Appeals court fires back at Obama's comments on health care case

(CBS News) In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president's bluff -- ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.
The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president's comments yesterday about the Supreme Court's review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was "confident" the Court would not "take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."
Overturning a law of course would not be unprecedented -- since the Supreme Court since 1803 has asserted the power to strike down laws it interprets as unconstitutional. The three-judge appellate court appears to be asking the administration to admit that basic premise -- despite the president's remarks that implied the contrary. The panel ordered the Justice Department to submit a three-page, single-spaced letter by noon Thursday addressing whether the Executive Branch believes courts have such power, the lawyer said.
The panel is hearing a separate challenge to the health care law by physician-owned hospitals. The issue arose when a lawyer for the Justice Department began arguing before the judges. Appeals Court Judge Jerry Smith immediately interrupted, asking if DOJ agreed that the judiciary could strike down an unconstitutional law.
The DOJ lawyer, Dana Lydia Kaersvang, answered yes -- and mentioned Marbury v. Madison, the landmark case that firmly established the principle of judicial review more than 200 years ago, according to the lawyer in the courtroom.
Smith then became "very stern," the source said, suggesting it wasn't clear whether the president believes such a right exists. The other two judges on the panel, Emilio Garza and Leslie Southwick--both Republican appointees--remained silent, the source said.
Smith, a Reagan appointee, went on to say that comments from the president and others in the Executive Branch indicate they believe judges don't have the power to review laws and strike those that are unconstitutional, specifically referencing Mr. Obama's comments yesterday about judges being an "unelected group of people."

This month, NBC News broadcast a heavily edited tape of George Zimmerman's 911 call in the Trayvon Martin case. The tape itself was fully available. Over the years, many friends of Hillsdale, those who never attended college here, have said to me: "Dr. Arnn, I wish I could take Hillsdale's Constitution course!"
In response to these requests, this past year, for the first time ever, Hillsdale College offered the "Introduction to the Constitution" lecture series at no charge. Frankly, I wasn't sure what sort of a response a course like this would have.
That's why I was excited to see that YOU and almost 200,000 other people from all over the United States registered for "Introduction to the Constitution."
Thank you very much for registering and participating. I hope you learned a lot from the series.
I was thrilled, not only by the response, but at what it indicates: Americans are willing and eager learn about the Constitution and to defend the principles of liberty that made America so prosperous!
And this re-awakening of national interest in the Constitution comes not a minute too soon.
Now, for the first time ever, Hillsdale College is offering a no-cost 10-week online Constitution course based on the class Hillsdale College students must complete for graduation:

This course on the U.S. Constitution is available online at no charge to anyone who wants to understand and defend the timeless principles of liberty upon which our nation was founded!

"Constitution 101" begins on February 20, 2012, and concludes the week of April 30. It will cover such topics as the Declaration of Independence and its connection to the Constitution, how the Constitution is structured to protect individual liberty and ensure good government, the crisis of constitutional government faced by Abraham Lincoln during the Civil War, and modern challenges to the Constitution during the "Progressive" era.
It is my honor to teach the first class, "The American Mind," and the final class, "The Recovery of the Constitution." All of the classes will be taught by Hillsdale College professors - the top teachers in their field and the same ones who instruct our students here on Hillsdale's campus.

The bad news is last month some well intentioned political activist announced a cut-off date for signing up co-sponsors for Rep. Rose Marie Swanger's American Law's for American Courts (HB 2029) in an effort to inject some urgency into the effort.
What it resulted in was an interruption of the campaign to encourage those Representatives not yet signed on as co-sponsors to join with those Legislators who have already recognized the death by smothering threat to our Constitution.
The good news is there is no cut-off date for adding co-sponsors and we are once again asking your readers to contact their representatives and ask they join the battle.
There are only three Representatives from Bucks who are co-sponsors, Representatives Clymer, Petri and Quinn and we thank them for showing their colors.
But that leaves seven more Representatives who appear to be still standing on the sidelines as the battle for our existence as a free people is joined.

Our laws have worked just fine since colonial times. What is needed are politicians who respect them. And you know whose job it is to remind them of that.

