The Congressional Super Committee is tasked with finding $1.2-$1.5 trillion in cuts over the next ten years. They will release their plan to the rest of Congress by November 23. It is up to us to make sure that the cuts they propose are REAL CUTS rather than the fake cuts they love so much. Politicians have a bad habit of using gimmicks and tricks to make it seem like they are cutting spending, when they are in fact, increasing spending.


 

On November 17, join thousands of patriots from around the country for a Deal in the District.

We will be visiting the local offices of our Representatives at NOON in your time zone ( or whenever your group can make it) to express our desire for REAL CUTS. Tell Your Member of Congress:

  • We want REAL spending cuts. No more gimmicks, no more lies. Make real cuts and prioritize!
  • Increasing spending more slowly than someone else is still increasing spending.
  • When you increase spending by $5 and then cut $3, you haven't made a cut. Your total spending is still $2 higher than it was before. This is a gimmick. Stop it. Now.
  • If you say you're cutting $3, then cut $3. This year. (And in case it's not clear to your Rep., $3 is an example. A whole lot more than $3 needs to be cut!)
  • All of the so-called cuts passed by Congress always get spread out over ten years, but this Congress has no authority over the next Congress and those cuts from this year can easily be overturned. Therefore, real cuts are cuts that occur within in the same fiscal year.
  • Our country's national debt has now surpassed our Gross Domestic Product (GDP). Now is the time for real cuts, not fake cuts.
  • We see what is happening to Greece and Italy, and to the Eurozone in general. It is the responsibility of elected officials to make real cuts now!

Dr. Richard Brake is the Director of Education at the Intercollegiate Studies Institute (ISI), a non-profit educational foundation with a mission to "Educate for Liberty"-by inspiring college students to discover and embrace the principles that make America prosperous, moral, and free. As part of his duties, Dr. Brake directs the Institute's Civic Literacy Program, which has documented the failure of America's top universities to teach their students the founding history, texts, and institutions of our constitutional republic. Dr. Brake earned a B.A. in History from Georgetown University; an M.A. in Government from the University of Virginia; and a Ph.D. in Political Science from Temple University. Prior to joining ISI, Dr. Brake taught American Politics and Constitutional Law at Temple University in Pennsylvania and the Richard Stockton College in New Jersey. Earlier in his career, Dr. Brake worked as a legislative assistant in both the Pennsylvania and U.S. Houses of Representatives, and in 2006 he retired at the rank of Captain after serving ten years as an Ordnance Officer in the Pennsylvania Army National Guard.

I urge you to stand with me and co-sponsor my new legislation, "American and Pennsylvania Laws for Pennsylvania Courts." This legislation protects the individual constitutional rights of the people of Pennsylvania from the incursion of foreign laws, in cases in which the application of a foreign law or foreign legal doctrine would violate someone's constitutional rights.

 Thursday, December 1st at 7:30PM: Paul Finkelman, "America's Covenant With Death: Slavery and the Founding."  Paul Finkelman is the President  William McKinley Distinguished Professor of Law and Public Policy, and Senior Fellow in the Government Law Center at Albany Law School. His lecture will explore the relationship of slavery to the American founding, and will examine how slavery was written into the original Constitution, and protected by it.

Thursday, December 8th at 7:30PM: George W. Boudreau, "'A Republic, If You Can Keep It': Benjamin Franklin and the Crafting of the Constitution."  The series closes with a talk by an audience favorite,   George W. Boudreau, Associate Professor of Humanities and History at the University of Pennsylvania, Harrisburg.  Professor Boudreau is Project Director of the "Teaching Franklin" website (http://harrisburg.psu.edu/teachingfranklin/).  His lecture will explore Franklin's role in the creation of the Constitution.

1. We Sent 'Tea Party' Republicans to Washington for This?

In the House Republican's Pledge that I told you was a "Pledge to Nowhere," you find this language:

"tax increases must be prevented" and "We will help the economy by permanently stopping all tax increases".

Got it? The House GOP pledged, also known as a promise, to stop "all tax increases." It was their promise.

According to The Hill, the Republicans are about to give a capital "F" and a capital "U" to the tea party and throw in the towel on their Pledge.

Lawmakers emerged from the closed-door meeting saying Hensarling had made the case that offering some new revenue - $300 billion in at least one publicized offer - would be a good trade to secure a permanent extension of the George W. Bush-era tax rates.

So we're going to keep permanent the Bush tax cuts that no one really thought would actually expire next year even though they technically are supposed to and replace those with a $300 billion tax increase?

To rub salt into the tea party's wounds, "Hensarling received a standing ovation following his presentation." Yes, a Republican got a standing ovation by Republicans for proposing a tax increase.

To be fair, if there are serious structural reforms to the tax code and serious concessions by the Democrats on entitlement reform, I would want to look seriously at the plan. But, based on what we know so far, the Democrats have offered nothing publicly substantive and the GOP is offering up a bunch of smoke and mirrors on the House side to cover up the fact that House leaders are actually proposing a tax increase on the American public.

Yet again the GOP is negotiating with itself. Given the way the GOP is operating on itself in public, I'm surprised it isn't blind.

 

 

 

2. House Republicans Set to Again Violate Their Pledge to America

With much fanfare in the midst of their campaign to take back control of the House of Representatives, House Republicans unveiled their Pledge to America. Many conservatives thought it was an enormous missed opportunity to lock a new Republican majority into a bold reform agenda. But House Republicans said that they wanted to under promise and over deliver. Who knew their conservative critics would end up being the keeper of their low expectations?

Unfortunately, Leadership's commitment to their Pledge deteriorated quickly upon taking control. The Pledge called for a $100 billion cut in nondefense spending, but since this was going to be too hard in an abbreviated fiscal year, they decided to "prorate" that amount. Conservatives at the Republican Study Committee fought their Leadership and got them closer to $100 billion, but not all the way.

However, the Pledge also promised to transform the way the House of Representatives as an institution would be run. They promised to end the practice of packaging spending bills and other related legislation into so-called "omnibus" bills. Specifically, House Republicans pledged to "end the practice of packaging unpopular bills with 'must pass' legislation to circumvent the will of the American people. Instead, we will advance major legislation one issue at a time."

Since it doesn't actually say the word omnibus, did they mean something else? No, the passage was widely known to mean an end to omnibus bills. In fact, according to an October 2010 post on Speaker Boehner's own blog, "House Republicans have also called for an end to the practice of passing massive 'omnibus' spending bills, arguing such bills make it too difficult to cut spending and too easy to shield spending projects from public scrutiny and debate."

