Background: In May of this year, the Environmental Protection Agency (EPA) and the Corps proposed a "guidance" document that attempts to expand their jurisdiction under the Clean Water Act (CWA) to include almost all waters across the country. The guidance has not been finalized yet, but the agencies are quickly moving forward to a rulemaking redefining the term "waters of the United States." It is likely the agencies may send the proposed rule to the Office of Management and Budget (OMB) within the next two weeks, which is the last stop before a regulation is officially proposed or finalized. The agencies intend to have a final rule by January 2012. American Land Rights expects the proposed rule to contain much of the language from the CWA guidance and would therefore expand the types and number of waters subject to regulation under the CWA. More waters falling under "waters of the U.S." would expand the permitting universe under the entire CWA, including Sec. 402 NPDES permits, Sec. 404 Dredge and Fill permits (wetlands), and Sec. 311 Spill Prevention, Control and Countermeasure plans. The Amendment would do two things: (1) prohibit the Corps from finalizing the guidance and (2) prohibit the Corps from promulgating a rulemaking redefining "waters of the U.S."
*Below are talking points for your phone calls:* * The guidance uses broad language to define things such as "tributaries" that could lead to almost any roadside, agricultural ditch or intermittent stream being subject to EPA and the Corps' jurisdiction. * The guidance defines "traditional navigable waters" as any water that supports one-time recreational use (one trip in a canoe down a stream would qualify a water as a "traditional navigable water"). In the history of the Clean Water Act, the term "traditional navigable water" has only been used to describe major rivers that can float commercial vehicles like barges. * Under this guidance, waters do not have to have a surface connection to a larger body of water that actually moves goods in interstate commerce to be subject to EPA/Corps' jurisdiction. The water body does not even have to have actual water in it for much of the year to be jurisdictional. * It allows the agencies to "aggregate" similar types of waters (small streams, adjacent wetlands, ditches or isolated waters) within a watershed. This means the agencies only have to make a "jurisdictional determination" on one water body to then get jurisdiction over numerous others without considering them individually. * The guidance goes beyond both the Supreme Court decisions in SWANCC and Rapanos because it takes the court's narrow opinion on wetlands and applies it to all types of waters. * The amendment would prevent the Corps from finalizing this guidance, and would also stop the Corps from initiating a rulemaking that would more broadly define "waters of the United States." 1. Will Iowa Be the GOP's Version of Gephardt vs. Dean?
Mitt Romney has to win New Hampshire. His own campaign has set those expectations. If he does not win New Hampshire it is game over for Mitt.
Unfortunately for Mitt Romney, expectations have been set so high for him in New Hampshire, a win might not be enough if the win is close. And right now Newt Gingrich is surging in New Hampshire. He has gone up dramatically now within 14 points of Romney. Likewise, Huntsman is going up too. Both are cutting into the numbers of other candidates, including MItt Romney.
If Newt Gingrich does as polls are suggesting in Iowa - a big win - he will have big momentum going into New Hampshire, but not just New Hampshire, South Carolina too. Winning two out of the first three races and then going to Florida where Newt is also ahead will pretty much destroy the inevitability argument Romney has had.
In other words, Romney needs to stop Gingrich in Iowa. But about the only way to do that with one month to go is to unleash hell on Gingrich. That brings us to Dick Gephardt and Howard Dean.