CAIR's Fight Against Pennsylvania Foreign Law Bill

Resistance to a new bill aimed at limiting foreign law in Pennsylvania courts serves as a case study of how Islamists and their allies operate: peddling falsehoods about Shari'a, painting Muslims as victims, and denying that anyone seeks to institutionalize aspects of Islamic law - even as they vigorously promote that very agenda. With similar legislation being debated across the U.S., understanding their tactics is critical.
At issue in Pennsylvania is House Bill (HB) 2029, which stipulates that "a tribunal shall not consider a foreign legal code or system which does not grant ... the same fundamental liberties, rights and privileges" as guaranteed by the federal and state constitutions. Introduced in November, it follows the American Laws for American Courts (ALAC) model and makes no mention of Shari'a. A preliminary memo sent to legislators last June in the name of Rep. RoseMarie Swanger, HB 2029's chief sponsor, does highlight Islamic law, but she later said that it had been circulated accidentally. Regardless, concerns about Shari'a are warranted due to its many provisions that conflict with the standards of American jurisprudence. For example, it disadvantages women in terms of inheritance, divorce, child custody, and other areas of family law. Shari'a already has shaped numerous cases nationwide, including in Pennsylvania, where one state court decided how assets should be distributed according to Islam.
Pushback against HB 2029 has been led by the Philadelphia office of the Hamas-linked Council on American-Islamic Relations (CAIR-PA) and was punctuated by an interfaith press conference (video here) at CAIR-PA headquarters on December 14. The overall campaign reflects CAIR's usual recipe of distortion, victimology, and contradiction between words and deeds.
Attacks on bills like HB 2029 begin by sowing confusion about Shari'a. Because Islamic law encompasses virtually every facet of life - governing personal activities such as eating and worship, but also forming an oppressive social and legal structure - suit-and-tie Islamists work to emphasize its unthreatening pieces whenever possible. CAIR-PA executive director Moein Khawaja's suggestion that Shari'a should worry Pennsylvanians no more than halal gyros is a fine example of this technique.

RedState Morning Briefing
For April 5, 2012
1. Welcome Back, Baseball At last, the long winter of our discontent is over. America's pastime has returned to its home fields. Last night, the World Champion Cardinals took on the revamped Miami Marlins in the United States opener. The Cardinals beat the Marlins 4 to 1 on the Marlins' home turf with Muhammad Ali throwing the first pitch. Today, the other 28 teams return to work. Although the game has changed to a huge extent since the days when fielders (including catchers) played barehanded and pitchers threw underhanded from 50 feet, and although the game has become almost as international in character as soccer, as fans file into stands today and tomorrow bedecked in their favorite team's gear, baseball remains an affirmation of the rebirth of spring and of our uniquely American sense of community and competition. And for fans of all 30 teams (except the Astros), it is a day of eternal hope.
2. Is This A Subtle Bias At Reuters?
In a story about the White House in damage control mode over the President's rather stupid remarks on the Supreme Court, Reuters reports the following:
"What he did was make an unremarkable observation about 80 years of Supreme Court history," Carney told reporters during a White House briefing dominated by the topic.

The president, who taught constitutional law at the University of Chicago, qualified the remark a day later by stressing he meant action by the Court on a matter of commerce, a legal distinction that cut little ice with his critics.

