TULSA, Okla. Aug 25, 2010- John Doak won the GOP runoff Tuesday over former Insurance Commissioner John Crawford. Doak, [age 47],of Tulsa, took the
lead early in the polls and never lost it, winning the Republican
Nomination for Oklahoma Insurance Commissioner with 71 percent of the
vote. He will represent the Republican Party in the Nov. 2 general
election. "Thank you to everyone who voted Okie Doak," Doak said. "We are
honored by the support we have received as well as pleased by the
national, state and local endorsements of my campaign. I am proud to
have earned the Republican nomination." Since the Primary Election on July 27, in which no candidate received
a majority in the insurance commissioner's race, a number of highly
respected Republican leaders endorsed Doak. These supporters include
former Presidential Candidate and Governor Mike Huckabee, U.S. Senator
Don Nickles, former Congressman J.C. Watts and current Corporation
Commissioners Dana Murphy and Jeff Cloud. "The full focus can now turn to the differences between me and the Democratic candidate, Kim Holland, who was a 2008 Oklahoma
delegate for Barack Obama," Doak said. "I have bipartisan support
across the state, and Oklahomans will have a clear choice to make in
November." "I look forward to beginning a dialogue with insurance companies,
both inside and outside Oklahoma, to enhance the business climate of our
state and improve its economy by drawing more companies here as the
next Oklahoma Insurance Commissioner as well as protecting Oklahomans
from irresponsible rate increases and taxes," Doak said. He is a plaintiff in the federal lawsuit against Obama Care and is an
advocate of implementing health care solutions at the state level, of
buying insurance across state lines and of association health plans to
increase options and lower insurance costs for Oklahomans. Doak has served as an agent for Farmers Insurance and State Farm
Insurance as well as serving in executive positions with national
companies such as Marsh Inc. and Aon Risk Services and is a member of
the Asbury Methodist Church and the National Rifle Association. He lives in Tulsa with his wife, Debby, and their two children, Zack and Kasey. Editor's Notes-John will now face current Insurance Commissioner, Kimberly Holland, in the November 2nd general elections. Holland, whose history in the insurance business is quite vague, will complete her four year term in January, 2011, unless reelected. As for Holland being on the front lines as an agent? That information cannot be confirmed. She was a political appointee in 2005 by Governor Brad Henry which term limits will vacate Henry from the Governor's Mansion in early 2011. It's up to you, as a captive agent, if you would like to change the leadership at the OID in 2011.

Dear Oklahoma Voice, 
I recently received bulletin #10-0174 that went to 11 states regarding consumer
notification of credit information. Farmers is apparently responsible to notify
BOTH the primary insured and the spouse that their credit may be used.
Naturally they passed this on as being the agents' responsibility. If I can not
obtain the approval of both people to use their credit information, does it then
become ineligible for Farmers and therefore eligible for my outside business? I
do not want to violate my contract by placing business outside, however I also
do not want to violate it by misrepresenting facts by clicking the "I agree"
button when I have actually been unable to obtain the second insured's ok.
Please advise if you have any incite... as my outside carriers seem to be
unaware of this requirement and will be quite happy with only the primary
insured's ok. Okie Agent.

