The recession, Stimulus Package,
and the Employee Free
Choice Act
are adding burdensome layers
and complexity to managing your business.
Responding to the poor economy is going to require
a well formulated plan. I have provided guidelines
in this newsletter on how to weather the storm
and, if necessary, deal with
painful layoffs.
A new COBRA subsidy has been included as part
of the Stimulus Package.
Now employees who have been "involuntarily
separated" are able to continue receiving their
health insurance benefit at a rate of 35% while the
employer
is responsible for 65%. This is a significant change
since,
under the old rules, the company paid nothing.
Anyone
who was involuntarily separated from employment
between September 1, 2008 and December 31, 2009,
is eligible for assistance for up to 9 months.
Though the
U.S. Department of Labor has yet to finalize all the
details,
employers must come into compliance now. To learn
the specifics of the plan, and for assistance in getting
into

Expect that the Employee Free
Choice Act
(EFCA) will become law this year. This pro-
union
act
will streamline the union organizing process resulting
in a
greater win rate by unions. The Card Check
provision
is the heart of the act. With card check recognition,
employers will no longer have the right to demand a
secret-ballot election before a union is certified as the
exclusive bargaining representative of its employees.
Under EFCA, unions organizing workers would
need
only to present an employer with signed authorization
cards from a majority of the employees it seeks to
represent, and the employer would be required to
recognize the union.
Another key concern is collective bargaining time
limits. Generally, under the current law, good-faith
bargaining can take from two months to a year.
But under the proposed EFCA, employers and
unions
essentially have three months to negotiate a first
contract. If an agreement is not reached within 90
days, the Federal
Mediation & Conciliation Service
can intervene. If those efforts are unsuccessful, there
is a potential for mandatory arbitration after 120 days.

unionized.

national unemployment rate has reached 7.6% for the
first time in 16 years. With the constant barrage of
bad news, from plant closings, to home foreclosures,