Since the 1930s the Supreme Court has without exception deferred to Congress when it comes to Congress's authority to pass legislation to regulate matters of national economic importance such as health care, 80 years," Carney said.
What Reuters did not bother to report is that, in fact, the Supreme Court has ruled unconstitutional a piece of legislation that passed with a bipartisan majority via the commerce clause just 17 years ago.
3. By Jon Bruning's Own Logic, Is He Into Gay Marriage and Inappropriate Relationships With Kids?
What a miserable question to have to ask about Nebraska Attorney General and Republican Senate Candidate Jon Bruning - in effect is he, at best, a creepy pervert and at worst a monster. But before you pick up pitch forks and torches against me for asking the question, you need to understand that this is Jon Bruning's own tortured logic in the Nebraska Senate Republican Primary.
Jon Bruning, the Attorney General of Nebraska all but accused his primary opponent, Don Stenberg, of being a pedophile. Bruning did so in a Senate primary debate when the debate kept coming back to Jon Bruning still defending Barack Obama's Attorney General, Eric Holder.
I wish I were making it up, but I am not. Even the Democrats in Nebraska had to jump in and point out that based on Jon Bruning's "evidence" about Don Stenberg, Jon Bruning is guilty of the same.
I warned each and every one of you that Jon Bruning had a reputation for being a hot head who would meltdown under the pressure of a campaign. As appalling as it is, he has done so. If he's resorting to suggesting his primary opponent is a pedophile to distract from inconvenient facts about his support of Eric Holder, to what new depths will the man sink in a general election? To what extent will he embarrass the GOP?
4. Obama's Continuing Assault on the Law, History, and Facts
In the wake of President Obama's moronic and widely-lampooned comments on judicial review yesterday, President Obama offered the following lame (and incorrect) walkback .
5. Does Harry Reid have the courage to boycott MSNBC over Lawrence O'Donnell's bigotry?
It's a valid question, I think, given the way that Lawrence O'Donnell viciously and insultingly went after Mormonism last night on that network. Goodness knows that I have my problems with Senate Majority Leader Harry Reid. And I have no intention of converting to the LDS faith any time soon, or indeed at all. But to say "Mormonism was created by a guy in upstate New York in 1830 when he got caught having sex with the maid and explained to his wife that God told him to do it" in the pursuit of crude partisan purposes is an insult that splatters far beyond its designated target (in this case, Mitt Romney).
I understand that Harry Reid was a boxer, when younger. If the Senator takes this punch without hitting back, then those days are long gone for him, indeed.
6. Mike Lee Wants to End the 'Monetary Morphine' at the Fed
What's worse than Congress picking winners and losers and distorting the free-market with bailouts, stimulus, and tendentious interventions on behalf of specific industries? Unelected members of the Federal Reserve doing the same through monetary policy.
It is amazing to watch how many Republicans will speak with such conviction against Keynesian fiscal stimulus policies, yet they will fervently promote monetary stimulus policies by the unaccountable Federal Reserve. Their support for near-zero interest rates, quantitative easing, bailouts, and intervention in the housing sector has muddled our message against Obama's anti-free-market policies. Moreover, in this time of record commodity prices, pro-(monetary) stimulus Republicans preclude us from showing how government intervention on behalf of special interests distorts the markets, depletes savings, and devalues the currency - a winning political argument if there ever was one.
7. Our Dangerous Dependence on Foreign Chocolate
America is addicted to chocolate. Foreign chocolate.
A majority of us consume chocolate each day. Although the U.S. produces only 6% of the world's cocoa, we consume more than 20%.
The threat is obvious. It's time for government to step in and promote alternatives.
Any day, President Obama will be barnstorming the country to tell us, "If we really want chocolate security and chocolate independence, we've got to start looking at how we use less cocoa and use sources that we can renew and that we can control, so we are not subject to the whims of what's happening in other countries."
Today, we are at the mercy of Africa, which produces over 75% of the world's cocoa. That's an unstable source, which means our chocolate dependency undermines national security.
Each of us probably began with that first innocent M&M but now it's an unsustainable $13-billion a year habit. The average American eats 11 pounds of chocolate per year. We gain weight from chocolate. Pimples get blamed on chocolate.
Fortunately, alternatives exist. With proper federal loans and subsidies these can relieve our cravings and wean us from our addiction to chocolate.

