Many of us went to the Restoring Honor event last year and we were deeply moved by the day's events. Being with others we know made this even more special. Although we are not going to travel to Israel, we are hoping that we can recreate that atmosphere here in Bucks County. We are still in the development stages of this event and would like to hear your suggestions on how to have it work out. The Pa legislature is going to have its first hearing ever on a Right to Work package of legislation (House Bills 50-53). It will be held on Tuesday, August 16 from 1-4 p.m. in room 205 of the Ryan Office Building. There is no doubt that the unions will be out in force to try to intimidate members of the Labor committee. If you can get out to the hearing that would be great, please let as many people know about it as possible so members know that the grassroots support Right to Work.

Tuesday night, the House of Representatives offered President Obama a deal he should not refuse. And yet, the president seems intent on doing just that.
For many months, President Obama and members of his administration have warned that failure to raise the debt limit will result in economic Armageddon. As we approach the president's Aug. 2 deadline, their warnings have grown increasingly dire and their tones increasingly shrill.
In May, President Obama warned the nation, "If investors around the world thought that the full faith and credit of the United States was not being backed up, if they thought that we might renege on our IOUs, it could unravel the entire financial system . . . We could have a worse recession than we already had, a worse financial crisis than we already had." Â Read more: |

1. It's All Too Odd
Consider that John Boehner and Harry Reid named their different legislation to raise the debt ceiling by the identical name.
Consider also that John Boehner and Harry Reid's legislation are virtually mirror images to each other - a fact that the rhetoric has obscured, but is in reality accurate.
Consider, in fact, that Boehner and Reid use the same language in various portions of their legislation.
Consider that John Boehner told Sean Hannity tax hikes could come out of his deficit commission despite earlier denials.
Consider also that in one of the key differing portions, John Boehner uses Mitch McConnell's gimmick of letting the President raise the debt ceiling on his own with merely a congressional vote of "disapproval" that the President can then veto. This is a gimmick embraced by Harry Reid.
Consider that John Boehner claimed actual cuts to the federal budget for 2012 would be just over $6 billion - that is for an entire year. The federal government spends $10 billion a day.
Consider that the Congressional Budget Office determined late last evening that the actual amount of cuts for 2012 would only be $1 billion for the whole year, or about 2.5 hours of federal government spending.
And then consider that the White House, after the Congressional Budget Office's determination, defended John Boehner on the White House website even after White House officials said they would recommend the President veto Boehner's plan - actually a different statement from the past. In the past, the White House said definitively that the President would veto the GOP's idea. Now, they are just saying it'll be recommended to the President.
Consider all these things and it seems the White House and Harry Reid are perfectly willing to let John Boehner pass his plan if he can get it out of the House. Their very hostility is designed to reassure Republicans. They'll sign it into law. Then they will blame the GOP when our credit rating is downgraded - something sure to happen with John Boehner's plan.
2. In Defense of Holding the Line
I'm getting beat to hell and back by conservatives for insisting the GOP hold the line on Cut, Cap, and Balance. Even here at RedState, I'm getting accused of "ideological intransigence." Yeah, here at RedState. There's a first time for everything.
People want a deal. People want John Boehner's deal. People are upset with me for not liking John Boehner's deal. People are telling me, "They only have one house, Erick. You can't expect them to not compromise. They control nothing."
I've said all along I expect a deal and a compromise. Here's the problem and I need you to understand this from perspective, whether you agree with me or not.
3. The Boehner Plan: Phony Cuts, Slimy Procedures, Dangerous Ignorance
The main problems with the Boehner proposal are:
- Most of the initial $1.2 trillion of discretionary cuts are (1) from defense, or (2) are phony, out-year, and easily avoided. The compensatory immediate $1 trillion increase in the debt limit is, on the other hand, very real.
- Even worse, however, the notion of giving a Reid/Pelosi/McConnell/Boehner-appointed commission the power to devise non-filibusterable, unamendable tax increases (or, for that matter, gun control, taxpayer-funded abortion, forced unionism, or federalized same-sex marriage) in the second tranche is devastating.
- And a guarantee of a losing vote on a balanced budget constitutional amendment doesn't get you anywhere.
4. Boehner Grounds into a Double Play
Late yesterday, the CBO reaffirmed all of our concerns with Speaker Boehner's Budget Control Act of 2011 - plus interest (pun intended).
We have asserted ad nauseam that any proposed budget plan that fails to countermand the current prodigal spending levels, including the modestly reduced spending levels of 2011, is not worth the paper it is printed on. The CBO estimates that Boehner's $1.2 trillion in discretionary spending cuts will only save us $850 billion over ten years. This means that Obama's credit card increase will be higher than the concurrent spending cuts, thus voiding the promise of the dollar-for-dollar agreement. Moreover, the CBO estimates that all the cuts will be backloaded, as the estimated savings for next year - the only enforceable year - will be a negligible $1 billion! It turns out that an extra $4 billion in mandatory spending for Pell Grants will ostensibly wipe out any savings from the paltry discretionary cuts.
5. The Speaker's Plan Is A Bad Bargain
Unlike several of my colleagues, I find there is a lot to like in the plan put forward yesterday by Speaker Boehner.
I like the idea of a smaller increase in the debt ceiling to give time and a sense of urgency to work out some very difficult problems that can't be solved in the short term.
I like the idea of this debate taking place again during the course of the 2012 election campaign as a way to put our candidates at all levels on the record in favor of fiscal sanity.
I like the idea of statutory caps on spending though, having lived through the era of the Gramm-Rudman-Hollings Deficit Reduction Act and the Concord Coalition, I'm not terribly sanguine about any statutory measure that doesn't involve federal marshals and congressmen spending time in jail for failure to comply. Just remember, there is statutory requirement that the Senate pass an annual budget.
What is unthinkable, in my view, is this bastardized "joint committee."
6. Get on the line to hold the line
You can go to http://www.redstate.com/action to bypass the congressional switchboard and get the direct dial to your Congressman.
Tell them to hold the line on Cut, Cap, and Balance.
A host of conservative organizations are coming out against Boehner's plan because, among other things, it only cuts $6 to $7 billion and punts major reform to a commission of 12 that will only need 7 votes to raise taxes.
Call your congressmen and senators and tell them to hold the freaking line.