2. Nancy Pelosi and David Axelrod Open Their Mouths and We Make It Too Complex I don't want to offend any of my friends or colleagues, all of whom I have a great deal of respect for, who are positing various theories on why Nancy Pelosi or David Axelrod are saying things about Romney or Newt. Everyone seems intend on making it a conspiracy or about reverse psychology or something. I don't see it that way. I am perfectly happy to admit I could be wrong, but I don't see it that way. I do not think the Democrats are intentionally trying to bait us into picking their preferred candidate by attacking that candidate now and I do not think Nancy Pelosi is bashing Newt with gnostic knowledge of prior bad deeds because she fears him as the nominee. For starters, Republicans have largely concluded that America's Mother-In-Law is a bit daft. Consistency requires that we not now view her as machiavellian enough to suddenly angle the GOP nomination in Newt's favor or let slip some level of fear about him by attacking him. The simple answer seems to me to be the right one - Nancy Pelosi just can't help but run her mouth on stuff like that. It also fits a long recurring pattern about Nancy Pelosi mouthing off about various matters when asked by reporters. For the first time this year she finds herself the center of attention. Additionally, because the events must be kept confidential and because the events are long forgotten, raising it now gives it time to start percolating with the press. 3. Anti-Pipeline Dave Heineman Should Not Run for Senate in Nebraska One of the biggest political and policy winners for Republicans is their strong support for expeditious approval of the Keystone Pipeline. Their unified support for this propitious project has provided voters with a sharp contrast to Obama's casual disregard for private-sector job creation and cheap energy for consumers. Hence, it is a no-brainer that the pipeline issue should be used as a rallying cry for all Republicans running for elected office in 2012. In that vein, Nebraska Governor Dave Heineman would be wise to remain in Lincoln, and discard any aspirations to run for Senate.

Ready to trade in your car for a bike, or maybe a subway instead? Interested in fewer choices for your home, paying more for housing, and being crammed into a denser neighborhood? You can have all this and more if radical environmentalists and "smart growth" advocates have their way and local, state, and the federal government impose the policies set forth in the United Nations' Agenda 21.
You might have heard of this nefarious-sounding policy in a recent Republican presidential debate, but even if you haven't, here's some background information: Agenda 21 is a voluntary plan adopted at the 1992 United Nations Conference on Environment and Development. It calls on governments to intervene and regulate nearly every potential impact that human activity could have on the environment. The end goal? Getting governments to "rethink economic development and find ways to halt the destruction of irreplaceable natural resources and pollution of the planet."

New Petition Calls on President Obama to Help Halt Religious Cleansing
WASHINGTON, Nov. 30, 2011 /PRNewswire-USNewswire/ -- Christian Solidarity International (CSI) issued a Genocide Warning today for endangered religious minorities in the Islamic Middle East, and called on President Barack Obama to make their survival a priority as the United States responds to the "Arab Spring". CSI simultaneously launched a petition to the President, asking him to respond to the upsurge of violence against religious minorities in the Middle East in his upcoming State of the Union Address. Christians, Jews, Baha'i, Yezidis, Sabeans, and Ahmadias, numbering collectively over 12 million, are among the endangered minorities. Leon Panetta, fresh from a stint as CIA director and off to his new job as Secretary of Defense, did his best to butch up in the usual way of DC hacks "daringly" delivering the same utterances that have been current in the capital for generations. When Panetta, the man who looks like everyone's least favorite accountant or funeral director, showed up at the Saban Forum, he butched up by shouting that Israel needs to "get to the damn table" and negotiate with the Palestinian Arab terrorists. What table? Which terrorists? Those questions didn't bother Panetta, who after years of being wedgied by Biden and having his pants pulled down by James L. Jones had finally discovered the thrill of being a bully. Or as David Igantius at the Washington Post puts it, "He liked the "just get to the damn table" line so much that he repeated it, for good measure." It's hard to say whether the former CIA director is familiar with anything that happened in Egypt this week, but he might have noticed that the big winners in the election down there were the Muslim Brotherhood and the Salafis. It's always a good idea to mend fences when the people on the other side of the fence want to establish a demented theocracy and kill you, but the fence mending is going to have to be a unilateral project and the fences are going to be really high and thick with missile launchers on top.

Germany Chancellor Angela Merkel approved the sale of a Dolphin-style military submarine U-boat to Israel last week on condition that Prime Minister Binyamin Netanyahu unfreeze taxes collected for the Palestinian Authority, Die Welt reported Sunday. The Prime Minister ostensibly freed the taxes, which were frozen in retaliation for the PA's unilateral bid for United Nations membership, because PA Chairman Mahmoud Abbas supposedly has "calmed down."
