Carryforward Caution
-------------------------------------------------------------------------

One thing about tax credits that is easy to overlook during this busy time of year -- carryforwards.  Make sure you are carrying forward your client's tax credits.  This is especially critical for pass-throughs that go to multiple equity owners.


We have heard that some tax software packages don't do a good job with Georgia tax credits in calculating annual utilization and tracking balances.  This can get complex with different percentages of individual tax liabilities (such as 50% of tax liability for retraining) and stacking credits (such as retraining and jobs tax credits combined).


Most tax credits have a 10 year carryforward, so make sure you double-check your client's prior year return to see if any tax credits need to be carried forward -- don't leave your client's money on the table!

More Patience Required!

Tax filing deadlines are almost here. Things are getting hectic and time is running out on getting that crucial information from clients.  The Retraining Tax Credits have new guidelines this year. To top it off, the State of Georgia has made major cutbacks in the areas responsible for approving this tax credit: the Technical Colleges are on four-day weeks and operating with far fewer reviewers.

So what can you do?  Plan for more lead time to get approvals.  Also, expect somewhat greater scrutiny of the tax credit documentation.  A little more patience and understanding of the situation can help.  And remember -- we are all (you, your client, and the State employees) trying to work through this together!

Quick Update

We have been tracking tax credit-related legislation during the 2010 Legislative session and haven't seen any major changes so far.  As you already know, the state budget has been the prevailing issue.  Stay tuned!