Closing of Iconic Post Office Would Not Please Ben Franklin

The Ben Franklin post office in Philadelphia was informed Tuesday that it will likely be shut down, as the U.S. Postal Service attempts to reel in spending by closing thousands of locations across the country. The unassuming, three-story brick building, which pre-dates the Revolutionary War, would lose a post office but potentially gain a pharmacy, a grocery store or "other appropriate retailers," the Postal Service told MyFoxPhilly.com.

The House will vote Wednesday on the new "Boehner Plan" in the debt ceiling debate. Unless you want our national debt to reach $23.7 trillion over the next 10 years, I need you to call your Congressman right now to tell them to vote NO. And then you need to forward this email to all your friends and ask them to do the same thing. Call NOW>>
Why? The Boehner Plan barely cuts ($6 billion next year), doesn't cap, and doesn't balance.
In fact, over the next 10 years it leaves the United States with a national debt of $23.7 trillion instead of $24.9 trillion and then asks a "special committee" to come up with some more ideas for cuts. Seventeen special committees since 1982 have left us in the hole we're in today so we have no reason to think this one would be any different. We need real cuts now.
The big vote is this Wednesday, so this cannot be put off. Call now to oppose the Boehner Plan.
Speaker Boehner and House Republicans did the right thing last week when they passed the Cut, Cap, and Balance Act with a massive 234-190 bi-partisan majority. That was our compromise position. It gave the Democrats their coveted debt ceiling increase so long as they passed permanent change to how Washington spends our money in the form of a Balanced Budget Amendment.
Then the Democrat-controlled Senate refused to debate the bill. That's right, the "most deliberative body in the world" refused to debate a bill with bi-partisan support and, according to a CNN poll, the support of 66 percent of Americans. They know the Balanced Budget Amendment is wildly popular across party lines and that they would lose that fight.
Unfortunately, rather than hold the line and force President Obama or Harry Reid to put to paper their own legislation (which they have failed to do), Speaker Boehner has (again) put forward a plan.
But this plan will not do and the credit rating agencies agree. So far, the only plan that could protect our national AAA credit rating is Cut, Cap, and Balance.
Please call your Congressman right now and tell him you oppose the Boehner Plan, or any plan that leaves us $23.7 trillion in debt in 10 years. We need to head in the other direction-toward balance, and toward Washington only spending what it brings in.
The Cut, Cap, and Balance Act is the only existing legislation that gets us there.
Washington wants a deal; the American people want a solution. Cut, Cap, and Balance is the solution. Please call now.

