Year Two of the Obamacare Era

On March 23, 2010, President Obama signed the Patient Protection and Affordable Care Act into law. The law's advocates confidently predicted that it would cut bankruptcies by half, save tens of thousands of lives every year, create 400,000 jobs "almost immediately," and even ensure that no one would ever again have to die of cancer.
In Year One of the Obamacare era, we got a preview of what is to come. We know that Year Three will be pivotal for the law's future, between the Supreme Court and the November election. But it was what we learned in the last twelve months that set the stage for this pivotal, upcoming year. MAY 2011 Massachusetts continued to give us a preview of what Obamacare would do to the country. In May, studies found that, contrary to what was promised, the new health-care regime increased emergency-room crowding, and increased already-long wait times for doctors' appointments.

The Kitchen Table Patriots are joining with a confederation of other Pennsylvania Tea Party, libertarian, conservative, Constitutional, Patriot, and 9-12, organizations to have a consensus on a single candidate that reflects the passion, principles, values and commitment of the grassroots as well as has the acumen and gravitas to beat Senator Bob Casey in November. All the groups would then commit to supporting this one candidate in the primary.

Over the years, many friends of Hillsdale, those who never attended college here, have said to me: "Dr. Arnn, I wish I could take Hillsdale's Constitution course!"
In response to these requests, this past year, for the first time ever, Hillsdale College offered the "Introduction to the Constitution" lecture series at no charge. Frankly, I wasn't sure what sort of a response a course like this would have.
That's why I was excited to see that YOU and almost 200,000 other people from all over the United States registered for "Introduction to the Constitution."
Thank you very much for registering and participating. I hope you learned a lot from the series.
I was thrilled, not only by the response, but at what it indicates: Americans are willing and eager learn about the Constitution and to defend the principles of liberty that made America so prosperous!
And this re-awakening of national interest in the Constitution comes not a minute too soon.
Now, for the first time ever, Hillsdale College is offering a no-cost 10-week online Constitution course based on the class Hillsdale College students must complete for graduation:

The bad news is last month some well intentioned political activist announced a cut-off date for signing up co-sponsors for Rep. Rose Marie Swanger's American Law's for American Courts (HB 2029) in an effort to inject some urgency into the effort.
What it resulted in was an interruption of the campaign to encourage those Representatives not yet signed on as co-sponsors to join with those Legislators who have already recognized the death by smothering threat to our Constitution.
The good news is there is no cut-off date for adding co-sponsors and we are once again asking your readers to contact their representatives and ask they join the battle.
There are only three Representatives from Bucks who are co-sponsors, Representatives Clymer, Petri and Quinn and we thank them for showing their colors.
But that leaves seven more Representatives who appear to be still standing on the sidelines as the battle for our existence as a free people is joined.

Our laws have worked just fine since colonial times. What is needed are politicians who respect them. And you know whose job it is to remind them of that.

CAIR's Fight Against Pennsylvania Foreign Law Bill

Resistance to a new bill aimed at limiting foreign law in Pennsylvania courts serves as a case study of how Islamists and their allies operate: peddling falsehoods about Shari'a, painting Muslims as victims, and denying that anyone seeks to institutionalize aspects of Islamic law - even as they vigorously promote that very agenda. With similar legislation being debated across the U.S., understanding their tactics is critical.
At issue in Pennsylvania is House Bill (HB) 2029, which stipulates that "a tribunal shall not consider a foreign legal code or system which does not grant ... the same fundamental liberties, rights and privileges" as guaranteed by the federal and state constitutions. Introduced in November, it follows the American Laws for American Courts (ALAC) model and makes no mention of Shari'a. A preliminary memo sent to legislators last June in the name of Rep. RoseMarie Swanger, HB 2029's chief sponsor, does highlight Islamic law, but she later said that it had been circulated accidentally. Regardless, concerns about Shari'a are warranted due to its many provisions that conflict with the standards of American jurisprudence. For example, it disadvantages women in terms of inheritance, divorce, child custody, and other areas of family law. Shari'a already has shaped numerous cases nationwide, including in Pennsylvania, where one state court decided how assets should be distributed according to Islam.
Pushback against HB 2029 has been led by the Philadelphia office of the Hamas-linked Council on American-Islamic Relations (CAIR-PA) and was punctuated by an interfaith press conference (video here) at CAIR-PA headquarters on December 14. The overall campaign reflects CAIR's usual recipe of distortion, victimology, and contradiction between words and deeds.
Attacks on bills like HB 2029 begin by sowing confusion about Shari'a. Because Islamic law encompasses virtually every facet of life - governing personal activities such as eating and worship, but also forming an oppressive social and legal structure - suit-and-tie Islamists work to emphasize its unthreatening pieces whenever possible. CAIR-PA executive director Moein Khawaja's suggestion that Shari'a should worry Pennsylvanians no more than halal gyros is a fine example of this technique.