Now, House Republicans are about to violate this pledge too.

 

3. A Tale of Two Pipelines

One of the reasons we're supposed to be wary of the Keystone XL Pipeline is its alleged threat to the Ogallala Aquifer, the water source for much of the Great Plains.

The pipeline would be separated by almost 400 vertical feet from the aquifer, which is not actively recharged. That makes it extremely unlikely that even a large pipeline leak would contaminate water supplies.

 

4. CBO Director Admits Stimulus Will Shrink Economy

We could have done a lot of good things with the $830 billion that was flushed down the toilet through the 2009 stimulus. That money could have been used to permanently transform our entitlement programs to free-market personal ownership accounts. It could have been used for massive pro-growth tax cuts. Instead, it was used to grow perennial dependency and for special interest handouts. But all of the supercilious smart economists say that it helps stimulate the economy, right? After all, it is called stimulus.

Well, earlier today, CBO Director Doug Elmendorf admitted to Senator Sessions that in the long run the stimulus will shrink the economy. He testified at a Senate Budget Committee hearing that the stimulus will indeed "be a drag on GDP" over the next ten years. Any diligent student of history already knew that, but now we have the "gold standard" of budget and economic scoring to affirm that self-evident truth. Nevertheless, fear not, the stimulus will have a stimulating effect in the short-term. That's why we are enjoying a robust annual average GDP growth of.....1.4%.

 

5. Senator Coburn: The Agony of a Pragmatic Conservative Amidst Inflexible Liberals

Senator Tom Coburn released a report, Subsidies of the Rich and Famous, detailing a list of subsidies, transfers, and "tax breaks," that are paid to individuals with Adjusted Gross Income (AGI) of over $1 million. The report found that millionaires have received at least $9.5 billion in "government payments" since 2003 and $113.7 billion in "tax breaks" since 2006. Accordingly, Coburn concludes that many of these tax deductions should be eliminated, while benefits for the rich should be means-tested or reduced.

As our debt approaches $15 trillion, Coburn's heart is undoubtedly in the right place; however, many of his proposals are misguided. While some of the deductions enumerated in this report should be eliminated immediately, most of the savings will come from revoking universal tax deductions from those who already have the highest tax burden. Additionally, while some of the subsidies, such as the farm and green handouts, should be abolished, most of Coburn's savings on government benefits would come from reducing Social Security payments to the rich. Social Security payments, unlike welfare and other subsidy programs, represent real money that was paid into the system through payroll taxes. Any effort to deny those payments from the rich would engender further redistribution of a program that was not conceived for redistribution. Also, it would ostensibly be a 12.4% tax increase on those high-income earners, as they would pay the tax without receiving the retirement checks.

 

6. HELP: I've Made it to Round 2, Now Vote to Get Me to Round 3!

If you were reading RedState a few weeks ago, you may have seen a post by Neil asking for help expanding the RedState Radio Empire by voting for me in a contest at my local AM flagship station WBT in Charlotte, NC.

Put simply, the contest will put someone on the air on Sunday nights from 6-8pm and then, following that 3 month period, may be given a full contract to be a permanent host at the station.

When the word went out from RedState to start voting for me, my 'likes' went through the roof and I quickly moved into 1st place. Unfortunately, this upset a handful of people who were also hoping to win and rampant cheating began.

Warning of Challenges To Israel's Borders

The immediate object of the League is to stop, by appeals to reason and conscience and, if necessary, by appeals to law, the defamation of the Jewish people. Nowhere does this call for the ADL to shield Barack Obama from the consequences of his policies toward Israel and other allies of the United States. The "National Pledge for Unity on Israel," which the ADL cosponsored with the American Jewish Committee, is but the most recent example of how this organization has lost touch with the very reason for its existence.

Rape and the Occupation

The multiple incidents of sexual assault in the Occupation tent cities are as ugly as they are inevitable. The absence of theft, assault and other forms of attacks is not a natural phenomenon, it is the outcome of a system that protects individual rights. The Occupy tent cities are not concerned with the rights of the individual, but with the grand collective right of the "99 percent" to demand private property on behalf of the government. And collectivist movements are notoriously unconcerned with what happens to the individual.

 
The collectivist response to the allegations is to urge the victims to remain silent to avoid harming the reputation of the movement. This is a commonplace institutional response to rape allegations. It is not concerned with the individual, but the group. You have to break some omelets to make some eggs and you have to cover up some rapes and assorted bits of ugliness to have a society where everyone's masters degrees are subsidized by the state.

Rape is a symptom of a larger loss of rights. When rape becomes widespread, as in South Africa, it can mean that the society is now lawless and the weak are preyed upon, it can also mean that a society has been conquered from the outside and the conquerors are looting the conquered, as Muslims are doing in Sudan or Sweden. Either way it means the end of a consensus on enforceable individual rights.

Between the tribalism of Islam and the totalitarian hierarchy of OWS or the USSR or any leftist system, the Western world has carved out an imperfect space of individual freedom by leveraging the free market that OWS is busy denouncing.

If OWS thinks the 1 percent is bad in the United States, try the 1 percent in Medieval England, the USSR or Egypt in the present day. The 1 percents over there were and are a good deal worse with much more power and few rights for the commoners that needed respecting. And for all the working groups, the occupiers have not managed to come up with anything that works any better than the system they are denouncing.

Just a few days ago, Obama and the White House went out of its way to issue a special proclamation for Eid al-Adha, the Muslim "festival of sacrifice."

In an official White House statement, the president and first lady gushed about Eid and congratulated Muslims involved in the Hajj "pilgrimage."

All of that is well and good, but what struck me about this special message was the reminder that this very same president deliberately ignored Easter this year, the most holy of Christian holidays, by snubbing Christians here and around the world... it now seems Obama's contempt for this nation is personal and isn't even something he bothers to mask.

In addition to gestures by this president indicating a personal contempt for the Christian foundation of this country, in the past 72 hours Americans were dumbfounded by the announcement of a "Christmas Tree Tax" by Obama's Department of Agriculture.

Really, imagine if the federal government even contemplated, let alone announced, a tax on Muslim prayer rugs. For some reason, however, taxing a popular symbol of Christianity used during a significant holiday was thought to be perfectly fine by this administration.

There is a precedent for this - in the Muslim world it's called the "Jizya" - a tax levied on non-Muslim citizens in the Islamic world, allowing them to practice their religion while being "protected" by the Muslim state.

