Blasphemy and Free Speech
PAUL MARSHALL is a senior fellow at the Hudson Institute's Center for Religious Freedom. He has published widely in newspapers and magazines, including the New York Times, the Wall Street Journal, the Washington Post, First Things, The New Republic, and The Weekly Standard. He is the author or editor of more than 20 books on religion and politics, including Their Blood Cries Out, Religious Freedom in the World, and Blind Spot: When Journalists Don't Get Religion. Most recently he is the co-author, with Nina Shea, of Silenced: How Apostasy and Blasphemy Codes are Choking Freedom Worldwide.
The following is adapted from a lecture delivered at Hillsdale College's Allan P. Kirby, Jr. Center for Constitutional Studies and Citizenship in Washington, D.C., on February 3, 2012.
A growing threat to our freedom of speech is the attempt to stifle religious discussion in the name of preventing "defamation of" or "insults to" religion, especially Islam. Resulting restrictions represent, in effect, a revival of blasphemy laws.
Few in the West were concerned with such laws 20 years ago. Even if still on some statute books, they were only of historical interest. That began to change in 1989, when the late Ayatollah Khomeini, then Iran's Supreme Leader, declared it the duty of every Muslim to kill British-based writer Salman Rushdie on the grounds that his novel, The Satanic Verses, was blasphemous. Rushdie has survived by living his life in hiding. Others connected with the book were not so fortunate: its Japanese translator was assassinated, its Italian translator was stabbed, its Norwegian publisher was shot, and 35 guests at a hotel hosting its Turkish publisher were burned to death in an arson attack.
More recently, we have seen eruptions of violence in reaction to Theo van Gogh's and Ayaan Hirsi Ali's film Submission, Danish and Swedish cartoons depicting Mohammed, the speech at Regensburg by Pope Benedict XVI on the topic of faith, reason, and religious violence, Geert Wilders' film Fitna, and a false Newsweek report that the U.S. military had desecrated Korans at Guantanamo. A declaration by Terry Jones-a deservedly obscure Florida pastor with a congregation of less than 50-that he would burn a Koran on September 11, 2010, achieved a perfect media storm, combining American publicity-seeking, Muslim outrage, and the demands of 24 hour news coverage. It even drew the attention of President Obama and senior U.S. military leaders. Dozens of people were murdered as a result.

Over the years, many friends of Hillsdale, those who never attended college here, have said to me: "Dr. Arnn, I wish I could take Hillsdale's Constitution course!"
In response to these requests, this past year, for the first time ever, Hillsdale College offered the "Introduction to the Constitution" lecture series at no charge. Frankly, I wasn't sure what sort of a response a course like this would have.
That's why I was excited to see that YOU and almost 200,000 other people from all over the United States registered for "Introduction to the Constitution."
Thank you very much for registering and participating. I hope you learned a lot from the series.
I was thrilled, not only by the response, but at what it indicates: Americans are willing and eager learn about the Constitution and to defend the principles of liberty that made America so prosperous!
And this re-awakening of national interest in the Constitution comes not a minute too soon.

It will cover such topics as the Declaration of Independence and its connection to the Constitution, how the Constitution is structured to protect individual liberty and ensure good government, the crisis of constitutional government faced by Abraham Lincoln during the Civil War, and modern challenges to the Constitution during the "Progressive" era.
It is my honor to teach the first class, "The American Mind," and the final class, "The Recovery of the Constitution." All of the classes will be taught by Hillsdale College professors - the top teachers in their field and the same ones who instruct our students here on Hillsdale's campus.

The bad news is last month some well intentioned political activist announced a cut-off date for signing up co-sponsors for Rep. Rose Marie Swanger's American Law's for American Courts (HB 2029) in an effort to inject some urgency into the effort.
What it resulted in was an interruption of the campaign to encourage those Representatives not yet signed on as co-sponsors to join with those Legislators who have already recognized the death by smothering threat to our Constitution.
The good news is there is no cut-off date for adding co-sponsors and we are once again asking your readers to contact their representatives and ask they join the battle.
There are only three Representatives from Bucks who are co-sponsors, Representatives Clymer, Petri and Quinn and we thank them for showing their colors.
But that leaves seven more Representatives who appear to be still standing on the sidelines as the battle for our existence as a free people is joined.