Obama A "Post-Racial" President? Think Again
Those Americans who have been able to pry themselves away from their video games,their satellite television,and their sports obsessions have probably heard the tragic story about Trayvon Martin's death. This young African-American was allegedly unarmed when he was shot by Hispanic George Zimmerman,a neighborhood watchman. An FBI investigation is currently being conducted to determine the facts regarding the case. God-fearing Americans,please pray that justice will prevail for all parties involved.
A primary focus of the investigation is the 911 call made by George Zimmerman. The call will be diagnosed by special technicians to determine if George mumbled any racial slurs before the shooting. If it can be proven that he did,then his claim of self-defense will crumble under the weight of a "hate-crime"accusation.
During Obama's presidential campaign,he portrayed himself as the great racial unifier. 1. The Republican Party is playing a dangerous game
There's a lot to like about Paul Ryan's budget proposal. It cuts some spending. It flattens the tax code down to just two individual marginal tax rates. It also includes some innovative policies designed to halt the unsustainable growth of health care entitlement spending. However, on balance, the budget is disappointing for fiscal conservatives for two main reasons: It waives the spending restraint that was agreed to in last year's debt limit deal, and it doesn't balance the budget until 2040. Broken promises and unbalanced budgets as far as the eye can see are neither good policy nor a good campaign rallying cry.
Last year, an agreement was reached in which Republicans gave President Obama a massive increase in the debt ceiling, in exchange for promised spending cuts that supposedly had "real teeth." As part of the deal, Congressman Ryan and most Republicans voted to require an annual spending cap and $110 billion in automatic spending cuts for next year - otherwise known as "sequestration" - if the so-called "super-committee" failed to find $1.2 trillion in deficit reduction.
Since the predictable collapse of the super-committee, the House GOP should have been working toward a budget proposal that allows for the sequester to take place for the coming year. Such a budget would include the $110 billion in reductions. Ryan's budget achieves vastly less. It contains $19 billion in discretionary savings and, at most, $53 billion in cuts to mandatory spending - $38 billion short. Thus, it leaves House Republicans breaking the terms of the deal they agreed to just seven months ago.
2. Liberals, conservatives, values and how we perceive each other Another day, another book I need to buy and hopefully read some day. In the March 21st NYT, Nicholas Kristof reviews a new book: "The Righteous Mind". In it, author Jonathan Haidt discusses some original research that investigates some key values held by conservatives and liberals - and how these two groups perceive each other on these values. I have long been interested in why Republicans and Democrats believe as they do, and this type of research on values zeroes in on this question. A couple of key observations emerge. First, the author points out how both conservatives and liberals adhere to values that are formed around a moral code, but conservatives follow some additional core values that liberals do not. 3. Birthdays, and Dinosaurs, and Slavery, Oh My! Recently, the New York City public school system put out guidelines to providers of test materials to the district. The guidelines included a list of naughty words that should not be included in the materials, so as not to stress out, offend, or cause boo-boos to the children of the city, who are mainly made of glass it would seem. Among the no good, very bad words were "birthday", "dinosaur", "Halloween", and references to junk food, swimming pools, and computers. This, dear friends, is unarguably a good thing. Take, for example, birthdays. Did you know that some people don't celebrate birthdays? And since they don't celebrate them, they would obviously be emotionally distressed to consider that other people do. Tsk, tsk. Likewise, Halloween might evoke paganism, and everyone knows school children are vehemently and actively opposed to such talk, ever since the Great Pagan and Gradeschooler War of nineteen aught seven. Swimming pools and computers, you would imagine, are banned because some people don't have one or both of these things, and might therefore forget what two plus two equals when presented with the horrible reality that some people do. Now yes, I know that computers are actually IN many classrooms. But that is different. Because. 4. Strange Bedfellows: Unions Protesting For The Right To Target Private Residences Get Tea Party Approval Union thugs protesting outside the homes of their targets has become a weapon more and more unions have added to their already-large arsenal. Now that the State of Georgia may become the first state to outlaw the offensive tactic, oddly enough, unions are getting support from an unlikely source-the Tea Party Patriots. Last year, when 45,000 union members struck telephone carrier Verizon, IBEW union radicals showed up outside the home of Verizon CEO Lowell McAdam's House causing a disturbance in McAdam's neighborhood (see video below). In another incident, up to 3,000 CWA protesters conducted a mock funeral outside the home of Verizon's chairman. Though it shouldn't be necessary for any legislature to even have to consider the protection of private residences from protesters, these incidents (and others like it) have drawn the attention of Georgia's legislature, which has moved to pass Senate Bill 469 to prohibit the targeting of individuals at their private residences. 5. Senator Obama Was Correct - The Ex-Im Bank Is Corporate Welfare On September 22, 2008, Senator Barack Obama (D-IL) sounded like a conservative in the below speech. Candidate for President Obama railed against programs "that don't work" like a "reading program that hasn't improved our children's reading." This talk was music to the ears of independent and conservative leaning democratic voters who don't like government waste.

