State Nullification
State Nullification is a political action firmly rooted in the founding of America and its two principle documents: the Declaration of Independence and the Constitution. The concept itself was articulated best by Thomas Jefferson and James Madison in the Virginia and Kentucky Resolutions of 1798. Nullification is based on the Compact Theory- that the Federal Government was created by the sovereign states to act on their behalf as a limited agent within the expressly enumerated and limited powers in Section 1, Article 8 of the US Constitution. As the principals, the States are the final arbiters for determining when its agent (the Federal Government) has overstepped its bounds. Although Supreme Court opinions are important ruling within the Federal Government, the Federal courts as constructed by the framers are not the final word with regard to Constitutionality between the Federal Government and the States. Rooted in the 10th Amendment, Nullification has a rich history in both the North and the South during the 19t Century. Nullification has experienced a popular rediscovery and resurgence in the 21st Century with many states invoking the 10th Amendment, State Sovereignty, and Nullification as the rightful remedy in protecting their citizens against an increasingly unconstitutional Federal Government.

The PA 10th Amendment Coalition was formed to be a collaborative, social networking springboard for grassroots across the Pennsylvania who are interested in promoting 10th Amendment solutions in Pennsylvania. It was initially an outgrowth of the Pennsylvania Tenth Amendment Center which is a State Chapter of the Tenth Amendment Center (TAC). TAC is leading the fight across the US with such prominent Constitutionalists as Thomas Woods, Judge Andrew Napalitano and Sheriff Richard Mack. The Coalition has grown to include a large number of grassroots groups across Pennsylvania with focus on educating on the 10th Amendment and also influencing mindsets and legislation in Harrisburg. Good Morning. I know you will reprint what we have to say, so I will try to be as "eloquent" as I can.
Our legislators have compared the failing school system to a burning building - I would say that they are correct in the severity of the problem. They want to rescue as many as they can, when in fact they have already predetermined who survives and who does not.
We did not create this analogy, they did, so let's go with it. All I can say is, thank God our legislators are not fireman! Because once they rescue a "select few", they are letting the building burn to the ground in the hopes that the ones in the flames can find their way out.
You could argue that the EITC program is the water hose that will help the rest survive. And it may for some, however, it is limited by the contract between the Scholarship organization and the school, the amount of money being donated by companies, the income level of those applying, the number of applicants, the participation of the private school in the EITC program and how much a family can contribute on their own.
You fail to understand that "the grassroots" coalition is not opposed to school choice, in fact, we are encouraging our General Assembly to be BOLD and create a Constitutional, Equitable and Fair bill that limits government, yet provides for the maintenance and support of a thorough and efficient system of public education that serves the needs of the "entire" Commonwealth.
The grassroots movement did not come this far to say "this is the best we can do". Firemen don't enter a burning building not knowing the risks. They assess the situation and do "everything they can" within in the confines of not losing their own life, to save as many as possible, not just the people on the first floor.

The best writer, commenting on Israel and the ME today, is Caroline Glick. Everyone of her articles should be read. Specifically, I want to bring your attention to her last two articles.
In the first article she decries the world reaction to the dispicable massacre of the Fogels and three of their children.
In the second article published before the massacre, she argues that Netanyahu must adopt an offensive strategy. She recommends annexation, at least in part.

