Potential New OFCCP Affirmative Action Requirements for Health Care Providers

The United States Department of Labor's Office of Federal Contract Compliance Programs ("OFCCP"), the federal government's affirmative action enforcement agency, has long sought to expand its jurisdiction to healthcare providers. The OFCCP requires federal government contractors and subcontractors to develop and maintain workforce affirmative action plans. For nearly 25 years, many healthcare providers avoided affirmative action obligations by relying on a court ruling that Medicare and Medicaid reimbursements did not trigger coverage. The OFCCP has had recent success extending coverage in two cases in Pennsylvania and Florida that focused on the evolution of contractual relationships for healthcare services. Many Physicians Routinely Witness Disruptive Behavior in Colleagues

Institutions should address bad behavior to prevent hostile work environments and protect patient safety, a new study says.
More than 70% of doctors in a recent survey said disruptive physician behavior occurs at least once a month at their institutions. Eleven percent of respondents said it happens on a daily basis.
Factors such as career burnout, heavy workload, marriage troubles or a diagnosable psychiatric illness may contribute to the behavior. Regardless of the cause, experts say physicians and institutions should address inappropriate actions head-on. If left unchecked, such behaviors can create hostile work environments and negatively affect patient care. Read More...

U of A President Shelton to Head Fiesta Bowl
| | University of Arizona President Robert N. Shelton today announced that he will be leaving the UA to accept the position of executive director of the Fiesta Bowl. Shelton will move to the leadership role of the Phoenix-based charity effective Aug. 1.
"This was probably the most difficult decision I've ever had to make," Shelton said. "I have spent my entire career in higher education, and I care passionately about the UA. But there always comes a point in life where you feel that it is time to try something new." Read More...

IOM targets accuracy of Medicare regional payments

A June report from the Institute of Medicine recommended changes to the methods the Centers for Medicare & Medicaid Services uses to pay doctors and facilities $500 billion annually. The report's recommendations include utilizing geographic health sector data from the Bureau of Labor Statistics, expanding wage data to account for all types of health workers in private practice, and using the same number of geographic markets for hospital and physician payments.
The report is the first of three planned by an IOM committee tasked with studying price variations caused by Medicare geographic adjustments. While questioning the accuracy of the current process, members of the panel stopped short of stating that current geographic adjustments are inaccurate or imprecise. The committee also would not say whether current methodologies favor large states over small states or physicians practicing in rural versus urban areas. Read More...
