For Release: 08/27/2009 FTC Rule Prohibits Unwanted "Robocalls" Effective September 1
Telemarketers Must Obtain Prior Written Approval from Consumers Who Want to Receive Such Calls
Beginning
September 1, 2009, prerecorded commercial telemarketing calls to
consumers - commonly known as robocalls - will be prohibited, unless
the telemarketer has obtained permission in writing from consumers who
want to receive such calls, the Federal Trade Commission announced
today.
"American consumers have made it crystal clear that
few things annoy them more than the billions of commercial
telemarketing robocalls they receive every year," said Jon Leibowitz,
Chairman of the FTC. "Starting September 1, this bombardment of
prerecorded pitches, senseless solicitations, and malicious marketing
will be illegal. If consumers think they're being harassed by
robocallers, they need to let us know, and we will go after them."
The
new requirement is part of amendments to the agency's Telemarketing
Sales Rule (TSR) that were announced a year ago. After September 1,
sellers and Telemarketers who transmit prerecorded messages to
consumers who have not agreed in writing to accept such messages will
face penalties of up to $16,000 per call.
The rule
amendments going into effect on September 1 do not prohibit calls that
deliver purely "informational" recorded messages - those that notify
recipients, for example, that their flight has been cancelled, an
appliance they ordered will be delivered at a certain time, or that
their child's school opening is delayed. Such calls are not covered by
the TSR, as long as they do not attempt to interest consumers in the
sale of any goods or services. For the same reason, the rule amendments
also do not apply to calls concerning collection of debts where the
calls do not seek to promote the sale of any goods or services.
In
addition, calls not covered by the TSR - including those from
politicians, banks, telephone carriers, and most charitable
organizations - are not covered by the new prohibition. The new
prohibition on prerecorded messages does not apply to certain
healthcare messages. The new rule prohibits telemarketing robocalls to
consumers whether or not they previously have done business with the
seller.
Under a previous rule that took effect on
December 1, 2008, telemarketing robocall messages by businesses covered
by the TSR must tell consumers how to opt-out of further calls at the
start of the message, and provide an automated opt-out mechanism that
is voice or keypress-activated. Prerecorded messages left on answering
machines must also provide a toll-free number that connects to the
automated opt-out mechanism.
After
September 1, consumers who receive prerecorded telemarketing calls but
have not agreed to get them should file a complaint with the
Commission, either on the donotcall.gov Web site or by calling
1-888-382-1222.

Analysis Reveals Surge in Suspicious Claims
During tough economic times, anecdotal evidence of a surge in suspicious
claims is easy to come by. Now, new data from the Des Plaines, Il.-based National Insurance Crime Bureau (NICB) backs it
up.
Indeed, for the first half of 2009, NICB data shows increases in
nearly all referral categories compared with the first half of
2008.
"While there has been modest improvement within a few categories of
referrals, the overall number of questionable claims for the first half of 2009
is 13% higher than it was at this time last year," Joe Wehrle, NICB president
and CEO, said in a statement.
Specifically, a total of 41,619
"questionable claims" were referred to NICB for closer review and investigation
by member insurance companies in the first half of 2009, compared with 36,743
received during the same period a year earlier.
While the NICB data
encompasses property/casualty, commercial and vehicle data, the most pronounced
surge occurred in auto claims, as suspicious car fires were up 20% from last
year, suspicious auto glass claims up 76% and "phantom" accidents were up 46%.
On the casualty side, the biggest gain was seen in "slip and fall"
accidents, which rose 47%.

