Money Woes - Part III, Do I Need a Prenuptial
By Rebecca Harris, MS, LPC, CEAP
Yours, mine, and ours-who pays for what? Today's world holds many types of families. Single person families, single people with pets, two people/one income, two people/two incomes, people with fixed incomes, big families, small families, multi-generational families, blended families. The list goes on. Everyone has different circumstances, responsibilities and obligations for the money they earn. Being responsible stewards of that money is where the discussion gets more spirited. 'Whose money is it, anyway' and, 'how I spend it is my business" are comments people make sometimes in frustration and resentment.
Going back to our family units, a question that often comes up in counseling is what is fair in a relationship. What are the standards for sharing expenses? One thing is obvious, there needs to be clear communication and understanding about how the bills get paid, by whom, and when. For instance, if I live with a group of friends, we had all better trust that the others are kicking in equally and on time. Eating other people's food and using their stuff gets old fast! I also don't want to think I've been paying my share, and then the electricity gets turned off. There needs to be a system, and someone accountable for it.
If I'm in a situation where I am sharing space but the other person owns the house, then what seems fair to pay? If my partner owns the house in just his/her name, then he/she gets the equity and tax credits. Maybe I should pay less since I don't have the advantage of the tax break.
Discussing these issues about sharing financial resources is always a good idea. It becomes a more critical discussion when people decide to legally join households. Perhaps the biggest mistake to make is not asking the question: Do I need a prenuptial agreement? Just the mention of it is enough to extinguish the flames in some romances. It can be seen as insulting, not having faith in the relationship, or maybe just good sense depending on your circumstances.
The 'experts' recommend the following issues to consider when thinking about a prenuptial agreement.
- Are we combining second or third marriages and children?
- What are the provisions made in our wills? What shares should children receive?
- How do my dependent children from a previous union get cared for?
- If one partner has a much greater asset portfolio, (inheritance, etc.)
- If one partner owns a business.
- If one partner has outstanding debt that involves legal issues. (Person's wages are garnished due to back child support, bankruptcy, etc.)
Because money is such a hot topic, and one that causes such emotional stress, it does help to acknowledge issues that may tend to cause resentment before they become bigger. When "we" decide what our priorities are together, we feel we have more say in how the income is spent.
If you would like to talk to one of our EAP counselors about your personal financial problems, we will be happy to provide you with information and referrals that address all aspects of financial stress.
