What's happening now... 

We are at the beginning of a new phase of regulatory compliance concerning the Patient Protection and Affordable Care Act and  the Reconciliation Bill, better known as "Healthcare Reform". Omni Resource is committed to assisting you to develop a strategy to meet your legal obligations in the most efficient and cost-effective manner.  We will continue to update you as regulations are finalized and we receive guidance on implementing the new legislation
. In the meantime, here are three items that may impact you, your business and your employees: 

1.  Effective with your health plan renewal on or after 10/01/2010, "eligible" dependents will be covered up to age 26 regardless of student status.  If your company's plan renewed prior to 10/01/2010 and your carrier is other than Aetna or CareFirst, your dependent(s) age 25 to 26 will remain uncovered by the plan until your plan renews in 2011. Early indications are that "eligible" means they do not have other employer coverage available to them.  This will change in 2014 to cover all dependents up to age 26 even if they have employer coverage. 

2.  Effective with your health plan renewal on or after 10/01/2010, there will no longer be lifetime limits on plan benefits.  This applies only to medical plans. 

3.  Effective with your health plan renewal on or after 10/01/2010, medical plans can no longer impose pre-existing conditions on dependent children under the age of 19.  If your company has a Maryland Small or Large Group Plan this does not apply to you.

On July 19, 2010 revised legislation went into effect designed to protect working children from hazards in the workplace while still recognizing the value that 'safe work' can bring to children and their families. 
The updated regulations affect a variety of changes on how the DOL will interpret the child labor provisions of the Fair Labor Standards Act (FLSA). Perhaps the most significant among these changes is the lifting of the restriction that limited the industries in which 14 and 15 year-olds were permitted to work.  Now, instead of being allowed to work only in retail, food service and gasoline service establishments, young workers may work in other environments such as state and local governments, banks, insurance companies, advertising agencies and information technology firms.
The new regulations also increase penalties for violations, especially regarding the injury or death of a teenage worker.

Breaks for Nursing Mothers

The Department of Labor's Wage and Hour Division (WHD) has released a fact sheet to help employers comply with the lactation break time obligations established by the new health care law. The Patient Protection and Affordable Care Act ("Affordable Care Act") amends section 7 of the Fair Labor Standards Act (FLSA) to require employers to provide rest breaks and suitable space for employees who are nursing mothers to express breast milk for up to one year after the child's birth.

Mixed news... 
 
Private-sector employment was up by 71,000 jobs in July and increases were seen in manufacturing, health care, transportation and warehousing, and mining. Employment in professional and business services, including temporary help services was little changed over the month. Other areas showing little change in July include wholesale trade, retail trade, information, and leisure and hospitality.
