| Governor
Signs Important Recycling Bill |
On March 8, 2010, Governor Schwarzenegger signed ABX8 7
which takes affect immediately and is an important victory for recycling in
California. This new law prohibits monies in the fund from being
used, loaned or transferred for any other purpose, and provides for a faster
replenishment of the fund. Currently beverage distributors are required to pay the
CRV for each container sold in the state not later than the last day of
the third month following the
sale. The new bill requires that CRV payment must be made no later than the last day of the second month following the sale.
In addition, for calendar years 2010 and 2011 the
Department can reduce or eliminate payments out of the fund for grants and
programs, and must pay processors their redemption value and administrative
costs. |

Several bills from 2009 were carried over into the
Second Session of the Legislature, and other bills have been introduced in
2010. The following are some of the
bills in which CIGA is engaged:

AB 1694 (Beall-D-San Jose)
|
|
This bill will impose fees equivalent to excise
taxes of 640% on the sale of wine, 267% on beer, and 129% on distilled spirits
in order to fund new alcohol-related government programs. CIGA OPPOSES.

AB 1998 (Brownley-D-Santa Monica)
|
|
Prohibits grocery stores and pharmacies from
providing single-use plastic carryout bags to customers, and requires retailers
to charge $0.25 for each paper bag. It
requires retailers to show the amount paid for paper bags in a separate entry
on customer receipts, requiring retailers to reprogram POS data. CIGA OPPOSES.

AB 2718 (Adams-R-Hesperia)
|
This measure requires the Department of Resources
Recycling and Recovery to provide incentives and assistance to reduce the
number of unserved convenience zones. It
also exempts a retailer, until December 31, 2011, from the requirement to
redeem beverage containers in the store.
It provides that if a retailer wishes to redeem beverage containers
"in-store", the retailer may be qualified to receive handling fees, refund
values, administrative costs and processing payments. CIGA SUPPORTS
this important legislation.

SB 1210 (Florez-D-Shafter)
|
This bill imposes a tax upon every sweetened
beverage manufacturer or concentrate manufacturer at the rate of $0.01 per
teaspoon of sugar placed into the sweetened beverage. It is estimated that a 12-ounce serving of
soda contains approximately 10 teaspoons of sugar. CIGA OPPOSES.

SB 933 (Oropeza-D-Long Beach)
|
Adds "debit cards" to existing law prohibiting a
retailer from imposing a surcharge on a credit card holder who elects to use a
credit card instead of paying by cash, check or similar means.
CIGA OPPOSES.

SB 356 (Wright-D-Inglewood)
|
This 2009 bill requires a determination whether any
regulation from any state agency would have an adverse economic impact directly
affecting small business. The bill is in
the Assembly Committee on Business and Professions. CIGA SUPPORTS.

AB 2424 (Niello-R-Sacramento)
|
This measure provides that if an employer discharges
an employee, payment of wages upon discharge shall be made within a reasonable
time not to exceed 24 hours after discharge, not including weekends and
holidays. If the payment is mailed, the
date the payment is mailed, or made available, constitutes the date of
payment. CIGA SUPPORTS.

The Sacramento County Environmental Management
Department and the Business
Environment Resource
Center are conducting a FREE Food Industry Workshop on April
26, 2010. There will be two separate
sessions, the first being 9 AM to 12 PM, and the second from 1:30 PM to 4:30
PM.
These workshops will provide
important
information on the following: (1) new Food Safety Laws of 2010; (2)
Trans Fat
Ban, (3) Service Animals and Food Facilities; (4) Refrigerant
Requirements; and
(5) SMUD's Energy Saving Rebates and Loans. The workshops will be