"Pinning down a reliable estimate of the number of Hezbollah operatives who now reside inside the U.S. is difficult because of their operational security expertise," an outline of the report stated. "But some officials estimate that, based on cases uncovered since 9/11, there are likely several thousand sympathetic donors, while operatives probably number in the hundreds." The committee also revealed that Hezbollah sympathizers have been involved in 21 legal cases since 2002-though the links of the accused to the militant group was not necessarily revealed. "Most Hezbollah-linked federal defendants have been Lebanese nationals or naturalized U.S. citizens from Lebanon; many of those charged by the Department of Justice over the past decade remain at large in Lebanon," the report states. "Many defendants were known or suspected of having military training or direct combat experience against Israeli forces," according the report. "Some were quietly convicted of fraud and deported as criminal aliens without their Hezbollah background being publicly disclosed by prosecutors." Hezbollah-more than any other terror group-has the unique ability to flip "a U.S.-based fundraising cell into a lethal terror force, should Iran decide that is in its interests," the report states.

The Total Power of the Mandate
The only real lesson of the ObamaCare defense is that if you define the macro broadly enough, you are entitled to completely control every aspect of the micro. Everyone can be compelled to buy health insurance because health care is no longer a service bought from a doctor, it is a national market which everyone by definition participates in. The market is then divided between good consumers who buy health insurance and the parasites who don't. Alternative possibilities such as people who pay as you go, choose alternative health care or reject medicine entirely for religious or political reasons don't figure into a macro equation which sees people in the macro, not as individuals. Defenders of the Mandate insist that you couldn't similarly force people to buy Broccoli or a Chevy Volt but why not? You might not be able to individually force people to buy a specific product, but once you define a transportation market or an edibles market, you can force people to participate in that market on the terms set by the government and its allied businesses. So there wouldn't be a mandate to buy a Chevy Volt. That would be a crude abuse of power. Instead we can define a transportation market in which everyone is presumed to participate in. Since everyone at some point in their lives has to buy a car, ride in a car or take a bus or a plane somewhere, we can include everyone as a participant in the business of going places. And once everyone has been included in the transportation market, a mandate can then define the terms on which they can participate in that market. Buy a Chevy Volt? No. Buy an electric car or alternative means of transportation which meets a target carbon footprint, or participate in a collective ride sharing system that meets the same requirements. Absolutely yes. And if rather few non-Volt vehicles meet those requirements, that's just incentive for more companies to make their own Volts. Or for you to buy a Volt. Compel you to eat broccoli? That's easy as pie. Everyone already buys food which makes them participants in an edibles market. Since their consumption also affects their health care which now directly interacts with the government, the only way to provide them with affordable health care is to control their diet. Here's one easy way to do it. Compel health insurance companies not to sell plans to anyone who does not commit to follow nutritional guidelines. Then fine them for not having health insurance. Allow them to buy health insurance again only after they agree to regular sessions with a nutritional counselor.

When Goldschmidt was the 30 year old boy Mayor of Portland Oregon in the 1970's it was common knowledge that he was repeatedly consensually raping a 14 year old girl. His staff would see him leave several times a week and knew where he was going.