Okie Agent. If you don't quote it how will you know if the client is eligible? How would you defend your actions for writing a policy with an outside company if you do not have any company documentation as to its' eligibility? As to the notification of both spouses on credit checks in Oklahoma, we enlisted the help (?) of the Oklahoma Insurance Department. We were directed to these Oklahoma State Statutes. Read them thoroughly as we did and it is a simple task on how to treat Farmers Bulletin 10-0174 under the statutes, as we comment below. -ed
The
disclosure of the use of credit information in underwriting is required
by 36 O.S. § 955. In relevant portion, § 955 provides: If an insurer writing personal insurance uses credit information in underwriting or rating a consumer,
the insurer or its agent shall disclose, either on the insurance
application or at the time the insurance application is taken, that it
may obtain credit information in connection with such application. Such
disclosure shall be either written or provided to an applicant in
the same medium as the application for insurance. The insurer need not
provide the disclosure statement required under this section to any
insured on a renewal policy, if such consumer has previously been provided a disclosure
statement. Okla. Stat. tit.
36, § 955(A). (Emphasis added.) "Consumer" means an insured whose
credit information is used or whose insurance score is calculated in the
underwriting or rating of a personal insurance policy or an applicant for such a policy . . ." Okla. Stat. tit.
36, § 952(4). (Emphasis added.) "Applicant" means an individual who
has applied to be covered by a personal insurance policy with an insurer
. . ." Okla. Stat. tit.
36, § 952(3). A "named insured" is a "person, business, or
organization specified as the insured(s) in a property or liability
insurance policy. In some instances,
the policy provides broader coverage to persons other than those named
in the policy if they have the insured's permission to use the property
that is insured." Barron's Dictionary of Insurance terms, 4th ed. "Other insureds" are "individuals or organizations covered by property and liability insurance other than the named insured." Barron's Dictionary of Insurance terms, 4th ed.
Section 955 uses both the terms "consumer" and "applicant." Because
the definition of "consumer" includes an "applicant" for a personal
insurance policy, an "applicant" is also one whose credit information or
insurance score is used in underwriting or rating the policy. If the
spouse is an applicant on the application, as opposed to being listed as
a potential "other insured," then the use of that spouse's credit
information or insurance score must be disclosed to that spouse "either
on the insurance application or at the time the insurance application is
taken . . ." Okla. Stat. tit.
36, § 955(A). If the spouse is listed on the application as a primary
"named
insured," but his or her credit information will not be used in
underwriting or rating, then § 955 does not require disclosure.
Simple, huh? In the past, agents ran the score on a particular name. Now , the systems runs the score. The question arises, the score on who? The primary insured, spouse or others in a H/.H? Just flip a coin and decide if you MUST or OPTIONALLY comply based on your interpretation of the statutes and what Farmers runs in the background of underwriting. Sorry, the DOI could not have been more help. But, really, what did we expect when we made the inquiry? This is not our first rodeo with this DOI administration. In previous years, the Commissioner would make an administrative rule of clarification. But, that has not happened in P&C in the last 5 years. Could it be that our current Insurance Commissioner only has knowledge and interest in one class of insurance? That being medical insurance? That needs to change in the November elections. -ed

It would appear these 2 districts are ripe for an IRS form SS-8 filing The resulting investigation and audit is long term and grueling for the DM in determining if the DM has crossed the line and complainants have been treated as employees. Agents receiving such letters should keep them in a file that would become very useful during an IRS investigation. -ed

AGENCY CONCERNS
Every
month thousands and thousands of agents call and send emails to UFAA
expressing their concerns with the direction of Farmers and the behavior
of certain management individuals that impede and interfere with their
ability to service and sell insurance policies. It is probably fair to
say that the majority of management individuals are academics in the
sense that they have no real concept of what it takes to sell and
service clients in an insurance agency. For them it is all academic, something they read about or learned in a classroom. They are given quotas from upper management and their only concern is achieving their quota by whatever means necessary. Which brings me to the purpose of this article. Most
agents know that September 2010 is hump month for Life insurance so
that district managers, DMM's, State Directors and other management
individuals can try and hit their assigned quotas. This is critical to
them personally as their bonuses, maybe their very jobs are based on the
achievement of their quotas. So the pressure has begun. Agent's
are starting to report that they are receiving letters from their State
Directors informing them that they have only sold X amount of policies
in the last 12 to 18 months. The agents have noticed that the letters
are being copied to their DMM, District Manager and agents file. They are also start!
ing to receive letters from their DM's concerning the same issue. This infuriates most agents as it is implying that the agent also has some type of quota. Most state they could care less if a copy goes in their agents file, as it doesn't really mean anything. Let
us be clear, that agents should always strive to sell life insurance
protection, auto insurance, homeowners insurance, disability insurance,
etc. whenever there is a need by their clients. That is the professional responsibility of every insurance agent. UFAA will be watching the behavior and actions of management individuals very closely in September to see if any of their actions violate the Independent Contractor ruling. To
refresh your memory, that means that production quotas, mandatory
meetings and mandatory reports are a violation of Federal law. If
any of these activities are breached, then the agent may be
reclassified as an employee by the IRS and FGI could be responsible for
the agents Social Security taxes, paying vacation, etc. The
AAA also specifically states that there are no production requirements
and nothing in the contract shall be construed as an employer/employee
relationship. Please inform UFAA, whether you're a member or non member at no@ufaa.com, if you feel your Agency Contract or Independent Contractor status is being threatened.