SAVING MEDICARE
Since 1964, our nation's senior citizens have relied on Medicare to ensure access to healthcare. Now the program is going broke -- and it is going broke fast.
It began spending its reserves in 2008 when payouts exceeded dollars collected for the program. [cite]
Predictions for exhaustion of the reserve vary, with 2024 identified by the Social Security Administration in the Trustees 2011 report. [cite]
The Democrat response is to reduce the amount Medicare reimburses physicians for their services. [cite]
This will result in fewer participating physicians and the physicians continuing in the program seeing fewer Medicare patients.
Patients will wait longer and have fewer choices in seeing a doctor.
If this makes access to care sufficiently untenable, or if Medicare does not get on viable financial footing, it will be administered through ObamaCare[cite].
This would include cost controls by a 15-member board of bureaucrats deciding wich treatments, drugs, and surgeries patients can receive.
Rep. Paul Ryan (R-WI), Chairman of the House Committee on the Budget, has a plan which saves Medicare with no disruption to today's seniors and reasonable changes for future retirees.
The Ryan Plan is widely misunderstood and misrepresented. The future of our seniors' healthcare is too important to be decided on misinformation. Here are the facts about Medicare and the Ryan Plan.
The Ryan Plan in a Nutshell
Those currently retired and those close to retirement (55 and over) will see no change from the existing Medicare system. Existing physician reimbursement flaws will be corrected to encourage physicians to continue participating in the system.[cite]
On retirement, those currently under 55 will be provided vouchers from the government to help pay for health insurance. Voucher amounts will be based in part on income, with wealthier individuals receiving less assistance. Risk pools [cite] will be created to ensure that insurance companies will provide coverage to seniors, despite their generally higher use of medical care.
The result is retirees will have a system that gives them options, similar to that which members of Congress use and which will include options similar to Medicare Advantage, the popular plan eliminated by Obamacare. [cite]

Currently in many areas of the country physicans are reimbursed for Medicare patients at a rate that does not cover their expenses. Recent changes put forth by the Democrats further reduce reimbursement. Patients are finding that their physician is no longer a Medicare provider and when they look for another physician it is increasingly difficult for them to find a Medicare provider who is accepting new patients and can see them in a reasonable time. The Ryan plan harnesses the free market and puts choice in the hands of the patient. Retirees will be able to pick the insurance plan that best meets their needs, applying government vouchers toward premium costs. Medical decisions would be made in consultation with their personal physician, based on the individual's situation and preferences.

The American Embassy's treatment of George, a man of great courage and faith who has overcome extreme physical tragedy and trauma, reflects quite the opposite of a compassionate, empathic America. This situation must be righted at once. Not only should George be welcome to visit the United States, he should be honored by Congress at the Capitol as an individual who represents the limitless power of the human spirit, and who serves as a source of inspiration and motivation for the handicapped, everywhere. It is not too late to bring this Haitian national hero and global role model to America, and, in the process, raise millions of dollars for the tens of thousands of still-desperate surviving victims of last year's devastating earthquake. President Clinton, along with President George W. Bush, have been the lead fundraising voices for Haiti since January 2010. President Clinton should have a keen interest in George Exantus, and in what he represents to Haitian Americans and the citizens of Haiti. President and Secretary of State Clinton had both been invited to join Mr. Exantus on a float at the Manhattan parade, but a scheduling conflict prevented them from accepting the invitation. I have since written to the Clinton's about George's visa denial - through President Clinton's charitable foundation - but have not received a reply from either of them. The Secretary of State and former President must help make things right. Certainly, they have the influence and standing to do so!

The ideologically-driven illogic of New York Times columnist Roger Cohen Dear Linda, New York Times columnist Roger Cohen exceeded all of our expectations in his remarkably illogical column below (highlights added) entitled "Breivik and His Enablers." Space does not permit a detailed analysis of what he wrote, but here are the high points.

He uses the phrase "racist Islamophobia," and just to be sure we don't miss the point, he later writes of "anti-Muslim racism." As Cohen surely knows, Islam isn't a "race" any more than Christianity is. But playing the race card to demonize those with whom you disagree has become standard operating procedure for people like Cohen.

