NDAA Nullification Passes Virginia Senate by a Veto-Proof 39-1 Vote

Today, the Virginia Senate took a firm stand in support of liberty, the Constitution for the United States, and the Constitution of Virginia by voting in favor of House Bill 1160 (HB1160), the "NDAA Nullification Act."
The final vote was 39-1. After a motion to recommit (delay until next year) went down to the wire before being rejected yesterday (report here), groups across the political spectrum activated in support of the legislation, which codifies in law that no agency of the Commonwealth of Virginia - including defense forces and national guard troops, will comply with or assist the federal government in any way under it's newly claimed powers to arrest and detain without due process. INTERNMENT: NEVER AGAIN The bill's primary sponsor, Delegate Bob Marshall, had this to say in support: "During World War II, the federal government incarcerated tens of thousands of loyal Japanese Americans in the name of national security. By this bill, Virginia declares that it will not participate in similar modern-day efforts. Even President Obama had questions about the bill, when he promised the American people that he would not use the unrestrained powers it granted him - but why should we trust any President with such powers? Over the years, many friends of Hillsdale, those who never attended college here, have said to me: "Dr. Arnn, I wish I could take Hillsdale's Constitution course!"
In response to these requests, this past year, for the first time ever, Hillsdale College offered the "Introduction to the Constitution" lecture series at no charge. Frankly, I wasn't sure what sort of a response a course like this would have.
That's why I was excited to see that YOU and almost 200,000 other people from all over the United States registered for "Introduction to the Constitution."
Thank you very much for registering and participating. I hope you learned a lot from the series.
I was thrilled, not only by the response, but at what it indicates: Americans are willing and eager learn about the Constitution and to defend the principles of liberty that made America so prosperous!

It is my honor to teach the first class, "The American Mind," and the final class, "The Recovery of the Constitution." All of the classes will be taught by Hillsdale College professors - the top teachers in their field and the same ones who instruct our students here on Hillsdale's campus.

House Bill 1776, The Property Tax Independence Act, will be introduced shortly in the Pennsylvania house and Senate. This bill is designed to accomplish the following:
- Eliminate school property and local school nuisance taxes across the Commonwealth and replace those taxes with funding from a single state source.
- Introduce a modernized school funding method that is based on 21st century economic realities.
- ABOLISH the school property tax as well as eliminate the local school earned income tax and nuisance taxes such as the per capita and privilege-to-work taxes imposed by school districts.
- Utilize in great measure our current sales tax mechanism to fund schools, restoring the original intent of the tax.
- Shift school funding to a predictable and stable funding source that is tied to economic growth. This is in clear contrast to the school property tax which is not based on economic growth and is subject to much variation.
- Address the problem of current school spending regularly exceeding tax revenue head-on by limiting school budget increases to the rate of inflation.

The bad news is last month some well intentioned political activist announced a cut-off date for signing up co-sponsors for Rep. Rose Marie Swanger's American Law's for American Courts (HB 2029) in an effort to inject some urgency into the effort.
What it resulted in was an interruption of the campaign to encourage those Representatives not yet signed on as co-sponsors to join with those Legislators who have already recognized the death by smothering threat to our Constitution.
The good news is there is no cut-off date for adding co-sponsors and we are once again asking your readers to contact their representatives and ask they join the battle.
There are only three Representatives from Bucks who are co-sponsors, Representatives Clymer, Petri and Quinn and we thank them for showing their colors.
But that leaves seven more Representatives who appear to be still standing on the sidelines as the battle for our existence as a free people is joined.

Our laws have worked just fine since colonial times. What is needed are politicians who respect them. And you know whose job it is to remind them of that.

Philadelphia Sharia Law: Philadelphia City Council Fights For Sharia Law
Pennsylvania House Bill 2029 has been introduced to protect the state from the implementation of foreign law in the state's courts. Known as the Anti-Foreign Law House Bill, 2029 includes Sharia Law, among others. The Philadelphia City Council has approved a Resolution urging the General Assembly to kill the bill - because "Philadelphia welcomes all religious beliefs, traditions and heritages."
Introduced by Rep. Rosemarie Swanger (R-Lebanon), the bill would ban all cases of foreign law infused in Pennsylvania courts...Swanger's intent was allegedly stated on a memo she sent out before the bill was introduced, in which she stated, "America has unique laws of liberty which do not exist in foreign legal systems, particularly Sharia Law." And: "We are a nation of laws. Unfortunately, increasingly, foreign laws and legal doctrines-including and especially Sharia Law-are finding their way into U.S. court cases." Source: PhillyNow
The Council on American Islamic Relations (CAIR) says Bill 2029 is "meant to induce anti-Muslim fervor the country over." CAIR is selling, Philadelphia is buying.

CAIR's Fight Against Pennsylvania Foreign Law Bill

Resistance to a new bill aimed at limiting foreign law in Pennsylvania courts serves as a case study of how Islamists and their allies operate: peddling falsehoods about Shari'a, painting Muslims as victims, and denying that anyone seeks to institutionalize aspects of Islamic law - even as they vigorously promote that very agenda. With similar legislation being debated across the U.S., understanding their tactics is critical.
At issue in Pennsylvania is House Bill (HB) 2029, which stipulates that "a tribunal shall not consider a foreign legal code or system which does not grant ... the same fundamental liberties, rights and privileges" as guaranteed by the federal and state constitutions. Introduced in November, it follows the American Laws for American Courts (ALAC) model and makes no mention of Shari'a. A preliminary memo sent to legislators last June in the name of Rep. RoseMarie Swanger, HB 2029's chief sponsor, does highlight Islamic law, but she later said that it had been circulated accidentally. Regardless, concerns about Shari'a are warranted due to its many provisions that conflict with the standards of American jurisprudence. For example, it disadvantages women in terms of inheritance, divorce, child custody, and other areas of family law. Shari'a already has shaped numerous cases nationwide, including in Pennsylvania, where one state court decided how assets should be distributed according to Islam.
Pushback against HB 2029 has been led by the Philadelphia office of the Hamas-linked Council on American-Islamic Relations (CAIR-PA) and was punctuated by an interfaith press conference (video here) at CAIR-PA headquarters on December 14. The overall campaign reflects CAIR's usual recipe of distortion, victimology, and contradiction between words and deeds.
Attacks on bills like HB 2029 begin by sowing confusion about Shari'a. Because Islamic law encompasses virtually every facet of life - governing personal activities such as eating and worship, but also forming an oppressive social and legal structure - suit-and-tie Islamists work to emphasize its unthreatening pieces whenever possible. CAIR-PA executive director Moein Khawaja's suggestion that Shari'a should worry Pennsylvanians no more than halal gyros is a fine example of this technique.

 Deception, betrayal, and dishonesty. These are not appealing traits in elected officials, but sadly, they aptly describe many Republican lawmakers across the country feverishly working to implement ObamaCare. Would you believe that Governor Tom Corbett is among those Republicans diligently complying with ObamaCare? Despite the fact that Pennsylvania is party to the lawsuit being heard before the Supreme Court, Tom Corbett is implementing the law in our state. ObamaCare requires that each state set up what is known as a Health Insurance Exchange. In theory, these exchanges will be one-stop online shops where individuals will pool together to purchase insurance. Without a state-created exchange, the individual mandate cannot be enforced. As in all bureaucracies, there are some major downfalls, not the least of which is the anticipated spike in the cost of insurance. Other significant issues include: - The federal government will dictate what insurers may participate
- The federal government will decide minimum coverage-potentially including such elective procedures as breast augmentation and face lifts
- The federal government will stipulate how the exchange is run
I could go on, but I'm certain you recognize the theme. The federal government will control every aspect of our health care. Yet, Governor Corbett claims that establishing CorbettCare will protect Pennsylvania citizens from undue federal regulation. The opposite is actually true. Creation of the CorbettCare Exchange does great harm and forces onerous federal regulations on our state. Governor Corbett is readily ceding state Sovereignty to the central government, and relinquishing all authority on health care matters. Our state has already requested and accepted over $33 million to set up the exchange! Merely accepting and spending federal funds requires absolute obedience to federal government regulations, and the loss of state sovereignty. A key responsibility of state officials is to protect our sovereignty, yet our legislators may be considering legislation to assist in the establishment of CorbettCare. And like obedient little children, these turncoats expect you to forget their empty promises, ignore their campaign rhetoric, and blame the Federal Government for all of the many losses you will suffer as a result. Those hundreds of millions will never be returned to our treasury-unless you and I do something to force the issue now. Tell your legislators that even if the Supreme Court fails to overturn ObamaCare, you expect them to protect your rights and jealously guard our state sovereignty by refusing to establish a state exchange. According to Stephen Bannon on Hannity, the tapes of Obama's radical days at Harvard will be released in a "week to ten days." Now I'm all for releasing the tapes, but wouldn't it be better to wait until about Labor Day or October?