Suppose that during the Cold War years, the American president's favorite leader and guide to Latin America was Fidel Castro. That would worry you, right? But such a notion is ridiculous, isn't it?

 

Not today it isn't. President Barack Obama can't stand Israeli Prime Minister Benjamin Netanyahu. In a recent statement to French President Nicholas Sarkozy, caught by a microphone both men thought was off, Obama said: "You're fed up with him, but I have to deal with him every day!"

 

 There is, however, a man who Obama loves to deal with, if not every day at least as often as possible: Turkish Prime Minister Recep Tayyip Erdogan.

Twenty years ago, the world watched the Soviet Union fall. PG&E BEGINS REMOVING 'SMART' METERS DUE TO HEALTH EFFECTS ... Widening Call for Immediate Return of Analogs; Disconnection of "Mesh" Wireless Network. SANTA CRUZ, CA-Just as PG&E enters the final phase of its deployment of wireless "smart" meters in California, the largest of the state's Investor Owned Utilities (IOU's) has reversed course, quietly beginning to replace the 'smart' meters of those reporting health impacts with the old trusty analog version. Consumer rights and health groups immediately seized on the news, demanding that millions of Californians unhappy with their new wireless meters get their analogs returned immediately at no cost. 'Smart' meters are new wireless utility meters being installed as part of the "smart" grid initiative, spearheaded by technology firms and backed by the Obama administration and the Department of Energy. Dominant Social Theme: Smart meters are very helpful for a green planet. So what's the fuss?

Free-Market Analysis: When we first wrote about these evil "Smart Meters" well over a year ago, they weren't receiving much attention. But we saw them as part of a broader plan of the Anglospherepower elite to continue their quest for control over every part of people's lives. We figured the deployment of Smart Meters would go forward for several years without much resistance but we were wrong.

The Smart Meter craze has been positioned as a subdominant social theme by the elites: There are too many people, not enough power and we need to control every aspect of our energy existence and use. The world is swimming in energy - and oil, as a matter of fact. We've reported on the statement of one of the Forbes brothers of magazine fame that the US has enough oil domestically for centuries of use, but that discoveries and exploitation have been artificially reduced by "environmental" regulations and federal land ownership. The US fedgov owns about one-third of America's lower 48, mostly in the Midwest.

But far sooner than we figured, it seems the Smart Meter backlash has arrived. Turns out that people don't like the considerable hikes in their bills once Smart Meters are installed. Nor do they enjoy the health ramifications that are apparently involved, either. Thus we were both surprised and gratified to receive this press release from StopSmartMeters.org, detailing considerable pushback to the deployment of Smart Meters in California. Here's more from the release:

Widely disparate political groups- from members of the Green Party to the Tea Party and Occupy protesters have attacked the program, and dozens of grassroots organizations have sprouted up over the past several months to fight what they call an undemocratic, unconstitutional and dangerous assault on people in their own homes and neighborhoods.

Dozens of people have been detained or arrested for peaceful civil disobedience and even simply speaking out against deployments. In California, more than 47 cities and counties have demanded a halt to installation, and a dozen local governments have passed laws prohibiting the controversial technology. The 'smart' meter issue has further angered a public already seething at the utilities over repeated gas explosions, safety breaches at nuclear reactors, and an increasingly extortionate rate structure.

Word of California's 'smart' meter nightmare has spread across the country and around the world, prompting some utilities to place smart meter plans on hold, and recently Nevada's PUC to call for investigations into the health effects and other smart meter problems. Now in a dramatic turnaround that could signal the beginning of a widespread recall of wireless 'smart' meters, on October 28th PG&E re-installed a classic spinning disc analog meter on the home of Santa Cruz, CA resident Caitlin Phillips, who had been suffering headaches and other symptoms from her 'smart' meter.

The move comes in response to verbal directives from the California Public Utilities Commission President Michael Peevey, who recently told members of the public that the utility "will provide for you to go back to the analog meter if that's your choice." The CPUC has been slow to respond to thousands of ordinary citizens reporting health effects from the new meters.

When a Wellington Energy installer (contracted with PG&E) came to install a smart meter at her home, Caitlin asked the installer to get off her property and not install, because of what a neighbor had told her about possible health damage and privacy violations. "When I returned home later, I discovered a smart meter on my house. That night I awoke to severe anxiety, headache, and buzzing in my teeth, and realized the new smart meter was on the other side of the wall from my bed."

Caitlin reported her experience to PG&E and the CPUC, who both declined to rectify the situation. When the symptoms persisted, Caitlin sought the assistance of the Scotts Valley based group Stop Smart Meters! who provided an analog meter and referred her to a professional who could help her remove her 'smart' meter. As soon as the analog was installed, Caitlin's symptoms disappeared.

Frustrated and outraged about her treatment by the utility and the PUC, Caitlin travelled to San Francisco to speak at a commission meeting on Oct. 20th. About a week later, PG&E crews were at her house replacing her temporary analog meter with a brand new official PG&E analog meter. This is believed to be the first time PG&E have willingly replaced an analog meter on the home of someone suffering from health effects.

An "opt-out" proceeding overseen by an Administrative Law Judge is underway at the CA Public Utilities Commission, yet those suffering (in some cases severe) health impacts have been stuck in limbo as utilities refuse to remove the harmful meters upon request- until now.

"There are hundreds of thousands- if not millions- of people suffering in their homes from forced 'smart' meter radiation," said Joshua Hart, Director of the grassroots organization Stop Smart Meters! "The utilities and PUC's must respond promptly to all requests that analogs be returned. The alternative is that people will increasingly turn to independent professionals to remove unwanted 'smart' meters from their homes, a reasonable action we assert is within our legal rights. Protecting your family's health is not tampering."

PG&E and other utilities have also been responding to health complaints by replacing wireless 'smart' meters with digital meters that are "wireless-ready." These digital meters have been associated with health problems from "dirty electricity" frequencies that pass into a home via the electrical wiring.

These "trojan horse" meters have been roundly rejected by those who report continuing health impacts after installation. Susan Brinchman, Director of San Diego based Center for Electrosmog Prevention. said "At this point, the burden of responsibility is on the utilities to demonstrate that any new meter they want to install on our homes is safe. Communities have the right to retain analog meters at no extra charge.

Smart Meters are an outgrowth of M. King Hubbert and the so-called Technocracy movement that was prominent in the mid-20th century. Hubbert is, of course, also the inventor of the concept of "Peak Oil" - the idea that oil production will at some point peak and then gradually begin to subside.