CAIR's Fight Against Pennsylvania Foreign Law Bill

Resistance to a new bill aimed at limiting foreign law in Pennsylvania courts serves as a case study of how Islamists and their allies operate: peddling falsehoods about Shari'a, painting Muslims as victims, and denying that anyone seeks to institutionalize aspects of Islamic law - even as they vigorously promote that very agenda. With similar legislation being debated across the U.S., understanding their tactics is critical.
At issue in Pennsylvania is House Bill (HB) 2029, which stipulates that "a tribunal shall not consider a foreign legal code or system which does not grant ... the same fundamental liberties, rights and privileges" as guaranteed by the federal and state constitutions. Introduced in November, it follows the American Laws for American Courts (ALAC) model and makes no mention of Shari'a. A preliminary memo sent to legislators last June in the name of Rep. RoseMarie Swanger, HB 2029's chief sponsor, does highlight Islamic law, but she later said that it had been circulated accidentally. Regardless, concerns about Shari'a are warranted due to its many provisions that conflict with the standards of American jurisprudence. For example, it disadvantages women in terms of inheritance, divorce, child custody, and other areas of family law. Shari'a already has shaped numerous cases nationwide, including in Pennsylvania, where one state court decided how assets should be distributed according to Islam.
Pushback against HB 2029 has been led by the Philadelphia office of the Hamas-linked Council on American-Islamic Relations (CAIR-PA) and was punctuated by an interfaith press conference (video here) at CAIR-PA headquarters on December 14. The overall campaign reflects CAIR's usual recipe of distortion, victimology, and contradiction between words and deeds.
Attacks on bills like HB 2029 begin by sowing confusion about Shari'a. Because Islamic law encompasses virtually every facet of life - governing personal activities such as eating and worship, but also forming an oppressive social and legal structure - suit-and-tie Islamists work to emphasize its unthreatening pieces whenever possible. CAIR-PA executive director Moein Khawaja's suggestion that Shari'a should worry Pennsylvanians no more than halal gyros is a fine example of this technique.

Romney wins US Virgin Islands, Northern Marianas and Guam

Three US territories held caucuses on Saturday giving Mitt Romney victories in each one and adding to his growing delegate count. Residents in US territories cannot actually vote in the General Election, however, under party rules, they are allowed to send delegates to the party conventions.

Santorum wins Kansas GOP caucus

As expected, Rick Santorum easily took the Kansas Republican Caucus on Saturday with 51% of the vote. Mitt Romney took a distant second place with a mere 20%.

Before starting the Weekly Standard in 1995, Mr. Kristol led the Project for the Republican Future, where he helped shape the strategy that produced the 1994 Republican congressional victory.  Deception, betrayal, and dishonesty. These are not appealing traits in elected officials, but sadly, they aptly describe many Republican lawmakers across the country feverishly working to implement ObamaCare. Would you believe that Governor Tom Corbett is among those Republicans diligently complying with ObamaCare? Despite the fact that Pennsylvania is party to the lawsuit being heard before the Supreme Court, Tom Corbett is implementing the law in our state. ObamaCare requires that each state set up what is known as a Health Insurance Exchange. In theory, these exchanges will be one-stop online shops where individuals will pool together to purchase insurance. Without a state-created exchange, the individual mandate cannot be enforced. As in all bureaucracies, there are some major downfalls, not the least of which is the anticipated spike in the cost of insurance. Other significant issues include: - The federal government will dictate what insurers may participate
- The federal government will decide minimum coverage-potentially including such elective procedures as breast augmentation and face lifts
- The federal government will stipulate how the exchange is run
I could go on, but I'm certain you recognize the theme. The federal government will control every aspect of our health care. Yet, Governor Corbett claims that establishing CorbettCare will protect Pennsylvania citizens from undue federal regulation. The opposite is actually true. Creation of the CorbettCare Exchange does great harm and forces onerous federal regulations on our state. Governor Corbett is readily ceding state Sovereignty to the central government, and relinquishing all authority on health care matters. Our state has already requested and accepted over $33 million to set up the exchange! Merely accepting and spending federal funds requires absolute obedience to federal government regulations, and the loss of state sovereignty. A key responsibility of state officials is to protect our sovereignty, yet our legislators may be considering legislation to assist in the establishment of CorbettCare. And like obedient little children, these turncoats expect you to forget their empty promises, ignore their campaign rhetoric, and blame the Federal Government for all of the many losses you will suffer as a result. Click here to sign the petition demanding that the over $33 million in grant funds be returned and all contingency plans to submit to ObamaCare be abandoned immediately! If you'd like to tell Governor Corbett how you feel about this scheme, you can reach him at 717-787-2500. There are over 1 billion reasons why some states are establishing these exchanges-and each reason has a dollar sign attached. With over $1 billion at stake, and more than $700 million already sent to complicit states, it's easy to understand why greedy politicians have their hands out before the court can rule. These funds are being used all over the country to enrich political allies and the well-connected. Millions of your taxpayer dollars are being wasted, and you are footing the bill while they steal your freedoms. Those hundreds of millions will never be returned to our treasury-unless you and I do something to force the issue now. Tell your legislators that even if the Supreme Court fails to overturn ObamaCare, you expect them to protect your rights and jealously guard our state sovereignty by refusing to establish a state exchange. 1. Can Republicans Win In 2012 Without Leadership?
Fred Barnes, who is nothing if not plugged in to the thinking of leading Beltway Republicans, looks at how the Congressional GOP plans to work with the presidential nominee. . . .
Even considering the fact that McConnell has to play coy due to the fact that there's as yet no nominee, you will notice what is missing in this picture: the idea that the nominee himself, now most likely Mitt Romney, will have any ideas of his own to which Congressional Republicans will have to accommodate themselves. This is part of a broader pattern: outside of the party's most moderate precincts - where Romney is seen as a bulwark against conservatives - Republicans who have resigned themselves to Romney have done so, more or less, on the theory that he can be brought around to do things the party's various constituencies want him to do. This is the opposite of the thing we normally look for in a president: leadership in setting the agenda of the party and the country. As such, it represents an experiment, or at least a throwback to the late-19th century model of how the presidency operates. Can the GOP beat Barack Obama and run the country the next four years without presidential leadership?
2. New Record Monthly Deficit 37 Months into Obama's Presidency Here's a headline you won't see in the media this week: we incurred the largest monthly deficit on record in February. Seven months into a government "reined in" by the Budget Control Act, we are supposed to be reaping the benefits of budget reduction. Yet, according to CBO, we incurred a gargantuan $232 billion deficit in the month of February. The conservative Washington Times was the only publication to note that this was the largest monthly deficit on record. Keep in mind that we didn't start accruing annual deficits of $230 billion until this past decade. The preliminary estimates from CBO projected outlays at $335 billion and revenues at $103 billion. Our total deficit for the first 5 months of fiscal year 2012 is $631 billion ($869 billion in revenue; $1.5 trillion in outlays). Think for a moment about what it means to spend $335 billion in 29 days. It comes out to $11.5 billion per day; $480 million per hour. So the next time Congress deliberates over a few billion in spending cuts over the course of a month, remember that we will add several hundred billion more in debt during the course of the debate. 3. The Utah Election When Orrin Hatch ran for the United States Senate the first time, he campaigned against then Democratic Senator Frank Moss. Hatch traveled Utah asking and answering a simple question: "What do you call a Senator who's served in office for 18 years?" "You call him home," he said. That was thirty-six years ago. Orrin Hatch beat Frank Moss and has been in the United States Senate ever since. This week, voters in Utah will begin the process of deciding whether or not it is time to call Orrin Hatch home, having served twice as long as the Senator he decided to challenge successfully in 1976. I was one when Orrin Hatch beat Frank Moss. He is the longest serving Utah Senator. He is, for those of us who started paying attention to politics in the 1980?s, a seminal figure in late twentieth century American politics. From his seat in the Senate Judiciary Committee, Hatch's face has been a visible presence in American homes for decades. Each time I have met Orrin Hatch, I've come away liking the man. But were I in Utah this week, I'd want to do as he wanted to do thirty-six years ago and call him home. 4. Fake Filibuster Outrage From Left The left is fear-mongering on the issue of the filibuster. Senate Majority Leader Harry Reid filed cloture on 17 nominees today and the left was quick to parrot the Reid talking points claiming Republican "obstruction" of these nominees. The fact of the matter is that there is no filibuster and Reid is merely setting the table so he can make hysterical arguments about Republican obstructionism. Republicans, nor Democrats, have uttered one word of debate on any of these nominations. There is no filibuster going on right now and there never was. This is a fake filibuster created by Reid. 5. Jon Bruning: The Eric Holder Republican At a time when Republicans of all stripes are calling for the resignation of U.S. Attorney General Eric Holder, one Republican continues to stand by his side. Meet Jon Bruning, candidate for U.S. Senate and the sitting Attorney General for Nebraska. Last week, we learned that Bruning lobbied the Senate to support Holder during his confirmation process. As President-Elect of the National Association of Attorneys General in 2009, Bruning co-signed two letters to the Senate Judiciary Committee praising Holder for his "fairness and balance" and urged members to confirm him. Bruning wrote: "We believe that Mr. Holder has the knowledge and experience necessary to run the Department of Justice and work with us to enforce our laws." Bruning of course was not alone in this. There were other Republicans who signed these letters, and some Republican Senators voted to confirm him. But many Republicans also opposed him - and importantly... for those who didn't, they now understand how bad Eric Holder is and would likely admit they made a mistake. But not Jon Bruning.