Bauer COUNTDOWN TO VICTORY: 223 DAYS TO THE 2012 ELECTIONS ObamaCare On Trial: Day Three Can ObamaCare survive without the individual mandate? That was the main point of today's debate before the Supreme Court. Yesterday, a majority of justices appeared highly skeptical of the government's claim that it has the authority to compel individuals to purchase health insurance. The mandate is the heart of ObamaCare. Without it, much of the law becomes untenable. Interestingly, some reporters noted with concern the degree to which the court's liberal members aggressively defended the notion that parts of the law could survive without the mandate. Justice Kagan argued that "half a loaf is better than no loaf," while Justice Ginsburg said, "It's a question between a wrecking operation and a salvage job, and it seems to me the more conservative option is the salvage job." One reporter observed, "The fact that the liberals were very engaged, particularly Justice Kagan, may show that they are very worried that the mandate is going to be held unconstitutional." Why is that relevant? As is frequently the case, the court's majority is likely to hinge on the decision of one man -- Justice Anthony Kennedy. For most of yesterday's arguments, Justice Kennedy appeared hostile to the Obama Administration's defense of the individual mandate. But toward the end of the hearing, just as folks might have concluded he had slammed the door shut on the mandate, Kennedy stuck his foot in the door, saying:
"In the insurance and health care world, both markets -- stipulate two markets -- the young person who is uninsured is uniquely proximately very close to affecting the rates of insurance and the costs of providing medical care in a way that is not true in other industries. That's my concern in the case."
Again, making predications based on oral arguments is difficult, and there is conflicting reporting on the issue. But today a majority of the justices appeared to believe that the law should either stand or fall in its entirety. As Justice Scalia declared, "My approach would be, if you take the heart out of the statute, the statute is gone." Appearing to agree with Scalia, Justice Kennedy said it would be a "more extreme exercise of judicial power" to uphold parts of ObamaCare after striking down the heart of the statute -- the individual mandate. That being the case, it seems we will have to wait until the summer to find out where Kennedy stands on the mandate and to learn the fate of ObamaCare. Calm The Waters Barack Obama is never at a loss for words and he needs to speak up now. The shooting death of Trayvon Martin continues to be exploited by a variety of black nationalists, Black Panther demagogues and race baiters like Al Sharpton and Jesse Jackson. Students protesting in Florida yesterday ransacked a store. On websites discussing the issue the rhetoric is red hot, and there are frequent calls for revenge and violence. An elderly couple -- a 70 year-old school cafeteria worker with a heart condition and her 72 year-old husband -- have temporarily fled their home after their address was mistakenly made public by Spike Lee as the home of George Zimmerman. Obama and Spike Lee are close. In January Lee held a fundraiser for Obama that raised $1.6 million. On Capitol Hill yesterday, House Democrats held a hearing with the parents of Trayvon Martin. Rep. Frederica Wilson (D-FL) declared, "Mr. Zimmerman should be arrested immediately for his own safety." Was that a threat? Why should he be afraid, Rep. Wilson, and who should he be afraid of? This morning Rep. Bobby Rush (D-Chicago), and a former Black Panther, was escorted off the floor of the House of Representatives for wearing a hoodie and sunglasses in violation of House rules on decorum. I checked the congressman's website and saw no statement about the 49 people who were shot, 10 fatally, in Chicago this month. I don't recall any theatrics by the congressman to draw attention to those deaths. But the congressman is willing to violate House rules in order to exploit a tragedy that didn't even occur in his own state. After the assassination attempt on Congresswoman "Gabby" Giffords, President Obama delivered a passionate plea for civil discourse. As the first man of color to be elected president, he has a special obligation now to "call out" black radicals who are trying to stoke street violence or worse. What about it, Mr. President? Do you want your daughters growing up in a country where the rule of law is replaced by mob violence and "high-tech lynchings"? Where is your legendary eloquence? What would Martin Luther King say? Employment Prevention Agency Strikes Again Barack Obama's Environmental Protection Agency took a major step toward implementing his cap and trade scheme by regulation yesterday when it announced new regulations purportedly aimed at limiting emissions from new coal plants. Obama's cap and trade scheme was so radical it could not pass the Democrat-dominated Senate in 2009 and 2010 when Harry Reid controlled a super-majority. But as one Bloomberg report noted: "The rules will permit emissions from new power plants at 1,000 pounds of carbon dioxide per megawatt hour... The limit would effectively preclude construction of new coal-fired plants." Why? Because the only way a new coal plant could possibly meet that limit is through the use of "carbon capture and sequestration" techniques that trap the emissions and pump them underground. But according to industry experts such techniques are "neither economically viable nor commercially available." Jeff Holmstead, a former assistant administrator of the EPA during the Bush Administration, told the Wall Street Journal, "This really is a ban on new coal-fired [electricity] generation. The EPA knows that." Luke Popovich, a spokesman for the National Mining Association, said, "They are threatening to destroy coal-based generation." America gets approximately half of its electricity from coal. We are the "Saudi Arabia of coal." There are tens of thousands of jobs involved in coal mining, transportation and electricity generation. But, once again, the EPA is living up to nickname as the "Employment Prevention Agency." Is destroying the coal industry part of Obama's "all of the above" energy strategy? Of course not. Because Obama doesn't have an "all of the above" energy strategy! As I have reported many times, Obama's energy strategy relies on making traditional sources of energy more expensive. This is part of Obama's stated goal to bankrupt the coal industry, causing electricity rates to "necessarily skyrocket," as he put it. And for what? To fight global warming that isn't happening or climate change that we can't control. Energy is the lifeblood of our economy. It is too important to be held hostage by radical ideologues. It is high time that the American people get control of the EPA and elect politicians who will implement a serious energy strategy. We can do that by voting Obama and his liberal socialist allies out of office on November 6th!