1. Mitt Romney Urged Obama to Embrace the Individual Mandate
Had Michigan not been as close, the Democrats would have waited to spring this on us in the general election. Luckily we have it now and I hope Ohio voters are paying attention.
In July 2009, Mitt Romney wrote an op-ed in USA Today urging Barack Obama to usean individual mandate at the national level to control healthcare costs.
On the campaign trail now, Mitt Romney says the individual mandate is appropriate for Massachusetts, but not the nation. Repeatedly in debates, Romney has said he opposes a national individual mandate.
But back in 2009, as Barack Obama was formulating his healthcare vision for the country, Mitt Romney encouraged him publicly to use an individual mandate. In his op-ed, Governor Romney suggested that the federal government learn from Massachusetts how to make healthcare available for all. One of those things was "Using tax penalties, as we did, or tax credits, as others have proposed, encourages "free riders" to take responsibility for themselves rather than pass their medical costs on to others."
2. Further Proof Romney Supported a National Individual Mandate In 2009 Back in 2009 Mitt Romney took to the pages of USA Today to tell President Obama that as he came up with a healthcare plan he should consider using "tax penalties" as Massachusetts did or "tax credits, as others have proposed" to help cover the costs of health care. The "tax penalties" is Mitt Romney's individual mandate, a key portion the Obama Administration has credited all along as having been embraced in Obamacare. Since pointing out yesterday that, in his own words, Mitt Romney supported a national individual mandate, his supporters have gone totally insane on twitter fully denying and trying to spin their way out of this story. Despite Romney's own words in his editorial, Mitt Romney's supporters are denying Romney's own words. But Romney did not just write an op-ed. He went on Meet the Press too. You can hear Mitt Romney on Meet the Press recommend the President take one of two approaches in formulating health care. The first approach Romney suggests is Romneycare, which Mitt Romney now claims was never intended to be a model for the nation. The second approach Romney suggests is the Wyden-Bennett health reform measure then pending in the United States Senate. Wyden-Bennett, like Romneycare, contained an individual mandate. 3. We Are at War. Is the Media Scared to Really Cover It? Journalists are much more tolerant of attacks on Christianity than Islam. It is a fact. ABC is airing a television show called "Good Christian Bitches." Never mind the outrage over the recent Sandra Fluke business, but there is a double standard. And let's not fool ourselves as the media would never tolerate a story where "Muslim" was substituted for "Christian" in that show. The media's present politically correct excuse is that Islam binds certain minority group's cultures in a way Christianity does not. First, that is crap and speaks of a secular ignorance about many Christian communities even in this country. Second, it is an excuse so the media does not have to admit it is scared of muslims. You'll see a news story about Christ in a jar of urine, but don't ever expect to see a cartoon of Mohammed on the nightly news. The reporter doesn't want to get murdered. I am starting to wonder if the same holds true in the present war our country finds itself in that too few reporters are really brave enough to cover. We are at war on our southern border with Mexico and the press is really not doing justice to coverage of the war. The latest story points out just how much of a war it is and just how badly our government and Mexico are handling themselves. 4. This Goes Both Ways, Right? Some Republicans Start Rooting for Conservative Defeat. Chris Cilizza as an interesting story in the Washington Post in which some Romney supporters are openly wondering if the Republican Party needs to be wiped out in 2012 in order to win big in 2016. "I'd personally enjoy all the 'we can't nominate another Republican In Name Only' crowd getting a stomping by an incumbent with an 8.5 unemployment rate,' said one senior party strategist, granted anonymity to speak candidly, warning of nominating a strictly conservative candidate like former Pennsylvania senator Rick Santorum." My only wonder is if this is a two way street. Because the party is finally deciding to rally to Mitt Romney. I suspect he will win Ohio and, with it, he will begin wrapping up the nomination. And then I think we will see the Democrats unleash unmitigated hell on him in a way in which the GOP is ill prepared. The Mormon Church will be the first major attack. Then Bain Capital and all the individuals who blame Mitt Romney for their unemployment. Then we'll get into Romney's flip-flops. Etc. Etc. Etc. It will be nasty. It will be ugly. And Romney will be left to complain about just how unfair it is that the media isn't paying as much attention to what Barack Obama's policies have done to the nation. And he will lose unless the economy, driven by gas prices and Europe, begins to decline again. So I hope this is a two way street. If Romney gets stomped by an incumbent with an 8.5% unemployment rate, I hope we can be rid of him and people who give the Washington Post these sorts of quotes. 5. Libertarian Ed Crane Decides to Act Like a Liberal. Will It Destroy the Cato Institute? A friend of mine asked me last week why I hadn't written about the Cato Institute lawsuit business with the Koch Brothers. I told him I hadn't seen it pulsing up anywhere, so why should I give it any attention. Ed Crane, the President of Cato, has no viable legal argument and it seemed to me he was just taking advantage of the current left-wing hate against the Koch's to try to garner some sympathy for an organization nobody has really cared about in more than a decade. Then suddenly there was a flurry of stories and I think they prove me right. The Politico had one of the few stories written before the weekend. The the Washington Post ran a big story. The Boston Herald referenced it. The Los Angeles Times was ahead of them all. When the news broke last week, Dave Weigel gave a pretty good overview. All of the stories show a pretty terrible sense of history and make rather clear that had the Koch Brothers not been involved, there wouldn't be much interest. This is a vendetta with journalists too happy to play along.

Give them another reason why Obama has GOT to go.
NO. 5 He doesn't think America's anything special. No really, he doesn't. Quote: "I believe in American exceptionalism, just as I suspect the Brits believe in British exceptionalism and the Greeks believe in Greek exceptionalism." In other words: everybody's special. Tell your friend that, with his Barney the Dinosaur egalitarian worldview of everybody being special, Obama ought to be a kindergarten teacher, leading the kids in non-competitive, non-judgmental songs, not the leader of the free world.

Note that it is still cold. Remark on this fact to liberals. Say: "Hey, do you remember the time when all those liberal, ecotard crazies used to tell us we were all going to fry because of 'Global Warming'? How dumb must they be feeling now?"