Ben Franklin was the first president of the first anti-slavery society in the United States. In 1787, the Northwest Ordinance outlawed slavery in the Midwest. Richard Bassett, a Signer of the Constitution, converted to Methodism, freed all his slaves and paid them as hired labor.
John Quincy Adams fought to end slavery by removing Congress' Gag Rule. In 1807, Congress passed the Slave Importation Act, prohibiting further importation of slaves. 19 of the 34 States outlawed slavery before the Civil War:

John Boehner has been criticized for exhibiting less than courageous behavior in dealings with Eric Holder, Barack Obama and most of the Democrat Party. Yet the Speaker's well-known lack of intestinal fortitude might be the only thing preserving the right of states like Arizona to make and enforce their own laws dealing with illegal aliens and the businesses which employ them.
Last year, the House of Representatives, led by Judiciary Committee Chairman Lamar Smith, advanced H.R. 2885, the Legal Workforce Act which if passed into law would "...require all employers to use the federal E-Verify program to identify fake or stolen Social Security numbers used by illegal workers." Passed out of the Judiciary Committee in September, the bill has remained in the Ways and Means Committee ever since, stalled it is said by order of Speaker John Boehner.

CAIR, NY Times smear campaign New York Police Department Commissioner Ray Kelly has been under fire from CAIR (Council on American-Islamic Relations), and one of America's top media enablers of radical Islam-the New York Times. Kelly has been attacked for using the documentary film "The Third Jihad" in counterterrorism training.
Many of you have seen this film. We promoted it heavily when it was first released. Now "The Third Jihad" is fighting back. This short video is a powerful rebuttal to the smear campaign CAIR and the New York Times have waged against Commissioner Kelly. As you will see in the video, the New York Times ran an editorial that clearly alters a quote from the film to fit its story line and discredit Commissioner Kelly. We're not surprised by this. The newspaper did this to us with a story it ran in 2010, where it:
- Misquoted our mission statement to create an erroneous, negative perception of who ACT! for America is.
- Refused to correct the misquote when we caught them red-handed.
- And then, amazingly, claimed-without any evidence-that what they quoted was accurate and that we must have changed our website.