Three Jewish children
The enlightened peoples of Europe, and growing numbers of Americans, have no interest in hearing or seeing anything that depicts Jews as good people, or even just as regular people. It is not that the cultured, intellectual A-listers in Europe and America share the Palestinians' genocidal hatred of the Jewish people.
The powerful newspaper editors, television commentators, playwrights, fashion designers, filmmakers and professors don't spend time thinking about how to prepare the next slaughter. They don't teach their children from the time they are Hadas and Elad Fogel's ages that they should strive to become mass murderers. They would never dream of doing these things. They know there is a division of labor in contemporary anti-Semitism.
The job of the intellectual luminaries in Western high society today is to hate Jews the old-fashioned way, the way their greatgrandparents hated Jews back in the days of the early 20th century before that villain Adolf Hitler gave Jewhating a bad name.
WHAT ALL this shows is that Netanyahu was wasting his time calling on world leaders to condemn the murder of the Fogel family. What does a condemnation mean? France and Britain condemned the massacre, along with the US. Does that exculpate the French and British for their embrace of anti-Semitism? Does it make them friends of the Jewish state? And say a British playwright sees the YouTubecensored photographs. No self-respecting British playwright will write a play called Three Jewish Children telling the story of how Palestinian parents do in fact teach their children to become mass murderers of Jews. And if a playwright were to write such a play, The Royal Court Theater wouldn't produce it. The Guardian wouldn't post it on its website. Liberal Jewish community centers in America wouldn't show it, nor would university student organizations in Europe or America.

What this shows is that Netanyahu's strategy for contending with Obama is fundamentally misconstrued and misdirected. Obama will not be moved by Israeli concessions. The only way to stop Obama from moving forward on his anti-Israel policy course is to work through Congress.
And the most effective way to work through Congress is for Netanyahu to abandon his current course and tell the truth about the nature of the Palestinians, their rejection of Israel, their anti-Americanism and their support for jihadist terror.
At the same time, Netanyahu must speak unambiguously about Israel's national rights to Jerusalem, Judea and Samaria, our required security borders, and about why US national security requires a strong Israel.
The stronger the case Netanyahu makes for Israel, the more support Israel will receive from the Congress. And the more support Israel receives from the Congress, the more Obama will be compelled to temper his anti-Israel agenda.

