Errors and Omissions Insurance "Agents Helping Agents"
Dear Editor,
I just received a call from Jenette with Calsurance, the Farmers E&O carrier. The courtesy call was just to ask why we have changed the insurance company on our errors and omissions policy.
I told her that Calsurance and Farmers Group Inc. were both super-duper companies to do business with, and the reason that we left had nothing to do with the service that we had been receiving.
So she asked, "If you don't mind, what was the reason that caused you to leave?" I was happy to explain to her, it is not a reason, it is several reasons.
#1. "Our new policy with Lexington sponsored by UFAA does not have the gaping holes in coverage that we had with your policy."
#2. "If an agent follows our newly selected company's loss control manual there is $0 deductible."
#3. "My premium is only $83 per month."
#4. "Farmers is not involved in my claim."

UFAA Sponsored E&O is a Go!
The up front costs of the billing costs of $40 is necessary as there is no folio access with the E&O carrier. The E&O education and documentation services is necessary to eliminate the policy deductible and creates a charge the first year only. After that, your E&O costs should be reduced $100 while gaining the needed broader coverage at an even more competitive price for small to medium size agencies. Larger agencies with considerable outside business have been a few dollars higher monthly but, it's worth it to get trustworthy E&O coverage.

Did you guys get this ad through farmersagent.com? (spam?) Independent Insurance Agency? "INCREDIBLE". "They are actively pushing us out, both from the rear and now from the front, dangling the carrot?"
This ad was received by several Farmers Agents in Washington State. That state is led by a Harley-riding-mama State Exec. that has surpassed the break-even point on GWP.
Per stats on the agency Dashboard, Washington has lost both PIF and Gross Written Premium during 2008 following several rounds of rate hikes. While GWP was somewhat offsetting agent income on lost PIF, that is no longer true. Agents are seeing folios drop continuously each month along with NB writings as GWP has moved into negative territory. It is unknown if the ad above was just a freak incident of spam or if it was a paid ad to promote agents to take the hint.
It appears several other states in Farmers territory will begin to see the same reversal in GWP. One can only hike the rates so much on a company-wide declining book of business before the GWP growth goes South as it has in Washington. To check the GWP in your state on Dashboard Managing Page <select> "agent online reports" at top of page under the title "Standard" and select the first report entitled, "Achievement Awards Program." (AG751MON) Near the bottom of the displayed report is the state GWP. Wash. Agent.
 As you can see in Oklahoma, state total GWP is still increasing through 2008 with a gain of $13 million likely from rate hikes, more so, than NB. We don't know if the the GWP is rising or falling in all states but, in states with declining GWP expected, perhaps, that's what all the hoop-la is about driving GWP contest carrots while the remaining loyal, profitable and dedicated insured's finally seek rate relief with the competition.
Get Ready as 2009 will be a hard recession year in your agency touted by Farmers to be recession proof. But, they have revised that statement to now being recession resistant. Better take your insured landlords out to lunch, to promote and resell your agency as two agents have reported a loss of over 55 Landlord Protector Policies so far in the first quarter of 2009. It's quickly being confirmed, management doesn't care about the Farmers Family under the corporate concept. The ad above looks better everyday. -ed |