Modern political warfare is a battlefield in which small battles give way to the larger conflict for national rule and succession. In feudal times such conflicts might be settled with a coalition of lords aligned one way or another. In the modern colonial territories between the Atlantic and the Pacific, populated by a fragmented collection of states, races, religions and classes, the coalitions are assembled out of those groups. Each side struggles to amass a winning coalition by showing as many groups as it can that it is on their side. In this environment political wars over policy come down to battles in which both sides position their approach as beneficial to as many of those groups as it can. That is why candidates pitch ethanol in Iowa, the auto industry in Michigan and moon colonies in Florida. It is also why Democrats inevitably roll out an election strategy based on their rainbow coalition of peoples supposedly advantaged by their policies. This strategy works because of the love/hate relationship that people have with government, fearing its power but wanting it to do something, even if that something is nothing. No one wants to be caught in a situation where the power is on the other side. Some of this is natural distrust and some of it has a basis. States and even the most benevolent organizations compete for funds. Commerce is full of lobbies that will rewrite the system to bankrupt the competition and has done it over and over again. Some of it is cultivated distrust, much of it by the rainbow coalition which has done an excellent job of programming voters to believe that the alternative will be a system of white males hostile to them. Half of winning a battle is choosing the terrain. The actual conflict, the clash of swords and spears is often secondary to positioning. Set up in the right place and you can win, even when you lose. Set up in the wrong place and all you have to look forward to is a victory so costly that it makes the war hopeless. When your battle is all about coalitions, then your positioning is all about selling your policies as being beneficial to as many coalition members as possible and their policies as being hostile to as many coalition members as possible. A mandate that forces religious institutions to provide products and services that is in conflict with their faith has to be fought on the grounds of religious freedom. The mandaters equally wanted to move the battlefield from religious freedom to women's rights. Both sides wanted to choose a terrain that would mobilize their own coalitions. To do that both sides had to emphasize their angle on the mandate and make that angle preeminent in people's minds. The vocal protests by Catholic groups put the religious freedom angle ahead. Then came Fluke and too many Republicans took the bait and the debate shifted from religious freedom to the promiscuity of graduate students and just like that defeat had been snatched out of the jaws of victory. The narrative had shifted from the right of religious institutions not to be compelled to violate their beliefs, to a debate over sexual mores, which was exactly where the left wanted it to be. The narrative defines the story you are telling. The story that the Republicans had been telling was that the mandate was a threat to our freedom. The story that the Democrats began telling was that the lack of a mandate was dangerous to women's rights. Pointing out that Fluke was lying about the expense of contraception demonstrated that a mandate was unnecessary. But it was also a distraction from the core point because the debate had shifted from religious freedom to whether subsidized contraception was needed. In the Manchurian Candidate, Senator Iselin famously complains about giving varying figures to which his wife explains that the varying figures shift the debate from whether a thing is true to the degree to which it is true. Debating to what extent contraception is needed undermines the core issue that religious organizations cannot be compelled to violate their faith to provide something a thing, regardless of whether it is needed or not and whether it is expensive or not. A debate on the availability of contraception, no matter how well handled, only served the narrative of one side. No matter how well the debate was conducted, it meant that the right was now fighting on the battlefield that had been chosen by the left. All it took was a few sexual insults lobbed Fluke's way for the diversion to be complete. The right was now either retreating from sexism charges or engaging in it. The social issue was framed in exactly the terms that fit the left's narrative. Limbaugh's apology was nearly as bad of an idea as his original statement. The only time you advance into an enemy's choice of terrain is when you are confident of being able to fight there and win. You do not give up the high ground just to take a few potshots at the enemy. After a temporary satisfaction, you end up losing the battlefield and being drawn into a battle that you never meant to fight. When that happens, you circle around and take back the high ground, you do not surrender because then there is nothing left to fight for.

THE IRAN WAR MYTH In 2007, Israeli Air Force jets crossed into Syria and destroyed an Iranian-backed nuclear reactor. The operation had the backing of the United States and employed intelligence derived from an Iranian defector. There was no regional war afterward. Not even an exchange of fire at the Israeli-Syrian border. In 1981, Israel struck deep inside Iraq, destroying Saddam's Osirak reactor. The attack was universally condemned at the United Nations and even by Israel's allies. Had Saddam used it as the basis for a war, Israel would have had no international support at all. But again no war followed. Today, Iran and opponents of any attack on its nuclear program hold up the specter of a regional war that will drag in the United States, devastate the region and drive up oil prices. This is the only card in their deck until the mullahs have their own bomb, and it's an effective card to play. In about two weeks we will be releasing our textbook analysis report entitled "Education or Indoctrination? The Treatment of Islam in 6th through 12th Grade American Textbooks." This report is the culmination of three and one-half years of planning, research, writing and editing. Here's just one example of what our research found. Obama's Deeds Do Not Match Obama's Words
Washington, D.C. (March 4, 2012) -- Republican Jewish Coalition (RJC) Executive Director Matthew Brooks issued the following statement in reaction to President Obama's speech at the American Israel Public Affairs Committee Policy Conference:
"President Obama once again came before the AIPAC conference with a speech where his strong rhetoric does not match his administration's weak record on support of Israel. Obama said, 'As you examine my commitment, you don't just have to count on my words, you can look at my deeds.'
"Obama's deeds include unprecedented pressure on Israel not to build in its eternal capital of Jerusalem, cutting critical military aid to joint US-Israel missile defense program in a time of need, adopting as U.S. policy the Palestinian demand that Israel accept 1948 armistice lines as the basis for a final settlement, and failing to holding Palestinian leaders accountable for their refusal to keep their peace-process commitments. "Mr. President, we have examined your deeds and they demonstrate that you are not providing the support that Israel needs. It is why elected officials, media and interested parties in the Middle East describe US-Israel relations as being at an all-time low and your policies as weakening Israel's position. "It is said, one way to look into someone's heart is to see what they say when no one is watching. President Obama provided a glimpse of that when, in November 2011, an open microphone caught him joining with French President Nicholas Sarkozy in expressing exasperation over having to work with Prime Minister Netanyahu. The Jewish community is too smart to fall for election-year revisionist history. We will remember in November."

Morning Bell: Obama's Hidden Tax Hikes

EXCLUSIVE: It could be said that President Obama has never seen a tax hike he doesn't like - whether it's letting the 2001 and 2003 tax cuts expire, insisting on higher taxes for job creators, and yesterday calling on Congress to raise taxes on the oil industry. But as much as the President wants to raise taxes, Heritage has discovered that there are even more tax hikes hidden in his budget, adding up to a total of $2 trillion in higher taxes.
In a new report, Heritage's Curtis Dubay uncovers Obama's hidden tax hikes and finds that the President's proposed $1.561 trillion tax increase over 10 years is much bigger than advertised. In fact, the President wants to raise taxes by $1.689 trillion - that's $128 billion more than was reported by the White House Office of Management and Budget (OMB) in the President's FY 2013 budget proposal.