Is it any coincidence that Hubbert, a believer in the Platonic idea of the rule by a few wise men over the many, also invented the ridiculous notion of Peak Oil? It is evident and obvious to anyone who bothers to give even a few minutes of study to the issue that the Anglosphere power elite has been plotting this gambit for nearly a century now.

Peak Oil was supposed to be the problem. Smart Meters were supposed to be the solution. The idea was to figure out exactly what people were doing as regards their energy habits and then tax them and regulate them.

The idea that a handful of men can force billions to do their bidding is a fairly ridiculous notion in our view. As their dominant social themeshave proven less effective in the 21st century, the elites have turned to violence and war. Yet violence is not only an ineffective way of moving society in a certain direction, it is an unpredictable one.

The Internet Reformation is a wonderful thing. Ten or fifteen years ago, a movement to dump Smart Meters would likely never have seen the light of day. There would have been no way to disseminate the information even if one could have concluded that Smart Meters were not what the authorities were claiming they were.

Conclusion: That a backlash against Smart Meters could have come so soon is further proof of our observation regarding the new communication technology: It is a process, not an episode.

Fellow Patriots and True the Vote volunteers- 

 

This Sunday, the Houston Chronicle's Outlook section featured a full front page story devoted entirely to the subject of vote suppression and you. The article, written by Judith Browne Dianis, co-director of The Advancement Project and Christina Sanders, Texas State Director of The League of Young Voters, was titled "PartisanTactic Could Suppress Voting". Guess what the partisan tactic was....you. The whole article can be read via this link, but here's an excerpt:

 

"To complement the voter suppression efforts, tea party-affiliated groups such as the Houston-based King Street Patriots have vowed to send individuals to observe activities at polling places, which could intimidate voters. Hundreds of volunteers have pledged their time to travel to polling stations, question the rights of fellow Texans to cast their ballots and disrupt polling-place activity if they deem it necessary. The idea of tea party volunteers storming polling places evokes strong images of Jim Crow-era voter suppression."

 

Many of you worked at the polls after having participated in True the Vote training. This article accuses you of "storming polling places" with the intent to disrupt and intimidate voters. We know that these accusations are biased, groundless, and hateful, yet they still make for headline news at the Chronicle. Make no mistake, there is a national, coordinated effort to sabotage the True the Vote effort. These kinds of articles are popping up all over the place; making false accusations, conjuring up vile images, and attempting to rally followers through anger and fear. That our hometown paper would be complicit in the promotion of such propaganda is inexcusable.  

 

Are you going to let the accusations made in this article go unanswered?  We hope not.  When citizens don't speak up, when we don't set the record straight - that is how lies become accepted as truth.  If you've ever been associated with the True the Vote program, if you've heard our presentations, if you've gone through our training, if you've worked at the polls, you are the BEST equipped source to respond to these fallacious allegations. Senators Want Info on Obama Denying Catholic Grant Over Abortion

Fear, Envy, and the Politics of Division

"The American Idea has done more to help the poor than any other economic system ever designed."

Congressman Paul Ryan made this bold statement in a recent major address at Heritage. The American Idea means that Americans work, compete, and cooperate in an open market, climb the ladder of opportunity, and keep the fruits of their efforts. With such social mobility, gone are the struggles of class against class. Self-government and the rule of law secure our equal, God-given rights. Our political and economic systems-rooted in freedom and responsibility-reward, and thus cultivate, traditional virtues.

In times of prosperity, the American commitment to equality of opportunity, economic liberty, and upward mobility that make up the American Idea is taken for granted. But, when the economy is lagging, businesses are closing, and people are out-of work, our commitment to the American Idea is tested. In these tough times, we must resist the calls to Europeanize the American economy and American politics and must preserve the American Idea.

Never one to let a crisis go to waste, President Obama has proposed policies and engaged in rhetoric to move us away from the American Idea and closer to the European model. He wants new tax increases on millionaires and billionaires (bizarrely defined as those earning over $250,000) to fund the ever-expanding welfare state. But the problem with chasing ever-higher spending with ever-higher tax increases, Ryan explains, is that "you eventually run into a brick wall of math," where there is not enough revenue to pay for the services. With the passage of Obamacare, the brick wall of math is larger and closer.

To market his proposals, Obama has turned to the divisive rhetoric of class envy and fear. He rails against the 1% of private citizens who earn too much money (on the backs of the 99%) and pay too little taxes; defends tax increases as restoring fairness; denounces restraint on government spending as heartless; and promotes equality of outcomes above all else. At the core of his rhetoric is the notion that Americans are stuck in their current station in life and government's role is to designate bureaucrats to help them cope with it. This is contrary to the social mobility and individual opportunity possible with the American Idea. 

It's tempting to believe that a small segment of the population who earn too much money causes all our economic woes. It's even more tempting to believe that the solution is easy: spending more money, supplying more welfare benefits, and funding it all with punitive taxes on the wealthy. But, Americans cannot let themselves be seduced by this line of thinking. We must remember that America has been successful because of the American Idea-not despite it.

Ironically, the real class warfare we face is the relentless efforts of bureaucrats and connected crony capitalists who rig the rules to preserve their place atop society. Look no further than the Department of Energy funding politically favored but economically unviable alternative energy, the National Labor Relations Board suing an American employer for politically motivated reasons, or the Department of Health and Human Services granting waivers from Obamacare to politically connected groups. Crony capitalists use the coercive arm of government to hold down the competition.
 
Our recent hardships have reopened a long-standing national debate: do we insist on equality of outcome whatever the economic cost, or are we a nation that still believes in equality of opportunity? If we embrace the former, then we are doomed to perpetual class envy where only bureaucrats can allocate the pieces of an ever-shrinking economic pie. But, if we believe in the latter, then as Paul Ryan reminds us, "we embrace the American Idea that justice is done when we level the playing field at the starting line and rewards are proportionate to merit and effort."

With 14 million Americans unemployed, you'd think President Obama would be open to job creating solutions.

But the opposite seems to be true.

 

Last week, the Obama administration announced it would delay a decision on the Keystone XL oil pipeline until after the 2012 elections-a $7 billion pipeline that would bring more than 700,000 barrels of oil per day from Alberta, Canada to the Texas gulf coast.

 

Over the last several months, President Obama had been feeling the heat from radical environmentalists and Hollywood's celebrity base to block the construction of the pipeline.  As The Heritage Foundation's Mike Brownfield explains, the administration's retreat on this issue shows "politics is more important than achieving true energy independence for the United States."