He foolishly and falsely compares Breivik's illusions of creating a new Knights Templar order to the call for the restoration of the caliphate by Osama bin Laden. The problem for Cohen, however, is that there is a global Islamist movement for the restoration of the caliphate, led by the Muslim Brotherhood. As far as we know, there is no worldwide movement to resurrect the Crusades.

Cohen calls Rep. Peter King and former Speaker of the House Newt Gingrich "ideological fellow travelers" of Breivik. King's "crime," of course, is to have the audacity to hold congressional hearings investigating Islamic radicalization in America. Cohen can't just disagree with King's actions; he has to demonize King by calling him a "fellow traveler" with a maniacal mass murdering terrorist.

Cohen writes, "Muslims have not done enough...to denounce those who deformed their religion in the name of jihadist murder." For Cohen to claim that the practice of violent jihad is a deformation of Islamic doctrine betrays an astonishing ignorance of that doctrine as well as its history. We would suggest, for starters, that Cohen read the history behind why Thomas Jefferson purchased a Koran. (The short answer is that he wanted to understand why the Barbary Pirates were engaging in what they called "jihad" against Americans.) He could then move on to Andrew Bostom's The Legacy of Jihad.

No doubt we will see more of the ideologically-driven illogic displayed in Cohen's column. The reason is simple: the apologists for radical Islam cannot defend the facts about radical Islam, so their only play is to attempt to silence anyone who exposes the truth. This includes the shameful exploitation of a horrendous tragedy in Norway.

Reports have emerged demonstrating U.S. funding the Taliban--the very enemy which our best and brightest have been fighting in Afghanistan since 2001. This should be no surprise to many. In May, Fox News reported similar activities of funding these Pashto insurgents through Pakistan. The article compared and contrasted the Afghan National Police and Afghan insurgent's pay scales.
"The United States has been pumping billions of dollars into Pakistan-a poor country that will do anything to keep foreign aid flowing into its corrupt regime's hands. One of our biggest concerns should be that once our foreign aid is disseminated abroad, it is extremely difficult to track. In fact, it's so hard to follow the money that an individual could argue that the United States cannot be 100 percent certain that our own U.S. foreign aid has not wound up assisting in the funding of America's enemy."

"There are not 218 Republicans in support of this plan," says Rep. Jim Jordan who heads the conservative caucus in the House. Speaker Boehner will have to rely on Democrats to pass the $1.2 trillion spending cuts plan. Minority Whip Steny Hoyer said "very few" Democrats will vote for the Boehner plan. A vote in the House is expected Wednesday, and Republican leaders are trying to round up enough support to pass their version. They hope that if it can pass the House, that will pressure Senate Democrats to drop their alternative and accept the GOP's plan. Mr. Boehner's bill would reduce spending by $1.2 trillion, grant an immediate debt increase of $1 trillion, and set up a committee to work on trillions of dollars in future deficit reduction through more spending cuts or tax increases. It would require both the House and Senate to hold votes on a balanced budget amendment. But many House Republicans said they don't just want votes on the amendment, they want an assurance it will be sent to the states. They want the Senate to vote on the debt increase the House passed last week, that includes deeper spending cuts and requires both chambers approve a balanced budget amendment and submit it to states for ratification before any debt increase happens. Cantor made the statement in a closed-door conference meeting. Boehner and Cantor are trying to rally restive members of their caucus behind a plan that would authorize up to $1 trillion in new debt in exchange for $1.2 trillion in spending cuts and the promise of more in the future. Some conservatives have balked at the proposal and Boehner could not guarantee the bill would pass the House. Cantor told lawmakers they had three choices: allow the country to default; pass the Senate bill Boehner has denounced as a "blank check" for President Obama or support the GOP leadership and "call the president's bluff." Boehner's proposal would raise the debt limit in two stages, but passage of the deal was not contingent on sending a balanced-budget amendment to the states. Boehner explained that he too feels the plan is flawed. The 26th amendment (granting the right to vote for 18 year-olds) took only 3 months& 8 days to be ratified! Why? Simple! The people demanded it. That was in 1971...before computers, before e-mail, before cell phones, etc.
Of the 27 amendments to the Constitution, seven (7) took 1 year or less to become the law of the land...all because of public pressure.

