J.D. Power and Associates Reports: Online Insurance Quote Applications Now Initiate A Majority of New Sales Within the distribution channel factor, the website now accounts for more than one-fourth of the importance weight, second to the local agent. In addition, more than one-half (54%) of insurance shoppers report getting their quote online. "This transition to websites as the dominant lead-generation channel is an important shift for insurers to recognize and address in their marketing and sales strategies," said Jeremy Bowler, senior director of the global insurance practice at J.D. Power and Associates. "While nearly one-half of all accepted Web quotes are closed by either an agent or call center representative, customers are clearly more often looking to insurers' sites or third-party sites in the early stages of the shopping process, and this behavior is blurring the lines of how we traditionally think about the discrete sales channels." The study also finds that the rate of policy churn in the U.S. market has increased during the past two years, returning to levels not experienced since 2008. This is driven both by an increase in the rate of shopping among insurance customers, which averages 33 percent in 2011 (compared with 27% in 2009 and 30% in 2010), as well as a significant increase in the rate of switching companies among shoppers. Among insurance customers who indicate shopping for insurance in 2011, 40 percent switched to a new insurer-up from 33 percent in 2010. More.. |

Independent Contractor Abuse "You Must Stand for Something or Fall for Anything"
CBS News December 2, 2011 8:28 AM
How some employers skirt paying benefits
Dutch Prior is considered an "independent contractor" by his employer Shippers Transport. He says the company classifies him as such to avoid paying him benefits to save money.
When is an employee not an employee?
The U.S. Labor Department is cracking down on businesses that call their workers "independent contractors" in order to deny them wages or benefits. This issue historically is linked to low-paying jobs, and now, as CBS News correspondent John Blackstone reported, it's hitting the middle class. More on the the video link above.

Police Write More Traffic Tickets to Boost Revenue
With severe budget cuts forcing cities and states to increase revenue, police officers are filling the resource gap by writing more traffic tickets.
Many drivers have found that the 5 to 10 mph "speeding cushion" they once enjoyed has vanished.
A recent study* found a strong link between declining revenue and increased traffic citations. The study examined 96 counties in North Carolina from 1990 to 2003 and learned that "significantly more tickets are issued in the year following a decline in revenue."

Farmers Insurance Settles Oklahoma Class Action Lawsuit
SOURCE: Farmers Insurance
November 30, 2011 12:42 ET LOS ANGELES, CA--(Marketwire - Nov 30, 2011) - Farmers Insurance entered into a settlement of a nationwide class action lawsuit, In Re Farmers Med-Pay Litigation, pending in the District Court of Canadian County, Oklahoma (the "Court"). The settlement includes Farmers Insurance Company, Inc., Farmers Insurance Exchange, Truck Insurance Exchange, Fire Insurance Exchange, Mid-Century Insurance Company, Farmers Group, Inc., Illinois Farmers Insurance Company, and certain related entities (collectively, "Farmers"). The Court entered a final order approving the settlement on November 29, 2011. Plaintiffs alleged that Farmers failed to pay reasonable expenses for necessary medical services related to automobile accidents under Medical Payments ("Med-pay") and Personal Injury Protection ("PIP") coverage in automobile policies based on Farmers' use of certain claim adjustment systems and procedures. Farmers denies all of Plaintiffs' claims in the lawsuit. However, Farmers agreed to resolve the lawsuit to avoid the burden and expense of continued litigation. The Settlement Class includes all persons who submitted claims for payment of medical bills related to an automobile accident under Med-pay or PIP coverage if (a) the claim was adjusted from January 1, 2001 to February 9, 2009 based upon a recommended reduction from Zurich Services Corporation ("ZSC"), (b) the claim was paid at less than the amount billed, and (c) total Med-pay or PIP payments were less than the respective limits of coverage. The Class also includes medical providers who were assigned the right to assert these claims. Those affected by this settlement must complete and submit a valid claim form postmarked no later than December 29, 2011. Further information and claim forms can be obtained by visiting www.MedpayClaimsAdministration.com or calling 1-877-846-0588. |

UFAA Chapter 15 Members Gather at Lone Star Steakhouse Entertainment, Gift Cards and Cash Dispersed The majority of UFAA Members registering for the Chapter 15 Annual Christmas Party gathered at the Lone Star Steakhouse in Broken Arrow at 6 PM on December 3rd. This was Okla. State vs. Okla. Univ. Bedlam Football Night!
Upon arrival, members and guests, bearing gifts, were greeted and presented with LED UFAA Flashlights and a $50 Lone Star Gift Card. Members and guests mingled during the greeting period and caught up on discussions from retirement to business activities among the group. All nibbled on appetizers and sipped drinks. As they were seated for dinner, they were presented with a Lone Star upgraded menu listing Porterhouse, New York Strip, Filet and Sirloin Steaks to Chicken and Fish dinners, all priced for two, within the range of the gift cards. Discussion among long time friends continued throughout the dinner period. During the evening, drawings were held to hand out crisp new $50 bills to several attendees. Following dinner, a paid comedian, Gains Kelly, was introduced and presented a comic routine that kept all in stitches, with outbursts of screams of laughter. All seemed impressed with Gain's live entertainment and would recommend him for future events. For more information go to gainskelly.com for your event.. . . . . Next, the hilarious Chinese Christmas gift exchange began. This is where a person selects and