 

Still touting his American Jobs Act, a new taxpayer-funded "stimulus," the President fails to realize the Keystone pipeline would have been a jobs and revenue creator. By some predictions, tens of thousands of jobs would have been created to build the 3,204 miles of pipeline, all while generating $5.2 billion in property tax revenue for Montana, South Dakota, Kansas, Oklahoma, Nebraska and Texas.

Taking The Battle To Obama

Yesterday we posted a video highlighting 53 seconds of Obama's "oops" moments. (There is so much material to work with we might do another one!) Our first foray into the 2012 election season has received more than 30,000 hits online. Within minutes of posting the video, the radical group "Right Wing Watch" had noticed it and personally attacked me. Other Washington media outlets gave it more positive coverage.

My friends, the battle for America is on and we cannot afford to lose. We will utilize every medium available -- TV, radio, the internet, mail, phones, etc. -- to take America back. What we are able to do is limited only by the support we receive from good folks like you!


2012 Update

  • Cain's "Oops" Moment: Herman Cain recently sat down with the editorial board of the Milwaukee Journal Sentinel. When Cain was asked whether he agreed with Barack Obama's Libya policy, he seemed stumped by the question and conceded that he had "all of this stuff twirling around in my head." For two minutes, he seemed unable to formulate a coherent response. The video of Cain's "brain freeze" has gone viral. You can watch it here.

    Herman Cain is a good man. It was heartbreaking to see him so unprepared. His tax plan has certainly added a lot to the discussion. But there is no doubt that the "Cain Train" has slowed down in recent weeks. The sexual harassment allegations have hurt him. His poll numbers are falling, and Mitt Romney has regained the lead in the RealClearPolitics.com average. This latest episode is already being used by the left and its media allies to raise serious doubts about whether Cain could navigate international affairs as president.

    Obviously Cain's foreign policy would be better than Obama's, whose support for the Arab Spring has resulted in major gains for radical Islamists and increasing danger for us and Israel. But this latest slip-up by a leading GOP contender will make it harder to win over independent voters.
  • Newt Rising: As Cain falls, Newt Gingrich is rising in the polls. Among the four most recent national polls, Newt Gingrich is second in three and leads in one. His standing has more than doubled in the past month -- from 7.2% to 17.6%.
  • 4-Way Tie In Iowa: If you need another example of the chaotic state of the GOP race, look no further than the latest Bloomberg Iowa poll. Four candidates are essentially tied for the lead: Cain 20%, Paul 19%, Romney 18% and Gingrich 17%. In addition, the poll finds that 10% of caucus goers are undecided while 60% could still be persuaded to support another candidate.



Kagan Not An Impartial Judge

In yesterday's report, I said that Justice Elena Kagan should recuse herself from next year's hearing on ObamaCare. It is just not plausible that Obama's solicitor general can be an impartial judge of his top legislative achievement. Reinforcing that assertion is a recently revealed email exchange between Kagan and left-wing Harvard Law Professor Laurence Tribe, who briefly worked at Obama's Justice Department.

According to CNSNews.com, on Sunday, March 21, 2010, the day ObamaCare passed Congress, an elated Kagan emailed Tribe, "I hear they have the votes, Larry!! Simply amazing." Tribe's response: "So health care is basically done! Remarkable." The subject line of their exchange was, "fingers and toes crossed today!"

As Terry Jeffrey of CNSNews notes, "According to 28 USC 455, a Supreme Court justice must recuse from 'any proceeding in which his impartiality might reasonably be questioned.' The law also says a justice must recuse anytime he has 'expressed an opinion concerning the merits of the particular case in controversy' while he 'served in governmental employment.'"

Clearly, Kagan was more than a dispassionate observer. She should step aside when this case comes to the high court, but you and I know she probably won't. Leftists believe the rules don't apply to them!


Bishops Battling Big Government

The Conference of Catholic Bishops is meeting this week in Baltimore, Maryland. Yesterday, Catholic leaders stepped up their resistance to big government by warning that religious liberty in America is at stake. In response to repeated assaults against traditional values, the conference formed a new committee on religious liberty and launched a new website aimed at defending the church's teaching on marriage. (Who would have thought it would ever be necessary?)

But as the "tolerant" left has pushed its agenda, big government has aggressively moved to push men and women of faith into the closet. For example, because the Catholic Church refuses to compromise on marriage, several states refuse to work with Catholic Charities on adoption services. The Obama Administration recently denied a grant to the Catholic Church to help victims of human trafficking because the church refuses to refer individuals for abortions.

America is at a tipping point. The values we have taken for granted are at great risk. Do not think that these concerns are just abstract issues that will not affect your life. As I have reported before, children are being indoctrinated in the public schools and individuals are at risk of losing their jobs if they believe in normal marriage. Unfortunately, for some, it is even worse.


Nurses Forced To Kill

I had the honor of speaking at a fundraising dinner for the New Jersey Family Policy Council this past weekend. One of the many issues addressed that night was a brewing controversy at the University of Medicine and Dentistry, one of New Jersey's largest hospitals.

Nurses at the hospital have been ordered to assist in abortions or risk having their employment terminated. At the dinner Saturday night, twelve pro-life nurses who refused to blindly follow orders were recognized and received a standing ovation from the audience.

I am pleased to report that Congressman Chris Smith (R-NJ) is taking up their case too. There are conscience clause protections in federal and state laws meant to prevent such abuses, but the Obama Administration has moved aggressively to undermine those laws. Elections have consequences.

As I argued in my recent Human Events column, the Democrat Party is increasingly made up of liberals who worship at the altar of big government. They are literally tithing to left-wing candidates and causes. Men and women of faith who cherish traditional values must "fight the good fight" in the political arena too!

Textbook Analysis Project Coming Soon!    

We have received a lot of emails asking when our textbook analysis project will be completed.

If you're not aware of this, 18 months ago we launched an in-depth analysis of thirty-eight 6
th through 12th grade textbooks, to see how they treated the subject of Islam.

The research has been completed, and what we have found will shock you. The historical falsehoods, bias and other misrepresentations of Islam in these textbooks are egregious and persistent.

We are currently completing the writing and final edits to the report, which will document over 245 errors in these various textbooks.

Here's a small sample of what we found.

 

"In Medina, Muhammad displayed impressive leadership skills. He fashioned an agreement that joined his own people with the Arabs and Jews of Medina as a single community. These groups accepted Muhammad as a political leader. As a religious leader, he drew many more converts, who found his message appealing."

  This is so preposterous, so lacking historical justification or support within sharia law, one wonders how it ever got into a textbook.

