The Senate is set to vote on a bill next week that would define the whole of the United States as a "battlefield" and allow the U.S. Military to arrest American citizens in their own back yard without charge or trial.

 

"The Senate is going to vote on whether Congress will give this president-and every future president - the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world. The power is so broad that even U.S. citizens could be swept up by the military and the military could be used far from any battlefield, even within the United States itself," writes Chris Anders of the ACLU Washington Legislative Office.  

 

Under the 'worldwide indefinite detention without charge or trial' provision of S.1867, the National Defense Authorization Act bill, which is set to be up for a vote on the Senate floor Monday, the legislation will "basically say in law for the first time that the homeland is part of the battlefield," said Sen. Lindsey Graham (R-S.C.), who supports the bill.

 Thursday, December 1st at 7:30PM: Paul Finkelman, "America's Covenant With Death: Slavery and the Founding."  Paul Finkelman is the President  William McKinley Distinguished Professor of Law and Public Policy, and Senior Fellow in the Government Law Center at Albany Law School. His lecture will explore the relationship of slavery to the American founding, and will examine how slavery was written into the original Constitution, and protected by it.

Thursday, December 8th at 7:30PM: George W. Boudreau, "'A Republic, If You Can Keep It': Benjamin Franklin and the Crafting of the Constitution."  The series closes with a talk by an audience favorite,   George W. Boudreau, Associate Professor of Humanities and History at the University of Pennsylvania, Harrisburg.  Professor Boudreau is Project Director of the "Teaching Franklin" website (http://harrisburg.psu.edu/teachingfranklin/).  His lecture will explore Franklin's role in the creation of the Constitution.

The Democratic Party controlled a majority in both chambers for the first time since the end of the 103rd Congress in 1995.

2. 'It's Time To Close The NLRB For Renovations'

According to The Hill, unions and their Democrats in Congress are apoplectic over the fact that Brian Hayes, the lone Republican on Barack Obama's National Labor Relations Board, has (allegedly) threatened to resign in protest over the union appointees at the NLRB deciding on Wednesday (Nov. 30th) to force ambush elections on companies and their employees. Due to a Supreme Court decision, where the high court ruled there must be a minimum three NLRB members to affect a quorum, with only three current members, a resignation at the NLRB would incapacitate the union-run agency.

Notwithstanding Democrats fleeing from their jobs in Wisconsin earlier this year, oddly, neither the union bosses nor their paid shills in Congress seem to realize (or if they do, they're not publicly admitting it) that the idea of incapacitating the NLRB came from their own playbook.

 

3. What Peak Oilers Won't Tell You About Peak Oil

M. King Hubbert is the father of Peak Oil theory. In a 1956, he paper correctly called the timing of the peak in U.S. crude oil production in the early 1970s.

Neo-Malthusians and Progressives make sure you know about Hubbert's pessimistic outlook for conventional crude oil. They made Hubbert a household name, the only oil technologist whose name they use without adding "sellout" or "whore".

6. #OccupyWalMart Protesters Occupy Handcuffs On #OccupyBlackFriday

Apparently, the Black Friday Occupation isn't working out so well for some #OWS protesters in Oklahoma City [#OccupyOKC].

After standing in the middle of the check out lanes and attempting to convince the WalMart workers to give up their jobs (jobs are slavery now, according to #OccupyOKC) and the shoppers to quit shopping, they tried to make a run for it and, based on the final scene, appear to have gotten the opportunity to occupy a jail cell.


 

 


Family of Marine Gunned Down by SWAT Team Still Searches for Answers and Justice

After video of SWAT team officers firing over 70 times at a 26-year-old former Marine in his home went viral, there was a public outcry for explanations and justice for Jose Guerena Ortiz, the former serviceman gunned down in the alleged drug raid. Six months later, the Guerena family remains frustrated and starved for answers as no arrests have been made.

 

 

Jose Guerena Ortiz was sleeping after an exhausting 12-hour night shift at a copper mine during an ordinary morning in a middle-class Tucson neighborhood on May 5, when an armored vehicle pulled into the family's driveway and men wearing heavy body armor and helmets climbed out, weapons ready.

She begged them to get Joel out of the house before he saw his father in a puddle of blood on the floor.

 

But soon afterward, the boy appeared in the front doorway in Spider-Man pajamas, crying.

Former Mossad Head Yatom: Israel Can't Afford Not to Strike Iran

The Begin Sadat Center, a respected think tank based at Bar Ilan University, held a conference on  November 23, 2011 on the subject of  "Israeli Security in a New Regional Envornment", which focused on the so-called "Arab Spring" and its implicatons. Its experts concluded that the  Arab Spring is not going to result in democracy, despite original hopes in the West, and may make things even worse for Israel.