No Kidding? Just what have we agents been screaming?
J.D. Power said price was the main driver in declining customer
satisfaction, with the industry satisfaction average moving from a high
of 801 last year to 777 this year. "Now that the market has stabilized, consumers are
feeling more in control of their finances and have become more aware of
and sensitive to the rate increases that have started to occur since the
recent recessionary period," said Jeremy Bowler, senior director of the
insurance practice at J.D. Power, in a statement. "As
a result, customers are considerably less satisfied with their insurer
and their rates, and have begun shopping for new insurers at
unprecedented high levels not seen since prior to the recession," he
added.
Last year, the top five, in order of [the 1,000 point possible index ranking], were State Farm, Shelter, Auto-Owners, Erie Insurance and COUNTRY. While GEICO moved up in the overall rankings, its index score fell from 806 in 2009 to 793 this year. State Farm, which was at 831 last year, fell to 795. Erie, the number-two carrier this year, saw its index score go from 823 in 2009 to 815. Auto Owners went from 825 to 813, and Shelter dropped from 828 to 807.
[ Reviewing the 3 yr. history on this index, the entire index average is down from 801 in 2009 to 777 in 2010. Farmers had 777 points in 2008 improving by 20 points to 797 in 2009. However, Farmers dropped a dramatic 40 points in the 2010 customer satisfaction index to 757, which represents a 40 point loss in while the industry average loss is 24 points dropping Farmers to dead last in the J D Power "About average" category.] Hello? Independent Companies beginning to tighten their belts
Travelers Dwelling Fire Changes in Oklahoma Effective immediately Travelers is no longer accepting new business dwelling fire policies. Current Travelers Dwelling Fire
Policies will remain in force and will NOT be nonrenewed at this time. Travelers
will continue to write new business homeowners subject to writing the
supporting auto policies. Some homeowners restrictions will apply based
on your agency's home vs. auto ratio. Safeco Dwelling Fire Policy Guidelines in Oklahoma Several years ago, the Oklahoma Department of Insurance implemented a mandatory change
to the base dwelling fire policy form to promote affordable coverage for Oklahoma
consumers. The state mandated that the base form limit coverage for
roofs to Actual Cash Value (ACV). Safeco responded to this change by
offering Replacement Cost (RC) on roofing through the addition of Option
A to the base form. Main Points to Consider: · Roofing
claims in the OK Dwelling Fire Program are settled on an ACV basis for
policy forms 2 & 3 unless Option A (Extended Dwelling Coverage &
Replacement Cost Roofing) is selected. · Option A is not available on any residence constructed in 1939 or prior. · Option A is also not available on policy Form 1 or on Condo Form 8. Hanover Homeowner Changes In Oklahoma Hanover has been working diligently to ensure that their pricing is supporting their desire to grow profitably in the Oklahoma market. Effective 9/1/2010 for Renewals and 10/1/2010 for New Business, Hanover is making the following revisions to the pricing of their Homeowners product: · For those customers writing both their Home and Auto policies with Hanover, Hanover has increased the Account Credit to 35% making it even more effective for you to write the total Account with Hanover · Hanover
has increased the Wood Roof Surcharge from 12% to 35%. Please note
that homes with Wood Roofs are ineligible as new business. This
surcharge applies to any in-force customers. · Hanover has revised their pricing significantly by territory - with territory only changes varying from +20% to -5% · Base rate increases for all form types · New Business Eligibility Changes Effective 9/1/10 · Minimum
Deductible on New Business is $1000 All Peril and 1% Wind/Hail
Deductible for all Dwelling and Condominium Policies; Tenant policies
require a minimum $1000 All Peril Deductible. · Coverage A Minimums have been increased to $150,000 in Tulsa County Hanover is not writing new business homeowners in the following counties: Canadian, Cleveland, Oklahoma, Logan, McClain, Grady, and Lincoln. Monoline Auto is still available. IMPORTANT HANOVER ROOF CHANGES EFFECTIVE 9/1/10 To
be eligible for Replacement Coverage on Roof materials, the age of the
roof must be less than 10 years old and in good condition. Submission
of a front and back photo of the risk is required and the risk may be
subject to inspection before approved. AT THE TIME OF BINDING: Please
submit front/back photos along with other required documents by email
to your underwriter. Refer to the quote submission for underwriter's
name and email address. Failure to provide front and back photos of the
risk will result in Actual Cash Value Roof Coverage. Roofs
older than 10 years but less than 15 years of age may be written on an
Actual Cash Value basis. Roofs older than 14 years are ineligible for
coverage. Safeco Auto Product Enhancements in Oklahoma Effective Aug. 26 for New Business and Oct. 15 for Renewals, Safeco will be making the following changes: · Increase to
base rates to keep pace with loss costs · Redefinition
of territories and territory factor changes, allowing Safeco to more
accurately align expected losses and pricing at the coverage level · Account Discount will no longer vary by coverage. The discount will be 12% across all coverages, making it easier to sell. Focus on Retention! · With
the change to the account credit, selling customers on the benefits of
packaging their Safeco Home and Auto together is easier, as the discount
no longer depends on the coverages purchased. · Annual
policies give agents more time for relationship building with their
customers on annual auto versus those on a six-month policy. It also
provides rate stability with only one renewal per year.

