 Continuing his commitment to recovery efforts in the Gulf of Mexico, Governor Charlie Crist today called a Special Session of the Florida Legislature from July 20, 2010 through July 23, 2010, to address a constitutional amendment banning offshore drilling in Florida waters. American Legion Outraged By Latest VA Negligence In St. Louis The American Legion National Press Release
 WASHINGTON (July 1, 2010) The American Legion expressed outrage today over revelations that a VA medical center may have exposed veterans to serious infections through improperly cleaned dental equipment. Because cleaning protocols were not followed by workers at the John Cochran VA Medical Center in St. Louis, more than 1,800 veterans may have been exposed to HIV and hepatitis viruses. Those veterans recently received letters from the VA center, warning them of possible exposure to the diseases and offering screening and support. "This is an extremely serious problem that has happened before and will happen again unless VA takes whatever actions are needed to make sure our veterans don't run the risk of contracting deadly diseases," said Clarence Hill, The American Legion's national commander. VA has shortened benefits application forms to reduce paperwork for Veterans. The new forms, which are being made available on VA's Web site at www.va.gov/vaforms include a shortened VA Form 21-526 for Veterans applying first-time to VA for disability compensation or pension benefits. This form has been cut from 23 to 10 pages. It is immediately available to Veterans via Web download, and will be available through VA's online claim-filing process late this summer. VA form 21-526 part b for Veterans seeking increased benefits for conditions already determined by VA to be service-connected. This new form more clearly describes the information needed to support claims for increased benefits.
In order to make the claims process faster the VA has also introduced two new forms for Veterans participating in the Department's new fully developed claim (FDC) program, which is one of the fastest means to receive a claims decision. Gathering the information and evidence needed to support a Veteran's disability claim often takes the largest portion of the processing time. If VA receives all of the available evidence when the claim is submitted, the remaining steps in the claims-decision process can be expedited without compromising quality. To participate in the FDC program, Veterans should complete and submit an FDC Certification and VA Form 21-526EZ, "Fully Developed Claim (Compensation)," for a compensation claim, or a VA Form 21-527EZ, "Fully Developed Claim (Pension)," for a pension claim.

Legion Pleased With New PTSD Regulations The American Legion National Article
 Craig Roberts (July 12, 2010) Leaders of The American Legion are today celebrating a victory in the government-mandated streamlining of post-traumatic stress disorder benefits claims by the Department of Veterans Affairs. Announcements by both President Barack Obama during a weekend radio address and by Secretary of Veterans Affairs Eric Shinseki signal a new and, in the Legion's opinion, more even-handed method of awarding benefits to those suffering the so-called "invisible wounds of war." The Legion played a key role in the VA's recognition and treatment of PTSD two decades ago. Under new regulations, in effect as of Tuesday, July 13, veterans applying for PTSD-related benefits no longer need to produce official documentation and eyewitness reports corroborating their claims of traumatic stress injury, nor do they need to have suffered the traumatic stress in a direct combat situation. Under the new regulations, the intense fears of injury or death at the hands of not-easily-identified enemy combatants and terrorists, and in implied combat zones not delineated by formal battle lines, are now considered sufficient "stressors" to support PTSD claims. This opens the PTSD claims process to those former military personnel who were stationed in "behind the lines but still in grave danger," and to women veterans who are technically barred from assigned combat duty. RAPID Claims Act Needs Improvement To Serve Veterans Better The American Legion National Press Release
 WASHINGTON (July 2, 2010) During its review of pending House legislation yesterday at a congressional hearing, The American Legion recommended further improvements to the Rating and Processing Individual's Disability (RAPID) Claims Act. The proposed legislation (H.R. 5549) would help to speed up procedures for considering the disability claims of veterans. In cases where veterans certify they have submitted "fully developed claims" (thoroughly documented to prove that disabilities are service-connected), VA can waive its own requirements for claim development. While such a measure could speed up the granting of benefits to veterans, The American Legion voiced some concerns about the bill at a hearing before the House Subcommittee on Disability Assistance & Memorial Affairs. Senate Urged To Provide Gold Star Parents With Nursing-Home Care Benefits The American Legion National Press Release
WASHINGTON (July 2, 2010)
Leaders of The American Legion are urging members of the United States Senate to pass legislation that would benefit the elderly parents of service members who died while serving their country. The bill, H.R. 4505, would allow any "Gold Star" parent - one who has lost a child during military service - access to veterans' homes administered by the Department of Veterans Affairs (VA). Currently, Gold Star parents can reside in a state veterans' home only if every one of their children died while serving in the armed forces. The bill was introduced by Rep. William "Mac" Thornberry, R-Texas, in late January and passed the House of Representatives unanimously on June 30. But the measure's fate in the Senate is in doubt, according to House Veterans Affairs Committee Chairman Bob Filner, D-Calif. The American Legion is appealing to the U.S. Senate to provide the well-earned benefit to Gold Star parents. Barry Searle, director of the Legion's veterans affairs and rehabilitation division, expressed the organization's support of H.R. 4505 in congressional testimony last May. He said, in part, "We believe firmly that a commitment is made not only by and to service members...but also to family members who must say good bye to their loved ones who head into combat to protect the freedoms of this nation."