We're not surprised by CAIR's actions either. Its representatives have viciously and dishonestly attacked legislation we have been pushing in state legislatures, "American Laws for American Courts." You can send a short email here to Mayor Bloomberg's office expressing support for Commissioner Kelly and outrage at the smear campaign that has been leveled against him.

Alexander's Reply: As noted in reply to the first objection to Rubio, for the record, Marco Antonio Rubio was born May 28, 1971, in Miami, Florida. His parents were resident aliens at the time of his birth, seeking and soon to receive their status as naturalized U.S. citizens. You may correctly assume that, because Rubio's parents were in the United States legally and thus, "subject to the jurisdiction thereof," he does qualify as a natural born citizen while under the same clause, the children of illegal aliens are most decidedly not "natural born citizen of the United States." If you do not understand this assertion, read on.
Regarding "birthright citizenship," let me offer a few unadulterated facts. Article II, Section 1 of the Constitution as ratified in 1789, states: "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States."
By all accepted definitions of citizenship at the time, Marco Rubio is a "natural born citizen," as were many of our ancestral Founders.
After the War Between the States, the Civil Rights Act of 1866 was passed to ensure that slaves born in the U.S., and legally subject to its jurisdiction, had the same rights of citizenship as all Americans. It stated, "All persons born in the United States, and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States."
Concerned about the integrity of the Civil Rights Act given the Supreme Court's decision a decade earlier in Dred Scott v. Sandford denying citizenship to blacks, and that some future Congress would reverse this legislation, the 14th Amendment was proposed to ensure rights of citizenship. In the plain language of its authors, those who are born to parents legally in the U.S., whose parents have no allegiance to a foreign power (as diplomats), are thus, "subject to the jurisdiction thereof," and have claim to birthright citizenship. (This would clearly exclude those born to illegal aliens.)
By the constructionist interpretation of the 14th Amendment, Marco Rubio is, indeed, a "natural born citizen."
The Rule of Law as outlined by the 14th Amendment stood until 1982 when it was adulterated by judicial activists who concluded in Plyler v. Doe, that "no plausible distinction with respect to Fourteenth Amendment 'jurisdiction' can be drawn between resident aliens whose entry into the United States was lawful, and resident aliens whose entry was unlawful." That opened the floodgates for "anchor babies," a gate that should be closed -- but that would require a judiciary that abides by its oath to uphold the Rule of Law.
Thus, as adulterated, not only is Marco Rubio a "natural born citizen," but so is everyone else born in the U.S., regardless of whether their parents were here legally or illegally. However, there is no comparison between the questions of Obama's citizenship and that of Marco Rubio, which seems to have inspired some reader comments. The legitimate questions about Obama's citizenship are based on where he was actually born -- as posited by some who argue he was not born in the United States. (I would note that enormous political capital has been thrown down this rathole for the last four years, much to the detriment of the campaign to defeat Obama.)
For further reading, I have authored several essays on this subject, including "On the Fourteenth Amendment," and more particularly, "Birthright Citizenship?" and "Immigration Policy: 'Subject to the jurisdiction therof'."
Now, for those so predisposed, you may resume the effort to self-destruct, but understand that effort is worth more to Obama's re-election than any ad share he can buy.

Today, the Senate will vote on whether to throw more money at "green energy" subsidies. Please stand with us: oppose the federal government picking and financing industry winners. The Burr-Menendez-Reid Amendment is the infamous and long-stalled NAT GAS Act. It subsidizes natural gas vehicles - from the production of vehicles and the purchase of these vehicles to building new fueling stations. It also levies a new tax on natural gas. >> Call your Senators now: tell them to oppose the NAT GAS Act. The NAT GAS Act is fast losing support in the House and now we must stop this green energy boondoggle in the Senate. Liberals are pushing the bill: President Obama touted it yesterday during his speech in North Carolina. Proponents of the NAT GAS Act claim that it is necessary to jumpstart a nascent industry, but this is untrue. Private investments have lead to the advances in natural gas extraction techniques and the technology to use it to power everything from our homes to our vehicles. In fact, Chrysler, GM and Ford have all announced plans to release bi-fuel (gasoline and compressed natural gas) versions of their popular pickup trucks. Clearly, new subsidies aren't necessary for industry progress. Washington's subsidies for technical progress is a long history of failure. Remember the Carter administration's Synfuels? The Art of the Double-Cross