Sense and severability

The issue in the Obamacare argument before the Supreme Court this morning goes under the heading of severability. The issue only becomes relevant if the Court holds Obamacare's individual mandate unconstitutional, the issue before it in the argument held yesterday. Thus the whole argument this morning becomes moot if the Court upholds the mandate.
Having read the transcript and listened to the audio of yesterday's argument, I think it is difficult to escape the conclusion that the mandate is in serious jeopardy. I think one can infer further from the tenor of the argument this morning that the mandate is in deep trouble.
So what is the issue of severability? The issue is whether a given provision of a law can be struck down by itself if found invalid, or if other parts of the law, if not the whole law, must fall with it.
Usually this question is answered by a provision of the law in issue. When enacting statutes, Congress frequently addresses the question with a severability clause providing that if any provision of the law is struck down, the remainder of the law is to survive. It can also address the issue with a nonseverabilty provision, which in my experience is less frequently the the case. The law itself usually answers the question of severability directly.
I think it's fair to say that the intent of Congress controls, even if that oversimplifies things a bit. Judge Vinson addressed the issue of severability and discussed the relevant case law at pages 63-74 of his decision finding the law unconstitutional. (He held the mandate not to be severable from the rest of the law.)
What did Congress intend with Obamacare? The problem in the case before the Court is that Congress - the clowns who enacted and signed Obamacare - didn't expressly say what it intended. The Obamacare law is silent on severability, although one can draw inferences or try to figure out what makes sense under the circumstances. Judge Vinson found the absence of a severability clause significant by inference, because one had been included in an earlier version of the act that became Obamacare.
Representing the 26 states challenging Obamacare, Paul Clement argued that the whole law should fall. The deputy solicitor general representing the United States before the Court this morning asked the Court to remove only the guaranteed issue and community rating provisions of the law if it holds the mandate unconstitutional. Even the Obama administration does not contend that the mandate can fall by itself.
As Adam Liptak explains, the Court appointed attorney H. Bartow Farr III to argue that the rest of the law should survive the fall of the mandate. In that case, the Court would leave Congress to clean up its own mess. The only comment I would make is that, the composition of Congress having changed since the passage of the law, precisely because of the passage of the law, that doesn't seem quite right.

Uncommon Knowledge with Mitch McConnell

In this intensely interesting episode of Uncommon Knowledge with Peter Robinson - interesting from beginning to end - Senate Minority Leader Mitch McConnell takes a look back at the dark days of 2009 when the Democrats held 60 seats in the Senate. With that majority, the Democrats jammed Obamacare down our throats, but without a single Republican vote:
Once it was clear the president was going to try to turn us into a Western European country as rapidly as he could, about the only strategy you have left when your opposition has a forty-seat majority in the House. . .We knew we couldn't stop the agenda. But we thought we had a chance of creating a national debate about whether all of this excess was appropriate. And the key to having a debate, frankly and candidly, was to deny the president, if possible, the opportunity to have any of these things be considered bipartisan.
Mission accomplished.
Toward the end of the interview Senator McConnell casts a gimlet eye on the early start of the Obama reelection campaign in August 2011. Since that time, in Senator McConnell's assessment, Obama has been AWOL. Senator McConnell presents the Readers' Digest version of the unifying theme of Obama's reelection campaign: "It's not my fault."
Senator McConnell recalls that his first memory in life is his last session of physical therapy for the polio he contracted at the age of two. From his rehabilitation, he says, he drew a life lesson in the virtues of doggedness. Justice Kennedy on the Brink