Bill Says: "Embrace Pipeline" Speaking at a Department of Energy conference in Maryland on Wednesday, former President Bill Clinton said America should "embrace" the Keystone XL pipeline. I hope he's talking to his wife. It is up to the State Department to approve the plans because it crosses the international border with Canada. Secretary Clinton just happened to be on Capitol Hill the same day testifying before the House Foreign Relations Committee. She was asked about her husband's remarks and responded: "He's a very smart man. But he, unfortunately, is not bound by the laws and regulations any longer of the United States to make decisions that follow a certain procedure. And that's what we have to do." Let me remind you that this is coming from the same administration that didn't give one whit about procedure when it wanted something done. Remember Obama's "We Can't Wait" mantra of the past few months? Any time he wants to circumvent or bypass Congress, he says, essentially, "We can't wait for Congress to act, so we will." Remember how the stimulus bill was such an emergency that it had to be approved without delay? Remember how no one was allowed to read ObamaCare and had no idea what the constitutional justification was for that socialist takeover of our health care system? They bent just about every rule possible to pass it. But now that there is something that Obama's radical green allies don't want done, suddenly this administration has a new found respect for laws and procedures. Steven Says: "I'm Not Working To Lower Gas Prices" Gas prices are going up again. The New York Times reported yesterday that the national average for a gallon of gas is now $3.73, while folks in California are paying $4.32 on average. The Times notes that the possibility of $5 a gallon is "hardly far-fetched." So what is Obama's administration doing about it? Not much evidently. Energy Secretary Steven Chu also testified on Capitol Hill this week. Not surprisingly, the issue of rising gas prices came up. Rep. Alan Nunnelee (R-MS) asked Chu whether it was the goal of the Energy Department to lower gas prices. "No," Chu responded, "the overall goal is to decrease our dependency on oil." It is a galling response, but not terribly surprising. Chu once said that he wanted gas prices in America to be closer to the sky-high prices in Europe. Why would he want that? Raising the price of something so that it becomes prohibitively expensive is one way to lower consumption and therefore reduce dependency. I guess Chu's comment about reducing our dependency on oil helps to explain why Obama wants us to put algae in our tanks. One can debate the merits of alternative fuels. But what is not debatable is that no one is going to be driving to work with pond scum in their tanks any time soon. And for many people paying $4.00 a gallon or more for gas is a very real emergency. Obama's War On Coal Two power companies announced Wednesday that they are shutting down nine coal-fired electricity plants. Both companies blamed EPA regulations for the closures. Consider this excerpt from the Washington Post:
"Edison Mission Group, issued a statement saying that in light of environmental rules being phased in over the next three years, 'unfortunately, conditions in the wholesale power market simply do not give us a path for continuing to invest in further retrofits at these two facilities.' ...In its announcement, GenOn outlined a schedule for closing 3,140 megawatts of generation capacity in Ohio, Pennsylvania and New Jersey 'because forecasted returns on investments necessary to comply with environmental regulations are insufficient.'"
In other words, Obama's EPA is making it too expensive to operate these power plants. The Post story did not say how many jobs would be lost when these plants shut down. But, again, this should not surprise anyone. Obama made it clear in 2008 that he wanted to "bankrupt" coal plants and that his plans would cause electricity rates to "skyrocket." So let's think about this for a moment. Obama doesn't want us driving our gas powered cars. He said no to the Keystone pipeline, and has severely limited drilling and exploration on public lands. His Energy Secretary wants the price of gas up to $8.00 a gallon or more. Obama wants to increase subsidies for the "Government Motors" Volt to $10,000. The Volt runs largely on electricity. Yet Obama admits his plans would cause electricity rates to skyrocket. America gets about half of its electricity from coal-fired plants, which Obama wants to bankrupt. Lo and behold, coal plants are shutting down now thanks to Obama's EPA. This is madness! From the gas you put in your car and the price to heat and cool your home to the costs borne by manufacturing businesses and every company that pays an electric bill, fewer issues are more important to working men and women than energy. Yesterday on the Sean Hannity show, CNBC's Rick Santelli blasted Obama's energy policy as "reprehensible." He added:
"Our society, our culture -- the greatness of America -- goes hand-in-hand with energy, and our leaders need to wake up. We need energy, OK? ...we need to be more honest -- do we want to be a superpower that uses energy and tries to do it wisely, or do we want to put our head in the sand... [Alternative energy sources] are not ready, and I think it's just a disservice to my kids that they're going to make energy usage such a penalty-type scenario, where we all know if you want to put GDP up, energy usage is going to go right along with it."
Santelli is right. Obama has been celebrating the fact that we have consumed less oil in recent years. But that reduced consumption has gone hand-in-hand with high unemployment and a collapsing economy. America can't afford four more years of Barack Obama. WASHINGTON - There is increasing concern that the Department of Homeland Security will fail to meet a coming congressional mandate to have 100-percent monitoring of all cargo inbound into the United States, according to a report in Joseph Farah's G2 Bulletin.

ObamaCare's Continued Chaos
To no thinking person's surprise, the Obama administration admitted this week that another element of ObamaCare is going to cost more than originally expected. This isn't really news so much as it is yet another confirmation that the president's takeover of health care will be an absolute disaster.
The latest program to exceed expectations is the Pre-Existing Condition Insurance Plan, which provides health insurance for people who can't obtain coverage through private carriers. The PCIP was meant to be an interim program phasing out in 2014, at which point all insurers will be required to accept all comers who want coverage. In November 2010, the federal government estimated an annual cost of $13,000 per enrollee. Since the program's launch last year, some 50,000 people have signed up, and now the expected cost is around $29,000 per enrollee.
While we're on the subject, the outrageous contraception mandate remains yet another tarnished gem in the ObamaCare crown. Health and Human Services Secretary Kathleen Sebelius announced this week that the administration has begun "outreach" to officials in the Catholic Church, insurers and groups that run self-insured insurance plans. However, Sebelius' "outreach" isn't in search of a compromise with faith-based groups whose rights are being trampled for the sake of free contraception. The administration hasn't backed down from its non-compromise offer that the cost for free contraception be shifted from faith-based employers to private insurance companies. The mandate is here to stay, and faith-based employers have 18 months to comply.
One of the free contraception mandate's more vocal supporters testified this week before the House Democratic Steering and Policy Committee about how tough life can be without free birth control. The hearing was nothing more than a showpiece for the issue with a single witness, Sandra Fluke (is there a pun here?), a Georgetown law student and self-professed "reproductive rights activist." Fluke made the absurd claim that free contraception is a necessity at her school, which currently doesn't provide it. "Forty percent of the female students at Georgetown Law reported to us that they struggled financially as a result of this policy," she complained. Of course, the HHS mandate has nothing to do with university students, but that's beside her point.
Fluke asserted that contraception could cost $3,000 through three years of law school. That's a lot of money to spend on protected sex over that time frame. In fact, humorist Frank J. Fleming quipped, "Anyone buying that much contraception should probably be writing it off on her taxes as a business expense." Fluke's assertion that she and other women have an absolute right to contraception at someone else's expense is disturbing. There is no right to sex free of consequences. Fluke also implies that the women of Georgetown law have no control over their urges or actions, all the while thinking she's standing up for women's rights. When did "get your laws off my body" become "you have to pay for the stuff that goes into my body"?
The most important question, of course, is just where within the Constitution is the government granted the power to mandate this sort of thing for private or religious organizations? This was asked of Rep. Kathy Hochul (D-NY) by one of her constituents at a recent town hall. She replied, "Well, basically, we're not looking to the Constitution on that aspect of it." We suppose Hochul's candor is refreshing, but it didn't sit well with the crowd -- nor should it. Hochul attempted to defend ObamaCare by stating that Congress determined that citizens are entitled to health care. "So why don't we provide free access to Band-Aids and cancer screenings?" the constituent followed up. "Aren't those more important to health care than contraception?" Hochul could only say, "Well, clearly more work needs to be done." Nice understatement.
In the Senate, an amendment to impose a religious-conscience exemption to ObamaCare was rejected Thursday. Proposed by Sen. Roy Blunt (R-MO), the Respect for Rights of Conscience Act was attached to an upcoming transportation bill. Democrats were nearly united in opposition, and retiring Maine "Republican" Olympia Snowe was the only GOP member to oppose it. Obama, adamantly pushing "free" contraception, would have been forced to veto the whole transportation bill in order to prevent the conscience exemption from again being the law. His other option would have been to let the amendment pass and hope it takes some of the heat off as the presidential election moves forward.
The one bit of good news is that a House committee voted to throw out the "death panel" provision of ObamaCare. The Independent Payment Advisory Board was supposed to help with cost control, but has been accurately tagged as a "death panel" because of its rationing of care. All things considered, however, a new administration and a more Liberty-friendly Congress must be installed in January to repeal this monstrosity.