Arlen Specter, one of our least-favorite politicians, is back in the news. He has authored a memoir called Life Among the Cannibals about his decades in Washington. It's an odd title; Specter apparently enjoyed the "cannibals" so much that, when faced with a tough primary challenge at age 79 after 44 years as a Republican office-holder, he became a Democrat rather than retire to private life. According to The Hill, Specter complains in his memoir that the Democrats double-crossed him after he negotiated with them to provide the 60th vote for Obamacare:
Former Sen. Arlen Specter (Pa.) writes in a new book that President Obama ditched him in the 2010 election after he helped Obama win the biggest legislative victory of his term by passing healthcare reform.
Specter also claims that Senate Majority Leader Harry Reid (D-Nev.) did not uphold his promise to grant him seniority accrued over 28 years of service in the Senate as a Republican. ...
Specter laments that Obama and Vice President Joe Biden did not do more to help him in the final days of his primary race against former Rep. Joe Sestak (D-Pa.), who beat him 54 percent to 46 percent in the 2010 Pennsylvania Senate Democratic primary.
Specter writes that Obama turned down a request to campaign with him in the final days of the primary because the president's advisors feared he would look weak if he intervened and Specter lost. ...
The snub was made all the more painful by Obama flying over Philadelphia en route to New York City a few days before the election and then on primary day jetting over Pittsburgh to visit a factory in Youngstown, Ohio, twenty-two miles from the Pennsylvania border, to promote the 2009 economic stimulus law. The painful irony for Specter is that his vote for the stimulus legislation, which was instrumental to its passage, hastened his departure from the Republican Party.
Specter was also disappointed that Biden, who was only a few blocks away at Penn University, did not attend a pre-primary day rally at the Phillies' Citizens Bank Park - a missed opportunity Specter attributes to a failed staff-to-staff request.
Just over a year before, Obama and Biden welcomed Specter to the Democratic Party with a press conference at the White House and promised him their full support.
Specter believes Reid acted with "duplicity" while managing the party switch. Specter said Reid promised him that he would be recognized on the seniority list as a Democrat elected in 1980 but failed to deliver on it.
Barack Obama, dishonest? Harry Reid, duplicitous? Say it ain't so, Arlen! Mitch McConnell, on the other hand, offered Specter good advice. Specter should have taken it:
"When I told him I was going to change parties, he was visibly displeased but not ruffled. Mostly, he was taciturn," Specter recounts. "McConnell and I had a serious discussion. He was very nice and very professional. 'Don't do it,' he said. 'It'd be a big mistake. Serve out your time as a Republican and retire gracefully.'"
It is hard to picture who Specter thinks his intended audience is. Who, exactly, will be sympathetic to a long-serving senator who sells out his party in a desperate (but unsuccessful) effort to hang onto his seat for one last term? Hardly anyone on either side of the aisle. It is fascinating to learn, however, that the passage of Obamacare-and perhaps the stimulus bill too-hinged, apparently, on a corrupt bargain which Obama and Reid abandoned as soon as they no longer needed Specter's vote.

A Word From Winston on the Afghan Campaign

The awful news of a U.S. soldier perpetrating a massacre of innocent civilians in Afghanistan is likely to reignite the fury of many Afghans against the American presence, and retard whatever progress is being made to stabilize the country and draw down American troops. A situation already difficult and expensive has been rendered more so.
John has already offered his opinion here that we should get out. He can find support for this view from an impressive witness: Winston Churchill. In his very first book in 1897, The Story of the Malakand Field Force: An Episode of Frontier War, Churchill reflects on the exact difficulties we are facing in exactly the same place. Despite all the advances in American firepower in the century since Churchill wrote, there is very little fundamentally different now-especially the forbidding geography of the country and the unremitting barbarism of the tribes that inhabit the rocky valleys; people rushing "headlong into the ninth century," as Bing West put it here last week. Churchill was a skeptic that it was wise to pursue a policy of attempting to subdue the region through military means.
Churchill's concluding chapter, "The Riddle of the Frontier," ought to be assigned reading in our war colleges, not to mention the Pentagon and State Department. See whether some of these excerpts don't sound entirely fitting to our present condition:
The spirit of reaction led to the final abandonment of the venerable policy of non-intervention. Instead of the "line of the mountains," it was now maintained that the passes through them must be held. This is the so-called "Forward Policy." It is a policy which aims at obtaining the frontier-Gilgit, Chitral, Jelalabad, Kandahar.
In pursuance of that policy we have been led to build many frontier forts, to construct roads, to annex territories, and to enter upon more intimate relations with the border tribes. . .
It may be said of the present system that it precludes the possibility of peace. Isolated posts have been formed in the midst of races notoriously passionate, reckless and warlike. . .
The possibility of a great combination among the border tribes was indeed not contemplated. Separated by distance, and divided by faction, it was anticipated they could be dealt with in detail. On this point we have been undeceived.
That period of war and disturbance which was the inevitable first consequence of the "Forward Policy" must in any case have been disturbed and expensive. Regarded from an economic standpoint, the trade of the frontier valleys will never pay a shilling in the pound on the military expenditure necessary to preserve order. . .
The "Full steam ahead" method would be undoubtedly the most desirable. This is the military view. Mobilise, it is urged, a nice field force, and operate at leisure in the frontier valleys, until they are as safe a Hyde Park. Nor need this course necessarily involve the extermination of the inhabitants. Military rule is the best rule suited to the character and comprehension of the tribesmen. They will soon recognize the futility of resistance, and will gradually welcome the increase of wealth and comfort that will follow a stable government. . . Only one real objection has been advanced against this plan. But it is a crushing one, and it constitutes the most serious argument against the whole "Forward Policy." It is this: we have neither the troops nor the money to carry it out.