Tasked with administering and enforcing the state's anti-discrimination laws, the Pennsylvania Human Relations Commission (PHRC) has become entangled in aiding an offshoot of the Muslim Brotherhood in its goal of stigmatizing and silencing any criticism of Islam or Muslims, including those engaged in terrorism.
The law that created the PHRC empowers it to:
Track incidents of bias that may cause community tension and to educate the general public, law enforcement, educators, and government officials in order to prevent discrimination and foster equal opportunity.
Occurrences labeled "bias incidents" are logged into a monthly "bias report" that is forwarded to the Pennsylvania State Police, who decide whether to investigate items appearing there. Take the Jewbags case of Danielle Gilbert, a staffer for Democratic National Committee chairwoman Debbie Wasserman-Schultz who had been appointed the DNC's Jewish outreach liaison. In a social media mishap, Gilbert posed along with her friends in a photo that she captioned "JEWBAGS" and that a friend of hers captioned as "Jew cash money team." This is the sort of incident that the hip crowd that thinks Heeb is a great name for a magazine and Jewcan Sam is hilarious will laugh off. But it's hardly the most offensive thing about Gilbert from a Jewish perspective. It's just a symptom of the problem. Debbie Wasserman-Schultz has long been associated with J-Street, the Anti-Israel group, which has repeatedly worked to undermine Israel's fight against terrorism through a campaign of deception. When a delegation from J Street arrived at Schultz's office last year, they were received by Danielle Gilbert who posed with them for a photo. That wasn't the limit of Gilbert's involvement with J Street. Danielle Gilbert's twitter feed suggests that she attended the J Street conference and she retweeted a call from the Anti-Israel group to freeze "settlements". Gilbert's own Anti-Israel background isn't casual. She attended the London School of Economics and Political Science and while there was part of the Association for the Study of Ethnicity and Nationalism. Even before going to Yale, Gilbert had volunteered at Givat Haviva, a leftist group dedicated to Muslim pro-terrorist activism. Givat Haviva had a presence at the J-Street conference and has its roots in Kibbutz Artzi, which was far enough to the left that it identified closely with the Soviet Union and its leader eulogized Stalin who had engaged in the mass murder of Jews. The roots of Givat Haviva lie with Artzi's Arab Department whose goal was a one state solution. Ilan Pappe founded and ran the Academic Institute for Peace in Givat Haviva. Pappe is a former member of Hadash, the Arab-Israeli Communist party, who supports the destruction of Israel via a One State Solution. An article on the Givat Haviva website features a photo of Danielle Gilbert with one of her friends, who writes about his support for the One State Solution.

Harper: Thanks to Obama's "no" on Keystone, the price of Canadian crude will go up for the U.S.

The damage is done. Even if President Barack Obama decides to approve the Keystone XL pipeline at some point in the future, he already sent a message to Canada that our northern neighbor can't rely on us as its only energy customer - and Canadian prime minister Stephen Harper heeded it.
In an interview with former U.S. Rep. Jane Harman (D-Calif.) in D.C. yesterday, Harper explained that Canada will now seek to expand its export market to Asia and will also cease to supply oil to the United States at a discounted rate.
"Look, the very fact that a 'no' could even be said underscores to our country that we must diversify our energy export markets," Harper told Harman in front of a live audience of businesspeople, scholars, diplomats, and journalists. ...
Harper also told Harman that Canada has been selling its oil to the United States at a discounted price.
So not only will America be able to buy less Canadian oil even if Keystone is eventually approved, the U.S. will also have to pay more for it because the market for oilsands crude will be more competitive.
"We have taken a significant price hit by virtue of the fact that we are a captive supplier and that just does not make sense in terms of the broader interests of the Canadian economy," Harper said. "We're still going to be a major supplier of the United States. It will be a long time, if ever, before the United States isn't our number one export market, but for us the United States cannot be our only export market.
"That is not in our interest, either commercially or in terms of pricing."
"We cannot be, as a country, in a situation where our one and, in many cases, only energy partner could say no to our energy products. We just cannot be in that position."
Harper's comments came the same day that Barack Obama's Super PAC, Priorities USA, released an ad that sought to tie Mitt Romney to Big Oil. The ad was itself a response to an ad underwritten by the American Energy Alliance that attacked Obama on his energy record and warned that this administration would be content to see gas prices rise as high as $9 a gallon.
This fallout from the president's decision on Keystone XL underscores the truth that Obama does not make policy decisions in a vacuum. He'll do what he will - and other countries will respond accordingly. Our famously "cerebral" leader might have preferred to have had more time to "sufficiently review" the project, but he didn't. In the time frame he was given, he made his priorities perfectly clear: He cares more to retain the support of certain constituencies than to approve a project that would have created thousands of jobs and signaled to Canada that we're committed to ensure a supply of affordable energy for ourselves. The American Energy Alliance had it right: The president's energy policies have done nothing to secure America's energy future. We'll be ever more at the mercy of the oil-producing countries the president likes to blame so much.

