up? (We're down to about two years left on the "ten years left to do something about global warming clock.) Of course this question is absurd: these folks will never shut up, though as we can see with Gore's CurrentTV, people will stop listening. Somewhere I have a collection of these "only ten years left to" statements, starting with UN Secretary General U Thant declaring in 1970 that we only had ten years left to get a handle on the environmental catastrophe or the Earth would be doomed. That's 42 years ago. And yet we're still here.
But be not dismayed! Remember that recycling is a prime virtue of environmentalism, along with the fact that they just can't get Thomas Malthus out of their waking nightmares as we noted here a couple days ago. Something called the Jay W. Forrester Institute at MIT (which seems not to have a website) has issued a study predicting global economic collapse. When? In 2030. Suitably far ahead that this study will be forgotten.
The amazing thing is that this study actually attempts to vindicate the 1972 Club of Rome "Limits to Growth" report. Amazingly the Club of Rome still exists, and they're still on their "limits to growth" jag.
Now step back for a minute and consider this. Recall Bjorn Lomborg's "Litany" of environmental disaster in his 2001 book The Skeptical Environmentalist:
We are all familiar with the Litany: the environment is in poor shape here in Earth. Our resources are running out. The population is ever growing, leaving less and less to eat. The air and water are becoming ever more polluted. The planet's species are becoming extinct in vast numbers-we kill off more than 40,000 each year. The forests are disappearing, fish stocks are collapsing, and the coral reefs are dying. We are defiling our Earth, the fertile topsoil is disappearing; we are paving over nature, destroying the wilderness, decimating the biosphere, and will end up killing ourselves in the process. The world's ecosystem is breaking down. We are fast approaching the absolute limit of viability, and the limits of growth are becoming apparent.
The book that drove them crazy
Now, just how did environmentalists react to this highly accurate summary? They denied it was true. They called it a "straw man." Allen Hammond of the World Resources Institute, for example, argued that Lomborg's Litany "paints a caricature of the environmental agenda based on sometimes mistaken views widely held thirty years ago, but to which no serious environmental institution subscribes today." (Emphasis added). Michael Grubb of Cambridge University, one of Britain's leading environmental figures, wrote in a Science magazine review of Lomborg that "to any professional, it is no news at all that the 1972 Limits to Growth study was mostly wrong or that Paul Ehrlich and Lester Brown have perennially exaggerated the problems of food supply."
Even the original authors of TheLimits to Growth study backed away from their original confidence in doomsday. In a 2004 thirty-year update to The Limits to Growth, the authors confessed that "we are not predicting that a particular future will take place. . . . We do not believe that available data and theories will ever permit accurate predictions of what will happen to the world over the coming century."
But like recovering alcoholics who succumb when walking past a busy and well-lit tavern, environmentalists just can't help themselves. Hence the new MIT study, which is just a recycled version of the old study. So where are the Hammonds and Grubbses of the environmental world to repeat their disclaimers of 2001 that no serious environmental organizations believe this kind of environmentalism? That's right: they were lying. They all believe it. They always will.