In "Not a penny more" alluded to the taxes baked into Obamacare as well as other taxes scheduled to take effect. Now Grover Norquist compiles a list of the tax increase in our future if we don't do something about it soon. Norquist's piece is "The taxman cometh." A dirty joke hid behind the title of the Eugene O'Neill play to which the heading of Norquist piece alludes. In this case, however, the joke is on us.
Obama is not done yet. He has lots of ideas for higher taxes. Norquist concludes his compilation with the observation:
The list goes on and on. During this election season, President Obama needs to answer this question: "why do you want to raise taxes in every imaginable way when our economy is weak and millions of Americans are looking for jobs?"
It is almost unbelievable that the subject of pending tax increases has barely been touched on in the media during this election season. The media are of course doing their best to assist the Obama campaign's misdirection.

Secret O' Life

Today is the birthday of singer/songwriter James Taylor; he turns 64. Visiting a friend in Boston in the fall of 1968 I caught a live show with Taylor opening for Joni Mitchell in a basement dive with benches for seats. It was an incredible show for the price of the $3.00 ticket. According to Sheila Weller's Girls Like Us, incidentally, Mitchell's affair with Taylor followed shortly after. Taylor's debut album on Apple was still a few weeks from being released, but both Taylor and Mitchell had developed followings based on the songs they had contributed to Tom Rush's Circle Game album earlier that year.
Mitchell was the featured attraction of the show that night. She had only recently arrived on the scene, having turned up with two dozen finely crafted songs that instantly put her on the map and with a restless spirit that has kept her an artist of continuing interest. "Both Sides Now" was in that first batch of songs, and Judy Collins had already turned it into a massive hit by that time.
But Taylor blew me and the rest of the audience away. I took it for granted that he would go on to a successful career, yet its longevity is remarkable set against the struggles with drugs and depression that have punctuated it. His long career now includes five Grammys and induction into the Rock and Roll Hall of Fame.
Peter Asher had signed Taylor to Apple for that fist album and then left the company to manage him. Listening to Asher talk about this chapter of his life during his own show at the Dakota in Minneapolis this past January, I was struck by his comments about Taylor. He said that Taylor had been given his name and number in London by a mutual friend. When Taylor hit London, he called and asked if Asher would listen to a demo tape of his songs. Asher loved the songs, but the guitar accompaniment really made an impression. "Here were these fantastic songs, and he was playing them on guitar in the style of Bream or Segovia." That's what the man said. He felt that he had heard something special.
You don't hear anything special in Taylor's politics. They are of the "shut up and sing" variety. Yet he has a gift for melody and for lyrics that are by turns witty and moving. Among his lesser-known gems is "(I've Got to) Stop Thinkin' 'bout That," written with his old friend Danny Kortchmar, performed live at New York's Beacon Theater in the video below. "I hate to think about the way it ended/I hate remembering the things that I said/I dream a dream of love so splendid/I wake up hard in an empty bed....Oh, Lucy, God have mercy, I've got to stop thinkin' 'bout that."
Let's bring him back for an encore. I love "Secret O' Life," in which he is obviously celebrating the arrival of one of his kids: "Einstein said he could never understand it all/Planets spinning through space/The smile upon your face/Welcome to the human race." If you hear the late, great Nancy LaMott sing this song on Listen To My Heart, you just might think that Taylor has earned himself a place in the Great American Songbook.

In Utah, Orrin Hatch Deserves Another Term

Orrin Hatch is one of the veteran Republicans in the Senate, and, if the GOP retakes the Senate in November as many expect, he will play a key role in that body. Hatch has always been regarded as a solid conservative, but this year there are activists who want to nominate someone else; someone who ostensibly is more conservative than the incumbent.
This strikes me as an amazingly stupid and destructive move. I can understand conservative activists trying to knock off the ladies from Maine, or maybe Richard Lugar. But Orrin Hatch? You've got to be kidding! Hatch is one of the most effective conservatives in Washington.
The American Conservative Union publishes yearly rankings of Senators and Congressmen, based on what the ACU believes to be the key votes in each year. The ACU rankings are an excellent benchmark to assess how our elected representatives are performing, and they show that Orrin Hatch has been, for a long time, one of the most conservative members of the Senate. You can see the ACU ratings here.
Senator Hatch scores a lifetime rating of 89.77%, which means that nine times out of ten he has voted in accordance with what the ACU deems to be the most conservative position. The tenth time, it may well be that Hatch was right and the ACU was wrong, but let's forget that possibility and compare Senator Hatch with other undoubted conservatives. Hatch rates as more conservative than Dick Shelby, John McCain, Johnny Isakson, Chuck Grassley, Pat Roberts, Mitch McConnell, Thad Cochran, Mike Johanns, Dean Heller, John Hoeven, Rob Portman, Lindsay Graham, Lamar Alexander, Bob Corker, Kay Hutchison, and even John Thune. Those who have a more conservative lifetime rating than Hatch are mostly new Senators who haven't cast very many votes.
I am personally acquainted with Orrin Hatch and John Thune, and can say with great confidence that both senators are stalwarts in the conservative cause. Both are at least as conservative as the most dedicated Tea Partier, if not more so. It would be an act of extraordinary stupidity for the GOP to fail to return Orrin Hatch to the Senate. If you live in Utah and plan on participating in the state's caucuses next week, don't shoot the GOP in the foot: vote for Senator Hatch, and return one of that body's solidest conservatives for another term, in which he will play a key leadership role.