PIF To Competition last 10 yrs. The agents and policyholders suffer as households and PIF continue to go South since creation of the State Office. A conservative estimate of PIF loss of 203,578 in about the last 10 years over and above written during the same period.
Your Agency Policy in Force (PIF)- Dead Issue:
PIF used to be the buzzword with the Direct Writer Companies until the last few years. Independents have most always spoken in Gross Written Premiums (GWP). Farmers jumped on this bandwagon a few years back and it has become so intense internally, they now are naming their contests GWP while market share is no longer in the corporate lingo.
There is little doubt that GWP is the best way to grade or compare an insurance company as GWP is used to select the top companies in the industry, to determine profits & losses, commissions, and of course, bonuses. However, the internal competition between management and the agency force has seemingly placed us onto a dead end street or is it a death spiral?. We learned over 20 years ago that one cannot hike the rates unreasonably. We did that on Oklahoma auto in 1985 with a 24% rate hike and agents lost hundreds of PIF as well as the related GWP. In 1987, DMs were threatening agents with the Limited Underwriting Authority (LUA) resulting from losses exceeding earned premiums. (LUA was an unprofitable penalty program where agents lost their binding authority in Farmers All NB autos were submitted in MCA. DOI's either passed legislation or issued administrative rules to prohibit such programs as being discriminatory to the insuring public.) There was such an agent uproar that Farmers created "Pricing Committees" across the operating territory. They decided to hike rates only a few percent on a regular basis to keep up with inflation and loss factors. But, those committees are long gone and the state office newbies came along and have continued to hike rates to deplorable levels, running off PIF by the hundreds of thousands in this state, as state directors compete for the next open V.P. throne in L.A. Unlike the past, the agents have remained silent, allowing it to continue, seeing their PIF stagnate or deteriorate- watching their business slowly go out of business. Even those 17% in the above Market Share poll stating income as remained level over 5 years, may not have considered 5 years of increased business expenses into account before answering the poll. The agents in an effort to hold on to clients work the rates downward plugging in unwanted deductibles and coverage reductions has only placed the agency force and management into a death spiral that cannot last. Unfortunately, we have hit our limit on premium reduction options and the company keeps hiking rates on a lower number of policyholders in larger per policy amounts that even our most loyal clients are giving up on us and going to competition as they see the last renewal discount has evaporated on the current renewal.
Oklahoma Numbers - Not a Pretty Picture
The numbers tell the Oklahoma story as our total ANNUALIZED retention is at 79% or a 21% average loss of PIF in policies annually. That means, in a 1,000 PIF agency you have to write 210 policies annually just to break even. But, the household numbers tell of a continuing deterioration of the lack of NB PIF. In December of 2007, Oklahoma had 288,621 households. In December of 2008, that figure had dropped to 271,810- a loss of 16,811. That loss breaks down to 6,942 households lost through the 2nd qtr. of 2008 and the balance of 9,869 lost households through the 4th quarter, and that includes new business written in 2008.TYPE DEC 2007 DEC 2008 G/L Okla. GWP unk +$13 million
Let's compare the last nearly 10 years from 1999 shortly after the State Office was created in 1998. Searching the records there are very few months during this period that H/H and PIF spiked. In fact, both have fallen in every year since mid-1999. We will break this down by state director. Looking back, August, 1999 was our highest H/H/PIF ever in the state.

Coble and Westerman are Sr. VPs in L.A. and, like them, Scott just may make it to L.A. at the expense of every agent's folio and contract value retirement. It appears the average agency PIF has dropped to under 600 at the end of 2008 or 590 PIF by our overly conservative count. For 2009, there will be 16,811 fewer households paying the increased GWP leading Oklahoma closer to the break-even point where accelerated loss of PIF may actually trend GWP to a negative balance compared to previous years. It cost Oklahoma agents the least PIF to make Coble a VP and 4 times as much to make Westerman a VP while Scott is now in second place. "We don't get to drive the train, blow the whistle or ring the bell. But, when the darn thing jumps the track, guess who catches hell." Farmers has selected the Richards Group as their ad company. Richard's has filled the airways with very positive ads over the last few weeks about the stability of Farmers. If Richards only knew the other side of the story of the growing un-stability with the Farmer's Agency Force. Let's check the "Pulse of the Agents." |

Are Farmer's ServicePoint Underwriters Violating Oklahoma Insurance Laws?
Several agents have complained that underwriters, marketing and HelpPoint are working to the disadvantage of the clients and agents. First, Marketing jacks the rates on fire policies to the point of running off insureds. The agent attempts to salvage and rewrite the home to a NG policy only to have it rejected for claim activity- even it it's a $.00 payout. Underwriting views this rewrite under new business rules, although, they are a current insured. Let's review the state laws and you decide if they are right or in error.

Chapter 1 Article Article 36 Section 3639.1 - Cancellation, Refusal to Renew or Increase Premium of Homeowner's Insurance Policy.
No insurer shall cancel, refuse to renew or increase the premium of a homeowner's insurance policy, which has been in effect more than forty-five (45) days, solely because the insured filed a first claim against the policy.
Title 36. Insurance Chapter 1 - Insurance Code Article Article 12A - Applications - Grants and Denials of Coverage Section 1241.2 - Insurance Decision Based on Claim Inquiry Prohibited. "No insurer that issues any type of property or casualty insurance policy in this state shall increase premium rates, cancel a policy, or refuse to issue or renew a policy solely on the basis of a policyholder inquiring about making a claim or requesting information about a possible claim, if the policyholder does not in fact submit a claim."

