Contact Your Representatives, Urge NO VOTE on
Miner Safety/OSHA Bill This Week! The House Education and Labor
Committee approved by a party line vote of 30 to 17, the Robert
C. Byrd Miner Safety and Health Act of 2010 (H. R. 5663). The
legislation is pending a floor vote by the House of Representatives
this week. Although most of the bill deals with enhancing federal mine safety
laws, Title VII of the legislation makes several drastic changes to the
Occupational Safety and Health Act (OSHA) that would potentially impact a
broad range of employers. Among the OSHA provisions are
new felony criminal penalties that could be brought against any company
officer or director. The bill also includes expanded whistleblower
protections and mandatory immediate abatement at a worksite without OSHA
inspectors having to show that an imminent safety threat actually exists.
Failure to comply with abatement would result in fines of $7,000 per day. The grocery industry is opposed to the legislation because of the OSHA

| Implementation of New
Debit and Credit Interchange Reforms Retailer Guidance Document
|
As you know, on July 21, 2010, President Obama
signed the Dodd-Frank Wall Street Reform and Consumer Protection Act into law,
ushering in sweeping reforms of the banking industry, including significant
reforms of interchange fees.
The legislation directs the Federal Reserve to
write regulations, no later than nine months from enactment of the law, to
establish standards for a number of provisions in the new legislation.
The
National Grocers Association (NGA) has provided a Guide for Retailers to reference as new provisions take effect. Specific questions regarding
implementing these changes with your front end systems should be directed to
your register dealer or third-party processor.

Senate
Clears Measure to Delay New Gift Card Disclosure Requirements
|
The Senate has passed an extension of the date for gift
card disclosure requirements in the 2009 credit card transparency law. The
bill, HR 5502, is pending President Obama's signature.
The legislation extends the
date for disclosure requirements from August 22, 2010 to January 31, 2011, for
gift cards issued prior to April 1, 2010. The gift card law prohibits
dormancy fees, inactivity charges, or service fees on gift certificates, store
gift cards, and general-use prepaid cards, while requiring consumers to receive
a set of disclosures related to their cards and certificates.
The delay addresses concerns by companies
about their existing inventory of gift cards. To be eligible for the
extension, companies must agree to eliminate the cards' expiration dates, and
consumers would be entitled to receive a free replacement card or certificate.
Gift cards previously printed without the new disclosure requirements could
continue to be issued during the 2010 holiday season.