"As steep as the price for hitting Iran may be, a military strike on Iran will be less painful than the cost of living with an Iranian nuclear weapons threat," argues former Mossad head Maj. Gen. (res.) Danny Yatom. "The backlash from a strike on Iran's nuclear sites will not be as bad for Israel as will an Iran armed with nuclear weapons," he says. "I don't think that those predicting apocalyptic repercussions of a strike on Tehran are correct, and even if they are, Israel can't afford to wonder if Tehran will go crazy and bomb us."

Iran Threatens to Hit Turkey If US, Israel Attack

TEHRAN, Iran - A senior commander of Iran's powerful Revolutionary Guard says the country will target NATO's missile defense shield in Turkey if the U.S. or Israel attacks the Islamic Republic.

Gen. Amir Ali Hajizadeh, the head of the Guards' aerospace division, is quoted by the semiofficial Mehr news agency as saying the warning is part of a new defense strategy to counter what it sees as an increase in threats from the U.S. and Israel.

He says Iran will now respond to threats with threats rather than a defensive position.

Tehran says NATO's early warning radar station in Turkey is meant to protect Israel against Iranian missile attacks if a war breaks out with Israel.

Turkey agreed to host the radar in September as part of NATO's missile defense system.

Pakistan Protests Alleged US-Led Attack That Killed Soldiers

Saturday, 26 Nov 2011 

Pakistan protested and U.S. officials expressed regret after reports that helicopters of the U.S.-led NATO force in Afghanistan killed at least 24 Pakistani troops at a border post.

Prime Minister Yousuf Raza Gilani "strongly condemned" the attack and ordered the Foreign Ministry to address the incident "in the strongest terms" with the North Atlantic Treaty Organization and the U.S., his spokesman said in an e- mailed statement. Gilani also called an emergency meeting of the country's defense committee.

Army Chief of Staff Ashfaq Kayani said the attack was a "blatant and unacceptable act," and demanded urgent action against those responsible. The attack is at least the fourth on a Pakistan border facility by NATO forces in 15 months, and earlier raids led Pakistan to temporarily shut NATO supply routes to Afghanistan across its territory.

The recent executive director of the controversial Council on American-Islamic Relations' South Florida chapter is a founder and spokesman of Occupy Miami, WND has learned.

 

Mohammad Malik currently is as an activist with several other Islamic groups.

He has led hate-filled anti-Israel protests in which participants were filmed wearing Hamas paraphernalia while chanting "Nuke Israel" and "Go back to the oven" - a reference to Jews being killed in the Holocaust.

Malik has been widely quoted in the Florida news media in recent weeks speaking for Occupy Miami.

 

The Miami Herald identified Malik as one of the organizers of Occupy's Miami's downtown campsite headquarters.

Cross Removed From Army Chapel in Afghanistan by Our Own Government

The Christian Post reports that "The U.S. Army has removed a cross that was prominently placed on the front of a chapel located at the remote base of Camp Marmal in Northern Afghanistan. . . . [O]fficials said that having a permanent sectarian image on the chapel violated army regulations. . . . One soldier referred to the decision and the regulation behind it as 'a direct attack against Christianity and Judaism.'"

This isn't the first time Christianity has been an issue in Afghanistan. Bibles translated into Afghan languages were sent to a U.S. soldier at a base in Afghanistan. Here's how CNN reported the story in 2009:

Military personnel threw away, and ultimately burned, confiscated Bibles that were printed in the two most common Afghan languages amid concern they would be used to try to convert Afghans, a Defense Department spokesman said Tuesday.

The unsolicited Bibles sent by a church in the United States were confiscated about a year ago at Bagram Air Base in Afghanistan because military rules forbid troops of any religion from proselytizing while deployed there, Lt. Col. Mark Wright said.

Looking north from the top of the Golan Heights, it's green, green, green, and then just past the Syrian border - brown and dead.

 

Drive throughout Judea and Samaria (West Bank) and you will see empty desert, dilapidated Bedouin shacks, and then green, thriving kibbutzim.

 

This is, of course, the story of Israel. The story of making a desert bloom. But it's also a metaphor for embracing life, as opposed to a cult of death that recently played out in the media with the Gilad Shalit prisoner exchange.

 

Israel agreeing to trade more than 1,000 prisoners, many with blood and death on their hands, in exchange for one young soldier, defies the logic of a fair trade. Prima facie, the scales overwhelmingly slam down on the side of the Palestinians. But if there is a message to be gained, it's this:

 

While young Gilad was being embraced by family and celebrated for being alive, the Palestinians were promoting their ideology of suicide bombing, spreading it to school children.

