Our clients are experiencing increased regulations from a variety of governmental agencies including the Department of Labor.  While the DOL has not been as visible with our clients as OSHA or EPA in the past few years, this is changing.  The DOL is examining more rural companies than ever before.  There are a couple of good topics below concerning the Fair Labor Standards Act.   It is imperative that your company be in compliance with these rules.  The DOL has assessed several large fines to Midwestern companies who were not properly addressing these FLSA issues.  Don't let this happen to your company.

FAIR LABOR STANDARDS ACT
 
DOLEverywhere I go there seems to be confusion about The Fair Labor Standards Act. This confusion usually takes two forms:
 
Salaried Positions verses Hourly Positions
About the only guaranteed Salaried Position in a "typical" Cooperative is the General Manager/CEO position. This one position alone is authorized to be salaried. Every other position should be examined very closely by a trained HR Professional who will audit the job and make a recommendation to the General Manager about classification of the positions in the company. No title will protect you from misclassification. In other words it isn't what you call an employee that counts, it is what he or she does to perform their job that counts. I have seen a lot of companies pay hefty fines for a "supervisor/foreman/manager" who is misclassified. If your company has one of these you could end up paying the employee double the amount for any overtime worked in the previous three years.
 
Bonuses
The second source of confusion about wage and hour laws involves paying bonuses. If you pay a bonus based on production (i.e. per bale or per acre) then according to the law you must recalculate overtime based on the new hourly wage that the bonus causes. If you pay a Christmas bonus that is equal for everyone you are okay. If you pay a bonus based on a percentage of the employees final pay for the year (which includes any & all overtime) you are okay. There have been a couple of Cotton Gin Coops that paid some very serious fines for paying a per bale bonus and not refiguring the hourly wages and overtime due. Responsibilities
· Developing and influencing strategic and operational HR initiatives for ProValue clients
· Driving engagement and high performance in order to leverage talent as a competitive advantage
· Planning and ensuring effectiveness of key HR processes (recruitment, on-boarding, training,
performance management, compensation)
· Providing HR direction to client management including guidance on best practices, processes and tools
· Acting as an advisor and coach for supervisors in client companies
· Leading functional HR projects
· Delivering training and developing training programs for clients (including on-site training and
webinars)

Qualifications
Bachelor's degree in relevant discipline with 2 - 5 years related experience as a human resource generalist in two or more of the following areas: employment, compensation, employee relations', or organizational development, or equivalent combination of education and experience.

· Proven skills in building and maintaining effective work relationships with the ability to counsel and advise a broad array of employees at all levels of the organization.
· Demonstrated ability to advance organizational change and development.
· Excellent judgment, problem solving, customer service, and interpersonal skills. Demonstrated ability to handle complex and sensitive matters with tact and discretion.
· Proven clear and effective written and verbal communication skills.
· Strong analytical skills and sophisticated reasoning skills.
· Proven ability to work in a team context and to set priorities, manage competing demands and to provide timely response to urgent issues.
· The ability to sustain ethical workplace practices.

Preferred
· SPHR/PHR certification

Travel
· This position requires extensive day travel as well as overnight travel several times per month, i.e., traveling 95% of the time.
