This week's meetings Hi team, Tomorrow, Tuesday Nov 15 is our working session at the Rock from 7:30 to about 9pm. Please come with a plan for some charity work we can do, and your ideas or writings for "Why the Snake?". (What is "Why the Snake?"? See below if interested.) Thursday, Nov 17 will be our monthly meeting, rescheduled from last Thursday. It's at the Rock, from 7-9pm. This replaces our Movie Night, the next one being Thursday Jan 19. "Why the Snake?" is a proposed PR campaign for the Tea Party. Bill started it off with an excellent presentation of the history and meaning of the Gadsden Flag at our last meeting (see our website for it). Through a "viral" marketing campaign, we need to drive people to a website explaining who we are and why we're here. A member brought to our attention a poll he saw where Occupy has a 43% approval rating, and Tea Party has a 29% approval rating. This is not to say they are our "adversaries"; this big govt is our "adversary". But it's frightening that a vague message, violence, and all these rude "mic check" infiltrations while people are speaking, are more popular than fiscal responsibility, Constitutionally limited govt, and free trade. -Jim for Tim and Pam

Introduction
The U.S. Senate Education Committee has decided to reauthorize the Elementary and Secondary Education Act of 1965 (ESEA). This massive federal education bill was last reauthorized in 2001 as the No Child Left Behind Act (NCLB).
HSLDA's federal relations staff have read this 868-page bill, and we believe that while it does not directly impact homeschool freedom, the bill will 1) increase the federal role in education at the expense of state, local, and parental control, and 2) will greatly increase the pressure on states to align their curriculum and standards, resulting in de facto national education standards.
Urgent Calls Needed to Senate Education Committee
The Senate Education Committee has already voted this ESEA bill out of committee, but at the urging of Senator Rand Paul (KY) the committee will hold a hearing on the bill Tuesday, November 8. If either of your senators are on the Education Committee, HSLDA urges you to call with the following message:
"I am concerned that the ESEA reauthorization bill scheduled for a committee hearing next Tuesday will greatly increase the federal government's control over education. As a homeschooler, I understand that parents-not federal education officials-are best suited to make educational choices for their children. Please oppose attempts to increase national control over education."

Background
In 2001, Congress passed NCLB. While HSLDA was neutral on this bill because it included strongly written protections for homeschoolers, and prohibitions on federal funding for national teacher certification, national standards, national testing, and national databases, NCLB also greatly increased the federal government's role in education.
A decade later, nearly all education policy makers agree that NCLB is too inflexible. HSLDA believes this illustrates that the federal government should not be in the business of establishing education policy for the nation's schoolchildren.
This past month, the U.S. Senate has been working on reauthorizing NCLB. HSLDA is concerned the Senate's bill continues the failed "Washington-knows-best, one-size-fits-all" approach that was widely criticized in NCLB. In addition, one provision in the Senate's bill mandates that any state taking federal funds must put in place "College and Career Ready Aligned Standards." Mandating that each state have aligned standards with aligned coursework will guarantee the creation of national academic standards, national curriculum, and national testing. We believe this will result in the eventual requirement that homeschoolers use these national standards, curriculum, and testing.

It is still unclear at this point whether homeschool protections will stay in the Senate's education bill, but even if they do, the trend of national standards could lead to homeschoolers losing the freedom to choose the curriculum for their children. For these reasons, HSLDA is urging opposition to the Senate's ESEA reauthorization legislation.

