Paying Non-exempt Employees for Work Done After Hours  

 

Do you pay your non-exempt employees for conducting business via cell phone or e-mail after normal work hours? If not, you are in violation of the Fair Labor Standards Act (FLSA). 

 

The FLSA states that employers must pay non-exempt employees for work that is permitted, even if it was not requested by the employer. For example, an employee may voluntarily check their work e-mail or return business phone calls after work hours. The reason for the work is immaterial. The hours are work time and are compensable.

Employee or Independent Contractor? 

 

It is critical that companies correctly determine whether an individual providing a service is an employee or independent contractor. The relationship between the two should govern this determination, not the way the company chooses to pay the person or any agreement made between the two parties. This is easier said than done.

 

The first step is to determine the business relationship that exists between the company and the person performing services. Some employers hire temporary workers to help them during a busy period and think that they are "contract labor" or "contract employees", when in reality such terms are practically meaningless under wage and hour laws and payroll tax laws.