1. This is What Happens When Republicans Get Milquetoast
There is new polling out today making its way around the bathrooms of House and Senate Republican leaders. After weeks and weeks of bending over backwards to try to show they were willing to compromise on everything, guess what?
The public thinks the GOP hasn't been compromising enough.
House Republican Leaders who are more concerned with image than principle are going to fall all over themselves with this polling in a rush to compromise more. Here's the problem I see.
House Republicans have been muddying the water so much since November and painting their policy positions in pale pastels. The public voted in November with bright colors - mostly in red. The public wants Washington to stop its profligate spending. The public wants bright colors, not pastels.
2. Washington Post: 95% Believe Spending Cuts Are The Best Way To Cut The Deficit
Greg Sargent, the Washington Post's in-house left-wing activist, has a hilarious post up analyzing the latest WaPo poll. (The post was originally entitled, "The pubic agrees with Dems, but they don't know it," although eventually someone caught on and fixed the typo.)
Everybody has typos; what's more enduringly amusing is Sargent's effort at spin.
If you are keeping score at home,a left-wing activist admits that 95% of the public believes spending cuts are the best way to reduce the deficit, whether or not that plan also includes tax hikes. Going to the poll itself, only 3% believe the best way to cut the deficit is simply raising taxes. And what's more, that's the public - not likely voters or even registered voters, but all adults.
3. More Pennsylvania Abortion Shops Shuttered
When the story of the abortion shop cum abattoir run by Philadelphia doctor Kermit Gosnell hit the press in January the nation was shocked by the near medieval conditions encountered by women seeking access to the "safe, legal, and rare" procedure which kills over a million children each year.
As we noted at the time, the conditions in Gosnell's facility was not an aberration, rather it was the easily foreseeable consequence of a governor, Tom Ridge, electing not to have abortion shops inspected because of a personal sympathy for the butchery that occurred within. A sympathy disguised by the hackneyed formulation "I'm personally opposed to abortion, but ..."
If there is a single good thing to come out of this incident, other than Gosnell and most of his ghouls spending most of the rest of their lives in prison, it is the heightened level of scrutiny to the business of baby killing, a business that has managed to intimidate its way out of any regulatory regime.
4. I Still Haven't Found What I'm Looking For
Yesterday in the Politico, Jonathan Martin gave a conservatives in the mist take on the 2012 "theme" from the GOP - America 'in decline'.
I think the take is exactly opposite how he characterized it - though it is all semantics. It is not 'America in decline', but 'America the Great' that is the theme.
At a time when Barack Obama is intent on taking over the economy one-fifth at a time and leftists are turning the more-likely-than-not traitor Bradley Manning into a hero, it is more and more clear that the San Francisco left that Jeanne Kirkpatrick warned us about 25 years ago has finally gotten to have their way with America.
The theme is not about our nation in decline, but about letting a group of people run the nation who want us to decline.
It is easy to get hung up on the doom and gloom of the 2012 Republican candidates. They are a gloomy bunch. Sure they are trying to sound optimistic, but I've heard most all of them speak. With few exceptions, they have the oratory skills of a gaggle of warbling albatrosses and some, worse, sound like warbling albatrosses being violated by lepers.
I still haven't found what I'm looking for.
5. For $25, You Can Learn to Be a Marxist Troublemaker...and Grab Lunch Too!
You may have noticed over these last few weeks that the protesters in Wisconsin and elsewhere seem to be well trained at trouble making. It's almost as if they have their B.S. degrees from the University of Alinsky.
Well, as every good community organizer knows, you can't astroturf without being properly trained in the science of trouble making and that is why you too can learn the dark science of Alinsky in Madison on April Fool's Day [actually April 1st & 2nd].
6. Answers From A Non-Interventionist
About the same time as I posted a diary against the idea of US military intervention in Libya, George Will wrote a column challenging those in favor of said intervention to answer a series of questions about what they were truly trying to achieve. American Delusionalism?
Like an eager kid who desperately wants to be included in his cooler older brother's activities, America looks to the European Union for cues on sophisticated governance. But what happens when that cooler older brother is middle-aged, unemployed, and still living in your parents' basement? This is America's dilemma. Will America learn from Europe's mistakes? Or, will America continue to be enamored with the European Union, despite its failed policies and unsound philosophical grounding? Practical problems of governance abound in the EU. Great Britain, Germany, Spain, France all agree: multiculturalism has failed completely. French President Nicolas Sarkozy admits, "We have been too concerned about the identity of the person who was arriving and not enough about the identity of the country that was receiving him." Look no further than Greece for proof that the cradle-to-grave welfare state is financially unsustainable. Unemployment benefits, pensions, child-care subsidies, free university education, generous paid vacation and holiday leave, and government-provided health care-these programs cost money and require a robust economy to support the social-welfare safety net. As Europe's population grows older and grayer, demands for more entitlements continue to increase. An ever-expanding welfare state needs the pitter-patter of little feet to fund it in the future. With the current declining fertility rates, by 2050 the European Union economies will have a mere two workers for every retiree.
Practical failures aside, Bruce Thornton argues that the European Union's philosophical grounding is diametrically opposed to America's principles. The EU model assumes the perfectibility of mankind-that "a universal, essentially rational human nature is progressing away from the irrational superstitions and traditions such as religion that in the past defined and disordered human life and society." Social, political, and economic institutions facilitate mankind's perfection, by creating peace, equality, and justice and enabling human happiness. And who will staff these institutions charged with perfecting mankind? Technical elites who know the best way to live will craft policies and allocate rights accordingly. Thus, the perfection of mankind results in centralized, top-down style governance. To embrace the European Union's premises about human nature, the purpose of government, and the status of rights, America must shed its own. America's way of life is premised on a permanent human nature-not one progressing towards perfection. It is a mix of base and lofty. Throughout the Federalist, Publius recognizes mankind's "destructive passions and selfish interests." But, this does not mean that men ungovernable. With the aid of institutional arrangements, a vigilant and manly spirit, and virtue, men are capable of self-government. The purpose of government is not to create "rights" to various welfare programs: limited government is necessary to secure natural rights. A self-governing people rejects administrative elites' advances on their liberty. Its citizens refuse to become "a herd of timid and industrious animals of which the government is the shepherd."
It is time to abandon our delusions about the European model. Whereas Publius once warned us "to teach that assuming brother moderation," our task today is to avoid following him down the same path of economic sclerosis, unaffordable entitlements, impending demographic collapse, and failed multiculturalism.