Attendees are encouraged to come to this morning-long seminar to learn more about the Roots of American Constitutionalism; the Fight over Ratification; the still-relevant Hamilton-Jefferson Debate; and the Progressive Critique of the U.S. Constitution. There will also be plenty of time for a vigorous question and answer session, as well as opportunity for networking with other citizens who care about the future of America's Constitutional Republic. What a perfect setting for considering the vital institutions and principles that American Patriots have struggled and died to preserve for over two hundred years of American history. Dr. Richard Brake is the Director of Education at the Intercollegiate Studies Institute (ISI), a non-profit educational foundation with a mission to "Educate for Liberty"-by inspiring college students to discover and embrace the principles that make America prosperous, moral, and free. As part of his duties, Dr. Brake directs the Institute's Civic Literacy Program, which has documented the failure of America's top universities to teach their students the founding history, texts, and institutions of our constitutional republic. Dr. Brake earned a B.A. in History from Georgetown University; an M.A. in Government from the University of Virginia; and a Ph.D. in Political Science from Temple University. Prior to joining ISI, Dr. Brake taught American Politics and Constitutional Law at Temple University in Pennsylvania and the Richard Stockton College in New Jersey. Earlier in his career, Dr. Brake worked as a legislative assistant in both the Pennsylvania and U.S. Houses of Representatives, and in 2006 he retired at the rank of Captain after serving ten years as an Ordnance Officer in the Pennsylvania Army National Guard.