AGENTS TICKED OFF
 Dear Editor, According to FB 09-0065, dated March 27, Personal Insurance Express, the
new auto and home quoting and application processing system will become effective
for agents in Colorado, Oklahoma, and Texas effective April 19th.
Personal Insurance Express was introduced to the Oklahoma agents in
district meetings over the past week so, we were aware of the pending
roll out. But, what was not mentioned is that the Agency Interactive Share
(AIS) Credit would be retired at the same time. Below is a paragraph from the
bulletin. =============
Discontinuance of Agency Interactive Share (AIS) [near bottom of page 2] We're taking steps in
accordance with the Farmers Way to provide you with the tools you need to
increase your agency's productivity. This means reducing the amount of time you
and your staff spend on administrative work. Our investment in cost- and
time-saving technologies, such as the Lead Center and e-CMS, has already
shown strong results. You'll soon be taking advantage of the increased
speed and accuracy of Personal Insurance Express.This dynamic, new application will save you the inconvenience of having to input Auto and Fire
applications. Now, the company will handle this chore for you and provide
third party pre-fill reports free of charge, saving you and your staff time
and expense. In concert with this new service, we will be retiring the
Agency Interactive Share (AIS) credit. We are committed as an organization to
continuing our development of innovative new tools to help increase your
effectiveness and long-term growth.

"This will cost me about $750 year. Imagine how much $$$ it will save FIG and
cost the agency force. Assuming an average agency PIF of 800, and a monthly AIS
folio credit of $40 x 14,000 agents is a loss of $560,000
a month to the agency force or $6,700,000 annually. So, it's the agents who will be paying
$6,700,000/year for the new quoting system. Oh, I almost forgot. It's designed
to work with Internet explorer 7 which is not supported by the Windows 2000 OS. So, you will
have to upgrade your OS to XP or Vista to even use the
new quoting system." Okie Agent
Dear Okie, Based on Farmers extremely bad timing, seems Farmers employees,
as they usually do on the last Friday [27th] of March, gathered across the
company to receive their profit sharing checks. You know, the profit from the
agent created GWP?
Employees gather, receive their checks and many
are dismissed for the remainder of the day. After they left, field bulletin
popped up on the dashboard of agents in Oklahoma, New
Mexico
and Colorado. Was it intentional that no managers were available to answer inquiries from the agents? They hope by Monday, you will have forgotten all about it.
However, a 2nd level super at SP, advised the Okla Voice, that Okla. SED Gregor Scott signed off on the loss of AIS credits to Okie agents, a company cost cutting expense that is bonus driven similar to GWP. With all the bad press AIG is getting over bonuses, it appears to have arrived in Oklahoma. AIG- Agent's Income Grab.

"From the Past" - The Oklahoma Echo- 1987
The Oklahoma Echo is the predecessor to the Oklahoma Voice. These reprints are from 22 years ago.1. The National UFAA Conference is now known as the UFAA National Convention and was held in Ft. Worth in July 1987. "In open discussions it was learned that many territories of FIG are not competitive in the market place. However, a few areas are very competitive in the commercial insurance arena." Sound Familiar today?
It was discussed, once again, that contrary to what DMs are telling agents, UFAA is NOT A UNION. Here this- Federal law prohibits independent contractors from forming a union. They may however, form an association similar to doctors forming and joining the AMA and homeowners forming a homeowners association. We gather and exchange ideas making our jobs more beneficial to our clients, our business and the company.
Professionalism: UFAA delegates have been instrumental in passing legislation in several states to require agent continuing education courses.
UFAA membership increased dramatically in 1986 and projections are excellent to continue through 1987. (The same has occurred over 2008 and into 2009)
Agent Privacy- Did you sell 167 count last month? So, what if you did or didn't? DMs have a nasty habit of reporting income, sales count, PIF and other personal information to others both in and outside your district. You own and operate your business and such information should be held in strict confidence. Your DM doesn't pass his folio around at district meetings and should extend the same courtesy to you. Simply, write your DM and advise him to refrain from printing your name and personal information or whatever method he used to transmit to others. Or, send him the Okla Statutes title 21 Sec. 839.1 dealing with "Right of Privacy" in using your name or picture. It's a criminal offense! (This would likely apply to the State Office, today.)
What's Happening in other States? -1987
89% of Oklahoma FIG Agents surveyed state they were not competitive in their market. Document other company rates and send to your DM or DAM (DMM). California UFAA Agents did this and with persistency received rate reductions. Be aggressive, not passive or your PIF will continue to dry up on the vine. (Good California wine country pun!)
IOWA: Losing agents as FIG not competitive. Big "I" agent losses are figured on a combination of both auto and fire losses that offsets the overall loss. UTAH: LUA pressured (similar to DARG, today) are being placed on Utah agents who have complained to the DOI who feels LUA Program affects prices to the consumer. Anti-LUA legislation is imminent. Central ARKANSAS: UFAA is the best thing to happen to Arkansas agents.It has allowed agent cooperation and severely reduced in-fighting and policy theft. MINN: Agents have joined an HMO with better benefits than the company program. LITTLE ROCK: Members have an inter-agency photo system and an alternative to the company's 5280 system @ $50.00/mo.
TULSA: One district's agents meet before the DM meeting to express opinions and select agent topics for discussion at the DM Meeting.