 My name is Aron Adler. I am 25 years old, was born in Brooklyn NY, and raised in Efrat Israel. Though very busy, I don't view my life as unusual. Most of the time, I am just another Israeli citizen. During the day I work as a paramedic in Magen David Adom, Israel's national EMS service. At night, I'm in my first year of law school. I got married this October and am starting a new chapter of life together with my wonderful wife Shulamit.    15-20 days out of every year, I'm called up to the Israeli army to do my reserve duty. I serve as a paramedic in an IDF paratrooper unit. My squad is made up of others like me; people living normal lives who step up to serve whenever responsibility calls. The oldest in my squad is 58, a father of four girls and grandfather of two; there are two bankers, one engineer, a holistic healer, and my 24 year old commander who is still trying to figure out what to do with his life. Most of the year we are just normal people living our lives, but for 15-20 days each year we are soldiers on the front lines preparing for a war that we hope we never have to fight.    This year, our reserve unit was stationed on the border between Israel, Egypt and the Gaza Strip in an area called "Kerem Shalom."  Above and beyond the "typical" things for which we train - war, terrorism, border infiltration, etc., this year we were confronted by a new challenge.  Several years ago, a trend started of African refugees crossing the Egyptian border from Sinai into Israel to seek asylum from the atrocities in Darfur.  What started out as a small number of men, women and children fleeing from the machetes of the Janjaweed and violent fundamentalists to seek a better life elsewhere, turned into an organized industry of human trafficking.  In return for huge sums of money, sometimes entire life savings paid to Bedouin "guides," these refugees are promised to be transported from Sudan, Eritrea, and other African countries through Egypt and the Sinai desert, into the safe haven of Israel.    We increasingly hear horror stories of the atrocities these refugees suffer on their way to freedom.  They are subject to, and victims of extortion, rape, murder, and even organ theft, their bodies left to rot in the desert. Then, if lucky, after surviving this gruesome experience whose prize is freedom, when only a barbed wire fence separates them from Israel and their goal, they must go through the final death run and try to evade the bullets of the Egyptian soldiers stationed along the border. Egypt's soldiers are ordered to shoot to kill anyone trying to cross the border OUT of Egypt and into Israel. It's an almost nightly event.    For those who finally get across the border, the first people they encounter are Israeli soldiers, people like me and those in my unit, who are tasked with a primary mission of defending the lives of the Israeli people. On one side of the border soldiers shoot to kill.  On the other side, they know they will be treated with more respect than in any of the countries they crossed to get to this point.    The region where it all happens is highly sensitive and risky from a security point of view, an area stricken with terror at every turn.  It's just a few miles south of the place where Gilad Shalit was kidnapped. And yet the Israeli soldiers who are confronted with these refugees do it not with rifles aimed at them, but with a helping hand and an open heart. The refugees are taken to a nearby IDF base, given clean clothes, a hot drink, food and medical attention. They are finally safe.    Even though I live Israel and am aware through media reports of the events that take place on the Egyptian border, I never understood the intensity and complexity of the scenario until I experienced it myself.    In the course of the past few nights, I have witnessed much.  At 9:00 PM last night, the first reports came in of gunfire heard from the Egyptian border. Minutes later, IDF scouts spotted small groups of people trying to get across the fence. In the period of about one hour, we picked up 13 men - cold, barefoot, dehydrated - some wearing nothing except underpants. Their bodies were covered with lacerations and other wounds.  We gathered them in a room, gave them blankets, tea and treated their wounds. I don't speak a word of their language, but the look on their faces said it all and reminded me once again why I am so proud to be a Jew and an Israeli.  Sadly, it was later determined that the gunshots we heard were deadly, killing three others fleeing for their lives.    During the 350 days a year when I am not on active duty, when I am just another man trying to get by, the people tasked with doing this amazing job, this amazing deed, the people witnessing these events, are mostly young Israeli soldiers just out of high school, serving their compulsory time in the IDF, some only 18 years old.    The refugees flooding into Israel are a heavy burden on our small country.  More than 100,000 refugees have fled this way, and hundreds more cross the border every month. The social, economic, and humanitarian issues created by this influx of refugees are immense. There are serious security consequences for Israel as well. This influx of African refugees poses a crisis for Israel. Israel has yet to come up with the solutions required to deal with this crisis effectively, balancing its' sensitive social, economic, and security issues, at the same time striving to care for the refugees.    I don't have the answers to these complex problems which desperately need to be resolved. I'm not writing these words with the intention of taking a political position or a tactical stand on the issue.    I am writing to tell you and the entire world what's really happening down here on the Egyptian/Israeli border. And to tell you that despite all the serious problems created by this national crisis, these refugees have no reason to fear us. Because they know, as the entire world needs to know, that Israel has not shut its eyes to their suffering and pain. Israel has not looked the other way. The State of Israel has put politics aside to take the ethical and humane path as it has so often done before, in every instance of human suffering and natural disasters around the globe. We Jews know only too well about suffering and pain. The Jewish people have been there. We have been the refugees and the persecuted so many times, over thousands of years, all over the world.    Today, when African refugees flood our borders in search of freedom and better lives, and some for fear of their lives, it is particularly noteworthy how Israel deals with them, despite the enormous strain it puts on our country on so many levels.    Our young and thriving Jewish people and country, built from the ashes of the Holocaust, do not turn their backs on humanity. That means if an Occupier brought a CER to resell at a profit to the factory owner down the block, then he just might be out of luck. The Euro flavored EUA variety of carbon indulgences aren't doing any better.

