Obtaining a signed "Applicant Background Check Authorization Form" is a fairly basic part of F.C.R.A. compliance? However, where many employers make a mistake is the manner in which they provide the applicant authorization form to the appplicant.
Seems like a "no brainer", you just provide them the form and have the applicant signs it, right? The fact is, you should be providing the applicant the background check authorization form SEPARATE from your job application or other related documents. That's right, if you staple, paperclip, scan into a single PDF, or otherwise intermingle the backgroud check authorization form with other documents, you risk being non-compliant with the F.C.R.A.
The Fix...
1) Check your current procedure. If you attach your background check authorization form and your job application form, simply separate them for future applicants.
2) If you currently have background authorization disclaimer text combined with your application form, (a paragraph on the last page for example) your best plan of action is to remove the text completely from the job application and utilize the SafeScreener.com applicant authorization form separately.