President Obama: An Advocate for a Restrained Judiciary?
Yesterday in a joint press conference with the Canadian prime minister and Mexican president, President Barack Obama expressed his confidence that the Supreme Court will uphold his signature health care law, following more than six hours of oral argument before the Court last week. Obama suggested that the Court-not Congress-would be taking an "unprecedented, extraordinary step" if it overturned Obamacare despite the fact that the Court will need to stretch its Commerce Clause jurisprudence to the outer limits to find that Congress' mandate that people buy inflated health insurance plans is a proper exercise of Congress' power to regulate commerce. But putting on his "constitutional law professor" hat, Obama chastised the Court, noting that the justices must exercise judicial restraint and resist the temptation to strike down a law passed by "a strong majority of democratically elected Congress." As Robert Alt argues, the President distorted the meaning of judicial activism in an effort to influence the justices as they determine the fate of Obamacare. Alt explains that judicial activism occurs...
...when judges write subjective policy preferences into their legal decisions rather than apply the constitutional or statutory provisions according to their original meaning or plain text. It does not necessarily involve striking down laws, but may occur when a judge applies his or her own policy preferences to uphold a statute or other government action...clearly forbidden by the Constitution. Not only does Obama misunderstand the proper role of a judge, but he's twisting the facts as well, claiming that Congress passed ObamaCare with a "strong majority." That's a bold misrepresentation (the House passed it 219-212 on party lines and the Senate passed it with 60 votes) and is simply a "rank attempt to intimidate" the Court into upholding Obamacare. With any luck, the justices will tune out this and any other attempt to sway them as they evaluate the constitutionality of Obamacare. "Someone will have to remind President Obama the Supreme Court is a co-equal branch of government, part of a system of checks and balances designed to rein in precisely the kind of runaway government exhibited by his administration. Our community-organizer-in-chief has a different opinion. 'Ultimately, I am confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress,' Obama said at a news conference with the leaders of Canada and Mexico. ... This is precisely what the Supreme Court is designed to do -- determine the constitutionality of laws passed by democratically elected legislatures and Congress. Surely the constitutional law professor has heard of Marbury v. Madison, the 1802 case that formed the basis for the exercise of judicial review in the United States under Article III of the Constitution. It was also the first time in Western history a court invalidated a law by declaring it 'unconstitutional.' Such an action is not unprecedented. ... By one estimate, the Supreme Court has struck down 53 laws between 1981 and 2005 alone. The president speaks of a law passed by a 'democratically elected Congress' yet it was a bill no one had read and which House Speaker Nancy Pelosi said we had to pass to find out what was in it. The fact is, most of the rules and regulations are written by unelected bureaucrats authorized by a bill that refers not to 'we the people' but to 'the secretary shall determine.' ... To say the bill passed 'a strong majority' of a democratically elected Congress is an overstatement. The bill passed the House with a vote of 219-212, a majority of seven, with 34 Democrats defecting. ... This isn't the first time President Obama has lectured the Supreme Court. In his State of the Union address on Jan. 27, 2010, he shamefully scolded the justices on national television for 'having reversed a century of law' in a ruling in which the court was protecting the freedom of political speech enshrined more than two centuries ago in the First Amendment. We've heard the words of German Pastor Niemoller who lamented that he stood by and did nothing as the Nazis murdered people by category.
Niemoller said, "First they came for the Jews and I did not speak out because I was not a Jew," and so on.
For the past three years Barack Obama could be paraphrasing Niemoller. Obama might have said, "First I attacked Christians, especially Catholics trying to force them to violate their religious beliefs. When I lost them as supporters I didn't care because I had lots of other supporters."
He could have said, "I attacked oil producers with Cap and Trade and my support fell. Since I had other groups to vote for me I didn't care."