By Barry Rubin, Rubin Reports There's nothing to worry about, we are told, of course Egypt wants to get the money from gas shipments, right? Ideology and politics are not important, we are told, but are always trumped by material considerations.
Well, it looks as if Egypt has stopped gas exports to Israel, just about their only trade link. The company that supplies 45% of the gas needed to produce Israel's electricity, has missed several promised deadlines to restore service since the pipeline was damaged in a terrorist explosion February 5.
The Egyptian government is pretending that there are technical problems but that's nonsense. Either there will never be any gas shipments at all or Egypt will demand such a steep increase in price that this will be designed more to end the deal rather than to increase their revenue.
So Israel's Electric Company is asking the Environmental Protection Ministry to switch to diesel and fuel oil. One day, Israel...

Lenin's Lessons for Obama on Dealing with Radical Islamists

Consider this in light of their inability to understand that not only al-Qaida but also Syria, Hamas, Hizballah, the Muslim Brotherhood, and the AKP government in Turkey, as well as Iran's regime and other Islamists are dangerous, anti-democratic forces.
1. In 1920, Vladimir Lenin, leader of the new Soviet Union and of the world Communist movement, wrote "`Left-Wing'" Communism: An Infantile Disorder." Lenin ridiculed small, radical groups that believed only instant insurrection could bring revolution. He explained that Communists needed to maneuver, to use all sorts of tactics, sometimes to advance and sometimes to retreat.
In our time, al-Qaida is the equivalent of the groups about which Lenin was writing. It knows only one thing: terrorism. In contrast, the West's really important...

State Troopers Forced to Drag Union Protesters From Tenn. Senate Hearing

NASHVILLE, Tenn. (AP) - Troopers forcibly carried out seven union supporters from the Tennessee's legislative office complex on Tuesday after their protest disrupted a Senate committee hearing.
The disruption occurred after hundreds of labor supporters gathered for a midday protest near the Capitol to denounce a bill to strip teachers of their collective bargaining rights. The seven arrested were among those who stood up during the hearing and began chants about "union busting" by the Legislature.

No Bureaucrat Left Behind

Did you know that it is Education Month in the Obama White House? Neither did we. But apparently it is, and accordingly the President crossed the Potomac yesterday to visit an elementary school in Arlington, Virginia, where he pushed for reauthorization of the unpopular No Child Left Behind (NCLB) program. It was a classic President Obama performance. First he denounced the "stale debates" over whether education needed "more money" or "more reform." Then-surprise-he said what the country really needed was both: "We need more resources for the schools, but we've got to reorganize how our schools are doing business in order to assure success for our young people. ... Let's seize this education moment. Let's fix No Child Left Behind." No, let's not.

Whatever else one might say about President Obama's Libya policy, it has succeeded brilliantly in achieving its oft-stated goal of not leading the world. No one can any longer doubt the U.S. determination not to act before the Italians do, or until the Saudis approve, or without a U.N. resolution. This White House is forthright for followership. That message also couldn't be clearer to Moammar Gadhafi and his sons, who are busy bombing and killing their way to victory against the Libyan opposition. As the U.S. defers to the world, the world can't decide what to do, and the vacuum is filled by a dictator and his hard men who have concluded that no one will stop them.

The State of Texas has set up a website to collect and post the stories real victims of Barack Obama's non enforcement border policies have to tell.
The stories these real Americans tell need to be heard and acted on if we are ever to gain control of our southern border. Here are some of the witness accounts posted on the site.