However, the day after the Cabinet approved handing over the monthly sum of $100 million, Abbas reiterated that the PA will continue its membership bid, a blatant violation of the Oslo Accords.

Wednesday marks the 70th. Anniversary of the Japanese attack on our Pacific Fleet. "Remember Pearl Harbor" was the Second World War's most enduring slogan - sported on buttons, blazoned across billboards and blared from the radio in one of the era's popular songs. ("Let's remember Pearl Harbor as we go to meet the foe. Let's remember Pearl Harbor as we did the Alamo.")
Remember Pearl Harbor? Remember the Alamo? Remember the Maine, Plymouth Rock and the Golden Rule? But how can you remember what you never knew? Americans are tragically ignorant of our past.
How can you know where you are if you don't know how you got there? Without the past as a guide, the future is fog-shrouded sea marked "Here be monsters" on a map.
Pearl Harbor was one of those defining moments in American history, like the drafting of the Constitution, the Louisiana Purchase and the firing on Ft. Sumter. U.S. deaths, military and civilian, numbered 2,403. The Japanese sank or severely damaged 18 ships, including 8 battleships, and destroyed 161 of our planes.

ElBaradei: Youth Was "Decimated" in Egypt Elections
Possible Egyptian presidential candidate ElBaradei: The youth feel let down by the rise of the Islamists.
Mohamed ElBaradei, Egypt's top reformist leader and a possible presidential candidate, said on Sunday the liberal youth behind the country's uprising have been "decimated" in parliamentary elections dominated by Islamists.
In an interview with The Associated Press, ElBaradei expressed concern about the rise of hard-line religious elements advocating extremist ideas such as banning women from driving.
He told AP he hopes moderate Islamists will rein in the extremists and send a reassuring message to the world that Egypt will not go down an ultraconservative religious path.
"The youth feel let down. They don't feel that any of the revolution's goals have been achieved," ElBaradei said on the same day electoral authorities announced that Islamist parties captured an overwhelming majority of votes in the first round of elections last week. "They got decimated," he added.

 Through a Mitt darkly Posted: 05 Dec 2011 12:55 PM PST (Scott Johnson) I haven't seen any commentary on the Web regarding Robert Draper's New York Times Magazine cover story "Building a better Mitt Romney-bot." Rachel Nolan's interview with Draper in "Behind the cover story" serves up a few more of the author's observations. Despite the venue and the political orientation of the author, it appears to be a fair story and it is interesting to boot. It is also useful for those of us trying to get a fix on the Romney campaign. The Romney campaign cooperated with the author, up to a point - the point being a one-on-one with the candidate himself. I come away with a renewed respect for Governor Romney's strengths as a candidate. He has learned from his failures in the 2008 campaign. I had not previously been aware of campaign media strategist Stuart Stevens or other members of the current campaign team quoted in the story; Draper briefly draws their profiles. I also come away with a wariness derived from the campaign's insulation of Romney from the kind of scrutiny Bret Baier was able to give him in the interview on Fox News last week. Those who take consolation from the low comedy of American politcs (I know, I know, it only hurts when you laugh) may also find some material worthy of study in Draper's article. Draper relates Romney's remarks on ethanol before an Iowa audience. Romney engages in a nuanced dialectical approach to the issue. Alluding to Stevens's maxim that "You've got to dig the ditch you're going to die in" - or, less metaphorically, "You have to be willing to lose" - Draper writes: I watched as the candidate confronted the dicey issue of ethanol subsidies at the Treynor business round table like a man who had no intentions of losing, dying, ditch-digging or anything else except ingratiating. First he stipulated that "I supported the subsidy of ethanol to help get the industry on its feet." After qualifying that support by saying, "I didn't feel the subsidy needed to go on forever," Romney noted that the subsidy was due to expire in December anyway. He qualified that observation by remarking, "I might've looked at more of a decline over time. . . ." But, he cheerfully observed, "most people I know in the ethanol industry say, 'Fine - we're now up and going.' " Lest anyone doubt his commitment, Romney reminded his audience, "For me, ethanol is part of national security - it is part of America developing our own energy. . . . And I would like to see the ethanol industry continue to be successful to grow and to provide a growing share of America's domestic energy sources. "And how to do that," he finished with an unsteady grin, "as Ross Perot used to say, I'm all ears!" Let no one say he didn't go all out to win the Iowa caucuses. Readers who, like me, are still trying to sort their thoughts about the candidates may find Draper's article to be of interest. No-So-Manly Mann Posted: 05 Dec 2011 12:47 PM PST (Steven Hayward)
