Greetings!

     Just like September, October is going to be another busy month at Range USA. And because of that, there are a lot of opportunities in October to bring friends to Range USA and introduce them to the 2nd Amendment, shooting sport, self-defense, or just target practicing.

 

     - Of course, Zombie Night 3 is a great way to show your friends how fun shooting firearms can be!

     - We have dozens of great classes for your friends to enroll in (you could even take it with them).

     - The Wild Game Dinner at 1776 could get them to the range for a great feast!

     - You could get them involved by inviting them to the Memphis Friends of NRA banquet.

     - You could also get them hooked by introducing them to Range USA at this year's Mistletoe Merchants show at the Agricenter. (By the way, at the Mistletoe Merchants show, we will be offering 20% OFF ALL CLASSES and $50.00 permit classes!)

     - Date Night is another great way to introduce new people to firearms - either your date or set up a double date with another couple.

     - You can also get them to sign up with the NRA at Range USA. When they do, they get a FREE lane rental.

    

     My point is, as Americans, we owe it to our country to introduce as many people as possible to firearms and our 2nd Amendment. And, Range USA offers a lot of ways/opportunities to do that!

Mississippi Enhanced Permit

Chip Holland, Range USA Training Director, is certified for the Mississippi Enhanced Permit.  

The Mississippi gun permit does not require any training, because of this, there are very many restrictions on where a permit holder can legally carry.

 

Mississippi residents can apply for an Enhanced Permit once they have completed required training, OR if they have a current MS permit, they can take the training and get an endorsement on their current permit. Sign up for any permit class Chip Holland is teaching to receive this permit certificate for MS. Either way, the Enhanced Permit allows the permit holder to carry legally in far more places in Mississippi.

 

With the REGULAR GUN PERMIT it is A CRIME to carry a gun into:

Any police, sheriff, or Highway Patrol station or any prison or jail;

Any courthouse;

Any polling place;

Any public park;

Any school, college, university;

Any school, college, or professional sporting event;

Any establishment that serves liquor as their primary business (bar);

Any church or other place of worship.

 

With the ENHANCED GUN PERMIT, all of the restrictions ARE REMOVED, except:

Police, Sheriffs, or Highway Patrol stations, prisons, and jails; and courtrooms where court is in session.

The History of the Arisaka Rifle...

 

Emperor Meiji, commissioned Colonel Nariakira Arisaka in the 1890's to create a new rifle to replace the earlier models such as the Murata.

 

During the 38th year of the reign of Emperor Meiji (1905), Nariakira Arisaka created the Arisaka Type 38 Rifle (named after himself) along with the year of Emperor Meiji reign. The rifle was stamped on the receiver with a 16 petal chrysanthemum which was the symbol of the Japanese Emperor. The chrysanthemum stamp showed the rifle was manufactured for the Imperial Japanese Army and therefore, belonged to the Emperor.

 

The Type 38 was four feet, two inches in length, which was the longest rifle used in combat during World War 2. It was designed to use the Type 30 Bayonet (twenty inches long). Considering the average height of the Japanese soldier was only five feet, three inches it proved to be difficult for the Japanese soldier to handle the weapon. However it did give them a distinct advantage in close quarter battles. The overall length did lead to future revisions of the original rifle for use by soldiers that provided roles in non-combat roles.

 

As face saving measures, Japanese soldiers who surrendered after the war, made attempts to grind the chrysanthemum stamp off their rifles. For those lucky few that have a Type 38 Arisaka rifle with the stamp still in place, you may have a valuable piece of history in your hands.

Last November, I made mention of Range USA's efforts this year to help others and various charities throughout the year and not just in November and December. Well, we have this year's charities chosen and we started in February! So, please, donate to these worthwhile organizations. It could be as easy as droping the change from your transaction into the bucket. It's an easy way to make a big difference in people's lives, in Memphis and throughout the entire world!

Myths and Facts About the Laws of Arrest

 

Many citizens mistakenly think they can arrest people using their firearm or hold them with a firearm until the police arrive. Due to the misunderstanding in this area we are stating the information and laws below. Let's start with the definitions of deadly force, force and arrest.

 

DEADLY FORCE: The amount of force that is intended or known by a person to cause or, in the manner of its use or intended use, is capable of causing death or serious bodily injury. (TCA 39-11-602)

 

FORCE: It is power, violence, or pressure directed against a person or thing. (Blacks Law Dictionary, pg 656)

 

ARREST: A seizure or forcible restraint. The taking or keeping of a person in custody by legal authority, in response to a criminal charge. To deprive a person of his/her liberty by legal authority. It is a restraint however slight on another's liberty to come and go. (Blacks Law Dictionary, pg 104)

 

Now consider the law on the use of deadly force by private citizen, TN 39-11-621:

  

A private citizen, in making an arrest authorized by law, may use force reasonably necessary to accomplish the arrest of an individual who flees or resists the arrest; provided, that a private citizen cannot use or threaten to use deadly force except to the extent authorized under self-defense or defense of third person statutes, ��

39-11-611 and 39-11-612.