Farmers sued for 1.7 million Flying house destroys both homes of Farmers insureds.
"Auntie Em, Auntie Em, help Me!"

Two more lawsuits have been filed in Multnomah County Court by the owners of the second home destroyed in the Burlingame Place landslide. The complaints totaling more than $1.7 million name Dave and Kathei Hendrickson, Farmers Insurance Company and the family's insurance agent.
The Oklahoma Voice requested information on this case from our Oregon UFAA Chapter concerning this flying home, and received this article from their local news.
According to the Portland Tribune, the plaintiff's attorney, Jim Martin said his clients are suing Farmers for not covering damage to the home. Farmers has refused saying the policy does not cover earth movement. "It is our position that the Hendrickson's house is a flying object that landed on my client's house, which is covered in the policy," he said, adding that photographs show no mud on the Chow home. So, my client's home was not damaged by land movement, it was damaged by a house falling on it." Portland Tribune 03/08/09

This week has been gorgeous in Phoenix. Temperatures are just reaching into the 80s. Unfortunately, some of my employees have put a damper on things. I've heard them sniffling and sneezing most of the week. No, a bug isn't going around-it's seasonal allergies!
On Wednesday, I sent out a link to this great site. It lists pollen counts and predominant allergens by area. Check it in the morning. You'll know whether to take your allergy medication. Seems like my hint worked-there were no sniffles Thursday or Friday. If you are fighting allergies, check out this site. Even if they continue, you'll at least know what's causing them.

Lost construction characteristics on homes territory-wide?

Residential Component Tecno-flub-up (RCT) has been a thorn in our sock since it was created with change following change and is constantly aggravating and now problematic on attached garages vs. built-ins per FB 09-0049 effective Jan. 21, 2009.But, now Farmers has crossed the line of decency and respect to their clients and agency force concerning FB 08-0889 where they all but admit they have lost the physical construction characteristics of renewing homes. But, have they? Is this another ploy to hike coverage and premiums to grow the bonus-based GWP with construction assumptions they admit will cause higher replacement values?
The bulletin alludes Farmers lost vital info on the most common construction details including: Year Built, Square Footage, Roof Type, Style of Home, Exterior Wall Covering, Interior Wall and Floor Covering, Garage Type, Kitchen Grade, Bath count by Quality Grade, Number of units, foundation type, Drywall and Plaster selection and any [all] additional features.
Renewing clients are advised to contact their agents to discuss renewals in the letter Farmers will send stating, "We have gathered as much of the missing info as possible from public records on your home." Public records usually contain all or a portion of the missing items above in blue.
According to a ServicePoint Und. Supervisor, the missing items are building characteristics that were not ask for by Farmers on older homes put on the books decades ago and critical errors when converting to FPPS and the subsequent updated versions.
SP will use a website that will give them FREE access to court house records through out many states and counties to update their records. But, they will not work data at fee based counties like Tulsa or those counties without web access such as Creek, Osage, Rogers & Wagoner.
So, we become the motel maids and trash men again cleaning up after Farmers. No wonder agents don't have time to sell. We're always cleaning up another corporate Techno flub-up or while they're just too cheap with record GWP earnings. They may guesstimate data higher to keep GWP high on H/O renewals, running off even more clients. This has the look and smell of another round of creating data retrieval costs to agents. -ed

Oklahoma Agent Survey Results as printed in the July, 1987 UFAA Oklahoma Echo
Our attempt here is to compare problems 22 years ago with with agency issues of today. This survey was published in the Oklahoma "Echo" in 1987, the forerunner of the Oklahoma Voice. Would you take an updated similar survey if we include it in a future issue? See agent poll below.