1. Term Limits.

A Congressman collects a salary while in office and receives no pay when they are out of office.
3. Congress (past, present& future) participates in Social Security.
All funds in the Congressional retirement fund move to the Social Security system immediately. All future funds flow into the Social Security system, and Congress participates with the American people.
4. Congress can purchase their own retirement plan, just as all Americans do.
5. Congress will no longer vote themselves a pay raise. Congressional pay will rise by the lower of CPI or 3%.
6. Congress loses their current health care system and participates in the same health care system as the American people.
7. Congress must equally abide by all laws they impose on the American people.
8. All contracts with past and present Congressmen are void effective 1/1/12.
The American people did not make this contract with Congressmen. Congressmen made all these contracts for themselves.
Serving in Congress is an honor, not a career. The Founding Fathers envisioned citizen legislators, so ours should serve their term(s), then go home and back to work.
If each person contacts a minimum of twenty people then it will only take three days for most people (in the U.S. ) to receive the message. Maybe it is time.

Obama Robs Reagan's "Grave"
Of all the distortions and deceits in Obama's address to the nation last night, none was more infuriating than his blatant attempt to rob Ronald Reagan's legacy and use it for his own big government, high tax agenda. Obama pulled a small quote from a Reagan speech and suggested that he was merely following in "the Gipper's" footsteps.
I began following Ronald Reagan from the age of 18. Later, I left a good job in Washington, and Carol and I lived on our savings in order to allow me to join the Reagan campaign in 1980. From 1981 through the end of his presidency, I proudly served in the Reagan Administration in several positions, including as the head of the Office of Policy Development at the White House.
If Ronald Reagan were alive and active today, I believe he would be fighting non-stop to defeat the Obama agenda. Obama represents everything Reagan devoted his life to stopping. Reagan would be mortified by the damage this president has done to our country.
Reagan said government was the problem; Obama thinks government is the solution. Obama is obsessed with raising taxes; Reagan lowered the top marginal tax rate from 70% to 28%! Reagan was pro-life; Obama is not willing to prevent even one abortion out 1.5 million a year.
Reagan believed the United States was a "shining city upon a hill;" Obama apologizes to thugs and tyrants for America's alleged sins. Reagan wanted government out of our lives; Obama wants government to direct everything we do - from what we eat to what light bulbs we use. Reagan respected "heartland values;" Obama said middle Americans were "bitter" and cling to their "religion and guns." Reagan respected the office of the presidency; Obama uses it to promote class warfare and to divide us.
Mr. Obama, keep your hands off Ronald Reagan!
The Great Exaggerator Speaks
Now let's take a look at some other things Obama said last night. As usual, it was a campaign speech intended to appeal to independent voters. But, once again, Obama's rhetoric bears little resemblance to reality. Here are my responses to a few of the worst exaggerations and deceptions in his speech.
- Obama's socialism was on full display last night. He characterized the GOP plan as one in which "nothing is asked of those at the top of the income scale." For the record, the top 1% of earners already pay roughly 40% of all income taxes collected. Think about that for a moment. If 100 people go out dinner, 1 person is going to pay 40% of the bill. To Obama that somehow equals "nothing."
- Obama again singled out tax breaks for corporate jet owners. Really, Mr. President? Obama is running an annual deficit of $1.5 trillion. The corporate jet tax, most recently renewed in the stimulus bill, would save $300 million a year. Just $1.4997 trillion to go! That is a sound bite, not a solution.
- Obama said that some Americans should "give up tax breaks [they] don't need and didn't ask for." Here we go again. This is so typical of the left. Liberals know what is best for you, and they think that all money belongs to Washington. Liberals will decided how much of your hard-earned income you "need" and how much of it they will allow you to keep.
- Obama specifically referred to "millionaires and billionaires," adding "I think these patriotic Americans are willing to pitch in." One, Obama's proposed tax hikes won't impact just "millionaires and billionaires." His new taxes start on those making $200,000, which includes many small business owners. If Big Government takes more money away from small business owners, that is less money they have to hire new employees. Raising taxes on job creators won't lower the 9.2% unemployment rate - it will make it worse.Two, if "patriotic" millionaires and billionaires want to "pitch in," the IRS gladly accepts donations! Obama could borrow Mike Huckabee's idea and set up a "Tax Me More" fund. It was a failure in Arkansas and in every other state that tried it. But perhaps "patriotic" liberals could be persuaded to donate to it instead of Obama's reelection campaign.
- Obama rejected the GOP's "cuts only" plan, and said that any deal to raise the debt ceiling should be a "balanced" approach that includes tax hikes. But earlier in the day Obama endorsed a plan by Senate Democrat Leader Harry Reid that did not have any tax increases. So, while the Republican House and Democrat Senate seemingly agree that tax hikes should be off the table, Obama positioned himself to the left of Harry Reid by demanding higher taxes.Now, if Obama wants to argue that Harry Reid is unbalanced that is his prerogative. But even a liberal pundit at CNN conceded that "nobody today is talking about tax increases, except Barack Obama."
- Half way through his speech, Obama made this incredible claim: "Understand -- raising the debt ceiling does not allow Congress to spend more money. It simply gives our country the ability to pay the bills that Congress has already racked up." That statement is half true. It allows America to make payments on the spending that Congress has approved this fiscal year, and we're currently borrowing roughly 40 cents of every dollar spent.But it just doesn't pass the straight face test to say that raising the debt limit "does not allow Congress to spend more money." Of course it allows Congress to spend more money. That's the whole point of raising the debt limit - especially raising it by more than two trillion dollars, far more than is needed for the current fiscal year.