Insurance Industry Loses Jobs for 10th Consecutive Month

Despite talk of improvement, things still look somewhat bleak for insurers.
The industry lost an additional 12,800 jobs in the month of August, the 10th
consecutive month of losses, according to seasonally adjusted data released last
Friday by the U.S. Bureau of Labor
Statistics.
Insurers' August payrolls included 2.240 million
employees, down from a seasonally adjusted 2.253 million in July, the report
says. Additionally, the adjusted number from the previous month, which
originally was reported as 4,800 jobs lost, was updated to 9,400 jobs
lost.
In contrast, the economy as a whole lost 216,000 jobs "an
improvement over previous months and less than economists' forecasts" but the
losses for the previous two months were revised upward slightly. This raises the
total number of jobs lost since the start of the recession in December 2007 to
6.9 million. While the decline seems to have slowed, the unemployment rate rose
more than expected from 9.4% to 9.7%, just shy of the 10% that many experts have
predicted could be a low point of the recession, says the report.
Looking
at individual lines of business, statistics showed only one sector saw
employment growth in a year-over-year comparison: health insurance, which has
exhibited steady strength. Health was up 2.7% over 2008, with 462,000 jobs,
though the total was down slightly from the month before.
Reinsurance,
which the report says also has been steady in recent months, remained relatively
flat "down just 100 jobs over the year" totaling 28,800. Property/casualty
insurers were the only group to see a very small month-over-month increase,
though the sector is down 2.6% since 2008 to 479,300 jobs. Life insurers
employed 346,000, down 3% since the year before. Agents and brokers, the largest
category of insurance employees, showed a 3.7% slip to 652,800. Third-party
administrators have slipped 6.3% since 2008, totaling 123,400 employees. Title
insurers continued their steep decline, showing a 15.2% drop year-over-year to
69,400. Finally, claims adjusters were down 13.2% to 47,300
jobs.
Additionally, the report found average weekly earnings for the
insurers' non supervisory positions were up across the board from June 2008 to
June 2009, save third-party administrators, who were paid $751.28 3% less than
the year before.
Life insurer pay climbed 7% to $988.23; health insurers
rose 5.2% to $930.40; title insurers increased 3.8% to $820.22; Reinsurance
rocketed 17.6% to $841,70; agents and brokers saw a boost of 4% to $745.17;
claims adjusters were up 2.1% to $876.46; and property/casualty ascended 3.2% to
$999.49" the highest rate of all the sectors.

Farmers Firing & Hiring Need a Job?
  Following an announcement of laying off over 750 jobs at the 21st Century facility in California, Farmers-21st Century has announced hiring up to 50 CSAs in Lewisville, Tx and hiring over 100 CSAs and others at the Wilmington, DE. facility. Farmers also updated the size of the planned new building by an additional 100k sq. ft.at the (Foremost) Caldonia, Michigan site by adding a third floor to the new facility to support 1,600 new employees.

Allstate Settles Age Bias Case with EEOC Chicago Tribune 09/11/09
ST. LOUIS - Allstate Insurance Co. will pay $4.5 million to about 90 employees
to settle an age discrimination lawsuit stemming from the company's 1999 move to
switch thousands of its agents from employees to independent contractors.
The settlement was announced Friday by the Equal Employment Opportunity
Commission office in St. Louis. Allstate said it believes it acted appropriately
but settled to avoid a lengthy legal battle.
The EEOC said Northbrook,
Ill.-based Allstate's 1999 reorganization hurt older workers looking to be
rehired in another role by the company.
"They basically terminated the
employment of 6,400 sales agents who had been employees, but everyone could have
remained as independent contractors," said EEOC lawyer Felix Miller.
Many sales agents who were no longer employees sought other jobs with
the company, such as positions in customer service or claims representatives,
Miller said.
But Allstate adopted a policy not to rehire sales agents
for one year after their employment ended, or longer if they were still
receiving severance benefits. The company had stopped hiring new employee sales
agents in 1990 as it moved toward using outside contractors, so the group of
workers affected by the changes in 1999 and 2000 tended to be older, Miller
said.
The EEOC said it brought the case because 90 percent of the agents
subjected to the hiring moratorium were 40 or older. It was filed in Oct. 2004
under the Age Discrimination in Employment Act. Allstate spokesman Mike
Siemienas said Friday, "While confident that Allstate acted appropriately, we
agreed to settle the long-standing dispute to avoid the burden and considerable
continued expense of litigation for everyone involved."
He said related
points of law remain disputed, and the company believes it would have legally
prevailed if the matter had continued in the courts. The settlement must
be approved by U.S. District Judge Richard Webber.
The awards to about
90 individual former agents are expected to range from about $9,000 to $114,000,
based on actual losses each person suffered and the likelihood of success each
case would have had for a legal judgment in its favor, Miller said. Funds go to
former employees who sought employment, or would have sought it, in the absence
of Allstate's policy. The settlement provides for discrimination
training and other efforts to educate Allstate managers to prevent any
violations of the Age Discrimination in Employment Act, according to the EEOC.
The Allstate
Corp., the parent company of Allstate Insurance, is one of the nation's
largest insurance providers. It has 37,000 employees and 14,800 agents and
financial specialists according to its Web site.