The Obama campaign's war on...the truth Over the weekend, Secretary of State Hillary Clinton waded into the culture wars over the weekend at the Women in the World Summit as part of the coordinate effort to reelect Barack Obama. Clinton said "Why extremists always focus on women remains a mystery to me. But they all seem to. It doesn't matter what country they're in or what religion they claim. They want to control women. They want to control how we dress, they want to control how we act, they even want to control the decisions we make about our own health and bodies." Yes, Mrs. Clinton is not-so-subtly comparing the GOP to the Taliban. This is a new low. It is glaringly apparent that Team Obama is hell-bent on ignoring the primary issue facing our country-jobs. Instead the President and his surrogates have decided that scaring women, especially single women, is the key to victory in November. Democrats know that today women face no restrictions getting contraception. They know that republicans aren't going to stop women from getting contraception. They know that most healthcare plans already cover contraception, most with minimal co-pays. If you are a woman working for Georgetown University Hospital and you want to have multiple sexual partners every week, no one is going to stop you from buying whatever contraception you want to use. Community clinics and places like Planned Parenthood will cover virtually all costs. This is a totally phony issue being pushed by leftists who have no strategy other than to go negative and divide Americans along racial, ethnic, and gender lines. Obama's boosters are misrepresenting what's going on and deceiving the American people just so he can retain power. This is cynical and dishonest. And the Washington Post/ABC Poll today shows that this isn't working. A record percentage of Americans (50%) give Pres. Obama "intensely low marks" on the economy-a 9 percent increase from last month. Almost two-thirds say they disapprove of the way the president is handling the issue of gas prices. On his handling of the deficit Obama hit an all-time low, registering a 32 percent approval rating among adults nationwide. 70 percent of independents disapprove of the president's handing of the deficit. Obama, once up over Romney and Santorum, is now in a dead heat with both of them. So much for the GOP primary hurting Republicans. So much for the spin that the economy is in a rebound. So much for the idea that Obama is sailing to reelection. Of course the Democrats want to change the subject to a wholly contrived "war on women" narrative--that is as fanciful as the notion that Mr. Obama's economic policies are working. If there IS a war on women-it's on women's pocketbooks, and its being waged by President Obama.

A singularly remarkable event has taken place in the United States of America. This event occurred in Arizona on March 1st and was an earth shattering revelation.
A long awaited press conference was given by Maricopa County Sheriff Joe Arpaio, a five time elected Sheriff, which should have made national and international headlines. Arpaio's credentials include serving in the United States Army from 1950 to 1953, service as a federal narcotics agent serving in countries all over the world with the U.S. Drug Enforcement Agency (DEA), and served as the head of the Arizona DEA. Without doubt, this is a serious Law Enforcement Officer, not one to be taken in by tin-foil-hat wearing loons.
Yet, in the five days since his revelations there has been little in the way of serious reporting on the findings he presented in his presser. With 6 short videos, the Sheriff and his team presented a devastating case, one the tame US press is apparently unable to report.
On April 27, 2011, President Barack walked into the White House Press room with a Cheshire cat like grin and a "Long Form Birth Certificate" from the State of Hawaii in hand. From the podium in the press room, Mr. Obama said, "We're not going to be able to solve our problems if we get distracted by sideshows and carnival barkers,". Quite the barb from a man holding a forged document.
That's right, forged.

Rarely have Republican voters made it as obvious that they would rather have anyone else than the inevitable nominee. Romney has the delegates summons all the voter enthusiasm of Taft and Ford combined. The establishment, as usual, isn't paying attention or pondering the implication of a situation where Rick Santorum is repeatedly beating out Romney, not just because of his message, but because any non-Romney is capable of doing the same thing. And has done it. The history of these primaries has been a list of alternative candidates to Romney who is winning because the candidates have either been personally destroyed by the media and/or the establishment, or because they have gotten in each other's way. Romney has not gotten this far on merit. Had he been up against a leading competent candidate all the way through, he would now be in the same position that he was in 2008. The electorate wants change. The party doesn't. The electorate wants principles. The party doesn't. There's a middle ground between the two, but so far it's been hard to find. The pure candidates tend to be inexperienced with problematic backgrounds who are unused to operating in the political arena. The realpolitik candidates have no values or principles, and knowingly or unknowingly, advance the liberal agenda. As a candidate Romney has one thing going for him, electability... just not in the actual primaries of his own party where he had to be helped over the finish line by the party establishment in a campaign where his only asset is his electability in a future campaign. Voting for Romney is an investment in defeating Obama, even if the returns aren't so great. Romney is low risk and low yield. There isn't much reason to hate him unless you're a conservative or a member of Occupy Wall Street. That's his best and only asset in a general election.