If the Supreme Court has followed long standing tradition, the preliminary decision as to the Constitutionality of the ObamaCare individual mandate and perhaps the fate of the law itself was known to the Justices on Friday of last week.
After oral arguments it is common practice for the Justices to meet Friday morning in a conference room where each Justice votes on the case, beginning with the Chief Justice and proceeding according to seniority. Shortly thereafter Justices will be assigned the writing of majority and minority opinions and comment on various case issues. Decisions can change over the months until presentation of the final ruling, which in the case of ObamaCare will probably be sometime in late June. (1)
Whatever happened Friday morning, it's a safe bet Barack Hussein Obama was the 10th person to know, having undoubtedly received a call from Elena Kagan minutes after the meeting ended.

Morning Bell: The President's Curious Speech Lacks Solutions
If you're looking for an iron-clad indictment of Barack Obama's failed fiscal policies, you don't have to look much farther than the President's own words in a speech he delivered yesterday at the Associated Press luncheon in Washington, D.C.
In what was seemingly an attempt to criticize House Budget Committee Chairman Paul Ryan's (R-WI) FY2013 budget plan - the only such proposal to emerge from either the House or the Senate - the President dredged up his stale complaints about President George W. Bush's policies - many of which he has maintained - and turned to scary rhetoric about Trojan horses and social Darwinism in order to paint the conservative vision for fixing America's budget crisis as a radical one.
To help bolster his case that more Obama-style policies are needed, the President detailed the problems America is still facing, despite three and a half years of his own policies:

