Youth Employment Regulations

 

High school kids can make great summer employees, but you should use extreme caution when employing minors under the age of 18.

 

Not only should your organization comply with the the Department of Labor's child labor provisions, but you should carefully document that thorough instructions have been given on restricted duties for each age class. The penalties upon conviction of violation are severe. Here are some federal guidelines to follow. 

 

A minor under the age of 18 is prohibited from: 

  • operating a forklift or tractor with any hydraulic equipment;
  • working in a grain elevator, feed mill, fertilizer blending facility, etc.;
  • riding on a forklift as a passenger;
  • operating certain power-driven hoists and work assist vehicles;
  • operating balers and compactors designed or used for non-paper products; and
  • operating power-driven chain saws, wood chippers, reciprocating saws and abrasive cutting discs.

Employee's who are at least 17 years old may drive on public roadways only when complying with the numerous and restrictive FLSA requirements. A minor under the age of 17 is prohibited from driving on public roadways as part of his/her job.

 

Minors age 16 and 17 may legally operate power tire changers in service stations and hoisting racks for the purpose of servicing light trucks and automobiles, sweep out trucks, probe for wheat samples, and operate ordinary power lawn or riding lawn mowers. Minors should not work on tires with interlocking rims. 

 

Child labor laws may differ slightly in each state.