  "Became popular" sounds more like a description of a new dance than what happened to the Hindus of India. Tens of millions of Hindus were slaughtered during the many jihad campaigns launched against it.

Rather than release this report as we enter the holiday season, we have decided to hold off until early next year. At that time we will mail an Executive Summary to every state and local school board member in America-over 70,000 people.

The Trouble With Crony Capitalism

The Solyndra scandal gets worse and worse, and as it does so it teaches one lesson after another about the evils of entangling the government with private enterprise. The latest revelation is that when Solyndra was planning a massive layoff in late 2010, the Department of Energy pressured the company to delay its announcement until after the midterm elections:

Solyndra's chief executive warned the Energy Department on Oct. 25, 2010, that he intended to announce worker layoffs Oct. 28. He said he was spurred by numerous calls from reporters and potential investors about rumors the firm was in financial trouble and was planning to lay off workers and close one of its two plants.

But in an Oct. 30, 2010, e-mail, advisers to Solyndra's primary investor, Argonaut Equity, explain that the Energy Department had strongly urged the company to put off the layoff announcement until Nov. 3. The midterm elections were held Nov. 2....

"DOE continues to be cooperative and have indicated that they will fund the November draw on our loan (app. $40 million) but have not committed to December yet," a Solyndra investor adviser wrote Oct. 30. "They did push very hard for us to hold our announcement of the consolidation to employees and vendors to Nov. 3rd - oddly they didn't give a reason for that date."

Ha ha ha. Of course, he who pays the piper calls the tune, so Solyndra's management complied with DOE's request-which was intended, of course, to help the Democratic Party by preventing the Solyndra scandal from emerging in time to influence the election.

This is one more reason why crony capitalism is such a terrible idea. Business decisions will be made based not on economic considerations, but rather on political expediency. The result is bad for everyone-except, of course, for well-connected executives whose interests will be looked after by their political allies, and politicians who spin fables about "green energy" to fool voters. The Obama administration is less than three years old, but it is already building an impressive record of corruption.

 

This Week's Applied Hayek: NPR Slip-Up Edition

Well, it's happened again: NPR slipped up and ran a mostly positive story on Hayek, today on Morning Sedition Edition.

Yes, I was in my car again, driving to the Columbus airport after last night's Ashland University political economy class, where our reading for the week was chapter 19 of The Constitution of Liberty, entitled "Social Security," though the chapter applies to Obamacare-and the general fiscal outlook brought about by runaway entitlements-perfectly.

Don't assume that Hayek necessarily rules out an individual mandate.  In fact, try out this passage:

There is little doubt that the growth of health insurance is a desirable development.  And perhaps there is also a case for making it compulsory since many who could thus provide for themselves might otherwise become a public charge.

Yikes!  That's the exact logic of the Obamacare individual mandate.  But Hayek quickly corrects this deviation:

But there are strong arguments against a single scheme of state insurance; and there seems to be an overwhelming case against a free health service for all.  From what we have seen of such schemes, it is probable that their inexpediency will become evident in the countries that have adopted them, although political circumstances make it unlikely that they can ever be abandoned, now that they have been adopted. . .

Hayek returns to this theme on a broader canvas at the end of the chapter (remember: this chapter was written before Medicare and Medicaid were enacted):

It is much more difficult to see how it will ever be possible to abandon a system of provision for the aged under which each generation, by paying for the needs of the preceding one, acquires a similar claim to support by the next.    It would almost seem as if such a system, once introduced, would have to be continued in perpetuity or allowed to collapse entirely.  The introduction of such a system therefore puts a strait jacket on evolution and places on society a steadily growing burden from which is will in all probability again and again attempt to extricate itself by inflation.  Neither this outlet, however, nor a deliberate default on the obligation already incurred can provide the basis for a decent society.  Before we can hope to solve these problems sensibly, democracy will have to learn that it must pay for its own follies and that it cannot draw unlimited checks on the future to solve its present problems.

It has been well said that, while we used to suffer from social evils, we now suffer from the remedies for them.  The difference is that, while in former times the social evils were gradually disappearing with the growth of wealth, the remedies we have introduced are beginning to threaten the continuance of that growth of wealth on which all future improvement depends.

These last passages could have been written with the present Euro crisis, and America's entitlement funding crisis, in mind.  The late economist Herbert Stein famously said, something that can't go on forever, won't.  My AEI colleague Alex Pollock (author of a fine short book on this whole matter, Boom & Bust) offers his own close corollary: Loans that can't be paid back, won't.  (See: Greece.)  To which I offer the Hayward Welfare State Codicil: Entitlement promises that can't be kept, won't.

 

Adios, Occupiers

Occupiers have been cleared from a number of parks and public spaces over the past few days, most recently in New York, where, early this morning, the NYPD cleared out the Occupiers, arresting 200 in the process, so that Zuccotti Park could be cleaned. (The New York Post, which shares our view of the Occupiers, headlines "NYPD raiders roust OWS rabble.") The battle, however, is not over in New York, where the Occupiers apparently have obtained a court order from a friendly judge, allowing them to return to the park with their tents. Naturally, the Occupiers are represented by the National Lawyers' Guild, a long-time Communist front.

Here is a lovely sight-Zuccotti Park, emptied of Occupiers, cleaned and, one hopes, sanitized:

Here in Minneapolis, something similar is happening. Our Occupiers have been camping out on the plaza adjacent to the Hennepin County Government Center. Last week, the Hennepin County Board ordered that, while the Occupiers and all others are free to protest on the plaza, they will no longer be allowed to stay there overnight. Some of the Occupiers have said that they will defy this order, and a few slept on the plaza last night. As I was leaving my office around 6:30 yesterday, I heard a group of Occupiers marching through the streets of downtown Minneapolis, chanting and banging on drums-making a good impression on local voters, no doubt:

Personally, I hope that the Occupiers in New York, Minneapolis and elsewhere stick to their guns. The longer their crime wave continues and the more the public learns about them, the better for the conservative movement. I had lunch yesterday with a group that included the Hennepin County Sheriff. Among other things, he talked about the Occupiers. He said they have been trying hard to get themselves arrested, but his office is highly professional and has avoided giving the protesters their wish.

That's a good thing, in my view. I want a handful of Occupiers to still be on hand the first time the thermometer dips to twenty degrees below zero, so that, rather than getting themselves on the evening news by goading the authorities into arresting them, they will slink quietly away to avoid frostbite.