Our former colleague Paul Mirengoff provides his impressions of today's oral argument in Department of Health and Human Services v. Florida:
When all was said and done, it seemed to me that we are where most people outside of the wishful thinking liberal commentariat thought we'd be - with the fate of Obamacare riding on a conflicted Justice Kennedy. To be sure, Chief Justice Roberts did not fully tip his hand. Indeed, he seemed to find force in the government's argument that everyone already is in the affected market here, and that this distinguishes the individual mandate from, say, legislation that would force everyone to purchase cars.
But while the Chief Justice thought the challengers' lawyers were at times overstating their case, he seemed more fundamentally troubled by the government's argument. So if there is a fifth vote to uphold the mandate, it will probably be Justice Kennedy's.
What should we expect from Justice Kennedy? Because the mandate expands the federal government's power at the expense of the individual, this case falls more in Kennedy's conservative wheelhouse than in his liberal one. But will he really pull the trigger and finish off the Obamacare mandate? To me, that seems slightly less than an even money proposition.
I want to conclude by praising Paul Clement's argument on behalf of Florida and the other states. I've long been a Clement fan, but I thought he surpassed himself today, delivering a near perfect argument.
I may be biased, though, so I was happy to read that top-notch Supreme Court advocate Tom Goldstein of Scotusblog, who does not share my biases, called Clement's argument the best he'd ever heard.

