In light of the prevalence of Ponzi schemes in the current economic downturn, those working with Ponzi perpetrators, either in a knowing or unwitting fashion, must beware. The panel will focus on the types of legal theories and factual scenarios which may lead to liability for professional defendants, as well as various defenses to those claims including standing and in pari delicto, among others. The panel will also address certain forensic procedures and examination techniques, and compliance with applicable professional standards.