President Obama wants to control all the land and all the water in the United States.
Legislation that would have deleted the word "navigable" from the federal Clean Water Act and given the EPA and Army Corps of Engineers jurisdiction over every drop of moisture in the country crashed and burned last Congress, ending the 36-year congressional career of its lead sponsor, Jim Oberstar, in the process.
But Obama's EPA, as usual, won't take no for an answer, and is now attempting to ignore two Supreme Court decisions, commonsense, and the American people and vastly expand federal Clean Water Act jurisdiction via a guidance document. A bipartisan group of 170 members of Congress told them not to, but they are doing it anyway.
If the EPA and Army Corps succeed, they can exercise effective control over all land and water in the United States. The green groups are fired up and pouring comments into the docket supporting this outrageous power grab, and we need to fight back.

Sunday Reflection: Is EPA's true purpose protecting the environment or shutting down industry?

On July 7, the U.S. Environmental Protection Agency released the Cross-State Air Pollution Rule -- another in an endless line of new federal environmental regulations with the stated purpose of improving air quality.
Like the others, this new rule will have little impact on the environment. Rather, its chief effect will be to kill jobs, put the brakes on economic growth, increase energy costs and impair our energy security. And in keeping with an emerging pattern of EPA behavior, the new rule was adopted in flagrant violation of due-process rights.
This rule will impose onerous new costs on coal-fired power plants, causing many to shut down, and threaten electrical generation reserve capacity all over the country. These reserve margins are needed to avoid power disruption during times of peak demand. Even temporary loss of reserve capacity risks dangerous blackouts.

Morning Bell: America Needs a Better Solution
Americans tuning in last night to watch President Barack Obama's primetime address from the East Room of the White House might have thought they stumbled upon yet another re-run from the networks. Instead of hearing news that Washington finally broke the debt ceiling stalemate, viewers were treated to more of the same from their President. He still had no plan for dealing with government overspending and overborrowing, and he repeated his never-ending call for tax hikes. Unfortunately, the plans proposed by House Speaker John Boehner (R-OH) and Senate Majority Leader Harry Reid (D-NV) don't get the job done, either.
The President's speech came as America stands at a fiscal precipice, with just a week to go before the August 2 deadline to raise the debt ceiling. Though the credit rating agencies see America's risk of default as small (though increasing), there remains the other, more serious risk-the failure to do enough to bring down debt in order to avoid a downgraded credit rating. Making Obamacare Bureaucrats Play by the Rules
In one of the most illuminating moments of the Obamacare debate, then-Speaker Nancy Pelosi said "we have to pass the bill so that you can find out what is in it." Pelosi meant that we would learn the truth about the bill after the controversy had died down. However, her words apply to Obamacare more than she knew. The Patient Protection and Affordable Care Act is not really a law, and we still do not know its full affects.
Laws set norms to regulate conduct. Obamacare, like most major laws, does not really do this. Instead, it authorizes administrators to make laws, insofar as they make the rules and regulations to govern our conduct. The public will not know the full implications of Obamacare until after unelected-and usually unknown-agency officials make the rules.
In response to these concerns, Representative David Schweikert (R-AZ) has introduced H.R. 1432, the Creating Sunshine, Participation, and Accountability for Our Nation Act, which would provide for greater transparency in agency rulemaking. As Gary Lawson explains, H.R. 1432 mandates that any rule issued pursuant to Obamacare must be made during public hearings in a trial setting, presided over by an officer confirmed by the Senate who will hold judge-like authority.
Under normal circumstances, agencies decide how to make the rules. For simplicity and ease, they usually forego conducting oral proceedings in a trial setting and, instead, make rules and regulations in private. In the private rulemaking process, agencies may communicate with whomever they wish, allowing them to seek opinions from sympathetic sources and to guarantee that the evidence favors the creation of certain rules. Although agencies must defend any rules that are challenged in court, they essentially handpick the evidence they wish to present.
H.R. 1432 would require agencies to create rules in a slower and more open manner. The law requires public hearings for all rulemaking and that an agency's decision be based entirely on the evidence formally presented at the public hearings. Public hearings were once commonplace, but have largely disappeared after the Supreme Court issued two 1970s rulings that required public hearings in only a handful of cases.
Some may object that requiring such stringent public oversight will lead to a more costly and drawn-out process. However, costs can be controlled, since the presiding agency official may limit redundant testimony, provided that he does so without prejudice to anyone's interest. Additionally, as there has been virtually no formal rulemaking in the last forty years, complaints about cost lack any recent relevant evidence and are, therefore, largely groundless. More importantly, the Patient Protection and Affordable Care Act will significantly affect everyone in the country. It demands intense public scrutiny-and such scrutiny will only be possible when rulemaking agencies hold public hearings.