opens a wrapped gift from the gift table and shows what they received. The next person has a choice of taking a gift from the table or steal the gift just opened. If the opened gift is stolen, the previous person returns to the gift table and the sequence continues with loads of laughter from expressions, funny comments and friendly threats of "Don't take mine!" As an opened gift can only be stolen twice, it is then frozen and no longer available. UFAA National Vice President, Mike Ward, was assigned to track and freeze all gift thefts. The Chapter 15 officers sincerely expressed their appreciation to members and guests for the ir attendance to enjoy our cash drawings,* expanded and upgraded menu,* our first live entertainment by paid comedian, Gains Kelly,* for the great laughs. Open enrollment period for child only coverage: Jan 1st - Feb 29, 2012 After State Law addresses Anti-Discrimination
From Commissioner John Doak-
As you all know, implementation of the Patient Protection and Affordable Care Act caused carriers to cease offering child-only health insurance. Although the Oklahoma Insurance Department enacted a child-only health insurance rule last summer, carriers continue to voice serious concerns about re-entering the child-only market. As a result, the rule has been modified. Gov. Mary Fallin signed the modified rule on Dec. 5. (OAC 365:10-1-15, View Online).

R U Being Charged $27.78 for Oklahoma MVRs?
Section 3623.3 of Title 36 Forbids MVR Charges
Effective:
Aug 26, 2011
NEW LAW: A new section of law to be codified in the Oklahoma Statutes as Section 3623.3 of Title 36, unless there is created a duplication in numbering, reads as follows:
No insurer, at any time, shall charge the insurance producer for any costs associated with the necessary documentation or records needed to underwrite a policy. The provisions of this section shall apply only to personal insurance as defined in Section 952 of Title 36 of the Oklahoma Statutes.
As used in this act: Sec: 952
9. "Personal insurance" means private passenger automobile, homeowners, motorcycle, mobile-homeowners and noncommercial dwelling fire insurance policies and boat, personal watercraft, snowmobile and recreational vehicle policies. Such policies must be individually underwritten for personal, family or household use. No other type of insurance shall be included as personal insurance for the purpose of this act.
The State of Oklahoma hiked their MVR costs from $10 to $25 last summer. However, the vendor supplying the MVRs either for Farmers or for the state adds an 11% processing fee of $2.78 to each $25.00 MVR. Oklahoma has the highest MVR fees of all states.
The Oklahoma Voice has received documentation of agent being charged for MVR costs to underwrite auto policies- SOLD. These charges occurred following the effective date of the above Oklahoma law. The agent states he has created two service requests requesting refunds through ServicePoint. Each request received a response that refunds would appear on next months folio. NOT!- according to the agent. "It's rather like they entice you that the correction will be made so you will forget about it." Put a reminder on your calendar to check that a future folio credit appears. Alternatively, you may have to demand an immediate direct deposit be made to you with an email to confirm the date of deposit.
It is our understanding Farmers has been in negotiations with the OID- stating Farmer's position that the new MVR law does not apply to policies quoted, On policies sold, the agent will not be charged- as they say.
So, just what is to negotiate here? The law appears fair on its' face stating, No insurer, at any time, shall charge the insurance producer... That appears to have the strong meaning and intent of the word "NEVER!" But, legal beagles may be able to weaken the intent and re-define weasel words that confuse.
Perhaps, the law should be revised in the 2012 Oklahoma Legislature stating: An insurer shall never for any reason charge the insurance producer.....
That minor change should remove any and all company negotiations for OID administrative exceptions to the law. In my opinion, this revision gives more than reasonable protection to the producer on all underwriting charges. However, even this revision does not protect the producer/agent for underwriting expenses of personal life and financial products as they are not listed in section 952 above. Perhaps, those products need to be named when sold as personal or family insurance defined in this or another section of Oklahoma law.. -ed

Remember Thanksgiving When Farmers Moved Your Cheese to Chicago?
Sent: 11/21/2011 17:43 From: CorpCommunications
As a reminder, we will be moving our main Data Center from Los Angeles to a state-of-the-art facility in Chicago over Thanksgiving weekend. The majority of Farmers' computer systems will be unavailable during the move. Dear Okie Voice, Well, except for the Monday following Thanksgiving when the system was mostly down, I was waiting on another improvement. SPEED! According to Google Maps Chicago is 692 miles from Tulsa while Los Angeles is 1461 miles away. So, if the distance from my computer is now 1/2 the distance closer to the new state-of-the-art Chicago ITT Center, shouldn't the speed have increased? I still get that rotating circle when moving from one page to another waiting on the next page to load. So, tell us how your communications speed is doing after the move to state-of-the-art(?) Farmer's ITT Facility in Chicago. Okie Agent