Bauer COUNTDOWN TO VICTORY: 239 DAYS TO THE 2012 ELECTIONS Obama Can Be Beaten Last week I expressed my chagrin that George Will and others in Washington were writing off the presidential contest as hopelessly lost, preferring instead to focus all our resources on the congressional contests. This is bad strategy and it is defeatist. It is bad strategy because, as I noted, there are several swing states like Florida, Ohio and Virginia that will decide the presidency. These same states also have key Senate contests. If Obama wins these states, he will most likely win the White House. And if he has coattails, Democrats will likely win these Senate contests too. In presidential elections, the race for the White House drives turnout, and defeatism at the top of the ticket can lead to defeats down the rest of the ballot too. But what is most perplexing to me is that there is no reason for conservatives to be so discouraged. Of course incumbent presidents have tremendous advantages. But they can and do lose elections. And this one in particular deserves to lose big -- just like Jimmy Carter! The good news is that the American people are not inclined to give Mr. Obama a second term. Just consider the latest Washington Post/ABC News poll. Last month this poll gave Obama a net positive 50% to 46% job approval rating. It also found Obama leading Mitt Romney by six points. But after weeks of fawning news coverage about an improving economy, endless commentary about the dysfunctional GOP primary and non-issues like birth control, the March Post/ABC poll finds that Obama's numbers have flipped: 46% approve of his job performance and 50% disapprove. According to the Post's report, "a record number of Americans now give the president 'strongly' negative reviews." By the way, the Washington Post/ABC News poll has a history of oversampling Democrats. Moreover, in head-to-head match-ups, both Mitt Romney and Rick Santorum are very competitive against Obama. For all the talk about how the silly "birth control" debate is costing the GOP with independent voters, the Post/ABC finds: "The downshift is particularly notable among independents -- 57 percent of whom now disapprove -- and among white people without college degrees, with disapproval among this group now topping approval by a ratio of more than 2 to 1, at 66 versus 28 percent." Consider how Obama fares on these measurements:
- The economy: 38% approve and 59% disapprove.
- Preventing Iran from obtaining nuclear weapons: 36% approve and 52% disapprove.
- The federal deficit: 32% approve and 63% disapprove.
- Gas prices: 26% approve and 65% disapprove.
Gallup recently asked whether Obama's presidency has been a success or failure. Half of those surveyed said it was a failure, while just 44% said it was a success. If gas prices keep going up, and given Obama's policies they likely will, he will be lucky to get 44% of the vote on Election Day! "It's ObamaCare, Stupid" Voters are clearly concerned about the economy and upset by high gas prices too. But ObamaCare could be the issue that costs Obama his job. A recent academic study found that support for ObamaCare cost House Democrats roughly six points at the ballot box. More than the stimulus or cap and trade, ObamaCare was responsible for the Democrats' historic defeat and loss of 66 House seats in the 2010 elections. The passage of time has not healed the Democrats' wounds. Last month a Gallup survey found that 72% of Americans -- and even 56% of Democrats -- felt that ObamaCare's individual mandate was unconstitutional. And the latest Rasmussen poll finds that likely voters still favor repealing ObamaCare by a double-digit margin of 53% to 42%. These are horrible numbers for the president's signature accomplishment, which bears his name. But as some in the GOP seek to make the campaign all about the economy, are they giving up our most potent issue against Barack Obama in the fall campaign? That was the question asked last week by the Wall Street Journal's Daniel Henninger. In a column entitled "It's Obamacare, Stupid," our friends at The Weekly Standard pick up the theme this week. Consider this excerpt:
"...the more Obamacare becomes an issue in the fall, the more it will highlight President Obama's liberalism in the minds of voters -- particularly independent voters. It correspondingly suggests that the more this election is focused simply on stewardship of the economy, the less Obama's big-government liberalism will be highlighted in voters' minds. "In other words, should Mitt Romney win the Republican presidential nomination, he could surely run (and has given every indication that he would run) as a centrist who's focused on the economy. But by choosing to de-emphasize Obamacare, he would allow Obama to come across as more of a centrist as well. This would effectively take the GOP's best issue off the table. What's more, no issue will more starkly highlight the differences between the parties than Obamacare. Voters know that if Obama is reelected, Obamacare is here to stay. If the Republican wins, there is at least a very good shot at repeal. ... "The electability argument is ultimately about issues. Obamacare is Obama's greatest weakness. He is more likely to be defeated by a candidate who is willing to run against Obamacare as the epitome of big-government liberalism -- emphasizing its singular threat to Americans' liberty and their way of life."
Obama Justice Department Undermining Ballot Security Today Texas became the latest victim in the Obama Justice Department's jihad against state voter ID laws. After the 2010 elections swept Republicans into power, several states passed voter ID laws in response to the ACORN scandal. But Attorney General Eric Holder declared that preserving ballot access -- not combating voter fraud -- was the greater "moral imperative." We have to produce an ID to buy alcohol. We have to produce an ID to drive. We have to produce an ID to board an airplane. We have to produce an ID to cash checks. Yet Democrats say that it is an onerous burden to ask citizens to produce an ID when they cast their ballots. The American public overwhelmingly disagrees. In 2008 the Supreme Court upheld state voter ID laws in a 6-to-3 decision. A December Rasmussen poll found that 70% of likely voters support voter ID laws, including 64% of independent voters and even 54% of Democrats. Game Change is one of the worst movies ever
