Dear Fellow REALTORS® and Affiliates,
Fiscally, 2010 has been a challenging year for Rhode Island municipalities and state government. Budget deficits, reigning public spending and the over-burden placed on Rhode Island taxpayers has been news, discussion and a concern in our homes and in our industry. As REALTORS®, we are fortunate to have a strong grass-roots organization, an ever present eye on the legislation introduced to the General Assembly and the resources to get our message to those elected officials who make important decisions on our behalf.
Today, I am asking for your help to make a difference in a local city ordinance that was introduced in the City of Pawtucket that would add an additional $100 fee/per rental unit for non-owner occupied dwellings. The ordinance, if passed, would place an onerous burden on landlords and includes additional fees and fines if not adhered to each year. The example offered is simple: If a landlord owns a three-family home in Pawtucket, he/she is required to file a registration form with the City and pay $300.00 per year. Currently, there are no written exemptions to this ordinance.
The Rhode Island Association of REALTORS®, in cooperation with the RI Apartment Association is requesting that all REALTOR® members respond and specifically contact Pawtucket landlords/owners you may know to speak out against this ordinance that may serve as a dangerous precedent to other municipalities facing similar financial stress.
The protection of home-ownership through our governmental outreach is an important function and service the REALTOR® organization offers our members. Our strength in numbers and the power of our voice before local, state and national issues will ensure the viability of our profession now and into the future. Government Affairs Update | REALTORS® TAKE ACTION! Stop the Pawtucket Rental Housing Fee
On June 23, the Pawtucket City Council voted 5 - 3 to balance the city budget on the backs of landlords and tenants by supporting a brand new rental fee every year. If this ordinance becomes final, owners of rental housing - including Pawtucket residents - must file a registration form and pay a fee of $100 per rental unit per year - unless the owner lives in the property. This fee is per unit, so if you own a 3-family, Pawtucket would force you to pay $300 per year. Who must pay this new fee? Owners of residential rental property who do not live in the property. Some claim that this new fee will not apply to affordable housing owned by non-profits or to rental properties of 6 units and above that are classified as commercial properties for property tax purposes. Ask them to show you a written exemption. What happens if I forget to file a registration form or pay these fees every year? The rent abates. This means that it will be illegal for you to rent your property, collect rent or evict a tenant for non-payment of rent until you have paid the fees and filed a new form. Misdemeanor fines - $100 maximum for a first offense - $500 maximum for additional offenses $10 per month late fee A lien against your property for unpaid fees after 30 days. The proposed ordinance would no longer require the city to send notices to landlords. What can I do to stop this?