Free? Online Courthouse Records
According to ServicePoint, there is a questionably free online website where you can retrieve home construction data. This allegedly allows you nation-wide access to courthouse data in all states and counties. You will be required to register with name, email address and provide a password. However, the Oklahoma Voice discovered that many courthouses are either fee based or do not have web access. Generally the phone numbers are listed for direct contact. It is rumored that Oklahoma (OKC) County has free access and retrieval of data while Tulsa is fee based & surrounding counties of Creek, Osage, Rogers and Wagoner do not have web access. U. S. Daylight Saving Time Issues with eAgent
eAgent Feedback answers vastly Improved
Most of the United States begins Daylight Saving Time at 2:00 a.m. on the second Sunday in March and reverts to standard time on the first Sunday in November. In the U.S., each time zone switches at a different time.
This is a change from 2006 when DST began on first Sunday in April and reverted back on the last Sunday in October. If your computer and other electronics are older and programmed under the 2006 and prior DST change dates, you could have a problem with eAgent and other time sensitive websites. So, look at your computer clock display and correct the time and date, if needed.
However, each year, the switch occurs on a different date. For example, this year, DST occurred at 2:00 AM on March 8th and will revert back to standard time at 2:00 AM on November 1st. Surprisingly, next year in 2010, DST will begin on March 14th and revert back on November 7th, almost a week later.
eAgent Feedback Answers Vastly "Improved" A supervisor in ServicePoint was highly promoting agent use of the eAgent feedback link as it has been vastly improved and he encouraged agents to use it. Supposedly, you get real answers today, rather than canned and worthless replies of the past similar to the Roach Motel, where "Roaches go in but never come out." So, the Oklahoma Voice decided to give it a try.
Using the company feedback button at the top of the main page of eAgent, the Oklahoma Voice asked, "What sensitivity issues do eAgent users face if the user's computer has the incorrect time or date?" Question submission form allowed the option of the "preferred contact." Agent selected "email."
Dear Agent, There are a few issues that can occur if the date and time is not set properly on the [agent's] computer 1. Users will not be able to access Webmail 2. Users will not be able to access the University of Farmers
Also, users that utilize Windows 2000 will have issues when daylight savings time takes place. Because the DST date was changed a few years ago, Microsoft stopped supporting Windows 2000 prior to the DST date changing, therefore they did not release a DST fix for Windows 2000. There is a fix available for this, however it entails going into the registry and changing several keys to certain values. This will require a local technician to implement this particular fix. Speaking of Dashboard - Security Alert! Dear Editor: Do you remember Field bulletin 0-9913 dated 09/13/2005 - 3+ YEARS AGO that begins with- "To maintain our high level of online security, we are introducing a new password policy for all users of the Agency Dashboard: you will need to create a new password for your Agency Dashboard User I.D. every 60 days. (Details were posted on Sept. 13 in see Breaking News bulletin 0-9913.")
Did this ever happen? There was a state by state conversion period starting on 09/16/2005 through 12/05/2005. Oklahoma was scheduled to require new dashboard passwords every 60 days effective on 09/22/2005. Dashboard has never ask me to change my password since 2005. I was wondering if my agent number was skipped in the conversion process or if it just did not happen territory-wide. Okie agent
Okie, great question and "yes" I do remember that bulletin and have wondered why it never occurred. This is a very important corporate security issue, especially with the new FACTA Law, that is reviewed on this month's homepage link below. Perhaps, it was just you and I that got left out of the conversion process. Let's check the "Pulse of the Agents" and see how wide an area this issue concerns as the Oklahoma Voice spans the majority of our marketing states. -ed.

"Hot Shot" Email Security Verifications, Receipts & Docs to Clients!"

The above bulletin announces an easy way to email payment receipts to clients. Farmers apparently took our idea and even improved on it where you can email a payment receipt from the ACA section of Dashboard. Thanks Farmers, but we did not see any easy way to email security verifications and other documents to clients. But, that's okay as "Agents Helping Agents" have already solved that issue.
The Oklahoma Voice ran this article July, 2008. It was recommended by a UFAA member who wanted to share this with "Agents Helping Agents." We still get an occasional email requesting the site link.
Dear Editor: "With the advantages built into the Dashboard to allow us to service clients via email, the system only allows agents to print or fax security verifications (SV) (A.K.A. Insurance ID Card on Dashboard) To email, you have to print it, scan it to a file then, attach to an email. I have discovered a free software program called "CutePDFWriter" that converts a document into a .PDF document file without the use of a printer and scanner."
"The agency prepares a SV as usual on dashboard then, hit the print button. When the print manager box pops up, just select the "CutePDF Writer" as your current printer. Then, hit the print button. A "save as" box will open and you can save the SV with a filename or optionally into a folder. Then, prepare your email to the client and attach the file you just saved. It's simple, quick and easy providing your client with a professional quality copy and you retain proof of sending to cover your E&O." Sincerely, UFAA Member Chapter 12, OKC.