On the Campaign Trail: Romney Sweeps
Mitt Romney won the Arizona and Michigan primaries Tuesday, as well as the Wyoming caucuses Wednesday, bringing his winning streak to four. Unfortunately for the frontrunner, he had to spend a lot of money in his "home" state of Michigan to squeak by Rick Santorum in the popular vote. This is in part because some 100,000 registered Democrats turned out to vote for Santorum in an effort to damage Romney's candidacy. This cynical mischief-making is to be expected of the Democrat Party and the current administration, but Santorum's last-minute robocall to rally Michigan Democrats seemed beneath him. In it, he assailed Romney for having criticized the taxpayer-funded $85 billion bailout of Detroit automakers. In fact, neither candidate supported the bailout, and Michigan is perhaps the only state whose voters still do.
For his hard-fought win, Romney receives 16 of Michigan's delegates while Santorum gets 14. Overall, Romney now has 168 delegates to Santorum's 86, while Newt Gingrich and Ron Paul lag behind with 32 and 19, respectively.
Super Tuesday is next on the docket, with voters heading to the polls in 10 states. Newt Gingrich hopes to regain momentum with a win in his native Georgia, as well as a couple of other states, but his poll numbers don't lead us to believe he will succeed. Ron Paul is sticking to his plan to win as many delegates as possible to elbow his way into a prime speaking slot at the convention.
It's here that we should pause to reiterate that The Patriot Post has not and will not endorse any Republican candidate during the primary. Our primary objective is defeating Barack Obama in November, and we fear that refusing to settle for less than a GOP Messiah could jeopardize that goal. None of the four candidates fits that bill, though any of them would be a vast improvement and start us on the road to recovering the Liberty lost since 2009.

Obama is the epitome of a divider, a racial polarizer. Whatever happened to "There is not a black America and a white America and Latino America and Asian America -- there's the United States of America"?

News From the Swamp: Department of Redundancy Department
The Government Accountability Office (GAO) reported this week that virtually no progress has been made in the past year toward cutting duplicate government programs. Shocking, we know. Last February, government bean counters identified 81 areas in which redundant programs run by multiple agencies are wasting billions of dollars. Barack Obama and Congress have acted to eliminate just four in the past year while 60 other areas have undergone some undefined early steps, and 17 haven't been acted upon at all. Last year, when talk about cutting spending was all the rage in Washington, Obama tried to convince the public that the government would save some real money by eliminating this waste. Such actions are welcome, but they wouldn't have much of an impact on the overall deficit picture.
The GAO report certainly indicates that there was no impact at all because the president and Congress only paid lip service to the effort. The report's findings identified some of the biggest culprits in budget redundancies, and none of them should come as a surprise. The Justice Department spent $30 billion in overlapping crime-prevention and victim-service grants since 2005. There are currently 23 agencies involved in 160 different programs to support homeowners and renters in some capacity. Fully two-thirds of all "green" building initiatives don't have goals or performance measures, making them completely unaccountable to Congress or the public. Meanwhile, members of Congress are still drumming up ideas for new programs that duplicate existing ones.
New & Notable Legislation
The House reintroduced this week several bills meant to give aid to job creation. More than a dozen such bills have languished in the Senate, despite overwhelming support in the House. One bill, the "Jumpstart Our Business Startups," or JOBS, Act, is a bundle of six bills. It targets some of the "red tape and access to capital" issues obstructing growth for would-be small-business owners. The bills all enjoy bipartisan support although not from the House Democrat leadership or Democrats in the Senate. Even the White House offered a word of support.
Andrew Breitbart, RIP
The conservative movement lost a "happy warrior" Thursday when Andrew Breitbart died at 43. He leaves behind a wife and four young children. Breitbart was instrumental in the early days of the Drudge Report and co-founded the Huffington Post before leaving over differences in direction. He then founded his eponymous news site, as well as the "Big" sites -- BigGovernment, BigHollywood, BigJournalism and BigPeace, each taking aim at the antagonists in their titles. Breitbart, however, was perhaps most noted for his devastating "hidden-camera" stings of corrupt liberal organizations such as ACORN and NPR.
He recently completed another book, "Righteous Indignation," in which he concluded, "I love my job. I love fighting for what I believe in. I love having fun while doing it. I love reporting stories that the [Media] Complex refuses to report. I love fighting back, I love finding allies, and -- famously -- I enjoy making enemies." The battle for Liberty will continue, but one valuable Patriot short.

Around the Nation: Construction to Begin on Part of Keystone Pipeline
It's not everything Republicans want and it certainly won't make environmentalists happy, but TransCanada announced earlier this week that they will press on with the southernmost extension of the Keystone pipeline project, a section connecting Cushing, Oklahoma with Port Arthur, Texas. They will also -- once again -- file for a federal permit to extend the Keystone XL pipeline across the Canadian border.
The new pipeline, when completed in late 2013, is expected to transport 700,000 barrels of oil per day and relieve what's become a glut of supply at the Cushing pipeline terminus. According to TransCanada, building and utilizing the new stretch of pipeline will create about 4,000 jobs.
The Obama administration now calls this "welcome news" and claims it hasn't ruled out the remainder of the pipeline yet, but it also makes the laughable assertion that Republicans were really to blame for its scuttling the project "by not allowing sufficient time for important review." Never mind the project's been at the mercy of the Obama State Department for over three years. Democrats, remember, just don't believe that drilling for oil is necessary with solar, wind and amoeba power just around the corner. Meanwhile, tapping the Strategic Petroleum Reserve will keep soaring gas prices down. Not that the White House actually wants prices to go back down.
While the pipeline won't be the complete answer to our energy needs, the adroit nature of TransCanada's decision shows that, regardless of the anti-energy nature of our current regime, smart businesses can still find enough capitalism to succeed despite the best efforts of socialists.

Why Drill When You Can Scoop?
"Drill, baby, drill" is the long-adopted slogan of those who seek a real answer to our energy needs. Last week, Barack Obama put out the call to "scoop, baby, scoop" up algae as the renewable resource we can use to fuel our cars. On the stump in Florida, the president said, "You've got a bunch of algae out there, right? If we can figure out how to make energy out of that, we'll be doing all right." And if Obama's inane utterances were nickels, there would be no debt crisis. Unfortunately, every time he speaks, we need a scooper of a different kind.
The truth is that billions of dollars of research into biofuels of many sorts has been going on for decades, and we're no closer to filling our cars with a plankton byproduct. Yet as recently as last year, the Department of Energy handed out $24 million in grants to researchers studying the process of creating oil from algae. This regime certainly has a propensity to "invest" billions into failed schemes that are nothing more than high-priced boondoggles.
There's not much promise on the electric car front, either. After Fisker Automotive lost out on the remainder of its $529 million promised from the Department of Energy, their battery supplier A123 Systems had to lay off 125 workers from its Michigan plant. Still, the "one percent" there is doing all right. Company executives voted themselves hefty raises ranging from 5.7 percent to 20.7 percent despite the company's losing $172 million in the first three quarters of 2011. Abound Solar, which received a $400 million stimulus loan, is also laying off 70 percent of its workforce. If these are stimulus "success stories," we would hate to see the failures.
From the Left: Obama Will Buy a Volt ... in Five Years
It was a daily double for Barack Obama as he could pander to two of his key support groups at the same time. In a recent speech to the United Auto Workers, Obama noted, "I got to get inside a brand new Chevy Volt off the line. ... I liked sitting in it; it was nice. And five years from now when I'm not president anymore, I'll buy one and drive it myself."
Let's face it: The speech wasn't about the car; it was about continuing a narrative that the government saved the American auto industry. He called the idea of a political payback to Big Labor "a load of you-know-what." But there's no denying that great effort was expended to make sure the UAW made out well in the GM and Chrysler deals at the expense of more than 200 years of settled bankruptcy law, as well as citizen bondholders and local auto dealerships, which are primarily non-union.
So what would have happened if the government had done nothing? Most likely one or both automakers would have declared bankruptcy -- just as they did under Obama's takeover -- but doing so under the capitalist system may have enabled them (or any new owners) to negotiate a better labor deal, thereby also strengthening the other two automakers, as negotiations with the Big Three are often based on the first deal struck. Even with the bailout, the fears of a foreign takeover of Detroit were partially realized since Italian-based Fiat now owns the majority of Chrysler. On the other hand, Ford, which didn't take federal money, is now as strong as ever. In the end, though, we would all be better off if Obama didn't have to wait five years to buy a Volt. How about January 2013?
Regulatory Commissars: EPA Heads to Court
Nearly five years after the Supreme Court dubbed the Environmental Protection Agency a legislative body by ruling that the Clean Air Act gives the EPA the authority to regulate greenhouse gas emissions, the outgrowth of that decision is heading back to court. This week, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit heard arguments challenging the EPA's premise that greenhouse gas emissions pose a public health threat -- the premise underlying the agency's rash of rules regulating and restricting greenhouse gases. According to the pro-EPA group Clean Air Watch, "The entire U.S. effort to limit greenhouse gases hangs in the balance." Set to ominous music, this line would fit perfectly in an Al Gore documentary.
In reality, however, what's really at stake is our constitutional system of checks and balances. As The Wall Street Journal notes, those calling out the EPA on its overreach "say the EPA rules give the agency the power to affect energy production in the U.S. [and that] the case has broader implications because the EPA could use its greenhouse-gas findings as a basis to regulate other parts of the economy." The EPA certainly has too much power under the current regime, and the two non-executive branches of our government need to step in and put a decisive stop to its blatant disregard for the Constitution. We fear the Circuit Court is about to do the opposite.