Illegals Hunting US Border Patrol Agents with Intent to Kill

On December 14, 2010, four US Border Patrol agents were patrolling an area a few miles north of the US-Mexico border in southern Arizona.  In the dark of night, they happened upon five illegal immigrants.  The agents spoke Spanish when they identified themselves of law enforcements officers.  Using thermal binoculars, US agents could see that at least two of the illegals were armed with rifles.  When the illegals failed to drop their weapons, two of the agents fired non-lethal beanbags at the illegals to stop them.  The illegals opened fire on the US agents resulting in the death of Border Patrol agent Brian Terry.

 

Information surfacing from a grand jury indictment reveals that the illegals were intentionally hunting US Border Patrol agents for the express purpose of killing them.

California Governor Jerry Brown recently signed SB 48 into law and it goes into effect on January 1, 2012.

SB 48 mandates positive teaching of lesbian, gay, bisexual and transgender lifestyles to children of ALL ages.  That means that any child attending public school starting with kindergarten on, in the state of California will be indoctrinated to accept lifestyles that God refers to as being an 'abomination' and punishable by death; Lev. 20:13 (God's words, not mine).

Legislative analyst for Traditional Values Coalition, Benjamin Lopez has been following the mandate closely and says that a number of school districts such as Alameda and Oakland have already started investigating material to use in the schools.  Lopez warned,

"I think parents need to realize that it's important for them to take the time and sacrifice, to start going to their school districts and investigating and looking at the curriculum and the content in books, in manuals, and instructional materials."

Voter confidence in the government to recover from our current woes is at an all-time low.  The Party ideologies are so far apart that Washington is as useful as snow blower in the desert.  Congressional approval is at single digits and the president's approval ratings are not much higher.  The stock market's record of late looks like one of the roller coasters at a major amusement park.  The situation in Europe is not any better and many experts over there are conducting a 'Euro death watch'.

National elections are a year away and while most of the Republican candidates claim they have solutions to help the nation climb out of the slough of despair, most Americans are skeptical of it happening.  Talk is cheap and the proof is in the pubbing, however, these days the pudding has a bitter taste to it.

The list could go on and on. He is in full political re-election mode!

Why are we allowing this person to destroy this wonderful country with his selfishness and his lies?

His type of change is killing our country. He needs to be stopped and only our votes can stop him.

    "I want to see the Microfiche," Sheriff Joe Arpaio told a packed East Orlando Tea Party audience last week.  In explaining his Birther Posse activities, he said his group of 60 retired cops and attorneys should have a report for him as early as January or February because they are searching around the clock to find out where the President was born. 

 Delivering a keynote speech to his rapt listeners, Arpaio said the l961 microfiche holds the key to determining if Barack Hussein Obama was born in Hawaii or Kenya. "Twins were born before Barack Obama, and now we have to see if he was born the next day."  But Sheriff Joe said he won't be taking any bets on his posse getting the microfilm.  He expressed consternation that the regular media are just not talking about the Obama birth issue which is on people's minds all across the country.

Along with general programming, it will feature decent constitutionally themed programming from conservative think tanks.  Much has been written about the democratic upraising in several Middle Eastern countries. Once those old regimes fell, the current Administration was quick to take credit for inspiring the democratic revolutions that will turn them into "new countries." Nevertheless, now that these revolutions have shown themselves to be less than "democratic" Obama's Administration must accept responsibility because things are going terribly wrong.