This legislation protects the individual constitutional rights of the people of Pennsylvania from the incursion of foreign laws, in cases in which the application of a foreign law or foreign legal doctrine would violate someone's constitutional rights. Paul Finkelman is the President William McKinley Distinguished Professor of Law and Public Policy, and Senior Fellow in the Government Law Center at Albany Law School. His lecture will explore the relationship of slavery to the American founding, and will examine how slavery was written into the original Constitution, and protected by it.
Thursday, December 8th at 7:30PM: George W. Boudreau, "'A Republic, If You Can Keep It': Benjamin Franklin and the Crafting of the Constitution." The series closes with a talk by an audience favorite, George W. Boudreau, Associate Professor of Humanities and History at the University of Pennsylvania, Harrisburg. Professor Boudreau is Project Director of the "Teaching Franklin" website (http://harrisburg.psu.edu/teachingfranklin/). His lecture will explore Franklin's role in the creation of the Constitution. 1. While You Were Distracted
While we've all been distracted by the Presidential race, there is other news out there that may give you heart burn. Way back when during a forgotten age, conservatives were treated to this:
The Hill - 6/24/11 - Speaker John Boehner (R-Ohio) on Friday said President Obama "must lead" if the standoff over the debt limit is going to be resolved but warned that any package with tax increases "cannot pass the House."
ABC News - 6/23/11 - GOP Congressman - Tax Increases Can't Pass The House
The Washington Times - 6/24/11 - "There is not support in the House for a tax increase, and I don't believe now is the time to raise taxes in light of our current economic situation," said Cantor (R-Va.).
The Washington Times - 6/24/11 -Speaker of the House John Boehner added today, "The president and his party may want a debt limit increase that includes tax hikes, but such a proposal cannot pass the House."
And now?
Politico - 11/13/11 - Rep. Jeb Hensarling "we believe that frankly increasing tax revenues could hurt the economy, but within the context of bipartisan negotiations with Democrats, clearly they are a reality," he said Sunday on CNN's "State of the Union."
2. Republican Chaos Chaos: Mathematically, we see it when small changes to the inputs of a function produce large, wild changes to the outputs. I believe we're seeing that now in the GOP primary race, as a weakened Herman Cain and a strengthened Newt Gingrich, combined with a steady Mitt Romney and a resilient Rick Perry, turn it into a four cornered brawl. Two new polls from late last week: First, ORC International for CNN polled 480 Republicans and Independent leaning Republican RVs, mobile and landlines, MoE 4.5. Ending the same day was The Tarrance Group and Lake Research Partners for Politico/George Washington polled 1,036 likely voters for an MoE of 3.1. Both polls hit mobiles and landlines. A third poll has come out that ended over the weekend, later than those two in fact. PPP polled 576 primary voters, MoE 4.1. The poll was automated, which I believe means legally mobiles were excluded. 3. Objectivity Lost: Journalist Covering Shale Gas Sues Same Industry I don't read the New York Times or the Chicago Tribune. For that matter, I don't read the closest newspaper to my home, the Charlotte Observer. I don't read these rags for a simple reason: I find the that the objectivity that is claimed within their pages is a sham. There are plenty of polls and countless bits of anecdotal evidence and investigations that have shown a liberal bias that overwhelmingly represents the modern newspaper. I basically stick to three kinds of news: partisan news, where I can at least trust that the person speaking is fully aware of and honest about their personal bias; breaking news, which is the kind of news that often hasn't figured out how to address the narrative that they are eventually going to apply to it; and finally, word of mouth. Word of mouth isn't a luxury that every person has, but I know enough people and have enough contacts that I'm often able to find out what's going on by simply talking to people I trust. Within the ever shrinking world of the newspapers I ignore is the paper of record for Denton, Texas: The Denton Record-Chronicle. Within the pages of this old world media artifact is a journalist named Peggy Heinkel-Wolfe. Peggy is the designated reporter on the Shale Gas industry which is a very important issue in the state of Texas. She also happens to be suing that industry for building a gas processing plant near her home. 4. The Implosion of Herman Cain Anyone who saw the debate on Saturday night and observed Herman Cain's performance clearly saw a man who was terrified of the questions he was being asked and was hoping to be noticed as little as possible. Apparently, there was a good reason for that. Herman Cain apparently sat down with the Milwaukee Journal-Sentinel editorial board to talk foreign policy and, well... this happened. 5. Jon Huntsman's Poor Messaging I'm a bit shocked by this excellent Coffee & Markets interview with Ambassador Jon Huntsman. Believe it or not, outside of his crummy campaign messaging ("I believe in science") and the debates, this is a guy who actually sounds conservative. I have to wonder if there are two Jon Huntsmans out there - the conservative and the liberal going to different events. If nothing else, he certainly sounds to the right of Mitt Romney on a number of core issues, including healthcare and the environment. Yes, I know! The same Jon Huntsman who did the pact with Ahnuld on global warming sounds to the right of Romney. This begs a serious question - is his campaign message just that far off kilter? Because in this interview, away from sound bites and debate one liners, this guy sounds reasonably conservative. That raises another question worth asking. Is it just Rick Perry who is having disastrous debate performances? They are killing Jon Huntsman with the base. His snotty one liners and bad jokes just rub conservatives (me included) wrong. But listen to this interview and you've got a small government, free market guy. Where's the disconnect? Someone might want to ask John Weaver. 6. The IRS as Tax Preparers? When conservatives and liberals advocate tax reform they are referring to radically divergent concepts. Conservatives desire a low, flat, and universal tax code, while liberals desire reform that would result in increased revenues. The obvious way to achieve that goal is to impose radical redistributive tax increases, such as the ones Obama has recently proposed. However, there is a more subtle way that is beginning to percolate into the liberal mainstream. Liberals envision a future in which the IRS would automatically pre-file your tax returns for free, sending you the bill. 7. Unionized Clerical Workers Fight UAW Greed... The Dangers of Legitimizing Muslim Grievances
There is no surer path to Muslim violence than through the legitimization of Muslim grievance. And once you accept the legitimacy of the grievance, then you are also bound to accept the legitimacy of the violence that follows. Violence begins with grievance. Grievance is the pretext for violence and the narrative for the violence. Liberals make a fetish of separating the grievance from the violence, emphasizing constructive means of resolving the grievance. But what do you do when the grievance and the violence are inseparable? Grievance is the stories that Muslims tell themselves to justify their violence. To explain why they kill children and why they murder the innocent. The list of grievances is an endless as the violence. Every act of violence carries its own narrative. The endless Muslim conflicts throughout the world all carry their burden of history. But it isn't a history that can be resolved with a tolerance session.

Bill Nelson, who's running for re-election, has rejected a contribution from a man associated with the Council on American-Islamic Relations, a Muslim group that has been accused in the past of links to radical organizations. The donor, Ahmed Bedier, is the former Tampa director of the organization, which says it rejects terrorism and violence and denies any charges of having links to or supporting terrorist organizations. According to a campaign spokesman, Bedier attended a Nelson fundraiser held last month by Manal Fakhoury, a prominent Ocala pharmacist, at her home. "Fakhoury sent out the invitation and decided whom to invite," according to a statement from the campaign. Attendees included "a city council member, a local law enforcement official and a number of area business and civic leaders." "Sen. Nelson does not know Mr. Bedier, who made a relatively small contribution of $500." The campaign returned Bedier's check because it "learned of some highly controversial statements Bedier made about Israel" which disagree with Nelson's views, the statement said. CAIR publicizes and opposes incidents of hostility or discrimination against American Muslims, and says it is an organization devoted to furthering religious tolerance, diversity and civil rights. However, federal investigators have said the organization at one time had ties to an organization created to support Hamas, which the federal government considers a terrorist group.