It's Official: Tea Is Good for the GOP

Of all the bombs that liberal pundits toss at the Tea Party, none better illustrates why the GOP should actually pay attention than Thursday's article by E. J. Dionne Jr., the liberal Washington Post columnist. Mr. Dionne, who looks at President Obama's feet and sees water wings, often tries to advise the Republican Party out of the goodness of his heart. This week's version of his political "Dear Abby" series is, "Toss the Tea Party aside: To forge a debt deal, the GOP must reject fringe ideas." Whenever Mr. Dionne professes to worry about the Grand Old Party, it's time to pivot 180 degrees and do the opposite. This means grabbing the Tea Party, holding on tight and listening to what the heartland is saying above the Beltway noise.

Education Is Worse Than We Thought
This column by ACRU Policy Board Member and Professor of Economics Dr. Walter E. Williams was published July 20, 2011 on Townhall.com.
Last December, I reported on Harvard University professor Stephan Thernstrom's essay "Minorities in College -- Good News, But...," on Minding the Campus, a website sponsored by the New York-based Manhattan Institute. He was commenting on the results of the most recent National Assessment of Educational Progress, saying that the scores "mean that black students aged 17 do not read with any greater facility than whites who are four years younger and still in junior high. ... Exactly the same glaring gaps appear in NAEP's tests of basic mathematics skills." Thernstrom asked, "If we put a randomly-selected group of 100 eighth-graders and another of 100 twelfth-graders in a typical college, would we expect the first group to perform as well as the second?" In other words, is it reasonable to expect a college freshman of any race who has the equivalent of an eighth-grade education to compete successfully with those having a 12th-grade education?

What the American people are about to demonstrate in 2012 is that the heartland's vision of a booming economy restoring America's traditional world-leading prosperity and superpower might is shared by far more citizens than you might think, and that the long outdated socialist vision of the "progressive" American Left, for whom that traditional American prosperity and superpower status is a moral embarrassment, is fading into oblivion. The U.S. House of Representatives is set to vote THIS WEEK on legislation that would prevent the Obama Labor Board from dictating to job providers like Boeing where they can and cannot create jobs. The Protecting Jobs from Government Interference Act (HR 2587) simply says that employers have the right to hire workers anywhere in the United States -- and the Obama bureaucrats won't be able to sue them for making the sound economic decision to move to a Right to Work state. The wealth gaps between whites and minorities have grown to their widest levels in a quarter-century, according to an analysis of new Census data.
The recession and uneven recovery have erased decades of minority gains, leaving whites on average with 20 times the net worth of blacks and 18 times that of Hispanics.

California "Dream Act" approved for illegal immigrants
Feds only gets involved when GA tries to pass immigration laws
California Governor Jerry Brown signed into law on Monday a bill allowing illegal immigrants to receive privately funded scholarships to attend the state's public colleges and universities.
The bill, dubbed the California Dream Act, passed the state Legislature earlier this month and aims at helping illegal immigrants who have earned a high school diploma after attending at least three years of high school in the state.
