Chapter 15 "Opts-out" of 2012 CP Meeting
Chapter 15 (East Okla.) Officers voted to "Opt-Out" of sending a delegate to the non-mandatory 2012 Chapter Presidents (CP) Meeting, aka, "Winter Vacation Junket." This is due to location is, once again, in a non-Farmers Agent Operating Territory eliminating the local agent recruiting mixer and chapter expansion. We will save the expense factor verses the on-going absence of chapter benefits derived.
Chapter 12 (Okla. City) is considering a similar motion.
We will re-allocate the junket funds to excel our chapter expansion program and enhance member events beginning December 1st as we move our monthly meetings to the more elegant Lone Star Steakhouse with select speakers & planned live entertainment at the 2011 Chapter 15 Christmas Party on Dec 3rd.

Do You Subscribe to AMP? New study shows true value of AMP customers Posted on Dashboard Sept 30, 2011 Thousands of agents already choose AMP for their direct mail efforts, but even these agents may not be aware of just how valuable AMP leads are. AMP's direct mail program uses a number of models to score and identify the very best prospects in every market, focusing your direct mail efforts on customers who are likely to respond and buy from you. We have partnered with a premiere direct mail analytics company to build and constantly fine-tune the models used in selecting these leads. It's worth taking a moment to look at how that process works, and the results that process brings to agents using AMP leads. The process starts with 200 million customer names across our 30 exclusive-agent states. We then count out any current Farmers, 21st Century and Bristol West customers. Next we remove anyone who's indicated they don't want to receive direct mail. Then, we verify addresses using U.S. Postal Service software to ensure the deliverability of each address. Now the fun begins. Each month we run billions of computations on the prospect file to determine which prospects are most likely to respond to and buy from you. These prospects are then sorted, and the very best are matched to AMP-subscribing agents. And a recent study has reinforced that all that work up-front pays off. We analyzed all new households added between January 2009 and June 2011, separating these new customers into two groups: - Forty-five percent of the new households written in this timeframe received one or more direct mail pieces from a Farmers program, including AMP, within 90 days of becoming a customer.
- Fifty-five percent never received a single mailer.

Agents Respond to Farmers Slow Pay of Contract Value Regarding the Okla. Voice article in Oct. 2011 issue and the CV litigation referred to in the case of (Farmers vs. Schirado) 1. Okla. Voice,* Wow, that guy (Schirado) did everything wrong: (1) Selling away, (2) Getting contracts with 20 outside companies before date of termination, (3) Sending his farewell letter on his new insurance company letterhead, (4) Inferring he could write Farmers clients business, just not solicit from them, (5) Alleging unethical conduct by Farmers, (6) Not sending his resignation letter by certified mail, (7) Withholding files even after his first and second contract installment checks, and (8) Apparently, intentionally caused difficulty in use of the files when finally given to Farmers. I'm surprised he won, at first, by getting a summary judgement. Has this case been resolved? Okie Agent 2. Okla. Voice,*
One interesting point in the Farmers vs. Schirado case which I thought was good in motion for summary judgement was the defense that Farmers failed to produce any clients to state they left Farmers because the agent left. UFAA's Bulletin board has numerous comments from terminated ( voluntary/Involuntary) agents about what not to do upon termination. However, actual cases like this are not only interesting, but very good information for the UFAA members. Could this type information be included in our local voice or national voice? Let's face it, all Farmers agents will be faced with this situation- voluntarily or NOT. Okie Agent 3. Okla Voice,* Regarding the Farmers/Schirado case. I am a recently retired Farmers Agent, and I am not defending Farmers in any way. But, I cannot believe what mistakes Schirado made. First, you personally hand the resignation letter to your DM with a signed acknowledgement of receipt, [not just fax it.] Or, as I did, you mail it certified with return receipt to the state office. Next, by sending such a ridiculous letter to his clients, he (Schirado) did violate his contract. Finally, getting appointments with other carriers is not a violation, but writing business that was acceptable to Farmers, is a violation. Yes, I did withhold transfer of the files and telephone number until I received my first contract value check, which arrived in the mail 12 days after my termination. This was clearly stated in my resignation letter per the terms of the AAA Contract. By the way, my DM picked up the files in a neat and orderly condition, not dumped into trash bags. Okie Agent Dear Okie Agents, Thanks for your responses to our article last month. The contract is pretty clear on this issue of switching policies to other carriers. Okie Agent 1, We have not been able to find any court docs later than the date of the appeal decision. Either it was settled out of court, still lingers in the court system or other unknowns.* *This article and comments are not actionable legal advice on how to submit your termination letter or how Farmers defines and pursues alleged contract violations. Fitch Affirms The Farmers Exchange's IFS Ratings at 'A+' October 18, 2011 02:56 PM Eastern Daylight Time
CHICAGO--(BUSINESS WIRE)--Fitch Ratings has affirmed the 'A+' Insurer Financial Strength (IFS) rating of The Farmers Insurance Exchange and it's affiliated Property & Casualty Insurers. The Rating Outlook is Stable. A full rating list of rating actions appears at the end of this press release. Fitch views The Farmers Exchange's strategic importance as 'Very Important' to the Zurich Financial Services(ZFS) group in accordance with Fitch's insurance group rating criteria, which provides uplift to the 'A+' rating of ZFS' other insurance subsidiaries. Based strictly on The Farmers Exchange's own financial profile, Fitch believes the stand-alone IFS rating of the company is two notches below ZFS' group IFS rating of 'A+'. More... Catastrophes caused significant 2011 first-half underwriting losses for U.S. property and casualty insurers, driving the industry's net income for that time period down 67 percent to $6.9 billion relative to the year before, according to an A.M. Best Special Report.
A.M. Best adds in its report, "U.S. Property/Casualty-6-Months Underwriting Trends," that the industry is likely to remain under pressure for the remainder of 2011 as underwriting results are expected to remain weak, commercial lines are expected to remain competitive and investment yields are expected to remain low.
The report says catastrophe-related losses in the first half totaled $27 billion for U.S. insurers, contributing 12.8 points to the combined ratio, compared to 5.8 points in the prior year's first half. The 2011 first-half combined ratio stood at 109.6, up from 100.4.
The overall industry underwriting loss for the half-year was $22 billion, compared to $2.5 billion a year ago.
For personal lines, the first-half net loss was $0.9 billion, compared to net income of $5.8 billion a year ago. The swing is attributable to an underwriting loss of $11.2 billion, driven by catastrophes, A.M. Best says.
For commercial lines, net income dropped 44.2 percent to $5.6 billion in the first half compared to net income of $10 billion a year ago. The underwriting loss was $8.4 billion, and the combined ratio climbed to 108.3 from 100.8.
A.M. Best notes that the P&C industry's top-line growth trended upward, as net premiums written grew 2.7 percent in the half to $217 billion, up from $211.2 billion a year ago.
Policyholder surplus also increased to $556.2 billion from $554.3 billion.
Investment performance "improved modestly," A.M. Best says, with investment gains coming in at $28.7 billion compared to $27.6 billion a year ago.
Speaking to market conditions, A.M. Best says rate increases continue for personal lines, but commercial lines has not seen widespread rate hardening despite the cat losses.