Employer health insurance hit new low: Gallup
You think it's expensive now? Just wait till it's free
The percentage of Americans who have health insurance through their employer slipped to a new low of 44.5 percent in the third quarter, a drop of over 5 percentage points in three years, according to a poll released on Friday.
Pollsters at Gallup and Healthways Inc., who surveyed more than 90,000 U.S. adults, blamed the decline on high unemployment, under-employment and an increased number of employers who do not offer health insurance to their workers.

Two police officers were attacked with sharp objects by protestors in an Occupy San Francisco march this afternoon, police said.
Protestors were marching in the area of Embarcadero and Broadway around 3:30 p.m. today when the attacks occurred, according to police. Officers accompanying the march were attempting to prevent demonstrators from taking over the middle of the intersection, where Muni light rail lines are located.

Over the last several months, radical environmentalists along with Hollywood celebrity activists descended on the White House in protest, urging President Barack Obama to block the construction of the $7 billion pipeline that would bring in more than 700,000 barrels of oil per day from Alberta, Canada, to the Texas Gulf coast. Last week, they got their wish.
The Obama Administration on Thursday announced that it would delay a decision on the pipeline until after the 2012 election. In siding with his leftist environmentalist, big Hollywood base, President Obama's ambition is nakedly apparent, as is his total disregard for the 14 million unemployed Americans sitting on the sidelines, waiting for Washington to get out of the way so they can get back to work. And it also shows that for him, politics is more important than achieving true energy independence for the United States.

McCaughey: Supreme Court Will Strike Down Obama's Healthcare Law

The Supreme Court's decision to consider whether President Barack Obama's signature healthcare law is constitutional is good for a nation that has been in legal limbo for months on the issue, says healthcare expert Betsy McCaughey.
The former New York lieutenant governor predicted a split court, with a 5-4 majority in favor of striking down the law's requirement for nearly everyone to take out health insurance.
The decision probably will rest on whether the court accepts a ruling from the Atlanta-based 11th Circuit Court of Appeals that around half the nation does not use any healthcare.
"The Obama administration lawyers have said mandatory insurance is necessary for free riders - the people who go to the hospital and do not pay for it," McCaughey in an exclusive interview with Newsmax. "They argued again and again that the need for healthcare is universal and inevitable, that everyone is involved in healthcare commerce and this law regulates how they pay for it.