Warfront With Jihadistan: Obama's Sincerest Apologies
Last week we detailed the accidental burning of Korans in Afghanistan, the standard Muslim riots resulting from those burnings, and finally, Dear Leader's expression of his "deep regret for the reported incident." How did Obama's apology work out for everyone? He credits it with having "calmed things down," but, back in reality, the latest body count is over 30 dead, including six American troops, and hundreds injured. Many of the victims were Muslim. We fail to see how killing members of your own Religion of Peace™ brings revenge on American troops, but we admit ignorance about the finer points of Islamist culture.
The usual assortment of leftists were out in full force defending Obama's apology from American critics. Secretary of State Hillary Clinton said, "I find it somewhat troubling that our politics would enflame such a dangerous situation in Afghanistan." Maybe the good secretary should stop blaming her domestic political critics for the violence of Muslims half a world away. We find that somewhat troubling. Besides, as conservative commentator Charles Krauthammer pointed out, Obama didn't apologize to the Afghans. Rather, he apologized to a mob, hoping to appease it. Apologizing to a mob demonstrates only weakness and invites further violence, which Obama got. Interestingly, when reporters asked for a copy of the "apology," White House propaganda minister Jay Carney said that Obama's "sincere" three-page apology to Afghan President Hamid Karzai "is not appropriate to show" to reporters. There is little doubt that is true, though we shudder to think what the Groveler in Chief actually said.
There is good news, though. The New York Times seems to have observed that the Taliban is still a brutal bunch of terrorists with this all-too real headline: Beheadings Raise Doubts That Taliban Have Changed. Keen sense of the obvious.

Department of Military Readiness: Lightning Strikes
Using his standard kick-the-can-down-the-road shtick, Barack Obama, through his Department of Defense (DoD) minion, then-Secretary of Defense Robert Gates, touted the wonders of the soon-to-be-operational F-35 Lightning II (a.k.a. Joint Strike Fighter) as a surrogate for the F-22 air superiority fighter. He then axed F-22 production and left America's air superiority against an advanced adversary and virtually any country buying their fighters almost totally dependent on an F-22 fleet one-quarter of the size DoD judges necessary.
That was 2009. Fast-forward to 2012, and the much-ballyhooed F-35 is still "soon to be operational." We are shocked to report that the horse-designed-by-committee fighter is still not ready for primetime. Of course, America has been down this one-size-fits-all road in the past. The original F-4 and F-111 programs are good examples.
Despite arriving last year, U.S. Air Force, Navy and Marine pilots chosen to train in these planes patiently wait at Eglin AFB in Florida's panhandle, and the end of their wait is not yet in sight. In addition to improperly installed ejection seat parachutes, concerns over cost overruns and inadequate flight testing now plague the fighter and delay the training.
Original projections put the total cost of the Pentagon's order for 2,443 F-35s at $233 billion. That figure has soared to $385 billion, making it the most expensive fighter program in U.S. history and allowing an opening for calls to cut the program dramatically. Meanwhile, some Pentagon officials have expressed concern that the fighter hasn't been flight tested adequately to release it to operational flight lines. None of these strikes against the F-35 bode well for its future, the future of America's air superiority or, more broadly, for the future of America's greater national defense.
Another North Korean Deal
"North Korea has agreed to halt nuclear tests, long-range missile launches and enrichment activities at its Yongbyon nuclear complex in exchange for food aid from the United States," reports CNN. "In return for the moratorium on nuclear activities at this key site, the United States has agreed to a package of 240,000 metric tons of nutritional assistance to North Korea." The administration made the agreement with North Korea's new supreme leader, Kim Jong-un.
Of course, the deal is bound to be just as worthless as previous ones to a regime that has little interest in honest deals -- that goes for the North Koreans, too. After all, the NoKos have dishonored every other non-proliferation agreement they ever made, and this one will be quite easy to ignore -- Yongbyon must cease nuclear activity but other facilities are not so constrained. The North Korean people are starving while their communist government pursues its nuclear program, which has provided ironic leverage for them over the years, and this administration has followed the failed example of those before it.
Jimmy Carter should be proud.

Second Amendment: Crime and Guns
Another school shooting this week brought attention back to the issue of the Second Amendment. There were the predictable calls for more gun control, but as we contest every time one of these tragedies occurs, it's a culture problem, not a gun problem. Three high school students in Ohio were killed and two wounded when a deeply disturbed student opened fire in a lunchroom Monday. We offer our prayers for their families and their fellow students.
In related news, the BBC noted the tragedy and referenced a story entitled, "US crime figures: Why the drop?" The article notes a steady fall in violent crime across the U.S. since 1991, and proceeds to offer "10 possible theories" to explain the trend, with the caveat that "no-one agrees on the reasons for this." The BBC chose to lead with "The Obama effect." The article paraphrases "one of the country's top criminologists, Alfred Blumstein," as surmising, "The election of a black president could have inspired some young black men, who are disproportionately involved in arrests for robbery and homicide, says the professor. It's very speculative, he adds, and probably only one factor of many." How something that happened three years ago accounts for a trend that began 21 years ago is left to the reader to interpret.
All nine other reasons were long-term hypotheses. None of the reasons included the increased number of concealed carry permit holders around the nation -- a trend that started, oh, about 1991. And if Obama had any effect, it's that he is now history's best gun-and-ammo salesman.
Meanwhile, it appears that Attorney General Eric Holder took the BBC story to heart and thinks the Obama Justice Department has helped reduce crime, too. In further testimony regarding the Fast and Furious operation, he defended himself by getting a bit testy. He admitted that it was a "fundamentally flawed program," but he insisted that he deserves credit, not accountability. "I think one thing that also has to be understood is that once this was brought to my attention" -- at this point, he slammed his hand on the table -- "I stopped it. I stopped it." He stopped it only after it got out of hand and came to the attention of the public.
How do more guns equal less crime?
Village Academic Curriculum: Trampling Religious Liberty on Campus
America's universities have become hotbeds of discrimination against Christian associations over the years. Two recent examples involve Vanderbilt University and the University of North Carolina-Greensboro.
The administration of Vanderbilt has instituted a policy prohibiting religious student organizations from using religious criteria in selecting their leaders. In other words, a Christian group must allow a non-Christian, even one hostile to the group's mission, into its leadership. Reasonable people can see why this would be a problem, but the Left, if it's anything, is always unreasonable. Organizations that refuse to comply will be denied official university recognition. Chancellor Nicholas Zeppos invoked a "sense of inclusiveness, of everyone being able to take part fully in the Vanderbilt experience." This typically empty-headed leftism ignores the fact that anyone can already participate in any group's activities. It's leadership that is at issue.
At North Carolina-Greensboro, a similar dispute is headed to court. The university instituted a policy of supposed "tolerance" for leadership of student associations, so the Alliance Defense Fund is aiding a Christian club to take the school to court. In this case, it appears that the university specifically targeted "Make Up Your Own Mind," a Christian organization, and insisted that non-Christians be permitted to serve as leaders because, the university says, the group is not affiliated with a church and therefore is not a religious organization.
What is it with leftists denying religious liberty these days? Perhaps they're so focused on defending the "right to assemble" portion of the First Amendment on behalf of the Occupy crowd that they have forgotten that it protects religious liberty, too.
And Last...
"At Guantanamo Bay, it seems no court appearance is complete without a minor controversy," reports Fox News. Majid Khan, a resident of Baltimore, pleaded guilty Wednesday to being an accomplice to a 2003 bomb plot in Indonesia. After the plea, he was asked to approve courtroom sketches of himself, which he declined to do. They were released anyway. As Fox notes, this isn't a new problem. "When Khalid Sheikh Mohammed was arraigned for the first time in the military commissions, under President George W. Bush, he, too, was asked by a court security officer for approval. Sources told Fox News, at the time, that Mohammed didn't like the nose in the picture and demanded that the sketch artist change it." The nose was indeed changed, and as a service to our readers we are releasing the accompanying edit of the sketch. It really reflects the true beauty of this Muslim extremist, don't you think?