A Lawless Administration
Does the Obama Administration think that it gets to pick and choose which Supreme Court rulings it has to obey? Evidently it does because there is no other way to explain the Justice Department's meddling with testing standards for police and firefighters in Dayton, Ohio.
According to local media reports, Dayton was forced to lower its testing standards for police and firefighters because in the Obama Administration's opinion, there were not enough minority recruits on the city's payroll. Police recruits, for example, had to score 66% on the first exam and 72% on a second exam. But as the local ABC affiliate reports, "The D.O.J. approved new scoring policy only requires potential police officers to get a 58% and a 63%," in order to boost the number of minorities who pass the exam.
This decision flies in the face of the Supreme Court's 2009 ruling in the Ricci case. In that decision, the court ruled that the city of New Haven, Connecticut, discriminated against white firefighters seeking promotions by throwing out test scores because too few minorities passed. So why is the Obama Justice Department telling Dayton, Ohio, to lower its standards?
Not surprisingly, the news isn't going over well in Dayton. Randy Beane, president of the Dayton Fraternal Order of Police, said, "It becomes a safety issue to have an incompetent officer next to you in a life and death situation." Even the president of the local NAACP chapter, Derrick Foward, blasted the new standards, saying:
"The NAACP does not support individuals failing a test and then having the opportunity to be gainfully employed. If you lower the score for any group of people, you're not getting the best qualified people for the job."
That seems obvious enough. But the left-wing ideology that is embraced by Obama and Holder requires them to divide us by race.
Broken Promises
Add transparency to the long and growing list of Obama's broken promises. The Associated Press reported yesterday that the Obama Administration is stonewalling on Freedom of Information Act requests. In at least one-third of FOIA requests, the AP reports, "The administration refused to release any sought-after materials." What's more, the administration seems to be finding ways to deliberately evade transparency.
It was recently reported that White House aides are steering lobbyists to a complex of townhouses just off White House grounds. Why? As Politico noted:
"It allows the Obama administration to keep these lobbyist meetings shielded from public view -- and out of Secret Service logs kept on visitors to the White House and later released to the public. ...The White House can't say who attended meetings there, or how often. The Secret Service doesn't log in visitors or require a background check the way it does at the main gates of the White House."
Obama Is Vulnerable
Today's daily Rasmussen tracking poll finds that Barack Obama's approval rating has plunged in recent weeks. He got a bounce after the State of the Union address, when his rating peaked at 52% for the year. But it has since collapsed to just 43%. Fifty-seven percent of likely voters now disapprove of Obama's job performance, including 42% who say they "strongly disapprove." And there's more bad news for Team Obama.
A new ABC News/Washington Post poll finds that just 26% of Americans have "confidence in our system of government and how well it works." That is the lowest confidence level recorded in 35 years, and down dramatically from nearly 45% in 2008. Moreover, the share of those who are unsure about our system of government has jumped 19 points, from 30% in 2008 to 49% today. So since Obama has been in the White House, the public's confidence in government has plummeted, while skepticism has skyrocketed.
It's not hard to figure out why. Obama seems totally disconnected from reality right now. His war on energy producers is partly to blame for skyrocketing gas prices, and is so radical even some labor unions are fighting mad about the likely job losses. He and his allies aggressively pushed policies so unpopular that 62% of voters want them repealed.
His assault on normal marriage is an affront to the established beliefs of most Americans. He was AWOL on Libya. There are reports today of Saudi troops entering Bahrain, home to the U.S. Navy's 5th Fleet, to quell yet another uprising in the Middle East. There was a major disaster in Japan, a key U.S. ally, that has world financial markets reeling.
And how has Obama responded? He played golf, gave a radio address devoted entirely to gender equality and today he is picking his college basketball brackets, which, according to Politico, will be revealed on ESPN tomorrow.
My friends, Obama is vulnerable in 2012. All that remains is for the GOP to nominate a candidate who can keep the conservative movement united, as Ronald Reagan did, by articulating a positive vision for our future. A Republican can win by presenting a pro-growth alternative to Obama's big government socialism and honoring our traditional values.
In God We Trust
With events around the world moving at breakneck speed, this is a good time to remember that it will take more than one good election to restore our nation. And with faith in government declining, it is important to remember where we should place our trust. As Ronald Reagan said, "If we ever forget that we are one nation under God, then we will be a nation gone under."
Rep. Randy Forbes (R-VA) is trying to remind us of that with a resolution reaffirming our national motto "In God We Trust," and encouraging displays of the national motto in schools and other public buildings. The Forbes resolution, which has 56 co-sponsors, will be voted on Thursday by the House Judiciary Committee.

