Greetings!

I am pleased to bring further news of success in claims for social security disability and federal workers' compensation.  However the SSA process itself continues to have more and more delay and backlog.  Read on for more details.
 
FEDERAL JUDGE OVERRULES FELLOW FEDERAL JUDGE AND SSA JUDGE b/w senior citizen

In this unpublished federal court decision of which I represented, the claimant was a older gentleman who had been denied his disability benefits by the Social Security Administration Judge.

The gentleman had been trying to obtain his needed disability benefits for almost four years. Despite the fact that the elderly claimant had less than a high school education and suffered from degenerative disc disease, pancreatic disease, heart disease, diabetes and profound loss of hearing, the SSA judge found that he could still work and was not disabled. 

On appeal to the federal court system, we argued that the SSA Judge was wrong and that this claimant should have been found as disabled.  The first federal magistrate judge who reviewed the appeal disagreed and recommended, again, that the claimant be denied disability benefits.  The federal magistrate judge agreed with the SSA judge and stated that the claimant could do other work, such as a dispatcher.

We objected to this federal magistrate judge's report.  In our objection we pointed out that this elderly gentleman had no computer skills whatever to operate a dispatch system and that due to physical impairments, he did not have the dexterity to even type or work the equipment for a dispatcher.  We also pointed out the obvious problem that the claimant was suffered a profound hearing loss literally defeating any job as a dispatcher.

Upon review of our objections, the US District Judge agreed with our arguments.  The District Judge overruled the findings of his fellow federal magistrate judge and the decision of the SSA judge and ordered that the case be sent back to the SSA for another hearing, this time to include consideration of all the claimant's impairments, his age, his education and his skills.
 
USDOL AWARDS FEDERAL EMPLOYEES FOR ON THE JOB INJURIES forms

In ongoing claims for compensation benefits due to federal employees injured on their federal jobs, I am pleased to note that the USDOL has agreed to award significant benefits.

For example in a case ongoing for years, the claimant was injured when she fell in the parking lot of the federal agency.  The fall caused further severe injury to her leg which had undergone surgery years earlier.  The fall also resulted in additional orthopedic surgeries to her arm followed by lengthy rounds of physical therapy. Although initially contested by the US Department of Labor, the US finally conceded to award her lost work time, medical care for life and over $100,000 tax free in compensation for her permanent injuries.

In another similar case, the claimant had suffered debilitating carpal tunnel disease to her hands after years of clerical work for her federal employer.  Her occupational disease required multiple surgeries and repeated rounds of physical therapy.  Once again the USDOL contested the claim, but eventually conceded and awarded her lost time, medical care for life and over $80,000 tax free in compensation for her occupational disease.

The delays and backlog in the Social Security Administration disability process continue to grow despite past promises by the White House and Congress to speed things up at the SSA.

This past July 2007 there were more than 749,224 SSA claims and cases waiting for some sort of action at the SSA.

The average processing time for a single claim at the SSA is now more than 528 days.

The fingerpointing as to blame continues in the Congress with the Congressional budget allowing for the hiring of some 1000 additional SSA workers. However this does not seem to take into account the fact that over 4000 SSA workers have left the SSA workplace in the past three years.

Funding for the SSA budget was passed by the House on July 19, 2007.  However the budget has yet to be approved by the Senate and then,  if approved, President Bush has threatened to veto the entire budget bill because the approved amounts exceed his personal proposed budget for the SSA.

In time meantime, disability applicants who are severely ill, injured and who cannot work, and have little to no income or access to health care will simply have to continue to wait on Washington DC.