Union Lackey Mustio Doubles Down
Pennsylvania Representative Mark Mustio was recently identified as one of the six GOP "Union Lackeys" who stood in the way of relatively moderate reform of the Commonwealth's Prevailing Wage laws. Mr. Mustio is currently running for both the PA House and Senate.
Incredibly, at a meeting this week of the
, Mr. Mustio presented a defense of Prevailing Wage laws and provided a two page handout detailing his reasons for refusing to support prevailing wage reforms in Pennsylvania. His entire defense of prevailing wage is listed at the end of this message.
His main points in defense of prevailing wage:
1. He disagrees that prevailing wage law drives up construction costs significantly.
2. He is concerned that, if cost savings are realized, those costs won't be passed on to the government, but that the companies may just add these savings to their profit.
3. Unions provide extensive training at no cost to the government
4. Unions have drug testing programs, non-union contractors do not
5. Workers used on Prevailing Wage projects are superior to those on other projects
The bottom-line is that Representative Mustio believes that "big government" should direct the economic activities of its citizens by forcing them to pay for the activities of certain groups that have "political power". New and small entrepreneurs that could qualify for jobs as small as $50 thousand do not have the administrative resources to bid for and complete all forms and certifications required by PA prevailing wage laws. Therefore Mustio prefers to prevent their entry and growth into the market to protect his "friends."
Mustio represents the type of General Assembly member that needs to be replaced by representatives that will reform the prevailing wage laws to promote the growth of new entrepreneurs in Pennsylvania.
This is the kind of attitude that allows Representative Mustio to vote for mid-night pay raises, fatten his pension, take $160 a day in per diems, and run for both the PA House and PA Senate at the same time. Protecting special interests will keep him and others like him in Harrisburg ---- unless we the people deliver a clear message on April 24.

Union Lackey Mustio's Defense of Prevailing Wage From hand-out provided 2/29/12 at VPU meeting The Pennsylvania Prevailing Wage Act has been a topic of discussion for many years in the General Assembly. You may be aware that under this Act, construction workers on projects covered by Pennsylvania's prevailing wage law must be paid minimum "prevailing" wage and benefit levels which vary by occupation and geographical area within the state. Each session, legislation is offered to alter changes to this system. When I am presented with any issue, I ask challenging questions of those advocating their position. I do not take anything said by a special interest as gospel. By seeking independent input on the topics that come before me for a vote, I am able to make my own informed decision as a member of the General Assembly. Many times this independent input comes from individuals that have vast experience in the field or particular topic being addressed by legislation. Quite honestly, prior to being elected to office I had some prejudices. As a business owner and the Chairman of the local chamber of commerce, I was anti-union. I placed all unions together into the same category. I have taken the time to tour facilities and seek independent input on the topic of prevailing wage. Specifically, for this issue, I toured and spoke with both union and non union contractors. My understanding of this issue is much more extensive than it once was. Generally, the first argument that I hear against the current Prevailing Wage Law is that it drives up the cost of construction. Some of the advocates that come to my office claim that eliminating prevailing wage will reduce the total cost of a construction project by l0% to 30%. Union and non-union contractors tell me that labor costs are typically only l9%o to 24% of the total cost of a project, depending on the scope. I have done the math and have found that the actual numbers show how claims of 30% savings are not attained. Let's assume that a bid of $ 1,000,000 for a new construction project is successful and we split the difference of the usual labor cost on construction projects and use 22%, $220,000 would be the labor portion of the project. It seems clear that any savings over 22%o would be impossible unless the workers not only worked for free, but also contributed to the materials for the project. To look deeper at the issue, let's assume that we actually can save 10Yo to 30Yo on labor. The ten percent claim would result in a savings of $22,000 or 2.2% of the total job cost, while thirty percent of $220,000 equals $66,000 or 6.6% savings at the high end of the claimed savings. As an advocate for government efficiency and saving the taxpayer money my next thought was to determine if these 2.2-6.6% savings are attainable. The contractors explained to me that contractors bid on projects based on wages, cost of materials, and the estimated number of employees to complete the job on schedule (along with some additional factors). The example I was given to consider was to assume a number of contractors consisting of union and non-union bidding on a private job. Union wages are set figures that are easily calculated, allowing the nonunion contractor the ability of adjusting the wage portion of the bid accordingly to gain an advantage in the bidding process. This does not guarantee that the wage portion of the bid will be passed on to the workers. It could just as easily be kept as profit for the contractor. Without Prevailing Wage laws, contractors are under no constraint to pay their workers a determined wage or benefit. How much of the 2.2% - 6.60% savings will be passed on to the tax-payer and how much will be kept as profit? When the primary claims of savings are statistically impossible, it raises questions about the rest of their argument. We are all looking for ways to tighten our belts in the face of declining tax revenues and growing budget shortfalls. At this time, I am not convinced that making these changes to the Prevailing Wage law will have that effect. One of the areas that impressed me about the union program was the value of their training through joint apprenticeship programs at little or no cost to the taxpayer. These apprenticeship programs are under the joint administration of the local craft union and the signatory contractor group the members work for. They are intensive training sessions that run 4 to 5 years in duration. In addition to learning the skills necessary to perform at the highest level possible, safety is also a priority in the training. Drug testing is also mandatory. In contrast, much of the non-union training is at taxpayer subsidized facilities. These costs are not factored into the argument by the prevailing wage reform advocates. Further, the non-union contractors I spoke with do not have drug testing programs. When I inquire why, the response is often: I would not have a workforce if they tested for drugs. As an insurance professional I am very much aware of the additional costs added when training is lacking and drug testing is not mandatory. As part of our caucus debate, the testimony of a non union contractor was considered. He testified before the House of Representatives Labor committee. In this testimony, he stated, "In order to make profit on Prevailing Wage projects I have to use my best workers". One could reasonably infer that the quality of work would be inferior and that he would have to hire more workers, further eliminating any savings and possibly even increasing costs. |

WASHINGTON - You don't expect to wake up in the morning to learn that a friend, colleague and fellow co-conspirator - 15 years your junior - has died.
It's just not right.
That's the news I got today about Andrew Breitbart, someone I have known and admired for nearly 15 years.
I still can't believe it. All who knew him were hoping that someone had hacked into his website this morning and posted the news as a cruel joke. That would be just like Andrew's enemies. But, alas, the unbelievably tragic announcement was confirmed.
I first met Andrew when he was about 28 or 29. He was working from his Santa Monica home as a backup editor for Matt Drudge. Over the years we chatted - more on Instant Messenger - than in person or on the phone. We both worked around the clock. We bounced ideas around. He was very generous with his ideas.