UPDATE: A New York judge has now upheld the City and has ruled that the Occupiers can't live in the park. It will be interesting to see whether protesters will try to defy that order so as to provoke further confrontations.

 

Reading the Tea (Party) Leaves at the Supreme Court

Between now and whenever the Supreme Court issues its decision on Obamacare (I predict the last day of the term in late June next year), there will be endless reading of the tea leaves, textual analyses of the briefs, the dynamic of the oral argument, and so forth. (Will the Court limit the number of amicus briefs it will take on this case?  America's forests ought to be very worried if they don't, given the amount of paper that may be consumed in amicus briefs on this.)  So I may as well offer my two cents.

There are a couple of big tests coming.  One is whether it is really true that, as the old saying goes, the Supreme Court follows the election returns.  That's one interpretation of the infamous "switch in time that saved nine" in 1937, at the time of FDR's (successful) court-paking scheme.  ("Wait!," I can hear you asking; "Did Hayward just say successful court-packing scheme?"  Yes I did.  I'll explain that some other time.)  If there is any truth to this axiom, then you'd think the Court will take note of the Tea Party and the 2010 election returns somewhere in the back of their mind.

The second big question will be the Court's willingness to overrule some old precedents like the Wickard case I mentioned here briefly the other day.  A very sage and wizened friend wrote me to say:

God knows, I ain't no prophet, but after reading Silberman's opinion, I don't see how we win unless Wickard is overruled or substantially modified.  There's nothing in Larry's opinion that Nino hasn't already subscribed to in various opinions.  So, even assuming Kennedy, Roberts, and Alito do the right thing (which is a big assumption), where the hell is our fifth vote?  Clarence, bless him, is the only one we can count on.

I can't quarrel with the reasoning here, except that, as noted yesterday, this is no ordinary case-not with 5 ½ hours of argument allotted for it.  If ever the Court was going to revisit "long settled" precedents, this will be it.  In this regard, The Hill has an interesting story this morning about Democratic anxiety over the case, based partly on their enduring outrage that Citizens United overruled several key precedents nearly as old as Wickard:

The pessimism is fueled in part by the John Roberts court's decision in the 2010 Citizens United case on corporate spending in elections, which [Democratic Sen. Sherrod] Brown has called the "worst" in his memory.

Don't forget that the Court's opinion in Citizens United wasn't by Roberts, but came from the key swing justice, Anthony Kennedy.  And here's excerpts from the relevant passage where Kennedy discusses overturning several key precedents:

Our precedent is to be respected unless the most convincing of reasons demonstrates that adherence to it puts us on a course that is sure error. "Beyond workability, the relevant factors in deciding whether to adhere to the principle of stare decisis include the antiquity of the precedent, the reliance interests at stake, and of course whether the decision was well reasoned We have also examined whether "experience has pointed up the precedent's shortcomings." Pearson v. Callahan, (2009).

These considerations counsel in favor of rejecting Austin, which itself contravened this Court's earlier precedents in Buckley and Bellotti . . .  "[S]tare decisis is a principle of policy and not a mechanical formula of adherence to the latest decision." Helvering v. Hallock, (1940).

For the reasons above, it must be concluded that Austin was not well reasoned. The Government defends Austin, relying almost entirely on "the quid pro quo interest, the corruption interest or the shareholder interest," and not Austin's expressed antidistortion rationale.  When neither party defends the reasoning of a precedent, the principle of adhering to that precedent through stare decisis is diminished. Austin abandoned First Amendment principles, furthermore, by relying on language in some of our precedents that traces back to the Automobile Workers Court's flawed historical account of campaign finance laws, see Brief for Campaign Finance Scholars as Amici Curiae; Hayward, 45 Harv. J. Legis. 421. . .

[And] Austin is undermined by experience since its announcement. . .

Translation into plain English: We might be willing to overrule old precedents if we believe they were poorly reasoned, and if subsequent experience shows the precedent to be stupid.  If ever there was a poorly reasoned opinion contravened by subsequent experience, it is Wickard.  And don't overlook that key quotation from Kennedy: "[S]tare decisis is a principle of policy and not a mechanical formula of adherence to the latest decision," along with Kennedy's original line that precedent can be rejected when "adherence puts us on a course that is sure error."  If ever there was a law that puts us on the course of "sure error," it is the individual mandate of Obamacare.  This all suggests an openness to revisiting a precedent on Kennedy's part.  And as in so many cases, if Kennedy goes there, it's a 5-4 win.  (And yes, the amicus brief Kennedy cites that demolished the Auto Workers precedent was from my spouse.  I'm hinting she should write another brief for this case

 

Tuesday Energy Notes

John has already noted here Obama's relentless lamosity over the Keystone pipeline, but you shouldn't miss Vaclav Smil's rant about it, "Obama's Indefensible Pipeline Punt."  Smil is one of the three or four best writers on energy questions, with several notable books deserving a place on your energy shelf.  (My favorite is Energy at the Crossroads, but his shorter book for my peeps at AEI, Energy Myths and Realities, is shorter and pithier.)

Meanwhile, in the interest of diversity of opinion on Power Line, my pals Ted Nordhaus and Michael Shellenberger at the Breakthrough Institute lodge a dissent on the Steven Mufson Washington Post article on government energy policy failure I referenced here yesterday.  I don't agree with some points of their post, but a few of their observations are worth contemplating, and the last paragraph excerpted here is mostly right:

What gets left out (and forgotten) is that virtually every one of today's major energy technologies exists thanks to sustained US government investments in research, development, and demonstration. Consider:

To be sure, US investments in energy must be reformed. We should stop bluntly subsidizing the deployment of more of the same energy technologies - whether current-generation wind, solar, biofuels, or nuclear - and retool energy incentives to demand steady and continual innovation and cost improvements.

This week, the UK debated whether to remove The Holocaust from its school curriculum because it 'offends' the Muslim population which claims it never occurred. It is not removed as yet.. However, this is a frightening portent of the fear that is gripping the world and how easily each country is giving into it.

It is now more than 60 years after the Second World War in Europe ended. This comment is being posted as a memorial page, in memory of the 6 million Jews, 20 million Russians, 10 million Christians, and 1,900 Catholic priests Who were murdered, raped, burned, starved, beat, experimented on and humiliated.

Now, more than ever, with Iran , among others, claiming the Holocaust to be 'a myth,' it is imperative to make sure the world never forgets.

National Right To Work Legal Defense 

I can't say I'm surprised.

Newly released documents demonstrate -- once again -- the blatant pro-Big Labor bias of President Barack Obama's appointees at the National Labor Relations Board (NLRB).

