HelpPoint Complaint Dear Ok Voice,
Have you heard any complaints from agents on HelpPoint liability adjusters denying small claims? Here's the story-
A now x-H/O client (as result of this claim) of mine and a senior citizen ask her friend to carry some boxes to an out building on the premises for storage. It had been raining and when the now claimant approached a small ramp to the building door, feet slipped injuring a shoulder requiring surgery. There is debate over the client's maintenance condition of the ramp. The claimant is x-military with medical benefits and works two minimum wages jobs living check to check.
The adjuster was advised only lost wages would be necessary following the surgery and during the healing process estimated at 6-8 weeks or about $3k, as medical was covered by the military. The adjuster quickly paid the $1k premises medical and stonewalled additional payments citing the homeowner had no liability in the injury.
The client called my office and I called the adjuster who stood ground and stated they would pay no more and claimant may consider getting a lawyer. And, continued to state with lawyer involvement, they would likely pay. I said, few lawyers would take on such a small case. "Exactly, came the adjuster's reply. I discovered a few weeks later that a reserve had been placed on my fire loss run for $1,000 for expected future pay-outs.
Is this an isolated case or does it run rampant with HelpPoint? Okie Agent. Dear Okie Agent,
I don't recall any number of liability complaints received on the part of HelpPoint adjusters. In fact, many agents have applauded Helppoint for their outstanding work on several (property only) cat claims over the last year.
But, I did some Internet investigating and found a report that may answer your question. I know this may sound strange, but first, you need to call the adjuster and inquire if he or she enjoys corporate pizza? If so, you must demand the claim be reopened. Trust me, they will get the connection as you will too, if you keep reading below. -Ed

giant Zurich Financial Services, which in the last few years has paid out
nearly half a billion dollars to settle bid-rigging and price-fixing cases.
According to regulators, "businesses shopping for commercial
insurance were deceived into believing they were getting the best deals
available. The whole anti-competitive scheme was an intentional smoke
screen by several insurance players to artificially inflate premiums and
pay improper commissions to those who brokered the deal." (excerpt)

Here comes another year of yo yo commissions up one month, charge backs the next eating recent NB and subsequent renewal commissions.
Along with the mystery amount Auto Rate Increase on January 1st, comes a Fire increase effective January 16. 2009 with suspected territory rating errors increasing rates even more.

P&C Insurers on Government Rescue Funds:
No Thanks!
October 27, 2008 Following reports that the U.S. Treasury is considering adding life, bond and mortgage insurance companies to its list of beneficiaries for some of the $700 billion federal bailout package, property/casualty insurers are making it clear to they don't want any rescue dollars.
The American Insurance Association said it surveyed its board of directors and learned that "a substantial majority of the insurers represented by AIA do not support the inclusion of property/casualty insurers in Treasury's Capital Purchase Program. If made available, they will not elect to participate."
The AIA represents 350 insurers that write more than $123 billion in premiums each year. AIA member companies offer all types of property - casualty insurance, including personal and commercial auto insurance, commercial property and liability coverage for small businesses, workers' compensation, homeowners' insurance, medical malpractice coverage, and product liability insurance. AIA members include ACE, Chubb, Farmers, The Hartford, Travelers, XL and Zurich among others.

How 'bout them SOONERS, COWBOYS and HURRICANES in an Oklahoma Triple Win Weekend.
Sooners Rip No. 2 Texas Tech, 65-21 Texas Tech who has not lost a game all year were trampled by OU Saturday nite Nov. 22. There just seemed to be some good ole Okie justice in that game following OU, OSU and Tulsa U being beat by Texas teams this season. OU now ranks #3 while Texas U is #4 and Texas Tech dropped to #7. (snicker)
Cowboys Beat Colorado 30-17
Oklahoma State's Zac Robinson broke Colorado's hearts again, leading No. 11 Oklahoma State past the Buffaloes 30-17 Saturday night Nov. 22. Oklahoma State still ranks #11 as as we head into bedlam week-end when OSU will face OU Saturday Nov. 29th at OSU's Stillwater home field.
This is bound to be a great game.
Tulsa University Hurricanes-
Whip Tulane 56-7
TU with a 9-2 record losing to Houston and Arkansas, came back Saturday Nov. 22 beating Tulane 56-7. Tulsa did not receive enough votes to remain in the top 25 teams this week. |
The 2008 Darwin Awards Yes, it's that magical time of year again when the Darwin Awards are bestowed, honoring the least evolved among us.
Here is the glorious 2008 winner:
1. When his 38-caliber revolver failed to fire at his intended victim during a hold-up in Long Beach, California, the would-be robber James Elliot did something that can only inspire wonder. He peered down the barrel and tried the trigger again. This time it worked. And now, the honorable mentions: 2. The chef at a hotel in Switzerland lost a finger in a meat-cutting machine and, after a little shopping around, submitted a claim to his insurance company. The company expecting negligence sent out one of its adjusters to have a look. He tried the machine and he also lost a finger. The chef's claim was approved [by Zurich?] 3. A man who shoveled snow for over an hour to clear a space for his car during a blizzard in Chicago returned with his vehicle to find a woman had taken the space. Understandably, he shot her. 4. After stopping for drinks at an illegal bar, you know, one for the road, a Zimbabwean bus driver found that the 20 mental patients he was supposed to be transporting from Harare to Bulawayo had escaped. Not wanting to admit his incompetence, the driver went to a nearby bus stop and offered everyone waiting there a free ride. He then delivered the passengers to the mental hospital, telling the staff that the patients were very excitable and prone to bizarre fantasies. The deception wasn't discovered for 3 days.