 Egypt

 The Muslim Brotherhood is set to win enough elections to take total control of Egypt and attempt to transform her into an Islamic Republic. The only organization in its way is the Egyptian military. The current protests and upraising are aimed at reducing the power of the military and put it under civilian government control.  These orchestrated protesters are a good indication that they are coordinated by the Brotherhood.

 The hostility directed towards the military may be due to its dependence on the West for its training and modern hardware.

     I recently received a response from an e-mail I had sent extolling the virtues of a political candidate. It read, "I do not want to hear anything about any of the candidates, Republican or Democrat. This is far too early for me, regardless of what you might think.  They all have jobs, and they are running around all over when our Nation is facing potential ruin.  When the time comes, I will listen to whoever is left and determine for myself which one I wish to vote for - if I decide to vote." 

     The response was from a person who keeps up with the news, is active in church, and earnestly prays for America. The message is the epitome of the millions of Christians who choose not to vote in primary and general elections.

Gingrich scheme a dangerous power grab against the federal bench

 Newt Gingrich has decided that the best way to battle the growing plague of left-wing judicial activism is to simply remove offending judges from the bench. He favors the passage of legislation which would allow Congress to eliminate federal judgeships thereby permitting the President to fill newly created voids with what in his view would be properly schooled jurists ready to make decisions based upon Constitutional content rather than agenda driven,  personal preference.

In Federalist Papers #78,  Alexander Hamilton wrote that the judiciary would clearly represent the weakest branch of government with  "...no influence over either the sword or the purse..."  "It may truly be said to have neither force nor will,  but merely judgment..."  he continued,   believing no decision the courts might make could be enforced absent the power the executive branch could bring to bear.

The author gratefully recognizes historian William Federer's reflection on Thanksgiving.

That "first" Thanksgiving in the autumn of 1621 involving the Pilgrims and members of the Wampanoag Confederacy under Massasoit occurred with many signs of God´s providence. That three day festival of meals including 5 deer (provided by the some 90 Indians attending); abundant wild game (probably waterfowl and wild turkey); fish, corn and bread was undoubtedly not the very first of celebrations giving thanks to God in the New World as these were a feature of the great Christian piety of the Europeans who came to the Western hemisphere after Columbus. But the Plymouth culinary event was the celebration most remembered as the quintessential thanksgiving in the U.S.

 National Association For Gun Rights

 

I know I don't have to tell you, but politicians often say one thing but do the complete opposite -- especially if they think no one is looking.

Newt Gingrich is the poster child for these sort of "flexible" principles.

I've been around the block a few times (I'm about to start my 20th year as a gun rights lobbyist) and dealt with literally thousands of candidates and politicians, but no Republican politician has managed to support and vote for anti-gun legislation and still proclaim that he is "pro-gun" more effectively than Newt Gingrich.

Don't be fooled by his rise in the polls; Newt Gingrich has a long history of supporting gun control ...

... and he has blatantly refused to return his National Association for Gun Rights Presidential Survey.

With more than three decades as a public figure, Newt is the quintessential political chameleon, shifting his views to reflect whatever is popular with the Washington, D.C. chattering class.

Make no mistake, while Newt may talk a solid conservative game, his record is that of a typical Inside-the-Beltway politician who will cut ANY compromise or make ANY deal with anyone for his own political or personal gain.

While Newt used the institutional gun lobby as a mouthpiece to convince millions of gun owners nationwide that "as long as he is Speaker, no gun-control legislation is going to move in committee or on the House floor," he was working behind the scenes to pass gun control.

In 1996, Newt Gingrich turned his back on gun owners and voted for the anti-gun Brady Campaign's Lautenberg Gun Ban, which strips the Second Amendment rights of citizens involved in misdemeanor domestic violence charges or temporary protection orders -- in some cases for actions as minor as spanking a child or grabbing a spouse's wrist.

Gingrich even called the anti-gun measure "reasonable," and predicted that it would sail through his Republican-controlled House of Representatives with little trouble.

The Lautenberg Gun Ban is one of the Congressional Republicans' worst betrayals of gun owners, and those complicit in its passage deserve nothing but contempt from gun owners.

This gun control measure ranks right up there with the Brady Registration Act as the most aggressive gun control in America, denying hundreds of thousands of would-be gun owners the right to self defense.

Gingrich also stood shoulder to shoulder with Nancy Pelosi to pass the "Criminal Safezones Act" which prevents armed citizens from defending themselves in certain arbitrary locations. You and I both know that Criminal Safezones don't protect law-abiding citizens, but actually protect the criminals who ignore them.

As you can see, Newt Gingrich is no friend of gun owners, or small government conservatives. He simply can't be trusted, and his record reflects his contempt not only for the truth, but his own integrity and the integrity of the very people he's asking to vote for him to be the most powerful man in the modern world.

