27 Jan. 2011 - the OECD held an intensive consultation process in 2010 on the transfer pricing aspects of intangibles and have just announced they will focus on the following aspects: 

 

 - Establishing a framework for analyzing intangibles. 

 - Defining the key terms for intangibles. 
 - Identifying different types and/or transactions of intangibles.
 - How to identify and/or recharacterize a transfer of intangibles.
 - Sharing in the return from an intangible that it does not own.
 - Developing guidance on the valuation of intangibles.
 

The OECD anticipates issuing a revised draft of Chapter VI on Intangibles for the OECD Guidelines on Transfer Pricing.

Concern for all Companies 

 

It is reasonable to expect the Canada Revenue Agency, the Internal Revenue Service and all other tax authorities will consider how these changes might impact their transfer pricing rules and administrative guidance.  However, it is not yet known how long it might take for these changes to be introduced, what the impact will be, the first year of implementation, transitional provisions, etc.