Bauer COUNTDOWN TO VICTORY: 216 DAYS TO THE 2012 ELECTIONS Obama Unhinged In his speech to reporters yesterday Barack Obama unleashed a barrage of rhetorical falsehoods and demagoguery at the latest budget proposal by Rep. Paul Ryan, which was approved by House Republicans. Obama went beyond policy disagreements and set out to demonize the GOP with slashing rhetoric and alarming adjectives. The goal of Obama's attack was to portray himself as a moderate or centrist and portray the GOP as extremists. Here are some of the ways Obama described Ryan's budget: "radical," "a Trojan horse," "a prescription for decline" and "thinly veiled social Darwinism." (That's odd -- I thought liberals were big fans of Darwin.) At one point, Obama even suggested that Ronald Reagan could not win a Republican primary today because the GOP is so extreme. How ironic. When Reagan ran, the left tried to paint him as an unelectable right-wing extremist! They were wrong about Reagan then, and Obama is wrong about the GOP today. Unbelievably, Obama also complained to his left-wing media allies saying, "This is not a situation where there is equivalence." Translation: Conservatives have no legitimate point of view you should be covering. Once again, Obama's intolerance for dissenting points of view was on full display. The editors of the Wall Street Journal fired back today and summarized well the president's over-the-top attacks. Here's an excerpt from the Journal's editorial:
"The President's depiction of the wonkish and formerly obscure House Budget Chairman as some political monster is itself telling. Mr. Obama is conceding that he can't run on the economic recovery, the stimulus, health care, green energy or any of the other grand liberal ambitions that have dominated his time in office. All of those are unpopular or failures. He was elected on hope and change, but now his only hope is to change the subject to the ogres he claims are the disloyal opposition. Did you hear about the GOP's red-in-tooth-and-claw plan for Medicare? Grandma and Gramps are going to be drafted for the Hunger Games."
If you're not familiar with the Hunger Games, it is a popular movie in which teenagers are forced to fight for food in a post-apocalyptic world. But the Journal's underlying point is one we have made repeatedly in this daily report: Obama can't run on his record (as you will read below), so he is going to demonize those of us who fight him and his agenda in a desperate attempt to portray the GOP as a worse alternative. Yet in spite of Obama's vicious personal attacks, we keep hearing over and over again that the one thing the GOP establishment is afraid of doing is attacking Obama. I can guarantee you this much: Obama's entire campaign will be one negative attack after another. According to one reporter, the goal of the Obama campaign is to make the Republican Party radioactive in the next 60 days. They want to so poison people's minds before the campaign traditionally begins in earnest -- after Labor Day -- that there is no chance of the GOP candidate being able to recover by November 6th. Again, my friends, I'm not trying to discourage you. I am trying to prepare you for the fight that lies ahead so you can help your friends and family members see through Obama's distortions and point out his hypocrisy. Judge Assigns Homework To Obama Lawyer As I reported yesterday, Barack Obama stepped way over the line with his outrageous comments attacking the Supreme Court and the separation of powers. Evidently there is one federal judge who agrees with me and had the courage to fight back. A three judge panel of the Fifth Circuit Court of Appeals is currently hearing another case challenging certain aspects of ObamaCare. As Justice Department attorney Dana Lydia Kaersvang began making arguments defending ObamaCare yesterday, Judge Jerry Smith interrupted and demanded to know whether the administration believed the courts have the authority to review the law. "I want to be sure that you are telling us that the Attorney General and the Department of Justice," Smith said, "do recognize the authority of the federal courts through unelected judges to strike acts of Congress or portions thereof in appropriate cases." Kaersvang affirmed the court's authority and referred to Marbury v. Madison, but Judge Smith wasn't convinced and then assigned her some "homework." Judge Smith demanded a letter from the Justice Department due tomorrow outlining the court's authority to review ObamaCare. "The letter needs to be at least three pages, single spaced, no less and it needs to be specific. It needs to make specific reference to the president's statements," Smith said. Kudos to Judge Smith! He, like every other federal official, has taken an oath to uphold the Constitution, and he is taking his responsibility seriously and holding the administration to account for Obama's thuggish attack on the separation of powers. Many GOP senators also spoke out. Senator Mike Johanns (R-NE) said, "What President Obama is doing here isn't right. It is threatening, it is intimidating." Senate Republican Leader Mitch McConnell said that Obama's "attempt to intimidate the Supreme Court falls well beyond distasteful politics. It demonstrates a fundamental lack of respect for our system of checks and balances." Even liberal George Washington University Law Professor Jonathan Turley blasted Obama, saying his remarks were "a cheap shot and beneath a president" and "both unfounded and unwise." Worst Recovery In History Over the next 216 days, Obama is going to do his best to claim the economy is improving, and even if it doesn't, he'll claim it's not his fault because George W. Bush gave us the worst recession in history. Stanford economics professor Edward Lazear published an op-ed this week challenging that premise. Consider these excerpts:
"The Great Depression started with major economic contractions in 1930, '31, '32 and '33. In the three following years, the economy rebounded strongly with growth rates of 11%, 9% and 13%, respectively. The current recovery began in the second half of 2009, but economic growth has been weak. Growth in 2010 was 3% and in 2011 it was 1.7%. Who knows what 2012 will bring, but the current growth rate looks to be about 2%... "Contrast this weak growth with the recovery that followed the other large recession of recent decades. In the early 1980s, the economy experienced a double-dip recession, with contractions in both 1980 and '82. But growth rates in the subsequent two years averaged almost 6%. ... "Are there other factors that may have contributed to the slow recovery that we are experiencing? It would be difficult to argue that government polices over the past three years have enhanced confidence in the U.S. business environment. Threats of higher taxes, the constantly increasing regulatory burden, the failure to pursue an aggressive trade policy that will open markets to U.S. exports, and the enormous increase in government spending all are growth impediments. ... "But unless we move to a set of economic policies that are aimed at growing the economy rather than at promoting social agendas, this may be the first 'recovery' in history that fails to see us return to long-term average growth."
The Economics Of "Green" Energy A big part of the left's agenda is to demonize traditional fossil fuels for causing global warning and force us to use inefficient, expensive and unreliable "renewable" alternatives. Barack Obama made "green" energy a centerpiece of his stimulus package, devoting billions of dollars to subsidizing boondoggles like Solyndra. Reno, Nevada, received a stimulus grant and the Reno Gazette-Journal recently reported on its "success:"
"The city's seven windmills have so far saved Reno $2,785 in energy costs after generating 25,319 kilowatt-hours of electricity. The windmills were installed between April and October 2010 and cost about $1 million out of a $2.1 million federal energy grant given to the city that was part of the stimulus package approved by Congress in February 2009."
Only in the left's bizarro world does it make sense to spend $1,000,000 to save $2,785. More evidence that America cannot afford four more years of Barack Obama.

