Grievance Report 

 

Local 802 presented the case for payment of wages and benefits during the period of the strike by Local One IATSE to The League of Broadway Theatres and Producers on Thursday, January 3, 2008. The attorney for Local 802 presented the legal argument for Local 802. The employers expressed their confidence that the language of the 802 contract does not support the union's case.  Two unions had presented similar claims for payments after the Local 802 strike in 2003. In those cases the arbitrator ruled in favor of the employers denying the union's claim. The 802 Executive Board voted to file for arbitration of this claim.

 

A meeting with the League and the producer of Cyrano produced a tentative settlement agreement to pay about twelve thousand dollars to three actor musicians in premiums and to pay full benefits on their entire wages for the two month run of the show, which closed last weekend.  

 
A grievance hearing for claims by the Legally Blonde orchestra for the broadcast of the show during Thanksgiving week is set for next week.

Given the changes in the Local 802 health plan, it is important that you know how to cal-culate the health benefit contributions you should be receiving from various kinds of work. If you know the contributions required from different jobs, you can determine the plan level you can expect to achieve. You can also determine if your ability to make a certain level of coverage might be endangered by taking time off from one job to do something else.

 

Other Contribution Rates

Single Engagement Club Dates - $27/engagement ($28 1/1/08)

Freelance Classical Concert - $41.73/ performance*

Freelance Opera and Ballet- $42.38 / performance

Sound Recording - $22/first session of the day, $16.50 ea addl.

Motion Picture and TV Film - $20.34/ day

TV/Radio Jingle - $17 +3% of wages ($20.45 one hour session)

Industrial Films - $21/ 2 hour session

TV-Video - $16/day capped at $70/week

Experimental Video Games - $21 / day

RCMH Christmas Spectacular (substitute) - $35/perf. cap $72/week

AFM touring shows, (Pamphlet B), $59 per week plus Hosp.

Off Broadway - varies with contract, check with off-Bdway Rep

Music Preparation - check with MP Department for rates

LS-1 Contracts - contributions of up to 15% of earnings can be made utilizing these individual contracts signed by your employer.

Music Director Personal Services Agreements - contributions of up to 15% of earnings, same as LS -1

Other Contracts - if a contract you work under is not included above, do not hesitate to call Local 802 to find the applicable contribution rate

Strike Benefits

The Local 802 Executive Board voted to replenish the Local 802 Strike Benefits Fund to the $500,000 maximum authorized by the bylaws. The funds were sourced from the 802 building fund which is also funded by member dues.

President Mary Landolfi appointed a Strike Fund Subcommittee of the Board  as follows:

"To look at the current bylaws and recommend changes that will allow Local 802 to utilize the strike fund more effectively, expand its resources when neces-sary and enable the local to provide meaningful benefits when needed.  The subcommittee should look at the systems in place in other unions, consult with the controller about the possible effect of any proposed changes on the Local 802 budget, reach out to members affected by the recent Local One strike for ideas and concerns and consult with our attorneys so that any recommendations conform to legal requirements."