In my Weekly Standard Climategate 2.0 article I refer to Michael "hockey stick" Mann as the Fredo of the climate mafia, because of his endless bluster and the obvious embarrassment he brings to his fellow scientists. Today he has a letter to the editor of the Wall Street Journal complaining about the whole matter. (If it's behind a subscriber firewall, Greg Pollowitz has posted the whole letter over on NRO's PlanetGore.) At this point it is difficult to tell if Mann is simply delusional, or a deliberate liar. He asserts: Our original work showed that average temperatures today are higher than they have been for at least the past 1,000 years. Since then, dozens of analyses from other scientists based on different data and methods have all affirmed and extended our original findings. . . In 2006, then-Rep. Sherwood Boehlert (R., N.Y.) asked the National Academy of Sciences to look into studies like the hockey stick. It affirmed our conclusions. That's not how I recall the NAS report, which not only said we could not have any confidence in Mann's findings beyond about 400 years back, but was also sharply critical of Mann for his lack of transparency about both his source data and statistical methods used to interpret the data. In fact, here's what the NAS report actually says: Substantial uncertainties currently present in the quantitative assessment of large-scale surface temperature changes prior to about A.D. 1600 lower our confidence in this conclusion compared to the high level of confidence we place in the Little Ice Age cooling and 20th century warming. Even less confidence can be placed in the original conclusions by Mann et al. (1999) that "the 1990s are likely the warmest decade, and 1998 the warmest year, in at least a millennium." (Emphasis added.) Note that the NAS report draws back from validating Mann's main claim, which he repeats again in today's letter. Read those three key words: "even less confidence." The NAS also included this polite rebuke of Mann's uncooperative attitude toward scientists who wished to review his data and methods: The committee recognizes that access to research data is a complicated, discipline-dependent issue, and that access to computer models and methods is especially challenging because intellectual property rights must be considered. Our view is that all research benefits from full and open access to published datasets and that a clear explanation of analytical methods is mandatory. Peers should have access to the information needed to reproduce published results, so that increased confidence in the outcome of the study can be generated inside and outside the scientific community. There's lots of snippets in the new and old batch of emails that many of Mann's colleagues would like to figuratively give him the Fredo treatment, or at least send him on a long boat ride. No wonder he's in high dudgeon about the embarrassment of the leak, as he continues: Mr. Delingpole ends his piece by saying the anonymous hacker or hackers who stole emails from me and my colleagues deserve thanks. What they deserve is to be brought to justice. But British police have not determined who stole the emails. Recent reports of police expenditures suggest they may be devoting far fewer resources to it than other similar investigations. Celebrating theft is silly. Question for Dr. Mann: Does he believe Daniel Ellsberg should have been jailed for his theft and leak of the Pentagon Papers? NB: This leaves out the entire matter of the BEST study, which throws serious doubt on Mann's interpretation of the data. But that's a long post for another time. "We easily advanced from kerosene lamps to Edison's light bulbs, from horse and carriage to automobiles, and from cassettes to CDs and DVDs, without any laws to mandate those changes." - Phyllis Schlafly We're all tired of the federal government encroaching on our personal freedoms through high taxes, overregulation, and overreaching programs like ObamaCare. Now they're getting into our linen closets dictating what kinds of light bulbs we have to buy!