 

And finally, the law on the grounds for arrest by a private person, 40-7-109:

 

(a) A private person may arrest another:

 

  (1) For a public offense committed in the arresting person's presence;

 

  (2) When the person arrested has committed a felony, although not

in the arresting person's presence; or

 

  (3) When a felony has been committed, and the arresting person has

reasonable cause to believe that the person arrested committed the

felony.

 

(b) A private person who makes an arrest of another pursuant to the

provisions of �� 40-7-109 -- 40-7-115 shall receive no arrest fee or

compensation for the arrest.

 

TN law 40-7-101 states there are three persons who can make arrests:

 

  (1) An officer under a warrant;

 

  (2) An officer without a warrant; or

 

  (3) A private person.

 

The bottom line is it is illegal for a citizen to use deadly force (firearm) to affect an arrest. They can however use force to affect an arrest. A firearm can be used (and by used I mean firing bullets from the gun) when a person is using it to defend themselves or another from death or serious bodily injury and they are afraid for their life. Merely saying you have a firearm, showing it to someone, or pointing it at someone can result in an aggravated assault charge (or possibly other criminal charges) no matter the location whether in your home, office, or in public. Carrying a deadly weapon is a huge responsibility and it should only be used in that last moment when the options are serious bodily injury, death, or using a firearm to defend yourself. Deadly force in self-defense is the ultimate arrest of another. If you decide to make an arrest as a citizen you can use force, but not your firearm. Let's hope we never need our firearm, but in case we do we must stay up-to-date on the laws. If you need an update on the laws attend our legal update class (the legal portion of the TN permit class) and obtain all the information and current laws.

- Wild Game Dinner Thursday, October, 19th. Space is limited and reservations are required. Call today to get on the list! You won't be disappointed! Up to date information will be posted on the 1776 Facebook Page.

 

- August 1st, 1776 began serving "plate suppers"! The plate lunches have been so successful, we have expanded it to the supper meal. The plate supper menu is different from the plate luch menu and is available Monday-Thursday from 5:00pm-8:30pm. Upgrades are available for the Monday night Date Nights.

 

- Saturday mornings at 1776 (starting at 8:00am) have become quite the place to be for breakfast! The menu consists of bacon, sausage, country ham, eggs, hashbrown casserole, quiche, toast, coffee, milk, and juice. Come out on Saturday mornings, enjoy a great breakfast and be the first ones on the range for some trigger time! Then you have the rest of the day for errands and honey-do lists.

 G.I. Jess's Warriors for a Cause

October is breast cancer awareness month.

 

Range USA has joined up in sponsoring the newest local racing team:

G.I. Jess's Warriors for a Cause.

 

G.I. Jess's Warriors for a cause is a not for profit charity foundation and multisport racing team with a goal to spread cancer awareness, early detection of the disease, and outreach to those fighting cancer. The team was started to support Jessica Hambrick after she was re-diagnosed with stage 4 breast cancer at the age of 31.  She has survived chemo twice now, a mastectomy, radiation, and just over a month ago brain surgery, and gamma knife radiation.

 

She is a warrior! So much in fact that her friends have named her G.I.Jess and her husband started a not for profit charity foundation and multisport racing team with a goal to spread cancer awareness, early detection of the disease and outreach to those fighting cancer in the local area.

 

While the team was in its infancy Jessica and her husband saw the need for a local charity that reaches out to people that cancer has impacted and the sooner after diagnoses the better.  By implementing a multisport racing team we make ourselves visible to the public and gather others with like interests to join us in the fight.  Each member of our team is a Warrior by taking some of the fear from those afflicted and replacing it with knowledge of their individual condition.  With this new knowledge they are better outfitted to fight and win over their type cancer.  On their website you will find resources on various subjects from cancer prevention to how to fight existing cancer.   

 

She and her husband both have taken two things they are passionate about: working out and preventing cancer, and turned it into a local charitable foundation. They have helped men and woman alike find ways to fight and beat their cancer with as little side effects as possible. She has found exercise, walking/ running; swimming, yoga, and boxing are great tools for survivors. A love for exercising, a strong connection to her faith, and a positive attitude has helped Jessica fight and beat this cancer twice now.  She is a true survivor!
