Avoid Celebrity-Size Problems |

On July 1, 2009, Michael Jackson's will was publicized. The will is only five pages and is somewhat standard. The most controversial issue is Jackson's decision of who he chose to administer his estate. While he appointed his mother to be guardian of his children, he appointed John Branca, his attorney, and John McClain, a music executive, to be the executors of his estate. There seems to be surprise and skepticism from Jackson's family that the will does not appoint family members to administer his estate.
The choice of executor is one of the most difficult decisions when preparing estate documents. The most important factor is the person chosen is trustworthy. Jackson was aware of the complexity of his assets and expected issues relating to royalties and music-related property to arise. In that instance, appointing someone with specialized expertise regarding assets is recommended. Was it necessary to appoint a lawyer? There is no prevailing reason to appoint a lawyer as executor. The legal aspects of estate administration can be handled by retaining an estates lawyer to provide legal advice as needed.
Maybe Jackson did not want to inconvenience his family with the complicated administration. Some attorneys recommend the will-maker appoint the family member, but leave a letter in addition to the will indicating they recognize the job of administering the estate will be difficult and thereby relieve the family of the obligation if they chose to renounce. This alleviates the guilt associated with renouncing as executor but gives the option of having control over the estate if the family so chooses.
Surprise is never good in estate matters. The disappointment felt by the Jackson family resulted from Jackson not advising them of his choice of executors before he died. When a family finds out after death they are excluded from the will bad feelings result. Reading it in a legal document without hearing it from the loved one makes it difficult to accept.

Kerry Peck teamed up with Elder Law attorneys Diana Law and Howard Berk to teach the seminar "123s and ABCs of Special Needs Trusts" at the National Association of Elder Law Attorneys "Phoenix Rising" special needs program. At the seminar, attorneys learned how to devise creative schemes to revolutionize the use of special needs trusts and increase a firm's revenue in the down economy. The Phoenix Rising special needs program took place May 27th through May 30th at the Grand Resort in Phoenix, Arizona.