The Obama administration lawyer responsible for the outrageous complaint against Boeing that could destroy thousands of jobs in Right to Work South Carolina joked in an internal email about taking a job with Airbus, the plane manufacturer heavily subsidized by European governments.

What NLRB Acting General Counsel Lafe Solomon said next is even more telling.

"We screwed up the [American] economy and now we can tackle [E]urope."

Looking at the nightly news, I don't think the Big Governments of Europe need Lafe Solomon's help to wreck the economy.

While Solomon may claim to be joking, the impact of the Boeing case could indeed be disastrous for the economy.

As you may recall, Solomon is scheming to force thousands of Boeing Company jobs from South Carolina to Washington State, where International Association of Machinists (IAM) union bosses can force workers to pay dues or "fees" as a condition of employment.

The goal is clear: paralyze the decision-making of job providers like Boeing as they consider where to expand their businesses and create new jobs -- unless they are willing to cave in to pressure from union bosses and federal bureaucrats.

If the NLRB rubber stamps this despicable union-boss greed, job providers across the country could be forced to get approval from union bosses before they expand their businesses.

It's a blatant attack on the rights of workers and businesses alike.

And as the economy continues to struggle, it's the last thing we need.

Thanks to the generosity of Foundation supporters, after Solomon filed the complaint we immediately launched an aggressive media blitz in South Carolina offering free legal aid to Boeing employees.

Our extensive outreach paid off, and three Boeing workers contacted the Foundation for free legal aid.

Dennis Murray, one of the Boeing employees, told local news reporters that the Obama Labor Board is "forgetting the little people...they're forgetting the people trying to make a living and feed their families."

But Solomon didn't just forget about the workers -- he actively opposed their intervention in the case.

And now we learn that Solomon has been cracking jokes about the impact of his decision to do Big Labor's bidding at the expense of American workers and the economy.

"If I lose my job, my family will be devastated," Murray explained.

The newly released documents only confirm what I already knew -- I'm proud to stand with these courageous Boeing employees fighting back against outrageous bullying from union bosses and an out-of-control Obama Labor Board.

I must admit it is amazing how much the above OWS poster which I actually downloaded off the OWS site looks like Soviet Propaganda, even down to the class warfare message. The artwork on this poster is a bit clunky (My guess is that it is hard to create good artwork in a tent that is being hosed down by the NYC sanitation department) but it has the look and feel of Communist artwork. Way to go OWS.

There is an age-old adage: if you're going to do something, do it right - or don't do it at all.

Based on poll results exclusively obtained first by Freindly Fire, nowhere is that more applicable than in the fight for school vouchers in Pennsylvania. According to the Pulse Opinion Research poll conducted on behalf of UNITE PA, which surveyed 500 likely voters across the state, the majority of Pennsylvanians prefer that any school choice program be open to all students (or at least most of the middle class), as opposed to just low income, predominantly inner city students. This result is not surprising on any level, and, undeniably, leads to five rock solid conclusions:

1) The middle class realizes that ALL schools need improvement, and competition through choice is the best way to achieve that objective;

2) Pennsylvanians, by a whopping 78 to 9 margin, favor a broad-based choice program;

3) If a comprehensive choice program isn't offered, citizens would prefer an expansion of the EITC educational tax credit --- by a 3 to 1 ratio;

4) The reason voucher legislation failed in the Spring, and in all likelihood won't pass now, isn't due to opposition to school choice, but because the senate refuses to consider a broader, more inclusive bill, and therefore:

Senator David Vitter to Eric Holder: You can't cherry pick election laws.

Senator David Vitter has fired off a letter to Attorney General Eric Holder criticizing his lawsuit against Louisiana under Section 7 of the National Voter Registration Act.  The Justice Department is aggressively (more on how aggressively later) enforcing Section 7, but refusing thus far to enforce Section 8 of the same law which requires states to remove dead and ineligible voters.  There are some rumors this three year old slumber may soon end, but it hasn't yet.  I will be in Tulane tomorrow to discuss Senator Vitter's demand of Eric Holder as well as the Section 7 case against the Bobby Jindal administration.  Senator Vitter's Press Release:

 

Vitter: DOJ Can't Just Pick and Choose Which Voter Registration Laws to Enforce


(Washington, D.C.) - U.S. Sen. David Vitter today called on the U.S. Department of Justice to be consistent in their efforts to enforce the National Voter Registration Act. In a letter to Attorney General Eric Holder, Vitter highlights that DOJ has recently filed a lawsuit against Louisiana alleging the state has not complied with Section 7 of NVRA, yet has done nothing to enforce Section 8 in other states.  


Section 7 of NVRA requires certain government offices, such as those who provide welfare assistance, to provide voter registration forms. Section 8 requires states to conduct voter roll cleaning to purge ineligible felons, illegal aliens and deceased voters from corrupting the election process. The two provisions act together as counterparts.


"If the Department of Justice is going to come down to Louisiana with undercover investigators to check on one section of voter registration law - the other sections better get enforced too," Vitter said. "They can't just pick and choose which sections to enforce, but unfortunately that's preciously what they're doing. They're allowing some states to keep felons, illegal aliens and dead people on their voter rolls, which is a clear violation of the law."

Grassfire

Any day now, the House will be voting on a balanced budget amendment in an effort to force Congress to abide by a defined budget. The move isn't sitting well with many House Democrats.

According to The Hill, House Budget Committee ranking member Chris Van Hollen (D-Md.) urged House Democrats to oppose the vote, suggesting, "This Constitutional amendment ... would weaken Congress's ability to govern, and would open the door to courts intervening in federal budget decisions."

Apparently, Mr. Van Hollen doesn't understand or appreciate the concept of a Constitutional Budget Amendment. Instead, he sounds more like a college frat boy who has just learned that his limitless credit card is being taken away by his parents.

The Goodlatte Balanced Budget Amendment would prohibit Congress from spending more than it takes in unless approved by 3/5 of Congress; and would require the President to submit an annual balanced budget to Congress.

The amendment is nearly identical to the one that fell short of passing by one vote in the Senate in 1995.

Early in the predawn hours of Tuesday morning NYPD police moved in on protesters camping out at Zuccotti Park and told them to pack up and get out. Sandusky's tragic interview with Bob Costas

Judge Elena Kagan won't recuse

 

Even though emails have now surfaced that reveal Judge Elena Kagan is extremely biased when it comes to anything related to the Health Care Law, there's no indication that she will recuse herself from any future rulings on the controversial law.