This is the same man who railed against the Obama bailouts of Fannie and Freddie Mac while receiving more than $1.5 million from Fannie Mae as a "consultant"
(4) while his firm also raised $37 million to pass healthcare insurance mandates.(5)

He's also the same man who sat next to Nancy Pelosi and insisted global warming was a man-made problem in need of a government-mandated solution. Now that he's running for the Republican nomination, he doesn't believe in global warming and calls the TV ad he did with Pelosi "inexplicable." Please click here to watch the video.

I'm concerned, though, that Newt's snake-oil act is catching on.

It's time for gun owners and liberty-minded, small government activists to hold Newt's feet to the fire.

That's why I need you to call the Gingrich campaign headquarters right now at (678) 973-2306. Demand that Newt Gingrich apologize for his past support of gun control, and make a dramatic turnaround statement of support to repeal the gun controls he's supported.

Tell his campaign that you expect Newt to not only apologize for his past support of anti-gun measures but also to reveal where he stands on international gun grabs like the UN "Small Arms Treaty" and domestic anti-gun schemes like the banning of .50 caliber rifles.

Demand he quit stonewalling gun owners and return his National Association for Gun Rights Presidential Survey -- at once. You and I both know that election season, when they're begging for the votes of gun owners, is one of the best times to lobby candidates and politicians.

With Republican presidential primaries in Iowa, New Hampshire and South Carolina mere weeks away, it's vital that gun owners know where the Republican candidates for President stand on important Second Amendment issues.

Newt's record is as crooked as a dog's hind leg. With a horrible voting record on Second Amendment issues, gun owners just don't know which side Newt's on.

Most GOP governors refuse to join calls for Holder's resignation

Republican governors are refusing to weigh-in on whether President Obama should fire his top law enforcement official over a botched gun-tracking operation.

The overwhelming silence of GOP state leaders comes as Texas Gov. Rick Perry and Louisiana Gov. Bobby Jindal have joined more than 40 Republican lawmakers on Capitol Hill in calling on Attorney General Eric Holder to resign for his role in Operation Fast and Furious.

The Hill spoke with the offices of all 29 Republican governors. Twenty-six of them either declined to comment or did not respond to whether their confidence in the Obama Administration has waned in the wake of Congress's investigation into Fast and Furious - a gun tracking operation in the Southwest that oversaw the sale of thousands of firearms to known and suspected straw buyers for Mexican drug cartels.

The reluctance of the GOP governors to voice their position differs dramatically from the Republican attitude on Capitol Hill where 40 members sent a letter to Obama this week calling for Holder's resignation.

Give 'Em Hell, Mitt!

Mitt Romney's first television ad stirred considerable controversy, even though it ran briefly and only in New Hampshire. The ad included Barack Obama saying, "If we keep talking about the economy, we're going to lose." The quote, from 2008, is legitimate, but Obama was quoting the McCain campaign. So Democrats went ballistic.

But a Romney aide told Byron York that there was method to the Romney campaign's apparently misleading ad:

Romney aides know some Republicans fear that if Romney is the GOP presidential nominee, he might run a cautious, measured campaign against Obama like John McCain's losing effort of 2008. They know Republicans want to see a fearless, all-out campaign against the president. In that sense, the first ad was an effort to show Republicans that Romney will be as tough as he needs to be. ...

one Romney adviser calls it "incredibly telling" that Democratic criticism focused almost entirely on the use of the soundbite, and not on the substance of the ad itself, which was high unemployment. "This is how these guys operate," the aide says of Team Obama. "This is how they shamelessly reduced Bill Clinton to sputtering that he wasn't a racist. This is how they attacked Hillary for not having a core, for saying anything to get elected - the same Hillary who hosted Senator Obama's largest fundraiser."

"We get that and get how to get under their skin," the aide continued. That fact that not just Obama campaign aides in Chicago but White House spokesman Carney joined in the pushback was, to Team Romney, a sign the Obama team was "rattled."

"We get it," said the aide. "We will tie them in knots." ...

[I]t appears the ad was directed at Republicans as much as Obama, with the Romney campaign wanting to send a signal that it would not run a go-along, get-along campaign against Obama, as some Republicans believe McCain did. If that was Romney's intention, he certainly made his point.

It is also true that attacks by the press tend to make Republicans like their politicians better. So far, the press has largely ignored Romney while going after Michele Bachmann, Herman Cain et al. If Romney gets the nomination, the inevitable attacks may go a long way toward endearing Romney to that portion of the party's base that doesn't view him as sufficiently conservative, or sufficiently aggressive.