Bauer COUNTDOWN TO VICTORY: 358 DAYS TO THE 2012 ELECTIONS ObamaCare To The Supreme Court The Supreme Court announced this morning that ObamaCare will be on the docket this term. Arguments will be heard in March and a decision is expected in late June. It's not at all clear how the ruling will impact the 2012 elections. Some speculate that a ruling against ObamaCare could fire up Obama's left-wing socialist base. Alternatively, a ruling in favor of ObamaCare could energize conservatives to fight even harder to defeat Obama and take back the Senate so the law can be repealed. Here are two things I know for sure. First, Justice Elena Kagan should recuse herself from the case. Before her appointment to the Supreme Court, she was Solicitor General of the United States -- the government's top attorney before the Supreme Court. The idea that she had no involvement in formulating a legal defense of ObamaCare in its early stages is laughable. House Republicans have been pushing the White House and the Justice Department for months to release all relevant records on Kagan's involvement, but the Obama Administration is stonewalling. Second, it will be tragic if there is a majority on the Supreme Court that believes the government has the authority to compel citizens to purchase products. If the government has that much power, then "we the people" have lost too much of our liberty. Has OWS Worn Out Its Welcome? After assaults, thefts, rapes, riots, outbreaks of disease, drug overdoses and deaths -- none of which occurred at Tea Party rallies -- it appears as though the Occupy Wall Street movement has finally worn out its welcome. In major cities across the country, police forces are sweeping out OWS camps, cracking down on illegal activity and dismantling tents and other makeshift structures. Philadelphia Mayor Michael Nutter called a press conference yesterday out of concern for the "rapidly deteriorating conditions" at Occupy Philly. Mayor Nutter said that the group was fractured with internal divisions and that the people in the group had changed. He also said "public urination and defecation remain a significant health threat." Police in Oakland, California, raided the Occupy Oakland camp this morning. According to Mayor Jean Quan, "The encampment became a place where we had repeated violence and, this week, a murder. We had to bring the camp to an end before more people were hurt." While we can applaud the belated return of law and order to many of America's major cities, I doubt we have heard the last of the OWS movement. Barack Obama and many Democrat are emotionally invested in OWS. They had hoped it would be their ticket to power in 2012. OWS may hibernate over the winter months, but I suspect it will come back next year and under new management, taking its orders from Obama's reelection headquarters in Chicago. Obama Sends Canadian Oil To China The radical environmental movement scored a major victory last week. American consumers and workers lost out. Under pressure from no-growth green extremists, the Obama Administration announced that it would conduct yet another review of the Keystone XL pipeline that would transport Canadian oil to Gulf coast refineries. This announcement is expected to delay a final decision on the pipeline until 2013 -- after Obama's reelection campaign. But it could be a moot point by then. Yesterday, Canadian Prime Minister Stephen Harper said the delay had produced "extremely negative reactions" in his country. In response to American reticence to accept Canada's oil, Harper said, "This does underscore the necessity of Canada making sure that we are able to access Asian markets for our energy products. I indicated that yesterday to [Chinese] President Hu Jintao." In other words, because of Obama's pandering to the radical left, the Keystone pipeline may well go west now, instead of south to the U.S. From there the oil can be put on tankers and sent to China, rather than be used here to reduce our dependence on imported oil from an increasingly unstable Middle East. The national security and economic implications of this decision are astounding. And the left's environmental argument against the tar sands oil is nonsense. Does global warming only occur in America? Of course not! The oil will be used and the Chinese desperately want it. By caving into the radical environmentalists, Obama is practically handing it to the Chinese. It was estimated that the pipeline project would have created 20,000 jobs and generated billions of dollars of revenue. In response to last week's announcement, Terry O'Sullivan, president of the Laborers' International Union of North America, issued a statement condemning the administration. Here is an excerpt:
"Environmentalists formed a circle around the White House and within days the Obama Administration chose to inflict a potentially fatal delay to a project that is not just a pipeline, but is a lifeline for thousands of desperate working men and women. The Administration chose to support environmentalists over jobs -- job-killers win, American workers lose."
Remember that the next time Obama says "we can't wait" to create jobs in America. Obama is so hostile to the energy industry, and so beholden to the radical left, he's willing to wait at least another year and risk losing these jobs altogether. Another Obama Scandal First it was Fast and Furious. Then there was Solyndra. Now get ready for the Smallpox scandal. Today's Los Angeles Times reports that the Obama Administration aggressively pushed through a no-bid $440 million contract to produce 1.7 million doses of smallpox vaccine. The Times notes that smallpox was eradicated in 1978 and the U.S. already has "$1 billion worth of smallpox vaccine" at $3.00 a dose. But the drug to be produced under Obama's no-bid contract costs $255 a dose, and "cannot be tested for effectiveness in people because of ethical constraints -- and no one knows whether animal testing could prove it would work in humans." So why was it approved? Surprise, surprise -- the company that won the bid is controlled by billionaire Ronald Perelman, a major Democrat Party donor. Cronyism and corruption could be a major campaign theme in 2012. A new book out by Peter Schweizer of the Hoover Institution shows that fully 80% of grants made by the Obama Administration for "green jobs" projects have gone to companies "run by or primarily owned by Obama financial backers." DeMint, Vitter & Sessions to Offer Bill to Stop Obama Administration from Suing States Over Enforcement of Immigration Laws