Simi council to take up Farmers move on Monday
The
Simi Valley City Council
on Monday is scheduled to address the recent announcement that Farmers
Insurance, the city's second largest private employer, is relocating to
Woodland Hills. Councilman Steve Sojka, who is running for mayor in November, said he
plans to present suggestions by neighboring businesses on how the city
can help them cope with the impending loss of Farmers. Many of the
company's 1,200 employees frequented those businesses. Sojka said he collected the suggestions during recent interviews with
a majority of the businesses near the 240,000-square-foot main Farmers
building at 3041 Cochran St. "The bad news is 1,200 employees who used to shop nearby before and
after work and during breaks will not be around until that building is
filled again," Sojka said in a prepared statement. The suggestions include: - Temporarily removing certain restrictions of the city sign ordinance, including limits on temporary signs and banners. - Temporarily waiving the business license tax for small businesses within one-half mile of the Farmers building. - Allowing for sidewalk sales and similar special promotions, which may be currently restricted. - Expediting the process to declare a new redevelopment zone that
would encompass Sycamore Plaza, the Target Center, the Mervyns Center,
and the Do-It Center. Sojka said that would allow small businesses in
the zone to apply for low-interest loans from the city's Community
Development Agency. Sojka will ask the City Council on Monday to direct City Attorney
Tracy Noonan and City Manager Mike Sedell to bring back the
recommendations for formal action at the council's Sept. 20 meeting.
Meanwhile, the council on Monday is expected to officially form a
so-called red team to expedite finding a new tenant for the building.
The team will include representatives from Farmers, which is locked into
a lease at the building through 2017. The company is consolidating its
offices and expects to move early next year. The city has sent letters to more than 1,200 commercial real estate brokers seeking their help in the tenant search, Sojka said. Farmers' decision to move from Simi Valley after nearly three decades
came a year after the company acquired 21st Century Insurance Co. The
latter company had a modern facility in Woodland Hills that is now at
Farmers' disposal. "We want you to know that the decision to relocate our employees and
consolidate our offices to Woodland Hills was solely a business
decision," Lonnie Sproat, Farmers vice president of commercial
operations, said in a letter released by Sojka. "We have been very happy
with the Simi Valley community and the support from the City Council
and the Mayor." Farmers owned the building until 2005, when the company sold it to
generate cash. It's now owned by a New York-based real estate investment
company, Capital Lease Funding Inc. Sojka is running Nov. 2 to succeed incumbent Mayor Paul Miller, who
is retiring from public office. He is being challenged by former Simi
Valley City Councilman Bob Huber, chairman of the Ventura County
Community Colleges Board of Trustees. The City Council will meet at 6:30 p.m. Monday in City Hall, 2929 Tapo Canyon Road.