Harry and Tonto revisited

I think I went to see Harry and Tonto after Art Carney won the Academy Award for his portrayal of Harry Coombes in the title role. For some reason, however, I went to see the film with no particular expectation that I would enjoy it. Probably for that reason the movie caught me by surprise and bowled me over. Watching it again on cable yesterday, I found that the film holds up remarkably well.

Harry is a retired high school English teacher and widower. When his New York City apartment building falls victim to redevelopment, Harry compares himself to King Lear: "He gave up his real estate, too." Like King Lear, Harry turns to his kids to put him up. (Harry's children are played by Phil Burns, Ellen Burstyn, and Larry Hagman, who are phenomenal).

Harry's travels to and from his kids across the country with his pet cat (the Tonto of the title) give rise to a series of closely observed portraits, slightly mocking but without the least hint of rancor or cruelty. One dinner with his oldest son and his family on Long Island early in the film is almost excruciatingly real and painful. Co-written, directed and produced by Paul Mazursky, this is a comedy with a difference. At the end of the film, you realize that Mazursky has made just about every character in the film likable in his or her own way. He showers them with affection, and you are sorry to see the film come to a close.

Mazursky says little about the film in his memoir, Show Me the Magic. Mazursky describes his desperation to find the money to get the film made: "It was a funny and touching story about a seventy-year-old widower looking for a place to live. I loved the script, but nobody wanted to finance a film about old age."

Having written sketches for Danny Kaye's variety series back in the sixties, Mazursky thinks to approach Kaye about playing the lead role and possibly financing the film, killing two birds with one stone. In their meeting, however, Kaye tells him: "I think it needs a few more jokes."

Mazursky comments: "I suddenly saw the project jump out the window! Humor, yes. Jokes, no." As I say, this is a comedy with a difference.

Mazursky asks Kaye what kind of jokes he had in mind. "Oh, I don't know, Paul - some physical stuff. Why can't this old codger bump into things? You know what I mean."

Mazursky knew he had lost Kaye: "I felt like throwing up." He tells Kaye: "I think there is a lot of humor already, Danny. Once we get into it, the situations, you'll see the humor. After all, the man talks to his pussycat. He walks his cat on a leash."

Mazursky brings his account to an abrupt conclusion: "Two years later Art Carney won the Academy Award for his devastatingly simple looking portrait of Harry."

For whatever reason, Mazursky omits the heart of the story about the making of the film from his memoir. (He puts back in some of the good stuff in his voiceover commentary on the DVD.) He leaves the impression that there must have been a few miracles along the way. The movie puts the evidence for them for all to see right up on the screen.

10News.comClimategate 2.0 is the main climate news this week, right?  As it happens, there's a study just out a couple days ago in ScienceExpress, which is the advance online venue for Science magazine, on a new study that blows the hinges off the catastrophic global warming scenarios.  The study concerns the sensitivity of climate to carbon dioxide concentrations.  The complete study ("Climate Sensitivity Estimated from Temperature Reconstructions of the Last Glacial Maximum," Andreas Schmittner of Oregon State University, lead author)requires a Science magazine subscription for the complete text, was peer-reviewed, and was funded by the National Science Foundation.  But here's the abstract:

Assessing impacts of future anthropogenic carbon emissions is currently impeded by uncertainties in our knowledge of equilibrium climate sensitivity to atmospheric carbon dioxide doubling. Previous studies suggest 3 K as best estimate, 2 to 4.5 K as the 66% probability range, and nonzero probabilities for much higher values, the latter implying a small but significant chance of high-impact climate changes that would be difficult to avoid. Here, combining extensive sea and land surface temperature reconstructions from the Last Glacial Maximum with climate model simulations, we estimate a lower median (2.3 K) and reduced uncertainty (1.7 to 2.6 K 66% probability). Assuming paleoclimatic constraints apply to the future as predicted by our model, these results imply lower probability of imminent extreme climatic change than previously thought.  (Emphasis added.)

Bottom line: the "consensus" IPCC range overestimates climate sensitivity by almost a factor of 2.  No doubt the mainstream media will be all over this study, and the next UN climate meeting opening soon in Durban will take note of it, too.  Yeah-right after the Redskins win the Super Bowl, no doubt.

Should the Rich Be Condemned?

Thomas Edison invented the incandescent bulb, the phonograph, the DC motor and other items in everyday use and became wealthy by doing so. Thomas Watson founded IBM and became rich through his company's contribution to the computation revolution. Lloyd Conover, while in the employ of Pfizer, created the antibiotic tetracycline. Though Edison, Watson, Conover and Pfizer became wealthy, whatever wealth they received pales in comparison with the extraordinary benefits received by ordinary people. Billions of people benefited from safe and efficient lighting. Billions more were the ultimate beneficiaries of the computer, and untold billions benefited from healthier lives gained from access to tetracycline.