Unless Congress takes action, it will be illegal to sell the 100-watt bulb after January 1, 2012. The lower watt bulbs will be phased out between 2012 and 2014. Lighting technology might advance, and some might like the new bulbs, but we, the people, through the free market should decide what kinds of products we will buy, not the government. There is nothing wrong with the incandescent bulb, and the new, allegedly "eco-friendly" CFL, the new bulbs we will be forced to buy once the incandescent bulbs go away, contain toxic mercury and present a grave danger to children and pets if broken. Recent reports show that large numbers of Chinese workers in the factories that make CFL bulbs are being hospitalized for mercury poisoning. Even the EPA is worried about them polluting our sewage. They are also significantly more expensive and less bright than the incandescent bulbs. Additionally, hundreds of American jobs have already been exported to China as a result of this ban.
We must stop the ban from taking effect and the only way is to urge Congressional leadership to bring a repeal to the House floor to fight for the ban in a year-end budget bill.

About a month ago, I posted in regard to what I called "the euthanasia of the saver." This comment had to do with the fact that nominal interest rates in the United States for financial investments such as bank certificates of deposit and bank savings accounts-the kinds of investments traditionally employed by retired persons and small savers, who wish to gain income without exposing their funds to great risk of capital loss-now fall considerably below the rate of inflation, and hence the real (or inflation-adjusted) yield on such investments is negative. That is, the nominal payoff is insufficient to offset the loss of purchasing power of the money invested.
About a month before I wrote my commentary, my old friend Richard Rahn had, without my noticing, written on the same issue in a commentary article published in the Washington Times, but he had gone beyond the simple point I made. Rahn notes that besides suffering the loss of wealth occasioned by the negative real yield on such investments, the investor has to pay tax on the nominal yield-truly a case of the government's adding insult to injury. He notes that given the currently prevailing rates of interest, rate of inflation, and tax rates, a small investor who earns a nominal yield of 1% and pays a 20% marginal tax rate, while the rate of inflation is 3.5 %, actually ends up paying a real tax rate of 370%. For example, an investor buys a $100,000 CD, earns $1,000 in annual interest, pays a tax of $200, and incurs a loss of $3,500 in purchasing power on the invested principal. Monday, December 5, 2011 To: Friends & Supporters From: Gary L. Bauer COUNTDOWN TO VICTORY: 337 DAYS TO THE 2012 ELECTIONS Cain's Pain; Newt's Gain? Herman Cain officially suspended his campaign for the White House Saturday. But, unofficially, few think we are likely to see the "Cain Train" on the stump again. He brought a lot to the race and elevated the discussion of tax reform with his "9-9-9" plan. Unfortunately, frequent allegations of harassment and affairs were taking a toll on his family and made it impossible for Cain to continue. As we reported Friday, Cain's position in the polls had already collapsed, and many of his supporters appeared to be realigning with Newt Gingrich, who has surged in recent days. Our own surveys and other polling indicated that Gingrich was the "second choice" favorite among many Cain supporters. There are reports that Cain may endorse Gingrich later today. Cain's fall and Gingrich's rise demonstrates just how volatile this race has been and how fluid it remains. The Iowa caucuses are just days away and the primary campaign is quickly approaching its zenith. It is very likely that the race will be down to two or three contenders in less than 60 days. A Stealth War Last week we reported on the mysterious explosions at critical military installations in Iran. An explosion near Bid Kaneh virtually destroyed an entire complex devoted to Iran's ballistic missile program, while another explosion occurred in Isfahan, seriously damaging a key nuclear facility. There is speculation as to whether Israeli commandos or the CIA are responsible for the explosions. Yesterday, Iran claimed it shot down a U.S. drone, but that is being disputed by Washington. NATO officials say operators lost control of a drone operating in western Afghanistan last week and it is possible it crashed in Iran. In addition to whatever is happening inside Iran, the Islamic regime continues to create mischief outside its borders. Iranian agents were behind a recent plot to assassinate the Saudi ambassador to the United States at a popular Washington, D.C., restaurant. And