 Oklahoma Statutes Citationized Title 47. Motor Vehicles Section 7-116 - Limitation on Recovery if Not in Compliance with Compulsory Insurance Law - Exceptions to Limit - Who May Assert Limit A. Except as provided in subsection B of this section, in any civil action to recover damages arising out of an accident involving the operation of a motor vehicle or for any claim against the motor vehicle liability insurance coverage of another party, the maximum amount that a plaintiff or claimant may receive, if the plaintiff or claimant is not in compliance with the Compulsory Insurance Law, shall be limited to the amount of medical costs, property damage, and lost income and shall not include any award for pain and suffering. Not getting paid for Policy Transfers?
Did you know that under FA2, if a family member leaves the household and stays with Farmers that the policy must be rewritten as a new policy. The big issue is as follows: You have a current household, the daughter gets married to another Farmers policyholder. The policy is not split or transferred out, but cancelled in the existing household. The new agent writes the policy as new business and the [previous] agent gets nothing for the loss of the policy. Even though, it is same driver, same client, same car, same auto policy Farmers. The irony is that you still have to split the driver out of the household but not the car.  Does Farmers Need an Email Traffic Cop?
Did they say "Without Prior Notice?" Dear Okie Voice, You likely don't remember back in July, 2010 when Farmers placed a new Acknowledgement Notice on the Farmers email system that you had to agree to before you were allowed to access your farmersagent.com email. Most of you probably clicked the agreement, likely, without reading it, and hit the continue button. But, It stated in part,
Farmers email Program"To access or use the Farmers eMail Program, you need to acknowledge you have received, read, and understood the following Notice and you agree to be bound by its terms by checking the box below and clicking "Continue." it continued with more verbiage until the last paragraph where it stated, Farmers reserves the right to modify this Notice, as well as the policies referenced above, without prior notice. Violations of this Notice or other policies of Farmers may result in termination of your appointment agreement or other business relationships with Farmers and/or its appointed agents or district managers, and/or criminal or civil penalties. Most of the United States begins Daylight Saving Time at 2:00 a.m. on the second Sunday in March and reverts to standard time on the first Sunday in November. In the U.S., each time zone switches at a different time. For 2011, we will Fall back one hour on Sunday, November 6th at 2:00 AM. For 2012, we will Spring forward on Sunday, March 11th at 2:00 AM The Spelling of DST The official spelling is Daylight Saving Time, not Daylight SavingS Time. Saving is used here as a verbal adjective (a participle). It modifies time and tells us more about its nature; namely, that it is characterized by the activity of saving daylight. It is a saving daylight kind of time. Because of this, it would be more accurate to refer to DST as daylight-saving time. Saving is used in the same way as saving a ball game, rather than as a savings account. Nevertheless, many people feel the word savings (with an 's') flows more mellifluously off the tongue. Daylight Savings Time is also in common usage, and can be found in dictionaries. Daylight Saving Time is Totally Inaccurate Adding to the confusion is that the phrase Daylight Saving Time is inaccurate, since no daylight is actually saved. Daylight Shifting Time would be better, and Daylight Time Shifting more accurate, but neither is politically desirable. A safety reminder Many fire departments encourage people to change the batteries in their smoke detectors when they change their clocks because Daylight Saving Time provides a convenient reminder. "A working smoke detector more than doubles a person's chances of surviving a home fire," says William McNabb of the Troy Fire Department in Michigan. More than 90 percent of homes in the United States have smoke detectors, but one-third are estimated to have dead or missing batteries. ===============================================================================

Ear on the ground.. Just got word that our Okla. State Executive, John Lucido, is heading over to Arkansas as their State Executive in the very near future. Question is, are we getting a new state executive or is FGI combining Oklahoma & Arkansas?
