Soon after I moved to New York in 1953, I began to realize how tough it is for sidemen and some leaders working mostly in jazz clubs to sustain a living. Although I had helped the American Federation of Radio Artists organize a radio station in Boston, I'd never been able to figure out how a musicians' union could organize players in clubs who appear from time to time.

 

Now, however, New York Local 802 of the American Federation of Musicians (AFM) is engaged in a jazz nightclub campaign that could expand to other cities around the country by using AFM affiliates there...

Sharing vs. stealing

New penalties for pirating music are in the works 

When is "sharing" the same as "stealing"? For many years, Local 802 and our allies have taken a firm approach against piracy. We believe that illegal file sharing is the same as stealing. It hurts the record labels and ultimately hurts musicians.

 

If musicians want to give away their music for free, or if they share their music willingly, that's one thing. But when people decide not to pay for music that should be bought and instead simply cruise the internet looking for free versions, we call that piracy. In the past, record labels would attempt to sue individuals who pirated music.

 

Now there's a new approach: people who pirate music might find that their internet connection gets slow. Real slow.

Are you protected from your bandmates?

If your band puts together a track or an album and sends it off to the world, what happens if it gets picked up by a record label or an indie film producer? If you don't have a written agreement in place, then you might find yourself totally shut out if your tune starts making money. Fortunately, the AFM has a simple form that a band can fill out. This form costs no money to file and no union dues are required. The form is a legal contract that says all bandmembers will share in the profits of the recording. There are other protections built into the form if your recording gets picked up by a record label or producer.

 

The form is called the AFM Joint Ventures Agreement and can be downloaded here.