there were reports last week that Iran was plotting to sabotage U.S. military bases in Germany. In the 60s, folks used to ask, "What if they had a war and nobody showed up?" Today perhaps we should be asking ourselves, "What if there was a war and nobody noticed?" Our political elites may not like to admit it, but Iran is already at war with us. Fast & Furious Back In The Spotlight There is no doubt that Obama would like the Fast & Furious scandal to go away. More than 50 members of Congress are calling on Attorney General Eric Holder to resign as a result of the gun walking program that left a Border Patrol agent dead. But in spite of Big Media's attempts to ignore the story, the administration's spin keeps unraveling. Friday night the Justice Department released more than one thousand pages of documents related to Operation Fast & Furious. Among the revelations in this latest document dump is the fact that the administration lied to Congress in its previous statements about the gun walking program. Stay tuned. This scandal isn't going away soon. Will Obama's Class Warfare Backfire? Obama's reelection campaign will look like the polar opposite of his 2008 campaign. Hope and unity will be replaced by demonization and division. His class warfare rhetoric and the Occupy Wall Street movement are all about dividing Americans. New Ordinance Orders NYC Jails to Release Illegal Aliens
Just two days before Thanksgiving, New York City Mayor Michael Bloomberg quietly signed into law an ordinance (Int. No. 656) ordering all city jails to ignore certain Immigration and Customs Enforcement (ICE) detainers issued to deport illegal aliens from those jails. As a result, New York City jails will now release many illegal aliens back into the community instead of handing them over to ICE for removal.

House Subcommittee Examines Administration's Efforts to Undermine Secure Communities
On Wednesday, the House Subcommittee on Immigration Policy and Enforcement held a hearing on the Obama Administration's efforts to undermine the Secure Communities program. Through the program, local law enforcement officers submit the digital fingerprints of all individuals they book for comparison against the Department of Homeland Security (DHS) and Federal Bureau of Investigation's (FBI) databases to determine if the person is an alien. If the DHS database identifies the individual as an alien, that information is sent back to both the local jail/prison and the local ICE office for further action. In most circumstances, ICE would issue a detainer on the alien and begin deportation proceedings.

House Eliminates Per Country Caps on Employment Visas; Senate Holds
Last Tuesday, the House of Representatives passed H.R.3012, legislation that eliminates the per country cap on employment-based visas. The bill, authored by Rep. Jason Chaffetz (R-UT) and co-sponsored by Rep. Zoe Lofgren (D-CA), also increases the per country cap for family-based visas from seven percent to fifteen percent. The House passed the bill by a vote of 389-15. Under current law, no more than seven percent of employment-based green cards or family-based green cards may come from one country in any year. 8 U.S.C. § 1152.

In Search of a Coherent Worldview with a Focus on America's Greatness
Last week, the reliable liberal pundit, Al Hunt said that there was nothing to criticize in President Obama's foreign policy.
From those I speak with, I beg to differ.
This week, we talk with Dr. John Lenczowski, founder and president of the Institute of World Politics. The Constitution entrusts our elected representatives in Congress with legislative power, but in recent years much of that power has been delegated away to unelected, unaccountable federal bureaucrats.
This week the House of Representatives has an opportunity to fix this. The Small Business Administration reported recently that it cost American businesses $1.75 trillion to comply with federal regulations in 2008, more than individual and corporate income taxes combined. With such significant costs, clearly something has gone awry in the process.
The REINS Act helps correct this problem. Whenever an agency seeks to finalize a new "major" regulation -- one with an economic impact of $100 million or more -- the House and Senate must first vote to approve it, and the President must sign it before it can take effect. Sound familiar? This is how the Framers intended the legislative process to work!
The REINS Act won't stop every costly federal regulation or solve our existing regulatory problems, but it will ensure that when a new regulation takes effect every citizen will know exactly who voted for it and will be able to hold them accountable. We'll soon find out how many Members of Congress are willing to accept that responsibility.