In 2010, Americans sent a clear message to Washington: things need to change. A historic election sent a tea party wave crashing into Washington, reinvigorating fiscal conservatives on a mission to cut spending and get our fiscal house in order.
One of their first victories was a ban on earmarks - the wasteful, special interesting expenditures which lead to "investments" like bridges to nowhere and indoor rainforests, while serving as a gateway drug to reckless spending.

Now lawmakers can't hide in anonymity for wasteful spending. And formerly-routine spending bills - like the highway bill or the reauthorization of the Export-Import Bank - receive greater scrutiny and cannot be passed with what amounts to legislative bribery. Lawmakers cannot use earmarks to grease the skids and encourage lawmakers to "take one for the team."
But now that victory is in danger of being reversed. Some prominent lawmakers on both sides of the aisle are considering a return to earmarking. We cannot let that happen.

Reinstating earmarks would be a significant step backwards in the fight to reform the way Washington works. It would increase spending by returning us to a time where it was acceptable to waste taxpayer dollars on ludicrous projects and "reward" lawmakers who support reckless spending bills.
We cannot allow Congress to reverse conservative victories, especially on earmarks. Lawmakers must be held accountable for their promises. If we are ever to save the American Dream, we cannot allow Congress to fall back into the hands of the Establishment, which has been fighting tooth and nail to maintain the status quo.

The Democrats' Election Forgery Racket
In the age of Obama, party fraud has spread from Chicago outward.

A few weeks ago, Obama senior adviser and seasoned Chicago operative David Axelrod joked on MSNBC about election corruption. Asked whether "vote early and often" scams had come to an end in his shady hometown, Axelrod snarked: "Well, certainly on the air." Yuk, yuk, yuk.
Behind the scenes, Democrats have been busy faking petition signatures, forging ballots, and enlisting medical professionals to authorize fraudulent doctors' notes for liberal teachers' union operatives protesting Republican opponents. It's no laughing matter.
This week, four Democratic officials in Indiana were hit with felony charges related to petition fraud in the state's 2008 primary. The prosecutions are a result of the local South Bend Tribune newspaper's investigation last fall into "hundreds of county residents' signatures" forged on petitions used to put Barack Obama and Hillary Clinton on the Democratic primary ballot. At least two whistle-blowing government officials came forward to expose the forgery racket, which court documents say was formulated by Democratic party officials inside local party headquarters.
A veteran county Democratic party chair, Butch Morgan, resigned in October over the scandal; three employees in the St. Joseph County voter-registration office reportedly helped Morgan execute the scheme. Among the hundreds of unsuspecting residents whose names were illegally signed to the petitions: the prosecuting attorney in the case and a former Democratic governor of the state!
That's the audacity of ACORN-style hoaxes.
Without the phony signatures, there's a significant chance that Obama would not have qualified for the primary ballot - throwing the validity of the entire election into question.

Coke caves in face of Democratic boycott threat

Democratic officials Wednesday launched a two-pronged attack on states with new laws requiring identification before voting, the highlight being a call to boycott Coke, Walmart and others that back a leading organization pushing for voter ID laws.
Coke was quick to react to the political boycott threat, pulling support from the targeted group just five hours after it was called. Walmart said that support for a group does not mean it backs every decision by those groups.

Alas, we still have Rick Santorum saying Obamacare is the same as what he calls "Romneycare"; the otherwise brilliant Mickey Kaus sniffing that if states can mandate insurance purchases, then we're "not talking about some basic individual liberty to not purchase stuff" (no, just the nation's founding document, which protects "basic individual liberties" by putting constraints on Congress); and the former law professor, Barack Obama, alleging that a "good example" of judicial activism would be the Supreme Court (in his words, "a group of people") overturning "a duly constituted and passed law."