Medicare and Medicaid Made $70 Billion in 'Improper Payments' Last Year-More Than All Spending by Homeland Security and State Departments Combined (CNSNews.com)- The Center for Medicare and Medicaid Services - the federal agency that has a major role in implementing Obamacare - made at least $70.5 billion in "improper payments" last year. "An improper payment," said the Government Accountability Office, "is any payment that should not have been made or that was made in an incorrect amount (including overpayments and underpayments) under statutory, contractual, administrative, or other legally applicable requirements."

John Conyers (D-Mich.), the ranking member of the House Judiciary Committee, told CNSNews.com Monday that he voted for the health-care law because he saw it as a necessary "platform" for building toward a single-payer health-care system in the United States.
House Republican Leader: CR Will Permit Funding of Obamacare (CNSNews.com) - House Majority Leader Eric Cantor (R-Va.) said on Monday that the new continuing resolution (CR) the House will consider this week to keep the federal government funded will permit the Obama administration to continue spending money on the implementation of Obamacare. Two conservative lawmakers are pressing House Republicans to refuse vote for any CR that permits funding of Obamacare.
Rep. Mike Pence Will Not Support Another Short-Term CR (CNSNews.com) - Enough is enough, Rep. Mike Pence (R-Ind.) said in a statement issued on Tuesday: "It's time to take a stand for taxpayers and future generations. I will not vote for the short-term Continuing Resolution," he said.
Japan's Nuclear Crisis Deepens With Third Reactor Explosion, Radiation Leak (CNSNews.com) - Japan's earthquake-induced nuclear emergency worsened Tuesday after a third explosion at a stricken power plant appeared to have caused some damage to the reinforced container around a reactor core. Raised radiation levels were detected in Tokyo, some 150 miles to the south.

(CNSNews.com) - Rep. John Conyers (D-Mich.), the ranking member of the House Judiciary Committee, told CNSNews.com today that the health-care law that President Barack Obama signed last March is a "platform" for building a single-payer health care system in the United States.
During a newsmakers program at the National Press Club on Monday, Conyers said that after discussing the issue with Rep. Dennis Kucinich (D.-Ohio) he voted for the health-care law because he saw it as a necessary "platform" for building toward a single-payer health-care system in the United States.