Senators Call Obama On His Energy Lies

The Obama administration's energy policies have been a disaster for America. Obama appointed a Secretary of Energy, Steven Chu, who shared Obama's desire that fossil fuel prices increase, so that it would be more expensive for you to drive your car, heat your home, buy groceries, power your laptop, and so on. Obama wanted higher prices in order to reduce carbon emissions and to enrich the Democratic Party fat cats who dominate the "green" energy industry. The administration has carried out its policy of higher fossil fuel costs by reducing exploration for oil on federal lands, imposing draconian standards on coal-fired power plants, banning normal light bulbs, and countless other measures large and small.
Now, however, Obama's re-election campaign is in trouble, in large part because voters aren't happy about being impoverished by Obama's anti-energy policies. So, in an absurd turnabout, Obama has postured himself as an advocate of "drill, baby, drill." In order to defend himself, Obama has repeatedly and consistently lied about his own administration's policies and about America's energy resources. That is a harsh characterization, but there is simply no other way to put it.
Today, Senators David Vitter, Jeff Sessions and John Cornyn called Obama on his lies in the form of a letter to Secretary of the Interior Ken Salazar. Their indictment is devastating:
Dear Secretary Salazar:
We are concerned with the veracity of statements you made in recent weeks regarding domestic energy production on our federal resources. These statements are similar to claims made by other members of the Administration including the President himself. As you may know, the federal government owns almost 2.5 billion acres of mineral estate, an area larger than the entire land mass of the United States. As director of the Bureau of Land Management, Robert Abbey, testified this month, oil production on our federal property is actually down 14% and offshore production from federal areas is down 17% from only a year ago. Just last week, the Congressional Research Service issued a report revealing that 96 percent of the increase in domestic oil production since 2007 has occurred on non-federal lands. It further revealed that in 2011 production on federal public lands has actually declined by an average of 275,000 barrels per day. Oil production on private lands is indeed up year-over-year, but the Administration does not manage private lands and should not attempt to take credit for private market decisions.
Oil production on federal lands increased in 2009 and 2010 as a result of leasing and permitting decisions made before your Administration took office. However, the falloff in leasing and permitting actions under the Obama Administration is apparent, and even your own Energy Information Administration anticipates continued falloff in production in 2012 and beyond.
We also ask that you rectify the President's claim that we only have 2% of the world's oil. Nothing could be further from the truth, as even the Washington Post reported last week.[1] He bases this statement on U.S. "proved reserves" but the U.S. Energy Information Administration has stated that proved reserves is "not an appropriate measure for judging total resource availability in the long-term." As Secretary of Interior, surely you are aware of the vast oil resources we possess both onshore and offshore that are currently off limits due to this Administration's combined actions. America is endowed with resources that exceed a TRILLION barrels of oil.[2]
According to the Institute for Energy Research, "USGS estimates that unconventional U.S. oil shale resources hold 2.6 trillion barrels of oil, with about 1 trillion barrels that are considered recoverable under current economic and technological conditions. These 1 trillion barrels are nearly four times the amount of oil resources as Saudi Arabia's proven oil reserves. We provide the following examples of what we would view as further inaccurate statements by the Administration regarding the state of federal energy production and resources:
1. Claim: "Expanding offshore oil and gas production is a key component of our comprehensive energy strategy to grow America's energy economy, and will help us continue to reduce our dependence on foreign oil and create jobs here at home." Secretary Ken Salazar, DOI Press Release 1/26/2012
Fact: You made the two most pivotal decisions to shrink domestic offshore energy production over the last three years that could have been made. First, you eliminated the 2010-2015 OCS lease plan that would have opened areas of the Atlantic, four geologic basins off S. California, one geologic basin off N. California, while expanding areas in Alaska, including the Cook Inlet. Instead, you have proposed a new 5-year plan that excludes all of the areas of the OCS where the moratorium was lifted in 2008, and reduces the number of planned lease sales by roughly half. Essentially, the moratorium lifted by President Bush and a Democrat Congress in 2008 will continue in effect for a decade under your plan.
2. Claim: The proposed 5-year offshore lease plan will "make more than 75 percent of undiscovered technically recoverable oil and gas estimated on the OCS available for development." Secretary Salazar, DOI Press Release 11/08/2011
Fact: These numbers distort the facts. The Outer Continental Shelf (OCS) is 1.76 billion acres. Of that 1.76 billion, less than 35 million acres are actually leased (less than 2%). Your proposed 5-year lease plan does not open a single new lease planning area, and therefore we have no way of knowing what estimates of "technologically recoverable" oil in all of the areas that remain off limits are because you have chosen to keep them off limits. Most of our OCS has not been explored for decades, and providing access to only a fraction gives us no clue what is truly there.
A more accurate statement is that your 5 year plan opens 75% of the oil and gas in areas where we think it exists because we have drilled there. We don't know about the vast majority of the OCS that isn't leased, much of which has not been assessed with the benefit of new information for a quarter century.
3. Claim: "Since we put in place new safety standards in the wake of the Gulf oil spill, we have approved more than 400 drilling permits. In fact, we are now permitting at levels seen before the spill, all while meeting these important new standards." Secretary Ken Salazar, 3/12/2012
Fact: There exists no evidence that permitting for production has indeed reached pre-moratorium levels. In fact, the families impacted in the Gulf are still reeling from the impacts of the slowed pace of permitting. Exploration and permitting have yet to recover to pre-2010 levels on account of the moratorium and ensuing permitorium on shallow and deepwater permits. According to one recent study, "Prior to the deepwater drilling moratorium, the U.S. oil and natural gas offshore industry was forecasted to grow significantly due to identified prospects, mostly in the deep water. With the establishment of the moratorium and the subsequent slowdown in the issuance of drilling permits at all water depths, an estimated $18.3 billion of previously planned capital and operational expenditures did not occur in 2010 and 2011."[3] The study further concludes that the permitting challenges have already cost 90,000 jobs. It is of importance to note that the moratorium was never endorsed by the National Academy of Engineers, as you had attempted to represent. An Inspector General investigation was required to uncover the political influence and misrepresentation by the White House and your office in an important scientific document.
4. Claim: "The fact of the matter is that we are producing more from public lands, both oil and gas, both onshore as well as offshore, than at any time in recent memory. And when you look back at the years of 2009, 2010, and 2011, we've continued to make millions and millions of acres of the public estate available both on the land, as well as on the sea." Secretary Ken Salazar, 3/12/2012
Fact: As we pointed out earlier in this letter, there is significant lag time to production after the process of leasing. Presumably this is the reason for your repeated observation that "there is no immediate fix" for higher gas prices. After a company has leased property they then have to explore, develop and produce, with each stage requiring new permits and compliance with federal processes. The production gains we saw in 2009 and 2010 were the result of leasing and permitting that occurred in the Clinton and Bush Administrations, and was just beginning to come online. However, by 2011 we began to experience the impacts from the moratorium and falloff of leasing and permitting under your leadership. Total oil production on federal lands is down 14% over the previous year, offshore is even worse at down 17%, and federal lands saw the fewest number of new onshore leases since 1984. You also failed to hold a single offshore lease sale in fiscal year 2011.
As a further example, in 2008 the industry spent $2.6 billion to obtain 487 leases in the Chukchi Sea for production offshore Alaska. So far, not a single well has been drilled on any of these leases. There have also been numerous new regulatory roadblocks and permit withdrawals from federal onshore production since you took over leadership of the Agency. Examples of onshore leasing challenges include your withdrawn and slowed leasing in the West, including Montana and the Dakotas.
In July of 2008, then as a United States Senator, you had an opportunity to support increasing domestic energy production, if the price of gas increased beyond a certain threshold. You repeatedly objected to increasing domestic energy production, even if the price of gas were to have reached $10 per gallon.
Although gas prices are not $10 per gallon, they are increasingly impacting our economy and fellow Americans, particularly low-income and middle-class families. We are hopeful that similarly to Secretary Chu, you have reevaluated your position on gas prices and will redirect your efforts to alter what the agency has done to limit future production, and will instead work to develop our truly vast domestic oil resources, resources that well exceed "2%" of the world's oil.