 | SECURING A WIRELESS NETWORK IN WINDOWS 7, VISTA Jack from Minneapolis, MN, listens to my national radio show via podcast and watches the show live at TVKim.com because he is a member of Kim's Club.
He is trying to secure his wireless network. But he can't find my
instructions for Vista or Windows 7. He wants to know if I can update
the directions.
Well, Jack, I do actually have some guides that includes Windows 7 and Vista. You can find one here. That should cover everything you need to know.
But, really, the instructions for each operating system actually
aren't that different. Most of the configuration is done in the router
itself. That's where you set the network name and encryption. And the
router can be accessed from the Web browser in any operating system.
The only differences occur when re-connecting to the network
after settings change. Fortunately, Windows 7 and Vista should handle
the connection almost automatically. Windows 7 is especially good about
wireless networking. So, you shouldn't have too much trouble securing
your network.
Keeping your wireless network secure against intruders is a good
start. Here are some other things you can do to keep your computers
safe: FINDING A FREE E-MAIL PROGRAM FOR WINDOWS 7 Juda from Herrin, IL, listens to my national radio show on
WJPF 1340 AM. He has a small business that recently upgraded to Windows
7. On his old machines, he used Outlook Express. But that won't run on
Windows 7.
He can't seem to find a good replacement e-mail program. And
no one else has had helpful suggestions. So he wants to know what I
recommend.
If you're comfortable with Outlook Express, Juda, I suggest
the latest version. Outlook Express got a name change. It is now called Windows Live Mail. It's a free download that comes in the Windows Live Essentials pack.
It's designed to work with Windows 7. So you shouldn't have
any problems. And the interface is pretty close to Outlook Express. But
it has a lot of upgraded features. For example, it now works better
with Webmail services.
If you don't like Windows Live Mail, there is another popular program you might try. That's Mozilla's Thunderbird. You indicated that you tried it three years ago and didn't like it. But it's come a long way since then.
The latest version has a lot of cool features. Managing e-mail
is easier than ever. And it's easy to set up mail accounts. You can get
the Lightning add-on to add powerful calendar functions. Since Thunderbird is free, it won't hurt to give it another try.
You might also consider accessing your e-mail online.
Free Webmail has gotten quite good. The functionality isn't much
different than desktop-based products. And you can access your e-mail
from anywhere. Finally, you could always buy the full version of Outlook
($139). It's guaranteed to be compatible with Windows 7. And it has more
features than you'll ever need.
E-mail is great for communication, but it can always be better. Here are some ways to make e-mail more useful:

Voluntary Terminations?
More non-existent farmersagent.com addresses were returned to the Oklahoma Voice following the emailing of the August issue. This brings, according our count, 113 agents leaving their Farmers Agencies since January. Since Farmers has prohibited personal email on the agency email system, UFAA is encouraging agents to obtain an alternate email source such as, Gmail, AOL, Yahoo, etc., for agents to receive their personal email. As we drop the farmers addresses and use alternate email addresses, our future tracking of non existent Farmersagent email addresses will become more limited. Today your Friends, Tomorrow your Competition We assume that most terminations have been voluntary and some may be forced under the new agent contract on agents not making quota. Many agents leaving Farmers are converting to independent status. They will come back after the non-compete year and take many Farmers clients back home with them.

If Farmers experienced a 17.7% loss in premiums, agents likely did too. To determine your 2009 losses, take 17.7% of your GWP and multiply by an appropriate commission average. Station Fire Victims Sue Farmers Insurance
Homeowners claim Farmers is refusing to pay for smoke, ash and other damage to their homes.KTLA News August 18, 2010
LOS ANGELES -- More than 1,000 homeowners whose houses were damaged in
the 2009 Station Fire are taking Farmers Insurance to court. A lawsuit filed Tuesday accuses Farmers Group Inc. of refusing to pay
claims to policyholders whose homes were damaged by last summer's
massive Station Fire near Los Angeles.
The suit, which claims breach of contract and unfair business practices,
seeks unspecified damages for homeowners who reported smoke, ash and
other damages from the blaze that killed two firefighters, destroyed 89
homes and scorched 250 square miles of Angeles National Forest.
Farmers denied or minimized claims to boost its bottom line, said Brian
Kabateck, an attorney for the plaintiffs, adding the average loss among
homeowners named in the lawsuit was $25,000 to $50,000. "Once again, it appears Farmers has engaged in the egregious practice of
denying or underpaying claims, simply to frustrate policyholders and
discourage them from seeking the compensation they deserve," Kabateck
said.
Farmers spokesman Jerry Davies said he couldn't comment on the lawsuit because the company had not seen it yet.
Farmers and other insurers were accused of similar practices after the
1994 Northridge earthquake that killed 72 people and caused an estimated
$15.3 billion in damage. Other insurance companies have paid claims for the Station Fire, Kabateck said.
Farmers is accused of hiring biased consultants to deny or undercut
claims as well as being unreasonable in its claims adjustment practices. "The result is that plaintiffs and defendants' other insureds are
cheated of monies rightfully owed to them," according to the lawsuit.
Russell Reed, 55, a plaintiff in the case who lives in Altadena, a
community near the site of the fire, said he had damage to his home and a
layer of ash and debris a foot deep in his pool that clogged drains and
became a nuisance for weeks. Farmers agents came out a month or two after the fire and said he wasn't eligible to receive any compensation, Reed said. "A month later, I guess they couldn't find no ash," he told KTLA. His wife, Marsha, said other residents had a much easier time collecting insurance money.
"Everyone else said how easy it was for them to collect... and they
weren't even as close as we were. They've collected and here we are and
we've collected nothing."