Dear Fellow Conservative:
The first major test for Republicans this year will be on how we address our nation's exploding debt. We are quickly approaching the statutory debt limit of $14.3 trillion so this issue will come to a head very soon.
Republicans need to do what they have too often failed to do over the last 10 years and fight to cut spending. And that's why I'm writing to you today. I need your help right now.
President Obama wants Congress to raise our nation's debt ceiling again without doing anything serious to cut spending and balance the budget. His economic advisor, Austan Goolsbee, recently argued that the sky would fall unless we keep borrowing. But the truth is the sky is already falling BECAUSE we keep borrowing.
We must stop the debt and balance the budget.
There are senators on both sides of the aisle who hope their constituents won't be paying attention when the Senate considers the debt limit. They want to quietly vote for more debt without paying a political price.
We can't let that happen.
Please join me in doing two things right now.
First, visit http://stopthedebtpledge.com and sign our "Stop the Debt" pledge. It states, "I hereby pledge to support only those candidates who demand that Congress stop the debt and pass a Balanced Budget Amendment."
In the last 10 years, Congress has raised the debt ceiling 10 times, but it has not voted a single time to pass a Balanced Budget Amendment. The only way to keep Congress from creating more debt is to pass a Constitutional Amendment that forces it to balance the budget without raising taxes.
I need you to sign this pledge right now so I can show my colleagues in the Senate that there are thousands of Americans who want them to draw a real line in the sand on this issue. Many of my colleagues are already telling me they may trade their vote on the debt ceiling for budget caps, which won't be enforced. The Balanced Budget Amendment sponsored by Senator Mike Lee of Utah will force Congress to balance the federal budget by cutting spending. Not only does it include an 18 percent of GDP cap on total spending, it also includes a 2/3 vote super-majority requirement to ever raise taxes.
Every state except for Vermont has a requirement to balance its budget and so should Congress. This is a commonsense reform that is overwhelmingly supported by the American people. There is no reason why the Senate cannot pass the Balanced Budget Amendment.
The last time the Senate voted on the Balanced Budget Amendment was in 1997 when it was just one vote short of the 67 votes needed for adoption.
We can win this policy battle if we're willing to fight for our principles. All 47 Republicans voted in November to make the Balanced Budget Amendment the policy of the Senate Republican Conference, and there are 23 Democrats up for re-election in 2012 who won't want to vote against it.
The President may attack conservatives who filibuster the debt limit and accuse us of putting the nation at risk, but the President and the politicians in Congress who refuse to balance the budget are the ones hurting our country. The time has come for Americans to draw a line in the sand and say "enough is enough".

Immigrant Job Numbers Grow as American Employment Declines

Napolitano: DHS Granted Deferred Action to Nearly 900 Illegal Aliens in 2010
During the Senate Judiciary Committee's Oversight Hearing of the Department of Homeland Security (DHS) last Wednesday, DHS Secretary Janet Napolitano admitted that the agency granted deferred action to nearly 900 illegal aliens in Fiscal Year 2010. However, according to Secretary Napolitano's own testimony, the final figure could be substantially higher as this estimate leaves out the number of illegal aliens granted deferred action for "humanitarian" reasons.

Utah Legislature Passes Series of Immigration Bills; Includes Amnesty
Last week the Utah Legislature passed three immigration bills causing uproar on both sides of the immigration debate. The bills range from a guest worker amnesty bill (H.B. 116), an Arizona-style enforcement bill (H.B. 497), and an agreement between Utah and a Mexican State to provide businesses with migrant workers (H.B. 466).

Washington and New Mexico to Continue Issuing Driver's Licenses to Illegal Aliens
Two states last week took affirmative steps to continue issuing driver's licenses to illegal aliens. In New Mexico, despite a push from Governor Susana Martinez to tighten the state's lax licensing laws, the state Senate passed a bill last Wednesday which continues to allow illegal aliens to obtain driving privileges. The bill does increase the residency requirement for any foreign national to acquire a driver's license in New Mexico from three to six months. (HB 78) It also requires illegal aliens to reapply for a license every two years and increases penalties for falsified documentation. (HB 78)

Senator Mitch McConnell, along with 43 co-sponsors (including Democratic Senator Joe Manchin of West Virginia), is forcing a vote on S. 482 (the Energy Tax Hike Prevention Act) as an amendment to the Small Business Innovation Research Act re-authorization bill. The vote could come as soon as today but it will probably come some time this week.
Unelected regulators are usurping the legislative power that the people, in the Constitution, granted to Congress. We must demand our senators step in and stop this regulatory tyranny.
President Obama is now pursuing his entire failed global warming agenda - decisively rejected as the cap-and-tax energy tax and in the 2010 election. In Obama's words: "Cap-and-Trade was just one way of skinning the cat; it was not the only way."
Indeed, the EPA is actively pursuing a bizarre legal theory that the 1970 Clean Air Act was designed as a global warming law, and that pursuant to it they can regulate just about everything that moves, as well as most industrial facilities. When it's fully phased in, their plans include over 18,000 pages of appendices that would regulate every industry in the U.S., cause electricity prices to skyrocket, and greatly diminish our freedom and prosperity.

