Securing your Trademark Rights


There are 3 methods of trademark protection:

Federal registration with the U.S. PTO grants an exclusive nationwide right to use a mark throughout the U.S.  Federal registration requires use of the mark in interstate commerce, and is the only way you can use the "®" designation.  Registration involves a relatively detailed application process, and must be renewed every 10 years.  Assistance from an attorney is strongly recommended!

 

State registration grants the right to use a mark in that state (this protection is not, however, available in the District of Columbia).  You can use the "TM" or "SM" designation with state registration, but not "®".  State applications are simpler than federal, and also renew every 10 years.

 

Common law trademark rights are established by the mere use of a mark, but geographically limited to where the mark is actually used in commerce.  These rights still trump a later federally registered mark in that geographic area.  You can use the "TM" or "SM" designation.

Reminder for Small Tax-Exempt Organizations

 

From the IRS: For tax periods beginning after December 31, 2006, small tax-exempt organizations whose annual gross receipts are normally $25,000 or less are required to electronically submit Form 990-N, also known as the e-Postcard, unless they choose to file a complete Form 990 or Form 990-EZ.  The IRS encourages representatives of small tax-exempt charitable community organizations to file Form 990-N before the October 15, 2010 deadline. Small community organizations that fail to file a Form 990-N by this date risk losing their tax exempt status.  As of June 30, 2010 more than 320,000 organizations were at risk of losing their exempt status.