Motion Ads on Yahoo
Slow Internet sites with Win2k and IE 6.0
Dear Editor,
Like me, there are likely a lot of agents using AT&T high speed Internet that also use the AT&T/Yahoo email program. There are just too many pop up ads on this service and their customer no-service just tells me to upgrade to a commercial email account for $9.99/mo. and receive no ads. But, that's like charging me to unlist my phone number! Okay, I got use to the static ads until several months ago, they started using Adobe Flash 10 moving ads. I could not retrieve or send an email until the ad finished its' motion. Then last week, they had an ad by AT&T that cycled on my screen like a merry-go-round and never ended. I had to restart Yahoo. AT&T customer no-service just repeated to buy a commercial email account w/o ads for $9.99/mo. A friend of mine told me about Mozilla FireFox Internet Explorer. I downloaded the latest version compatible with Windows 2000, XP and Vista. I saw an add-on called Adblock Plus. Of course, I now have to access AT&T/Yahoo mail through FireFox and when a moving ad pops up, Adblock Plus places a small "delete box" on the ad and I just click it. Bam! It's gone-4-good. Just thought others may use Windows 2000 and IE 6.0 I would share this with you and "Agents Helping Agents." Okie Member Dear Okie, I have had the same problem using Windows 2000 and Internet Explorer 6.0 on some websites that have become woefully slow in loading and page changes. I have used FireFox for several months to create the Oklahoma Voice but, not to access my AT&T/Yahoo account.I took your advice and upgraded FireFox to the latest version and added Adblock Plus. It works as you say and, very well I might add. And, Firefox has sped up those use to be slow sites. Thanks for "Agents Helping Agents." -ed. |
 Will DWT become Illegal?
Here's one issue in these contentious times that almost everyone appears to
agree on: Driving while typing out text messages on a mobile phone is dumb,
potentially deadly and should be banned.
So let's just ban driving while texting, right? Not so fast. Nothing's ever
that easy, especially when powerful economic interests and different levels of
government are involved.
Later this month, the National Highway Traffic Safety Administration plans to
convene a "summit" on "distracted driving." The issue of driving while texting,
or DWT, will be high on the agenda. For the first time, it appears that most
major interest groups involved are for doing something to make DWT illegal.

Insurance Journal National Surveys
The Insurance Journal asked it's online readers the following survey question-
Has your agency seen an increase in auto insurance business due
to the government's "Cash for Clunkers" program?

customers are shopping around and customer retention is about 90%.

advertising in our area, there are xxxxxx dollars. As business owners this is

21st Century Leads May become Discriminatory The following was printed in the 09/18/09 issue of the Agency Insider
"With the acquisition of 21st Century complete, we continue to work diligently on developing a strategy to distribute leads to Farmers agents. Ensuring that we create a system that is effective and turn-key for our agents to use is a top priority. Our first step in developing a strategy was to gather feedback and ideas from the agency force. Working with 26 Presidents Council agents and district managers we addressed many topics including:"
· What criteria agents should meet to be eligible for leads · How the leads will be segmented, prioritized and distributed to agents · Support materials that agents need to convert leads to sales

convicted of violating the provisions of this section shall be guilty of a
misdemeanor and shall be punished by the imposition of a fine of not more than
Five Hundred Dollars ($500.00) or imprisonment in the county jail for not less
than six (6) months nor more than one (1) year, or be punished by both said fine
and imprisonment.
Number of infractions and victims affected may be combined and penalties totaled. In Oklahoma, any jail term exceeding 1 year and/or fine of $1,000 or more is considered a felony- DOI will not renew license! -ed
