GREFPAC Awards UGA Student $2,500 Grant

GREFPAC President Tom Merkel (left) and UGA Professor Andy Carswell (right) present UGA Student Reginald Miller with $2,500 grant. | At its Educational Conference, GREFPAC awarded its $2,500 Founders Grant to Reginald Miller, a Ph.D. student and graduate assistant in Housing and Consumer Economics at the University of Georgia. Ph.D. candidate Miller will use the grant to research the effects of two types of foreclosures: those that arise out of mortgage fraud and those that arise out of other causes, such as job loss or divorce. It has been suggested that the effects of fraud-based foreclosures are harsher, due to the criminal elements involved with the transaction in the first place, and the research will help to prove or disprove that theory. In addition, the grant will aid the effort to catalog mortgage fraud's long-term damage to communities. Reginald will make a presentation on his research and findings at GREFPAC's 2013 Educational Conference. |

GREFPAC's 8th Educational Conference was held on March 7 at the Cobb Galleria Centre. It featured outstanding speakers, who alerted attendees on evolving real estate fraud trends, regulatory changes, the impact of fraud on neighborhoods, and best practices to detect and prevent fraud. A recap of the day's events is posted here. Plans are already underway for next year's conference. |
Joint Luncheon Meeting with NAPMW Planned for April GREFPAC and National Association of Professional Mortgage Women (NAPMW)-Atlanta are working to host a joint luncheon meeting on April 17 at the Dunwoody Country Club. More information will be distributed as it becomes available. It is anticipated that GREFPAC members may attend at NAPMW member prices. |
June Meeting: "Sovereign Citizens" and Adverse Possession of Vacant Homes
The June 6 quarterly educational meeting will focus on the "Sovereign Citizens" and the emerging trend of persons claiming adverse possession of vacant homes. An election of the 2012-13 GREFPAC board of directors and officers will also be held at this meeting.

Former Cartersville Mayoral Candidate Sentenced to Federal Prison for Bank Fraud

According to United States Attorney Sally Quillian Yates, the charges and other information presented in court: In March 2003, H. Gregory Cordell, a realtor and real estate developer, bought a house and six acres of land for $1.25 million. Although the seller had listed the property for approximately $950,000, Cordell and the seller agreed to inflate the sales price by $307,000, obtain an inflated mortgage, and then pay the extra $307,000 to Cordell after closing. Interthinx 2011 Annual Report Sees Disturbing Rise in Employment/Income Mortgage Fraud Risk Interthinx | Mar. 28, 2012
Interthinx has released its annual Mortgage Fraud Risk Report, which highlights some of the most significant mortgage fraud risk trends based on analysis of loan applications processed in 2011 by the Interthinx FraudGUARD system. According to the annual report, the Employment/Income Fraud Risk Index rose 14 percent during 2011 and has been on an upward trend for more than two years for a total increase of more than 45 percent. The report lists Georgia as the eighth riskiest state, the same position it held a year ago, but points out that Georgia was among the states with the largest decreases in the mortgage fraud risk index between 2010 and 2011, with a decrease of 15 points. Interthinx Releases Q4 2011 Mortgage Fraud Risk Report

Interthinx released its latest Mortgage Fraud Risk Report, reflecting data collected in the fourth quarter of 2011. According to the report, the national Mortgage Fraud Risk Index increased 1.4% from the last quarter and 3.6% from a year ago; while the Income/Employment Fraud Risk index rose only 1% from Q3, it has jumped by nearly 14% from one year ago and by 46% over the last two years; and although the overall Index has remained relatively flat, the Property Valuation Fraud Risk index jumped nearly 8% over the last quarter after a period of decline and stability. In addition, the report indicates that Georgia has the eighth highest mortgage fraud risk among all states and that the Atlanta metropolitan statistical area remains in the "very high risk" category. Amendments Proposed for Mortgage Fraud Sentencing Guidelines U.S. Sentencing Comm'n | Jan. 19, 2012
In addressing a Dodd-Frank Act directive, the U.S. Sentencing Commission proposes changes to the calculation of loss in cases of a fraud involving a mortgage loan, including that (i) the loss should be determined by the amount recovered from the foreclosure sale where the collateral has been disposed of at a foreclosure sale; and (ii) reasonably foreseeable administrative costs to the lending institution associated with foreclosing on the mortgaged property may be included as reasonably foreseeable pecuniary harm provided that the lending institution exercised due diligence in the initiation, processing, and monitoring of the loan and the disposal of the collateral.