The Smithsonian notes that several experts strongly objected to "The Limit of Growth's" findings, including the late Yale economist Henry Wallich, who for 12 years served as a governor of the Federal Research Board and was its chief international economics expert. At the time, Wallich said attempting to regulate economic growth would be equal to "consigning billions to permanent poverty."
Drawing on Obama's luncheon speech on the budget to (his supporters at) the AP this week, the RNC has posted the video below comparing this year's model with last year's. Hmmm. Same as it ever was - as the RNC has previously demonstrated for Obama's 2011 and 2012 State of the Union addresses.
The RNC calls the ad "Same tired rhetoric." Tired rhetoric is no crime. What can we learn from it? The RNC doesn't say. I have a few thoughts, as I'm sure readers do as well.
There is no premium on originality in political rhetoric, but Obama is testing the limits. He is extending the concept of recycling into previously uncharted territory. Unlike traditional waste recycling, however, Obama's rhetorical recycling actually saves energy! He's saving the energy of his speechwriters.
In order to soar, words must have the force of truth. Obama left the area some time ago.
There is no contrast between Obama 2011 and Obama 2012. He's been in formal campaign mode since August 2011, and informally well before that. There is a contrast to be drawn - the contrast between Obama as a candidate for election in 2008 and as a candidate for reelection in 2012.
The contrast is stark. In 2008 Obama ran as a redeemer come to save the time. In 2012 Obama is in old hard left class warrior.
Does Obama ever express a thought using words in a new form? It seems that political cliches are the essential medium of his expression. His speeches are like New York Times editorials. They ought to be accompanied by a warning: Reading them can kill brain cells.
Is this really the somewhat interesting guy who wrote Dreams From My Father I doubt it. I don't say Bill Ayers necessarily wrote the book, but it couldn't have been Obama. He has yet to formulate a political thought in an original way.
Conservatives had Obama's number last time, but a lot of voters chose to ignore the evidence and hope he was who he pretended to be. As Samuel Johnson said of remarriage, it was the triumph of hope over experience.
This time around, pretty much everyone has Obama's number. He isn't even trying to conceal it or present it as something other than what it is. That's progress, isn't it?
If Obama is reelected, we will hear a lot more of this. But to what effect? Republican forces in the Senate will be enhanced and probably only modestly diminished in the House. What then? If he is reelected, it will be a long, long four years.
Well, let's hear it from the Talking Heads. Key question: "You may ask yourself, well, how did I get here?"
The left has dominated the arts-pretty much all of them, are there any exceptions other than country music?-throughout the modern era. And yet, how much good left-wing art has been created? Surprisingly little, it seems to me. But the latest from Gunter Grass is an especially lame instance of the genre.
Grass, if you don't recall him, is an 84-year-old German novelist whose best-known work is his first book, The Tin Drum, which was set before, during and after World War II. Grass was awarded the Nobel Prize for Literature in 1999, even though his writing has had little impact for some decades. At one time, Grass was hailed as the conscience of post-war Germany, but then it came out that he served in a Waffen-SS Panzer division in the latter part of the war. I don't hold that against him; he was really a boy at the time. Still, most people, if they had a stint in the SS in their past, would have the delicacy to avoid posing as a moral arbiter.
Not Gunter Grass. Inoculated by his left-wing politics, he assumes the right to instruct others, most recently, his bete noir, the state of Israel-again, a target that a former SS soldier might deem it prudent to avoid. Grass has written a poem called "What Must Be Said," which has been published this week in multiple European newspapers, including the Sueddeutsche Zeitung and Italy's La Repubblica. Grass's poem warns against a possible strike by Israel against Iran, and protests Germany's sale of a submarine to Israel.
The politics are entirely predictable, but what I want to comment on is how terrible the poem is. You can read a translation of it here. Now, to be fair, any poem will lose something in translation, and this particular version sounds a bit like instructions for use of a product that were written in German and translated into English. But is there any conceivable translation that could turn this into actual poetry?
That is the claimed right to the formal preventive aggression which could erase the Iranian people dominated by a bouncer and moved to an organized jubilation, because in the area of his competence there is the construction of the atomic bomb.
Or this:
Now, since my country, from time to time touched by unique and exclusive crimes, obliged to justify itself, again for pure business aims - even if with fast tongue we call it "reparation" - should deliver another submarine to Israel, with the specialty of addressing annihilating warheads where the existence of one atomic bomb is not proved but it wants evidence as a scarecrow, I say what must be said.
And this:
And I admit: I won't be silent because I had enough of the Western hypocrisy; Because I wish that many will want to get rid of the silence, exhorting the cause of a recognizable risk to the abdication, asking that a free and permanent control of the Israel atomic power and the Iran nuclear bases will be made by both the governments with an international supervision.
Other news sources have quoted somewhat different translations, but you get the picture. That isn't poetry, it is mindless left-wing noodling with occasional line breaks.
I don't think there was ever actually a time when patriotism was the last refuge of a scoundrel, but isn't it obvious that leftism is the last refuge not only of scoundrels, but of the untalented, the over the hill, the too scared to be anything but conventional, and the depraved?

The idea that government could replace the family is probably not something the average American would support. Yet, the average American might support Head Start programs, whereby the government taxes you to provide "pre-school" services for children. Most Americans might also bee in favor of federal support of K-12 education - a la, the No Child Left Behind Act. We also expect the government to take care of our retirement (Social Security) and our health insurance once we retire (Medicare). We also expect government to provide health insurance for our indigent relatives under Medicaid.

Why We Celebrate
Today on Good Friday, we think about the cross and the sacrifice paid for our sins; the amazing love that took our place and the grace we have been given. That kind of sacrifice is almost impossible to imagine. But we see a small glimpse of that love every day in the firefighters and policemen who risk their lives for strangers. We see it in the heroism of our men and women in uniform, who sacrifice their todays for our tomorrows.
I was reminded of that sacrifice as the week began, when Sergeant Dennis Weichel, 29, was laid to rest in Providence, Rhode Island. Sgt. Weichel gave his life to save an Afghan boy who ran in front of a 16-ton armored fighting vehicle. Weichel threw the boy to safety, but was himself hit. Sergeant Dennis Weichel was posthumously awarded the Bronze Star for his heroism and is survived by his wife and three children. Sergeant Weichel's sacrifice reminds us that every life is precious, each person made in the image of our Creator.
As a child, when I read the Easter story, there was a part of me that wanted a different ending. If only He had come down from the Cross and destroyed His enemies -- that would have demonstrated His power. That is what I thought then. Of course, now I know how wrong that thought was.
Christ had to die so that we might have everlasting life. His sacrifice on the cross saved all who believe in Him. Others, however, follow a god who demands that they seek their own death and the deaths of others to achieve salvation. What a contrast!
Ultimately, it is not the birth of a man that Christians celebrate. Nor do we gather on Easter morning to remember a martyr. We have confidence because of Christ's resurrection as the living Son of God. If Christ had not risen from the grave and ascended into Heaven, He would have been forgotten as a common criminal whose birthday would have no significance.
Thank God for the cross and the empty tomb! Carol and I send our love to you and yours. This weekend, may each of you find a remembrance of the peace that surpasses all understanding.