Unions Show No Class in Wisconsin 'War'
This column by ACRU Senior Fellow Robert Knight was published March 11 on The Washington Times website.
"I'm not going to lie to you, this is going to get ugly." So predicts "Goldfish," a Daily Kos blogger who boasts of spending two weekends in Madison, Wisc., "on the Front Lines of the Class War." Now, "Goldfish" is predicting a general strike, like the ones in Greece whenever the bankrupt government tries to cut ruinous spending.
A bigger fish, film director Michael Moore, announced on MSNBC's The Rachel Maddow Show on Wednesday that, "This is war. This is class war," and that a national walkout of government school students would happen Friday. Jesse Jackson told Fox News that public unions will retain collective bargaining or "you're going to have it through the streets. People here will fight back because they think their cause is moral."

Atheist activist Michael Newdow, a controversial lawyer who once received significant media attention, may have worn out his welcome at the U.S. Supreme Court this week.
Although many lawyers who argue before the Supreme Court only do so once, a select group of perhaps 20 elite lawyers repeatedly appear before the court. The court often welcomes cases offered by these top-shelf attorneys, knowing that the justices will read polished briefs and hear well-reasoned arguments, which assist the court in reaching the correct result.

The Anachronism of State Income Taxes
This column by ACRU General Counsel and Director of Policy for the Carleson Center for Public Policy Peter Ferrara was published March 9 on Forbes.com.
Nine states survive perfectly well with no state income tax at all. These include large states such as Texas and Florida, medium-size states such as Tennessee and Washington, and smaller states, in terms of population, such as New Hampshire, Nevada, South Dakota, Wyoming, and Alaska. This policy should now be extended to the other 41 states.
Income taxes are the most economically destructive of all taxes. That is because income levies tax directly the reward for work, savings, investment, and entrepreneurship. With the reward reduced, the incentive for pursuing these economically productive activities is reduced. The result is less work, less saving, less investment, fewer new businesses, less business growth, less job creation, lower wages and income, and lower overall economic growth.

Fear the Media Meltdown, Not the Nuclear One (UPDATED)

The March 11 earthquake off the coast of Japan has been an unprecedented disaster. Now estimated to have been a magnitude 9 earthquake - one of the top five earthquakes measured since reporting started in 1900 - it was the result of a "megathrust" in which an area of sea floor bigger than the state of Connecticut broke free and moved under the force of colliding tectonic plates. It was so strong that it literally moved the entire island of Honshu eight feet to the east. The earthquake was then followed by a tsunami comparable to the Boxing Day tsunami of 2004 - but since the epicenter of the quake was only a few miles off the coast of Japan, the tsunami struck the heavily populated coast of Honshu with almost no warning, basically washing many coastal villages off the face of the earth.

I repeat, there was and will *not* be any significant release of radioactivity from the damaged Japanese reactors.
By "significant" I mean a level of radiation of more than what you would receive on - say - a long distance flight, or drinking a glass of beer that comes from certain areas with high levels of natural background radiation.
I have been reading every news release on the incident since the earthquake. There has not been one single report that was accurate and free of errors (and part of that problem is also a weakness in the Japanese crisis communication). By "not free of errors" I do not refer to tendentious anti-nuclear journalism - that is quite normal these days. By "not free of errors" I mean blatant errors regarding physics and natural law, as well as gross misinterpretation of facts, due to an obvious lack of fundamental and basic understanding of the way nuclear reactors are build and operated. At present The Forgotten Taxpayer pays to have the government collect dues fro for the unions from the unions' own members. This is unique; the government does not collect revenues for any other private organization.

Japanese people are setting the example
The Japanese people are doing an incredible job of maintaining order and calm during one of the worst natural disasters in recent memory. Stories keep pouring in about the kindness and generosity Japanese people are showing towards each other - like the man who grabbed the last 10 bottles of water at the store but put most of them back so others could have them. Americans are amazing in times of need as well, but let's be honest - have we ever had a disaster of this magnitude where there wasn't any looting? Amazingly, that's the case in Japan.