Sandra Fluke's Claim of $1000 Yearly Contraception Expenses Among Georgetown Students Accounts For 5 Sexual Encounters Per Day.
It is a known fact that public health service organizations make condoms free to the public upon request. But even if students were unaware of free access to condoms, the price of condoms, calculated against Fluke's $1,000 per year expenditure would mean that she and her fellow students have sex five times a day. Wal-Mart, for example, sells a 12-pack of Trojan condoms for $6.50 each. $1,000 divided by $6.50 is 153.85 condom packs. 153.84 condom packs times 12 condoms a pack is 1,846.15 condoms used. 1,846.15 condoms divided by 365 days is 5.06 sexual encounters a day.
That's a lot of sex.
Perhaps, however, Ms. Fluke was talking not about condoms, and instead about birth control pills. Just like condoms, public health organizations make birth control pills available to women who cannot afford them. But what if students are unaware that free birth control pills can be gotten? The fact is, generic birth control pills can be bought from national chains like Target for just $4 a month.

Here is another thought: If Ms. Fluke is in a monogamist sexual relationship, then her partner should share the expenses. If she just has casual sex , then she better choose the less expensive condom path or she may request HIV drug help in the future.

Friend -- Police escorted me across campus to protect me from radical black liberals who came out to protest my speech at Texas A&M University the other night. Sadly, these are the next generation of black leaders, the indoctrinated supporters of Obama. Because of the outcry against my presence on campus, some people wanted to cancel my speech, or refuse to let the protestors into the lecture hall. But on the front lines of the battle, we can't back down. So I let them in along with everyone else who wanted to hear why on earth a black woman would be a conservative. With scorn and disrespect, the protestors gathered to their seats in the back of the hall, stood up and immediately turned their backs to me. The hall was tense with disagreement and the possibility of a violent outbreak. You could have heard a pin drop, but I wasn't about to give them the silent treatment that they gave me. Moments like this are the opportunities to say what I desperately wish that someone had said to me at their age, before I signed up to live on the government plantation and watched my life spiral out of control over seven miserable years.
You can see in this picture there are at least three rows of black students protesting my speech, about my life and personal responsibility, by turning their backs to me.

I decided, I'm going to try to reach them with everything in me. I will tell my story, and I will tell the story of hundreds of thousands of black Americans who bought the lie of the Left. Then I will show them the sweet redemptive power of God's intervention in my life that showed me the only way to live is a life of personal responsibility. And I told them how big government is an idol that will destroy their lives and our great country and threatens our freedom, day-by-day, the deeper we're mired in a culture of dependency. But any black who speaks against Obama is considered a traitor by other blacks, these students were brainwashed to think. "This president has failed you and all of us," I wanted to shout. I cannot let these young men and women throw away their lives for Obama. His election shouldn't be about his personal popularity and certainly not his race. I wanted them to understand there are real-life consequences to his policies, and in just a year or two, they're going to enter the real world and have to decide: do I want to live in the free world or on the plantation? I know what they're thinking: "how dare you leave our side!" The black students talked about Barack Obama, Martin Luther King Jr., and Malcolm X as if they stood for the same ideals because they're all black! They have tunnel vision because they ignore what Obama is really providing for African-Americans: more blacks unemployed, more black babies aborted, and more black families on food stamps than ever. They continued to protest, and I saw more clearly than ever how brainwashed they are. Some people said I looked mad, and I was. These young people who have the ability to think for themselves are going to throw away their lives and destroy the country with their socialist ideas taught by liberal professors who only teach one point of view. But I know what the real consequences of ivory-tower liberalism look like. Like every inner-city in the nation. When I lived on welfare, my friends and neighbors were floundering in despair and you could see it in their faces. You can see it in our inner-cities today. A young man I knew took his own life because there is no hope when you're trapped on the government plantation. Friend, this is what happens when liberals hold a monopoly on thought on our college campuses and this is why I must go into these leftist stangleholds on freedom and thought. The next campus I'm visiting is UCLA, and I'm asking very strongly for your prayers, and your help. I can only go to these campuses and reach these young leaders with your continued financial support. But I won't stop there. I will reach our current political leaders too, with policy reports on Capitol Hill. And I will reach our communities and families through our black pastor program that works at the grassroots level to break the cycle of poverty and restore families and personal responsibility. The Solyndra Saga Continues
If you thought the $535 million that the American taxpayer shelled out for the utter failure that was Solyndra was expensive, you may want to sit down for this one.
Crossing the wires this hour is news that the General Motors corporation will be halting production of the Chevrolet Volt electric car and laying off 1,300 employees.
The company announced that the layoff and production halt will last at least 5 weeks but is not necessarily permanent; however the dreadful sales numbers of the Volt lead some to believe that this may be the first of many nails in the coffin of this heavily subsidized program. Read more.
Senator Rand Paul Fights the Abusive EPA
Since being sworn into the Senate, Rand Paul has proved himself to be fearless defender of liberty. He has proposed real spending cuts, pushed for an audit of the Federal Reserve and hasn't been afraid to stand against his own party. He was one of the few senators to vote against the reauthorization of the Patriot Act and the National Defense Authorization Act (NDAA). His short record in the Senate already shows that the apple doesn't fall far from the tree.
The courageous senator is now fighting back against the Environmental Protection Agency (EPA). Sen. Rand Paul has introduced S. 2122, the Defense of Environment and Property Act of 2012 which would reform federal water policy to protect land owners. The bill would redefine "navigable waters" to explicitly clarify that waters must actually be navigable, protect the rights of states to have primary authority over the land and water within their borders, prohibit federal agents from entering private property without the express content of the landowner, among other things. Who's the Enemy?

Polls show that Americans consider Iran to be enemy number one these days, but one is never sure that President Obama sees things the same way. For years, his most visceral hostility has been reserved for Israel. Now, as part of his election-year fence-mending, he is trying to walk back that hostility. With respect to the current Iran crisis, I admit to some uncertainty as to what is going on. Is the administration really trying to restrain Israel, thereby manifesting a lack of concern for our ally's survival? Or is its oft-stated fear of an Israeli strike part of a coordinated effort to convince the mullahs of the reality of the Israeli threat?
Such uncertainty, of course, is not the province of the editorial cartoonist. Michael Ramirez takes Obama at his word:

Yesterday, 51 Senators voted against economic and religious liberty. It was a stunning vote that served as a stark reminder of the challenges we face in Washington - a majority of U.S. Senators are more interested in creating new rights than defending our unalienable rights guaranteed to us in the First Amendment of the U.S. Constitution.
This time, the federal government used the sweeping powers embedded in Obamacare to mandate insurance companies to provide a product free of charge and mandate religiously affiliated organizations - such as schools, hospitals and charities - to violate their religious beliefs.

Americans have known all along that Obamacare is nothing more than a massive power grab by the federal government. This latest assault on liberty by the Obama Administration opened up another front in the effort to repeal Obamacare: its impact on the freedom to exercise religious beliefs. In essence, President Obama and 51 Senators declared that religiously affiliated organizations cannot continue providing services for the poor and the sick, or educate children, unless they abandon their most fundamental beliefs.

If the Obama Administration and the U.S. Senate can so blatantly trample on our First Amendment protections and economic liberty, we have to ask where does it end?
We cannot afford to find out what President Obama's next mandate will be or which of our liberties will be the next to fall under the guise of Obamacare. We must continue the fight for the full repeal of Obamacare - nothing less is acceptable.

Breitbart chatted up strangers at bar less than an hour before dying
Andrew Breitbart was firing away on his Blackberry as usual when he stopped in for a drink at a local bar. He struck up a friendly political debate with a stranger and a short time later the conservative figure collapsed. For all the time liberals spend talking about how loving and caring they are, there are an awful lot of people reveling in Breitbart's death.
