Dear Reader,

 

Spring is in the air here in Boston and I was lucky enough to recently see a few spring training games for my beloved Cleveland Indians. I'm always optimistic in March and then reality sets in by July when it comes to my team! This is a great time for our industry to be optimistic too, as I feel we will end up on top by the end of this year, unlike my baseball team.

 

So many things are going on from a legal perspective that we could write for days about it. If you want to know the latest info, feel free to contact me. With the Supreme Court case hearings at the end of March, there will be plenty to talk about for months to come.   We here at The Phia Group are doing all we can to ensure all of you are in compliance with health care reform and can reduce the cost of health care.

 

Lastly, I want to say thank you to the over 100 colleagues in the industry who have already donated to my cause.   As most of you know, I will be riding my bike for 192 miles on August 4th and 5th to raise money for cancer research. I am getting close to my $20,000 goal but I still need more funds. My best friend and his family appreciate any support you can give. Letter From the Editor

 

 

If you look at the top right hand side of the newsletter you will see a picture of a small jet. This is a common site for myself and others in our office these days, as we will be spending the majority of the next few months on the road, speaking at conferences and visiting many of you to discuss ongoing industry issues.

 

I will be heading to our beloved Texas twice over the next few weeks. First, I will make a stop in San Antonio, where I look forward to seeing the Alamo for the first time. Shortly afterward, I make my way over to Dallas to visit our friends at TABA. We have often considered getting second homes in Texas, as it seems we spend as much time there as we do in Boston.

 

As usual, there are many things stirring about the industry - most notably the SBCs. I want you to know that we are here to help. It is our duty to consistently stay on top of the challenges healthcare reform presents. The SBCs are number one priority on that list. We have many of the same questions you may have, so you are not alone. We have made inquiries directly to the Department of Labor ("DOL") and as much as we'd like to think we are first in line to hear back, we understand the reality of the situation.

Legal Case of the Month

 

AssignConsutlingment of Benefits Gaining Momentum

 

Recently, Ernie Clevenger posted in his newsletter an update regarding the case of Medical University Hospital Authority/Medical Center of the Medical University of South Carolina v. Oceana Resorts LLC, D.S.C., No. 2:11-cv-01522-DCN, 3/2/12), wherein a benefit plan successfully prohibited assignment of benefits by a participant to a provider, despite the execution of an assignment of benefits form by the patient, and the in-network status of the provider.  As a result of this recent development, there has been an influx of inquiries to the Phia Group Consulting ("PGC") team, inquiring as to whether it makes sense - in an effort to combat excessive charges and force participants to have "some skin in the game" - to prohibit assignment of benefits in all plan documents. 

 

If this were to occur, we would likely see an influx in balance billing by providers.  Once consumers are faced with thousands of provider bills, each weighing in for thousands of dollars apiece, one of two things will happen.  Either (1) the public will be made aware of excessive pricing, inequity in provider charges, the government will impose laws meant to control pricing by providers and the public will push back against providers by "shopping around" for reasonably priced providers, or, (2) laws will be passed requiring insurance carriers and benefit plans to allow assignment of benefits.  Between you and me, in light of PPACA, #2 seems a lot more likely than #1.

"SBC Issue Outline - The Big 6"

 

Below is an outline of some of the issues.

 

(1)    Applicability:  Plans must provide the SBC, notice of modifications, and uniform summary to participants who enroll or re-enroll in group health coverage through an open enrollment period beginning the first day of the first open enrollment period beginning on or after 9/23/12 (i.e. October 1 so this will apply for November 1 plans).

 

Issue:  This is being rolled out at the busiest time of the year for renewals, the Departments failed to consider the consequences of rolling this out mid-year so as to ease both plans and administrators and insurers into the process. 

 

(2)    Interim:  Rule is issued as "final" but multiple references that this applies for "the first year of applicability only" and the "Departments intend to issue updated materials for later years." 

 

Issue:  What is the "first year of applicability" - does this mean 9/23/12 to 9/22/13 or only for 2012 or 2013 or until 2014?

 

(3)    Year One of Applicability:  Departments give plenty of materials for the first year (SBC template, samples, a guide, example calculations, etc), but there are references to all the changes with respect to coverage set to employ for 1/1/14. 

 

Issue:  Why not develop one standard template to come into effect for January 1, 2014 when all the changes will be in place instead of making multiple rounds of updates and revisions to the templates and materials.

 

(4)    Minimum Essential Coverage:  The regulations require a statement in the SBC about whether the coverage provides "minimum essential coverage" and whether the plan's share of the total allowed costs of benefits provided under the coverage meets "applicable minimum value requirements."

 

Issue:  What is "minimum essential coverage" and who decides whether "applicable minimum value requirements" have been met?  Also, the Departments "recognize" that beginning 1/1/14 new market reforms will take place and adjustments to the SBC will be necessitated.

 

(5)    Coverage  Examples:  One two types of coverage examples are contained (1) having a baby (normal delivery) and (2) managing type 2 diabetes (routine maintenance).  Breast cancer was removed.  Comments to the interim regulations suggested that "coverage examples facilitated individuals' understanding of the benefits and limitations." 

 

Issue:  Examples are still convoluted and costly to prepare.  Samples and guidance will not minimize this issue.  Further, the Departments advise that they will add coverage examples and make other changes after the first year of applicability.

 

(6)    Stand-alone or Incorporated:  Prior guidance advised the SBC must be a stand alone, but now the Departments authorize the SBC to be a stand-alone document or in combination with other summary materials (i.e. SPD) if the SBC information is intact and prominently displayed at the beginning of the materials (i.e. immediately after the Table of Contents in an SPD).

 

Issue:  Does this mean that if a self-funded plan wants to incorporate instead of a stand-alone document they must restate the plan (i.e. an amendment is not an option)?  Having the information incorporated will also create mass confusion - terms, coverage examples, etc.

 

Recovery Case of the Monthclaims

 

This month's case involves a member that was involved in a boating accident. To complicate matters, the boat involved was owned by a friend of the claimant's father.

 

The claimant sustained extensive head injuries as well as a collapsed lung, broken ribs and a broken jaw.

 

At the time of the incident, the member had been driving the boat under the influence of alcohol.  The boat was also uninsured.

 

Upon receipt of this information, The Phia Group specialist immediately reviewed the applicable plan language to reveal an alcohol provision in the exclusions portion of the plan document.

 

The administrator, in this case had already paid ALL related claims and advised us to attempt to recover the overpayments.

 

To date, The Phia Group has collected over $30,000 on behalf of the plan due to the presence of alcohol exclusion.

 

Spotlight Employee of the Month - LeAnne MacKenzie

  

LeAnneLeAnne joined the Phia Group in May 2011 as a Legal Assistant. Since January 2012, she has expanded her role and is taking on new responsibilities as the Phia Group Consulting Liaison.
As "PGC" liaison, it is LeAnne's responsibility and passion to provide our clientele with a point-person for all thier consulting needs. Her dedication to this fairly new position has exceeded all expectations.

 

LeAnne attended Emmanuel College in Boston where she earned a bachelor's degree in English Literature and Writing.

 

Outside of work, LeAnne enjoys spending time with her husband, friends and family. She is an avid reader, amateur violinist, and a lazy yogi.
