NPDES and LOGGING ROADS?

 Logging Roads and NPDES

EPA announced that it intends to revise its stormwater regulations to specify that a National Pollutant Discharge Elimination System (NPDES) permit is not required for stormwater discharges from logging roads. EPA is also requesting comment on potential approaches for addressing stormwater discharges from forest roads and seeks input on examples of successful state, tribal and certification-oriented programs that are based on best management practices. EPA is working with stakeholders and its federal partners to determine how best to address stormwater discharges from forest roads and will consider a full range of potential non-permitting approaches under the Clean Water Act including voluntary programs and further support for state and tribal programs.

EPA will accept written comments for 30 days after publication of the notice in the Federal Register. EPA also plans to hold listening sessions to obtain stakeholder input this summer on its consideration of how best to address stormwater discharges from forest roads.

ATLANTA - May 31, 2012) The U.S. Department of Justice (DOJ), the U.S. Environmental Protection Agency (EPA) and the Georgia Environmental Protection Division (EPD) today proposed an amendment to a 1999 Consent Decree that would give the City of Atlanta additional time to complete the limited remaining repairs needed to eliminate sanitary sewer overflows and ensure Clean Water Act compliance. The untreated sewage from these overflows can contaminate rivers and streams, causing serious water quality problems. It can also back-up into residences and businesses, causing property damage and threatening public health.

2012 Nation Wide Permits (NWPs) Regional Conditions state that every use of every NWP requires some form of notification to ACOE and at least one office of Georgia DNR.

 

ACOE Culvert DiagramAll uses of NWPs that require submission of a Pre-Construction Notification (PCN) to the Corps, also requires that a copy of the PCN be submitted to Georgia EPD and/or Georgia Coastal Resources Division (GACRD)CRD. For all uses of NWPs that do not require submission of a PCN to the Corps (example: NWP No. (25) or NWP No. (03(a)) under 100 linear feet or 0.1 acre, etc.), the one-page Georgia DNR form (Appendix A) must be submitted to Georgia EPD and/or GACRD.

NASCAR and EPA Decide to Partner

4th District Court of Appeals Reprimands NCDOT
The case may have major implications for GDOT

 

The North Carolina Turnpike Authority's plan to start construction this year on the $725 million Monroe Connector-Bypass near Charlotte was set back Thursday when the 4th Circuit U.S. Court of Appeals ruled in favor of environmental groups that sued over misleading information in the project's environmental impact study, the Charlotte Observer DOT Stormwater reported.

Instead of making a required evaluation of the toll-road's costs and benefits by comparing these measures to what would happen if the road was not built, the NCDOT study incorrectly had compared building the road to ... building the road.

 

The 4th Circuit ruling said NCDOT should have acknowledged its error when regulatory agencies and environmental critics raised questions, according to Steve Harrison's story today in the Charlotte Observer:

The court wrote: "...rather than take these opportunities to make a 'candid acknowledgement' of what they knew to be the truth, the agencies maintained that the 'no build' data did not include (the road)."

Carl Tobias, a University of Richmond School of Law professor, said he was surprised at the nature of the court's ruling.

"It's interesting how strongly the court reprimanded the agencies," Tobias said.

You may wonder what is a Municipal Separate Storm Sewer System (MS4)? A MS4 is a conveyance or a system of conveyances that is owned by a state, city, town, village, military base, or other public entity (Universities) that discharges stormwater to waters of the United States.  A MS4 collects or conveys stormwater (including storm drains, pipes, ditches, etc.).   It's not a combined sewer system and is not part of a publicly owned treatment works (POTW).  MS4s must report annually to the State administering the MS4 permit or the US EPA, and that's where we can help!  Call us at 678-469-5120 and ask for Luke.
Americans are able to catch fish and hunt in this awesome country because of our investment into water quality!  It's important that we sacrifice a little to give our future generations an equally great place to work, live, fish, hunt and enjoy. Today, it's sometimes difficult to make sense out of the politics that heavily influence our environmental protection laws? However, a couple of things are for sure.  It's important that industry is profitable in the United States to provide jobs and income for the common man so that EVERYONE has a great life.  That's exactly what makes America Great!.  But it's just as important that water quality impacts from  industry are compliant with the rules that safeguard our way of life.  
Before the Clean Water Act was passed, sediment, sewage, and chemicals caused LOCO Spencers NPDES Training America's rivers like the Chattahoochee River to be void of fish.  Stress on our rivers is still going on today as evidenced by last years fish kill of approximately 38,000 fish on the Ogeechee River in south Georgia.  As Americans, we cannot take our eyes off of the importance of water quality!  The Clean Water Act if properly enforced will continue to be the key to our nations healthy economy and environment!