President Barack Obama, in stoking up class warfare, said, "I do think at a certain point you've made enough money." This is lunacy. Andrew Carnegie's steel empire produced the raw materials that built the physical infrastructure of the United States. Bill Gates co-founded Microsoft and produced software products that aided the computer revolution. But Carnegie had amassed quite a fortune long before he built Carnegie Steel Co., and Gates had quite a fortune by 1990. Had they the mind of our president, we would have lost much of their contributions, because they had already "made enough money."

The Bell Tolls for Obamacare

On November 14, the Supreme Court granted the Writ of Certiorari to hear the appeal of the cases testing the constitutionality of Obamacare. The resulting decision will mark an historic watershed not only in the restoration of constitutional jurisprudence, but in fundamental, market reform of the entire entitlement state.

Historic Decision Brewing

I write serving as the General Counsel of the American Civil Rights Union (ACRU), as one of several current positions. The ACRU was started by former top Reagan aide Robert Carleson, with former Attorney General Ed Meese as Chairman of the Advisory Board, along with other former Reagan Justice Department officials, besides myself as a former Reagan White House staffer.

In my capacity for the ACRU, I wrote and filed amicus curiae briefs on behalf of the ACRU in both the district court and the circuit court in the challenge by 26 states in the 11th Circuit that resulted in an order striking down the entire Obamacare law. I also wrote and filed ACRU amicus curiae briefs in the challenge by Virginia Attorney General Ken Cuccinelli in both the district court and the circuit in the 4th Circuit. The district court found the individual mandate unconstitutional, while the circuit court ruled that Virginia had no right to bring the case (two Obama appointed judges on the three-judge panel).

Gingrich Follows FDR with Court-Packing Scheme

 

This column by ACRU Senior Legal Analyst Ken Klukowski was published November 20, 2011 on The Washington Examiner website.

Former House Speaker Newt Gingrich's idea for checking judicial activism is a textbook case of historical revisionism that is strikingly similar to the court-packing scheme of liberal icon Franklin Delano Roosevelt.

Gingrich says Congress should just pass a law eliminating specific judgeships, presumably immediately ousting the activist judges currently filling those seats.

Gingrich lionizes an incident now regarded as profoundly troubling by constitutional scholars. When Thomas Jefferson replaced John Adams as president in 1801, the outgoing Congress created new federal courts and judgeships, which Adams promptly filled. The new Congress repealed the law and the judges were ousted.

Jefferson considered trying to impeach the entire Supreme Court. As Rep. James Bayard said at the time in objecting to Jefferson's plan:

"He uses the Legislature to remove the judges, that he may appoint creatures of his own. In effect, the powers of the Government will be concentrated in the hands of one man, who will dare to act with more boldness."

Supreme Opportunity to Right a Wrong

In March, the Supreme Court will hear the challenge by 26 states and the National Federation of Independent Business to the constitutionality of the Patient Protection and Affordable Care Act, better known as Obamacare. A ruling is expected by midsummer.

Although many provisions don't kick in until 2014, this 2,700-page mess is already giving America's health care system a bad cold, which will morph into pneumonia if the law is not overturned. A few of the symptoms already have emerged:

Adding costs: Some doctors are charging patients extra fees for basic services such as processing forms. Without malpractice tort reform, which Obamacare rejected, doctors themselves are facing higher insurance fees along with anticipated bureaucratic regulatory costs.

Reducing coverage: Faced with a mandate to ignore pre-existing conditions, insurance companies have dropped child-only coverage.

There Are No Longer Any Excuses for Obamanomics

The history of America's recessions is provided at the website of the National Bureau of Economic Research (NBER). Before this last recession, since the Great Depression recessions in America have lasted an average of 10 months, with the longest previously lasting 16 months. Yet here we are 47 months after the last recession started, and we still have no real recovery.

Instead, unemployment has been stuck at 9% or above for the longest period since the Great Depression. Unemployment for blacks has remained over 15% for over 2 years, with Hispanic unemployment stuck well into double digits over that time as well. Teenage unemployment has persisted at nearly 25%, with black teenage unemployment still nearly 40%.

The U6 unemployment rate, reflecting all of the unemployed still wanting work and the underemployed who can't get full time work, is still 16.2%. That includes an army of the unemployed or underemployed of over 26 million Americans. And that still doesn't fully count the millions of Americans who have given up and dropped out of the work force altogether.