Today, U.S. Senators Jim DeMint (R-South Carolina), David Vitter (R-Louisiana) and Jeff Sessions (R-Alabama) announced they will soon offer legislation to prohibit President Obama's administration, including the Department of Justice (DOJ) and other agencies, from participating in lawsuits against South Carolina, Alabama and Arizona over recently passed immigration laws.
Senator DeMint said, "It's absurd that the Obama Administration, which has failed to enforce the nation's immigration laws, is now stopping South Carolina, Alabama and Arizona from taking commonsense steps to protect citizens and uphold the law. President Obama has failed to build the southern border fence mandated by Congress. He's also failed to control the northern border, allowing the Border Patrol to stop conducting routine checks at bus stops and train stations for illegal immigrants who could be smugglers or terrorists. Herman Cain has spent his life living and working all over the country - Indiana, Georgia, Minnesota, Nebraska, Kansas, Washington, D.C. - but never in Chicago.
So it's curious that all the sexual harassment allegations against Cain emanate from Chicago: home of the Daley machine and Obama consigliere David Axelrod.
Suspicions had already fallen on Sheila O'Grady, who is close with David Axelrod and went straight from being former Chicago mayor Richard M. Daley's chief of staff to president of the Illinois Restaurant Association (IRA), as being the person who dug up Herman Cain's personnel records from the National Restaurant Association (NRA).
The Daley-controlled IRA works hand-in-glove with the NRA. And strangely enough, Cain's short, three-year tenure at the NRA is evidently the only period in his decades-long career during which he's alleged to have been a sexual predator.

Why has Herman Cain's campaign thus far survived a media-led sexual harassment assault which would have surely doomed Republican candidates with more money, more powerful friends and the party's blessing and support?
Certainly it isn't because this scandal-pimping subsidiary of the Democrat Party has a history of taking it easy on black conservatives. Clarence Thomas and Condi Rice will attest to that.
On October 25th, Cain had topped party favorite and Northeastern liberal Willard Romney by 4 percentage points in a CBS/New York Times poll. And 5 days later, by strange and timely coincidence, the liberal on-line hit service Politico had presented 2 females brought forward by anonymous sources, willing and eager to resurrect dozen year old sexual harassment claims against the newly crowned Republican front runner.

USCIS Memo Helps Implement Backdoor Amnesty
U.S. Citizenship and Immigration Services (USCIS) issued a policy memo on November 7 to assist Immigration and Customs Enforcement (ICE) in implementing the Obama Administration's backdoor amnesty program. This backdoor amnesty program began earlier this year when ICE announced through the Morton memos that it would selectively enforce immigration laws and Homeland Security Secretary Janet Napolitano announced she was establishing a new interagency working group dedicated to administratively closing pending and future deportation cases.

Senators Defend State Immigration Laws
Senators Jim DeMint (R-SC), Jeff Sessions (R-AL), and David Vitter (R-LA) introduced a bill Thursday that would prohibit federal funding for Department of Justice (DOJ) lawsuits seeking to invalidate state immigration enforcement laws. The bill provides that the federal government may not use taxpayer dollars to participate in any lawsuit seeking to overturn, enjoin, or otherwise invalidate existing state immigration enforcement laws. It then goes on to list the specific state laws the DOJ may not challenge, including: Oklahoma HB 1804; Missouri HB 390; Arizona SB 1070; Utah HB 497; Indiana SB 590 and HB 1402; Alabama HB 56; South Carolina S 20; and Georgia HB 87.

Senate Passes Bill Relaxing Requirements for Members of Military
On Thursday, the U.S. Senate passed via a voice vote H.R. 398, a bill sponsored by House Immigration Subcommittee Ranking Member Zoe Lofgren (D-CA). H.R. 398 would amend the Immigration and Nationality Act to ease rules under which aliens who marry members of the U.S. military may become legal permanent residents.