Is Obamacare Going Down?

Obamacare has run into a buzz saw at the Supreme Court. That isn't really a surprise, and, as countless commentators have pointed out, you can't necessarily predict a judge's opinion from the tenor of his questions during oral argument. Still, Justice Kennedy, a moderate liberal, is likely the decisive vote, so the fact that he explicitly recognized that Obamacare is unprecedented is heartening to conservatives:
Kennedy: [H]ere the government is saying that the Federal Government has a duty to tell the individual citizen that it must act, and that is different from what we have in previous cases and that changes the relationship of the Federal Government to the individual in a very fundamental way.
In that last observation, Kennedy seems to be channeling Mark Steyn-a very bad sign for proponents of the law.
The question inevitably raised by the Obamacare appeal is, if the federal government can do this, what can't it do? The Constitution established a limited federal government with enumerated powers. Over the years, however, the national government's powers have expanded almost beyond recognition. The Commerce Clause has been used to justify endless federal intrusions into every nook and cranny of our lives. As a practical matter, the idea that the federal government is limited to the Constitution's enumerated powers has been abandoned. The liberal position now is that there is no limit to the authority of the federal government, except as its powers are specifically restrained by the Bill of Rights.
Yet the text of the Constitution stands as a continuing rebuke to the thoughtless expansion of federal power. Whatever Nancy Pelosi and Harry Reid might believe, no Solicitor General can stand before the Court and deny that federal powers are limited. So when the justices asked, if the government can do this, what can't it do, Solicitor General Donald Verrilli was obliged to argue that health care is unique, and therefore affirming Obamacare will not amount to a blank check for federal authority. So a special empowerment of the federal government with regard to health care ostensibly lies hidden somewhere in the Constitution.
Some have speculated that if the Court strikes down Obamacare, it will give Obama's re-election campaign a boost. I am not sure whether that is correct or not-it strikes me that losing this case in the Supreme Court will contribute to the impression that the Obama administration has been a fiasco-but if so, it is a small price to pay. In a few cases in recent years, the Court has signaled that there are limits to the Commerce Clause. But Obamacare offers the Court an opportunity to do more: to issue a landmark opinion that would re-establish, in ringing terms, the proposition that ours is a government of limited, enumerated powers, and that would reassert the Court's fidelity to the text of the Constitution. If that happens, it will be an important victory for the forces of freedom.
One final observation: some of the news coverage of the arguments before the Court has been good, but we have also seen howlers like this one in the Los Angeles Times:
[T]he administration has argued that Congress can use its authority under the commerce clause of the Constitution to impose the mandate as a means to regulate health insurance.
The Constitution says Congress has the power to "regulate commerce" and to impose taxes to promote the general welfare.
What the Constitution actually says (Article 1, Section 8, Clause 3) is:
The Congress shall have Power...To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.
Ask yourself where in those words the Constitution authorizes Congress to control your family's health care, and you get some idea of the magnitude of the task facing Solicitor General Verrilli.

Morning Bell: Another Vision to Solve the Budget Crisis

While Washington's eyes are focused on the historic Obamacare hearings at the Supreme Court, work continues across the street in the House of Representatives where some Members of Congress - though not all - are doing their best to clean up Washington's budgetary mess.
It has now been 1,064 days since the U.S. Senate passed a budget, the national debt is nearing $16 trillion, and the deficit is at $1 trillion. In the face of this mess, the Republican Study Committee (RSC) yesterday unveiled its plan to balance the budget in five years, and it does so with entitlement reforms, sharp and aggressive spending cuts, avoiding tax hikes, including pro-growth tax reform, and providing for a strong national defense.
Rep. Jim Jordan (R-OH), RSC Chairman, and Rep Scott Garrett (R-NJ), also of the committee, issued a statement saying that their plan is a clear, practical way to cut spending and balance the budget - and that leadership is needed in Washington's budgetless vacuum:

Black Panthers: Zimmerman charged with murder according to "street people law" The Black Panthers and other radicals are out for vigilante justice after the tragic shooting of Trayvon Martin. Spike Lee, for example, tweeted what he thought was Zimmerman's home address and it was incorrect. The home belongs to an elderly couple who are now fearing for their life. Lee so far has refused to apologize. According to the Constitution, Zimmerman is entitled to a fair trial. Do we have to like it? Not necessarily, but it's still part of the way things work. But when The Black Panthers call for street justice, they join a disturbing trend of radical groups who have decided to cast off the rules of civil society. Glenn has more on radio today.
